नेरूळ, नवी मुंबई येथील एका सहकारी गृहरचना संस्थेमध्ये मध्ये लेखापरीक्षकांची नेमणूक झाली. त्या नंतर त्यांनी सन १९९३ पासूनचे लेखा परीक्षण करून संपूर्ण खाती तपासली. विविध अनियमितता असल्याने त्यांनी कारवाई म्हणून सर्व पदाधिकार्यांवर गुन्हा दाखल केला.

संपूर्ण महाराष्ट्रात अनेक housing societies आहेत... ज्या ठिकाणी फक्त पदाधिकारी मनमानी करून कामकाज करतात...इतर सभासद कुठे ही तक्रार करायला गेला तर अगोदर च पैसे खाऊन सरकारी अधिकारी ऐकून घेण्यास तयार नसतात....आज वीस वर्षे झाली आम्ही झगडत आहोत
योग्य कलमाखाली आणि योग्य ठिकाणी कारवाई केली नसेल त्यामुळे २० वर्ष वाया गेले. पुढे पुढे लढण्याची तयारी असली तर न्याय नक्कीच मिळतो.

आमची सोसायटी tenement धारकांची असून सोसायटी पदाधिकारी काही सभासदांच्या हितासाठी स्वतंत्र प्लॉट होल्डर असल्याप्रमाणे भिंती बांधून सोसायटीच्या ओपन space वर अतिक्रमण करणाऱ्याला सहाय्य करत आहे. मनमानी कारभार चालू आहे. तसेच सोसायटी कार्यकारी मंडळातील सदस्य हे ज्येष्ठ नागरिक संघाचे पण पदाधिकारी आहेत. त्यामुळे सामान्य सभासदाला धन दानडग्यामुले न्याय मिळणे अशक्य आहे.
सहकार कायदा कडक् झाला पाहिजे.
आमचे हौसिंग सोसायटी मध्ये गेले १२/१५ वर्षा पासून एकच कमिटी कार्य रत आहे , सोसायटी रजिस्टर नोंदणी झाले पासून आमची कमिटी चे पद धिकरी यांनी बिल्डिंग १रू चा पण खर्च केला नाही फक्त लाईट बिल चां खर्च आहे बाकी इतर जमा होणाऱ्या मेंटेन्स रकमेचा कित्येक वर्षापासून पैशाचा अपहार होत आहे , जमा खर्च बाबत माहिती विचारली तर हे पद धिकारी दादागिरी आरेरावी करतात ,स्थानिक गुंडांना हाताशी धरून रहिवाश्यांना दादागिरी केली जाते , उपनिबंधक कल्याण, S.p police , स्थानिक पोलिस स्टेशन ला तक्रार करून ही काहीच कारवाई झालेली नाही

सहकार अधिकाऱ्यांनी सोसायटीना भेटी देऊन मार्गदर्शन केले पाहिजे.
बरयाच वेळा मेंबर्स voluntary काम करतात. खूप प्रॉब्लेम असतात. माफिया (सरकार व बिल्डर) सिस्टीम मुळे, सोसायटी formation, कन्व्हेयन्स डीड प्रोब्लेम आहेत...

साहेब सोसायटीत फक्त 11-12 सभासद असतील, आणि आज अष्याप्रकरे शिक्षा वैगेरे सांगितल्यावर कोणीही तयार होणार नाही. असेही कोणी तयार होत नाही. सगळे मागे थांबतत.
बरोबर
नियमांचे पालन करू संस्था चालवली तर काहीही होत नाही. मात्र लोकांना सोयीच्या गोष्टी करायच्या असतात. त्यामुळे असे प्रकार होतात. कायदेशीर सल्ला घेऊन संस्था अतिशय सुरळीत चालवली जाऊ शकते. संस्था नोंदणीची उद्दिष्ट सभासदांच्या हितांचीच असतात.

सोसायटी मधे कमिटी मधे काम करणारी व्यक्तीच सोसायटीवर पगारी मॅनेजर म्हणून काम करत आहे
सोसायटीच्या नियमा प्रमाणे सप्टेंबर 2001 साला नंतर ज्या सदस्यांना तीन अपत्ये असतील अशांनी निवडुकी उमेदवारीसाठी अर्ज करु नये आसा नियम आहे तरी पात्र नसताना सुध्दा अधिकार्योंशी संगणमत करुन निवडणू लढवील्या जातात ह्याला खिळ बसणे आवश्यक आहे.

आमच्या स़ोसायटीत पूर्व कमिटीने आर्थिक घोटाळा केला. टीडीआर कडे बरेच पत्र लिहिले पण कार्यवाही झाली नाही. आमची कमिटी खोट्या तक्रारी वर बरखास्त केली. आम्हाला कोर्टात जावे लागले.

This is outrageous. This is a ridiculous law. Such laws only make sense if the office bearers are getting some monetary benefits for the work that they are doing. In most societies, committee members take on the work because no one else is willing to. So, ideal bylaws sometimes get sidelined. If the government starts penalizing those who volunteer their time for the betterment of societies for free, no one will step up for society elections. This is already happening in the PCMC area.

जर सो.चा मेंटेनन्स भरत नसतील तर सदर सदनिका धारकला आधी पत्र द्या,त्याची प्रत उपलब्ध नि. द्या. असे 15दिवसाच्या कालावधी अंतराने स्मरण पत्र 1,2,3 द्या.प्रत्येक पत्राची प्रत उपनि.यांना द्या. म नोटीस द्या.कालावधी संपला तर 101खाली नोटीस द्या.उपनिबंधक कडे भेटून नोटीस द्या.व्याजा सगट वसुली होते.

Kalyan la तर असेच मनमानी करणार्या बरेच इमारती आहेत. सरकारी कार्यालयात तक्रार केल्यावर पैसे घेऊन ह्या गुन्हेगारांची साथ देतात. मग अशा सरकारी अधिकारी विरुद्ध काय करावे???
लाच मागत असतील तर त्यांना लाचलुचपत विभागाद्वारे पकडून द्यावे.
तुमच्या तक्रारींवर कारवाई झाली नाही तर वरिष्ठाना कळवावे. तिथेही नाही झाली तर यांचे वरिष्ठाना आणि कोणीच योग्य कारवाई करत नसेल तर न्यायालयात दाद मागावी.

No one comes forward to work in housing aociety as it is honorary work and not paid for. It's not cooperative society, it's cooperative housing society. So those who only say , should take rokes snd work jonarary basis spend weekends, night tine when they come home on the society work. There may be a few corrupt taking advantage and possibly the bigger societies where there are many members, but in begeral noe on one will cone forward to work in society. When society goes to registrar, people have seen that even if the guttee floods and entire floor is not walkable, no one can do anything till someone from registrar comes and fixes it. No one can spend even a rupee , only registear (his officer) is authorized and then people know the work done by management when there is so mich neuissance. Registrar of course xna be now tried in courts as they cause discomfort. And all this service is multiple times of what society spends currently, as registears officers salary is taken from it for sdministration.

परंतु अशी काही उदाहरणे देता कि त्यामुळे होऊ इच्छित पदाधिकारी हतोत्साहीत होतील.व हे मानेवर जोखड कोण ओढवून घेईल?
प्रत्येक सोसायटीत फक्त एकच व्यक्ती असते की जिला सर्व प्रकारच्या उपविधींची माहिती असते बाकी निव्वळ खोगिरभरती !
महिना अखेरीस मेंटेनन्स चा चेक टाकला की मेंबर चे काम झाले.व मग पदाधिकारी वर्गावर यांची अरेरावी चालते ७५%मेबर (यांत बायकांचं प्रमाण जास्त आहे एकमेकांना चुगल्या करण्यातच यांचा वेळ जातो मेंटेनन्स दहावेळा सांगितलं तरी भरत नाहीत.
तरी केवळ पदाधिकार्यांनी काय केले पाहिजे कसं घाबरून काम करायला हवे असे व्हिडिओ बनवु नका ४७ जणांवर गुन्हे दाखल हे सांगून तुम्हि सोसायटी क्षेत्रात एकप्रकारे दहशत निर्माण केली तर आहेच पण सोसायटी चे नाव पण बदनाम केले आहे आता हा खटला किती वर्ष चालेल देव जाणे मात्र त्यापोटि येणारा सर्व खर्च ज्याने फिर्याद नोंदविली त्यानेच करावा।
उगीच सोसायटी वर बोझा नको।

सर , आमच्या सोसायटी मध्ये 30 सभासद (रहिवासी) आणि 3 सभासद (दुकाने) असे आहे.
रहिवासी सभासद पैकी 2 सभासद 5 ते 6 वर्षे झाली मासिक Maintenance खर्च देत नाहीयेत . कारण काही नाही . सगळ्या सेवा वापरतात जसे की पाणी / वॉचमन / सफाई कामगार / लिफ्ट वगेरे . विजेची बिले / मालमत्ता कर व्यवस्थित भरतात , फक्त सोसायटीचा मासिक खर्च थकवतात . यावर सोसायटीने 2 -3 वेळा त्यांना नोटिस पाठविली , पण प्रतिसाद शून्य .
अशावेळी आम्ही काय करावे . मासिक खर्च त्या दोघांकडून कसा वसूल करावा ? आणि त्या दोघांपैकी 1 जण गेल्यावर्षी सेक्रेटरी म्हणून पदावर आहे .
जर सोसायटीचे मासिक खर्च थकवले असतील तर त्या सभासदाला सेक्रेटरी पदावर राहण्याचा अधिकार आहे का? आणि जर तसा अधिकार नसेल तर आता सोसायटी त्याला पदावरून काढू शकते का ?

बहुधा पदाधिकारी नेहमीच जबाबदारीने काम करतात. १९ ९३ पासून सोसायटी च्या पदाधिकाऱ्यांनी मनमानी कारभार केला होता का? म्हणून.हा व्हिडिओ परिपूर्ण नाही.

आमची सोसायटी रजिस्टर झाली आहे....तरी सुद्धा टेनेंत पोलिस व्हेरिफिकेशन न करता राहतात...तेव्हा कुणावर गुन्हा दाखल करावा.pl ...salla dyawa

There should be the provision of proper training before members elect to the committee of society,for smooth work.
Yes, there is already a provision for education and training, but most of the committee members do not take any education, nor do they work under guidance.

FIR कोणी केलेला आहे.पदाधिकारी हा मुख्य प्रवर्तक असेल तर त्याच्यावर पण FIR दाखल होउ शकतो का गुन्हा दाखल करण्याचे अधिकार कोणाला आहे.
वेगवेगळ्या परिस्थितीत सभासद, प्राधिकृत अधिकारी, लेखापरीक्षक गुन्हा दाखल करू करतात. कायदेशीर सल्ला घेऊन पुढील कारवाई करणे योग्य.. ढोबळ उत्तर योग्य नाही.

सर माझ्या सोसायटी मध्ये 2016 ला एक सभासद सचिव झाला, पण फ्लॅट त्याच्या नावावर नव्हता, आणि त्यांनी अचानक असं इतिवृत पास केलं की गच्चीवर पत्रे लावायचे, तेव्हा मी आक्षेप घेतला, की पहिल्यांदा structural audit करा, तेव्हा रिपोर्ट असा आला की गच्ची वरून लिकेज नाही आहे, आणि इतर दुरुस्त्या सुचवल्या, तरी सुद्धा, गच्चीवर पत्रे बसवले,audit मध्ये असेही नमूद केले होते की काही कॉलम ची अवस्था बिकट आहे त्याला सपोर्ट ची गरज आहे, तरीही कमिटी ने हे कामं केले.
आपलं मार्गदर्शन अपेक्षित आहे, महत्वाचा मुद्दा कामं चालू झालं त्यानंतर दीड महिन्यांनी अध्यक्ष साहेबाना कोटेशन मिळाले, बाकी मी ddr ला complaint केली आहे, तुमच्याशी सवांद होऊ शकतो का

Sir,kahi members reguler मेंटेनन्स न भरता जेंव्हा वाटेल तेंव्हा एक ठराविक रक्कम बँकेत सोसायटी अकाउंट वर भरतात.प्रत्येक महिन्यात न भरल्याने उपविधी नियमा प्रमाणे त्या सभासदाला थकीत रकमेवर व्याज लावले जाते.हा व्याजाचा फुगा वाढत जातो.हा थकीत मेंबर आपले कोणी काही बघडवू शकत नाही या आविर्भावात उलट सोसायटी कमिटी मेंबर्स वर खोटा गुन्हा दाखल करतो.कोर्टात सबळ बदली होत जाणारे कमिटी मेंबर्स केस चा व्यवस्थित पाठपुरावा करीत नसल्याने कोर्ट केस निकालात काढते.म्हणून व्याज थकवणे हा उपविधी नियमा प्रमाणे गुन्हा नाही का.? त्यावर इलाज काय.?? कृपया मार्गदर्शन करावे.
मुळात तुमचे अकौंटिंग योग्य होत नसेल. दर महिन्याला आधी व्याज मग थकीत रक्कम वसूल केली पाहिजे. म्हणजे व्याज वसूल होत जाते आणि मुद्दल तसाच पुढे चालू राहते, मुद्दल वसुलीसाठी वसुलीची कारवाई केली नाही तर समिती कामचुकार आह असे समजायला वाव आहे.

sir...i purchased flat from first owner and took possesion in dec 2021.. before purchase of flat in nov 2021 society issued me NOC for no dues of first owner.
from jan 2022 to april 2022 the maintenance bills were recoeved which were paid promptly by me.
on june 2022 i recieved a invoice from society for dues of OCT 2021 i.e.before purchase of my flat from forst owner.
the first owner informed he has paid all dues and he has given NOC from society
Now society is demanding this money from me.
Pls guide as per legal and byelaws

संचालक मंडळाने निवडून आल्यावर प्रशिक्षण घेण्याची तरतूद आहे. मात्र अनेक पदाधिकारी सगळं माहित असल्याच्या अविर्भावात काम करतात.

सर कंमिटी जेव्हा कोणती काम सांगितली किंवा निदर्शनास आणून दिले तर दुर्लक्ष करतात एक कारण असते आम्ही फुकट काम करतो कोणतेच मानधन मिळत नाही.. सर आताच 30 लाख च रिपेअर वर्क चालू केल पण काम निकृष्ट दर्जाचे आहे आणी ज्या कॉन्ट्रॅक्टर ला काम देण्यात आले त्याचा आधीचा अनुभव ही वाईट असताना पुन्हा त्याची नेमणूक झाली.. सोसायटी मधील काही गुंड प्रवृती सारखी तरुण मुळे हाताशी घेऊन इतर रहिवाशीना त्रास देण्याचे प्रकार होतात. काही सदनिका मूळ मालक जागेवर नसतात अस्तित्वात आहे का नाही माहिती नसताना ही खोटी नाहरकत प्रमाण पत्र बनवून सदनिका नावावर करण्यात आल्या.. वार्षिक सभेचा अहवाल दप्तरी खर्च प्रिंट चा आम्ही पैसे वाचवतो सांगून देण्यात येत नाही.
सर रजिस्टर ऑफिस ला ह्या बाबत कश्या प्रकारे तक्रार करावी किंवा ह्यावर कारवाई कशी करता येईल ह्या विषय माहती पूर्ण व्हिडिओ बनवा🙏🏻🙏🏻 धन्यवाद 🙏🏻
