  • Fraud and mis-management in affairs of Housing Society are a widespread occurrence. Frequently members of the Managing Committee are caught embezzling funds or earning kickbacks from society contracts. Such unscrupulous people further conspiracy to suppress information from concerned residents. Therefore in such circumstances it becomes necessary to invoke the legal remedies enshrined in the Maharashtra Co-operative Housing Societies Act, 1960.
    In this video Aditya Pratap, lawyer in Bombay High Court explains how to go about the legal process and approach the competent authorities to hold Society office-bearers accountable.

      Use the courts, adverse ruling by deputy registrar opens up judiciary for you to challenge the ruling.

      It's not proper to spitting on register and MC.
      It's the duty of every members to go through Balance sheet which is submitted inthe AGM.
      Ask clarification with 4 days in writing to MC.

      @@lawfullyyours123 How old is the dispute? Have you gone directly to the co-op court? I have been fighting for 14 years and yet to succeed. Corruption is in the blood of the department. Complaint with ACB is of no help. It is a well-knit web of corruption. So much so that members have lost their homes since 2018 for an act of one disqualified member continuing to hold the reins everywhere.

    In spite of so called enquiry under section 83 five years ago to joint registrar CIDCO and recommended by enquiry officer to proceed under section 88, no action from MC for a years period. There are more than 220 members, but nobody wants to proceed. I have provided approx 500 pages with photos, date and time, no action for more than 5 years. Transgenders are better than society members.

    I have 2quries regarding the 2different societies that the committee is disqualified and administra are appointed in both the society.In(a)society the advisior confessed front of the administrator that they have collected the funds part of payment the have deposited in the society remaining they have equally shared among themself but the administrator has not taken any action.
    In the other society the XChariman and Secreatry has been interfering in the society affairs.they have still have power more then the administrator nearly about in lacs of maintenice people have not paid for years together.we have given written application also RTI regarding balance sheet Audit reports but still now no respose what can we do regarding both the matters

    Hello, out of 44 members, myself only had filed a complaint against the society in Navi Mumbai with Registrar. A lady administrator was appointed and then, now a male administrator is appointed. Complete violations of law by the committee members, administrator and the Registrar themselves. Have approached Mantralaya as well. However, nothing much. Kindly guide on the next course of action. Thank you.

    Send the complaint directly to the State Registerer at the head office.
    Wait for 1/2 months.
    Then file a RTI application asking for the outcome of your complaint letter.
    It will work like magic. You will think me.

    Good information. I would like to know whether it is compulsory to register the contract given to the contractor. If the managing committee does not register the contract given to the contractor under which section of mcs act 1960 or any other acts the action can be taken against the managing committee.

    Hello Sir, I have a question... If new MC has taken charge after 2 years they are unable to share financial facts, instead they blame previous MC (10years back)and put blame on them without anything in black and white... Is there any section which has provision to appointment registrar?? Please throw some light if possible... Thanks.

      No both, registrar and deputy district registrar DDR are corrupt, with your complaint they get money from committee

      no one can be a chairman or secretary if he/she does not live in the building. comitee member are people who are supposed to be present in the society all the time.

      Take proof submit it police housing section/file for, complain to registrar and ask for enquiry sec83-to 89 and mention lodge complaint against person, but you must have some evidence with you for your safety

      Depends on the discrimination. File a complaint with deputy registrar first.

    Members filed complaint against the committee for challenging the financial audited accounts of society before sub registrar but complaint was not attended & proceeded by members for three years can the complaint be reopened by members again ?       You have to be a resident. Tenants can file complaints.

      Penal interest compounded goes against the principle of mutuality. This is for RWAs where income from residents are tax exempt because of principle of mutuality which mandates that RWA cannot profit from its residents.
      If the society charges compounded penal interest then it's a violation of the principle of mutuality.
      File an official complaint with Registrar of Societies. This can potentially result in dissolution of RWA if penal interest has become a revenue stream.

      After exhausting options with Deputy Registrar when no relief is granted. You can approach HC.
