- Fraud and mis-management in affairs of Housing Society are a widespread occurrence. Frequently members of the Managing Committee are caught embezzling funds or earning kickbacks from society contracts. Such unscrupulous people further conspiracy to suppress information from concerned residents. Therefore in such circumstances it becomes necessary to invoke the legal remedies enshrined in the Maharashtra Co-operative Housing Societies Act, 1960.

It's the duty of every members to go through Balance sheet which is submitted inthe AGM.

@@lawfullyyours123 How old is the dispute? Have you gone directly to the co-op court? I have been fighting for 14 years and yet to succeed. Corruption is in the blood of the department. Complaint with ACB is of no help. It is a well-knit web of corruption. So much so that members have lost their homes since 2018 for an act of one disqualified member continuing to hold the reins everywhere.
Most of the members are moot witness for mismanagement.
In spite of so called enquiry under section 83 five years ago to joint registrar CIDCO and recommended by enquiry officer to proceed under section 88, no action from MC for a years period. There are more than 220 members, but nobody wants to proceed. I have provided approx 500 pages with photos, date and time, no action for more than 5 years. Transgenders are better than society members.
Some society members have no courage to file case.
I have 2quries regarding the 2different societies that the committee is disqualified and administra are appointed in both the society.In(a)society the advisior confessed front of the administrator that they have collected the funds part of payment the have deposited in the society remaining they have equally shared among themself but the administrator has not taken any action.
In the other society the XChariman and Secreatry has been interfering in the society affairs.they have still have power more then the administrator nearly about in lacs of maintenice people have not paid for years together.we have given written application also RTI regarding balance sheet Audit reports but still now no respose what can we do regarding both the matters
Hello, out of 44 members, myself only had filed a complaint against the society in Navi Mumbai with Registrar. A lady administrator was appointed and then, now a male administrator is appointed. Complete violations of law by the committee members, administrator and the Registrar themselves. Have approached Mantralaya as well. However, nothing much. Kindly guide on the next course of action. Sir, as per which act there would be no action on a complaint given by a non-member of the housing society.
Send the complaint directly to the State Registerer at the head office.
Wait for 1/2 months.
Then file a RTI application asking for the outcome of your complaint letter.
It will work like magic. You will think me.

Good information. I would like to know whether it is compulsory to register the contract given to the contractor. If the managing committee does not register the contract given to the contractor under which section of mcs act 1960 or any other acts the action can be taken against the managing committee.

Penal interest compounded goes against the principle of mutuality. This is for RWAs where income from residents are tax exempt because of principle of mutuality which mandates that RWA cannot profit from its residents.
If the society charges compounded penal interest then it's a violation of the principle of mutuality.
File an official complaint with Registrar of Societies. This can potentially result in dissolution of RWA if penal interest has become a revenue stream.

After exhausting options with Deputy Registrar when no relief is granted. You can approach HC.
