I think Nintendo should take the Bethesda route and hire these people then provide Uranium as an on-line download. They could make money from this AND appreciate the player base. Seriously.
SEGA is now allowing people to upload their own Rom Hacks to the SEGA Genesis workshop on Steam. The system they use is kinda shit but its still an awesome thing to do.
Well, part of it is they have to take legal action once they find out about something (they rarely bother to pursue these things of their own volition and wait till they hear through the grapevine), the reason most pokemon roms or whatever dont get taken down is literally because nintendo doesnt hear about them, this one made IGN news which pretty much gaurentees itll get stomped into the mud because they work with IGN. The laws governing this kinda thing are incredibly vague and companies have to protect the image of the product (even if the product they are taking down is good). If you want to see what happens when companies cant/wont deal with this go check the mobile games market out for games that violate copyright, they are fucking plentiful there.
TheHolyFox123 haha. Funny guy. But it doesnt take 9 years to make a 2d game. Maybe 3 to 4 max. Plus the art assest werent even made from scratch. He stole those from the original pokemon games. So if anything he should have finished it way before 4 years.
No way was Uranium a threat to SuMo. I understand why Nintendo did it (I guess), but obviously that just means they do not understand their fans. None of us who actually plan to play SuMo would get Uranium, and then decide not to get Sun and/or Moon due to this. The only people who would play Uranium and not SuMo are the ones who already don't plan to buy SuMo. Regardless, it's easy to find a download for Uranium still. I'm currently playing it to fill my spare time while I impatiently await November 23rd. It's a fantastic and admirable fan-game that deserves recognition, but even the best of the Fakémon will never feel the same as the official Pokémon.
I do not think Nintendo has and will ever understand how people think. Lately they have been making stupid decision. If it wasn't for the classics I probably wouldn't have bought Another 3ds and Will.
I mean, it's Nintendo's legal team who takes fangames down. There's no telling if the higher-ups even knew about this game, since I definitely didn't before its release.
It's given further credence by the fact they took down the Metroid 2 Remake and released a new Metroid Prime game, when for years there's been an outcry for a new classic style Metroid game. I even enjoyed the Prime series on the GameCube, but a new one just isn't what the fans wanted. I'm the same, the only reason I own Nintendo consoles these days is the classics from the e-shop, and the (good) sequels to older games, such as new Pokémon, Mario Kart and Smash Bros.
That's not accurate. Personally getting sun and moon would be cool. But if I can get a full length Pokemon game brand new with a new Pokemon type and all for free... Yeah I'm getting the free one instead. At best case, I put sun and moon off for a month or 2 because I can't physically play all three games at once. This hurts their release week sales which is a big number investors and such look at to gauge how worthwhile their investment was. It makes perfect logical sense from a business stance. It just super sucks for the gamers
Also, they had every right to take down AM2R as well. Even if the man developed it for ten years, what'd he expect? He remade an _entire_ game to release for free. If that isn't breaching copyright, I don't know what is. It would also hurt the sales of Federation Force, because let's be honest, we'd rather be playing AM2R than Federation Force. Of course, everyone forgets the fact the developer was perfectly fine with the take down and probably wouldn't want people spewing Nintendo doom and gloom everywhere.

Mr Saturn what Im saying is remember...sonic is Sega's flag franchise...and they utterly fucked him up with two games in a row, and they stopped delevolping their other main IPs (the ones you see in Sega All-stars), Metroid is just one of 4 or 5 of Nintendo's heavy hitters(every game in said series ,not counting story for obvious reason since one screwed up big time, was good to near perfect) and it's not like it's been on the backburner for that long *coughs* F-Zero *coughs*. Actually legally speaking Nintendo had to take it down to protect Pokémon. Maintaining a copyright is an all or nothing deal, if you don't enforce it you lose it. Uranium got too big for Nintendo too ignore so they had to go after it.
If you go on the official Pokemon Uranium discord, they've said that Nintendo didn't even contact them, nor Game Freak. They wanted to make sure their bases were covered if they WERE contacted; the download links being removed were on their own decision. I keep seeing these sort of videos, but this is the first time I've commented on one, because the title is just wrong. Also, I want to know: if Nintendo really is going after Uranium, why not shut down PokeMMO too? With that fangame, they profit off of microtransactions!

In order for Nintendo to protect its Intellectual Property, they are required to protect it every single time. If a prior example can be shown of Nintendo not DMCA'ing a threat to their IP, the judge can rule in favor of the defendant, because Nintendo wasn't protecting their IP before. *It's Use it or Lose It.* Nintendo can't pick and choose who to DMCA. It's either all or none, and if they choose none they lose their protections for their IP.

They took it down because they had gotten notices... I'm sure they wouldn't take down their own gme for no reason. Yeah they was not forced to but they did. besides You can still find the game and they said they'll continue with the updates.
Nintendo did not make them take down the game, it was out of their respect to take it down. it was their choice, and the game is still playing this. the team has been emphasizing this on twitter
I'm not even sure Nintendo CAN do much about it. GameFreak and the Pokemon Company own Pokemon. Not Nintendo. It just so happens that GameFreak and the Pokemon Company are PARTNERED with Nintendo. And considering that they pretty much got AM2R the day it released... there is no reason they wouldn't have contacted the team of Pokemon Uranium personally. Lawyers don't just "dance around" the creators that they want to take down. They go straight to the people in charge.
They need to flex their copyright. If they don't take it down another game with pokemon on it can bybass their copyright because Pokemon Uranium did it and then Nintendo's copyright is pretty much useless.
tl;dr You're wrong, confusing copyright with trademarks. Copyright law doesn't have any clause that would weaken Nintendo's copyrights if they leave this alone. The rights conveyed by Copyright are absolute until one either relinquishes control (selling the copyright for example) or when the copyright expires (which is unlikely with Disney getting copyright continuously extended). Only Trademark works anything like that, and even then requires a mark to become generic before anything like that can happen. Even then, it would require the Mark in question become, in the public mind, unconnected with Nintendo. That is, if people didn't see Pokemon as a Nintendo property, then you could challenge it in court, and get Pokemon invalidated as a Trademark. Note that this doesn't affect the copyright, only the mark. Another thing to note, Trademark only applies in business competition. A free fan game not being sold or marketed as a commercial endeavor is immune to any claims under Trademark law because the purpose of that set of law is to prevent consumer confusion. That is, when you see a mark, you know who made it, and know who you're giving money to, and what kind of quality you are likely to expect based on previous products with the same mark. This prevents some one from claiming to be Nintendo and selling games as though they were, taking advantage of the brand recognition and loyalty that comes with the brand, while selling things that are of low quality, or simply don't work, to a consumer who simply doesn't realize this isn't actually from Nintendo.

That said, no, a complete rip-off of a game with some made-up stuff thrown in doesn't count as a "parody" A parody only covers the _style_ of a work, not the copyrighted content. It's not all Nintendo's fault, they have to enforce their IP belonging to them or otherwise they risk losing said IP altogether. Obviously they want to keep making Pokemon games, so if someone uses the Pokemon IP they need to enforce their IP belonging to them.
You must not keep up to date on Nintendo. They love taking down let's plays (mainly if you have ads on the video) and other content that uses their footage. You can't even show a trailer for pokemon and overlay it with commentary on what's going on in the trailer (which makes zero sense, since a trailer review is only spreading knowledge and hype about the game...which is the entire point of a trailer). Nintendo has never been big fans of their games being online in any capacity, and this is just par for the course with them.
And no, Nintendo wouldn't take your video down if you uploaded a video of Pokemon uranium. Thousands of people have uploaded videos of it, including munching orange, who has 900k subs, and he is fine

I hate to say it, but taking down that Metroid game does make sense. Since they have it on Virtual Console, this could easily be directly taking away sales from that. The Pokemon one I still don't quite understand though.
People are so ignorant about copyright and trademark laws, and they get upset and angry when companies shut down fan games/fan projects that get too big, not understanding that they are legally required to do it, least they want to lose the rights of their IPs.

A good example to point against them is Valve, one of the best efforts on fan gaming I ever saw was Portal Stories: Mel, it is a free mod on Steam, they not only developed original characters, paintings and models for a full scale game that was incredibly well done as a "portal 2 hard mode" that ties in with the canon, they took a scrapped off multiplayer character to be the main one (basically the equivalent of the unused female sprite on RGBY). You know what Valve did? They not only gave some concept art models to help the artist of the game to paint new pictures of Caroline, they fucking asked the guys to go to their place and use their own movement detection to capture movements like shooting a portal gun. I guess the legal term for that is "not being a cunt", perhaps nintendo lawyers should try sometime.
It doesn't use the same engine since it is not a ROM hack. The game only has about 20 of the original pokemon and over 200 of their own fan-made ones. They composed all of the soundtracks and music in the games themselves. All of the the tiles in the game are custom. Other than the trainer/npc sprites, some sounds and cries the game is almost completely custom which does fall under fair-use. But they do use the name "Pokemon" which is why they can be taken down.
Look, man, the game blatantly ripped off Nintendo's own assets and intellectual property. They titled it "Pokémon," they used some of Nintendo's existing Pokémon characters. It's a blatant violation of copyright law. Nintendo was well within their rights to have this pulled. Same with the Metroid II remake. I don't give a damn how long it was worked on. It was and is IP theft. They should have made it their own thing and not used Nintendo's property in it at all.
Unfortunately, I disagree with the law, personally. Plus, the game was doomed from the get-go, Nintendo was gonna kill it no matter what. Its funny to me, Uranium is more of a pokemon game than ANY of the latest games have been. Black and White? Gay. Black and White 2? Gay. X and Y? Gay. ORAS? Gay. Thats not to say that some of the pokemon were bad, its that the gameplay itself was very dull and uninteresting. And SuMo is on the exact. Same. Path. Black and White introduced "Pokemon fusion", X and Y "mega evolution", ORAS brought back those stupid primal forms from the mystery dungeon games, and now they're trying to shove pokemon redesigns down our throats. Is it out of the question for them to just make a game using the game aspects we know and love? Look at Johto and Kanto. Two of the most beloved regions from pokemon. Each new region you go to, you see this "spike" in technology levels, like Nintendo can't decide what era they're in. Johto and Kanto both had this simple, lovable art style that every pokemon game afterwards totally butchered. The proof is in the sales. each new game their profits plummet. To the point they're needing to crush these long-standing fan games just to make a buck. At this point, Pokemon should be a public domain IP, because new games are only going to get worst.
Leonardo Farias You have to understand, im not hating on the good things about black and white. I am merely pointing out how lackluster it is compared to prior pokemon games. Alot of the pokemon looked amazing, the story was pretty good (even if repetitive), and the elite four was possibly the best ive seen yet. Despite that, it suffers from the "Tech spike" possibly the worst in the whole franchise, team plasma is very bland in comparison to the other evil teams, and the story behind the legendary pokemon was overly dependent on their connection to Kyurem and their ability to fuse, which really butchered the concept of "Every pokemon is unique".

NOW, over some years a mad scientist in some underground lab somewhere in a volcano island finds Reds to be a way way cool dude for the way he does things. "a rather remarkable specimen indeed" exclaimed the Madscience dudeman. His massive interest leads him into making a clone of Red that takes him 9 years to complete, while it's not 100% the identical Red, it's close enough to be considered essentially a clone of him. 1. Should Red decide if this is right and shut down the mad scientist for cloning him? Keeping his originality intact. 2.Or do the fans decide, wanting MORE of the duplicate Red roaming about simply because he is so excellent. Don't you think this would diminish the actual frugality, authenticity and praise from Red just a tad? This is MY own funny strange hypothesis basically, I am NOT saying this is why Nintendo are doing what they do.. but gotta admit it makes a tiny bit of sense as to why they'd want to refrain from letting people dupe their game in order to retain authenticity as much as possible. Especially considering they have so many generations of their game already out there. Imagine spin offs made by fans becoming massive and hugely successful using their company name and everything.. feels a bit.. wrong to me idk. It's well made don't get me wrong but he could have used a different name too. Just put the word Uranium at the end and give it his own spin and theme. What do you think? :D

I've been hearing that some of the copyright police are getting stricter at protecting copyright. DMCA is getting abused more and more. I was struck myself.
if it can cut into profits it's against copyright. also they have the right to protect the IP in any way. cause of this. even tho no harm was intended. also copy right laws promote defending it. if they don't try to defend their IP they will have harder time defending it in the future. because this fan made game could be used against them cause they didn't take action. if it was smaller they could pretend it went unnoticed but since it's being covered by big channels like IGN they cant really ignore it.
Nintendo doesn't lose anything by having fan made games exist. There are fans out there who are willing to make a fully flesh out games just because they are a fan of the series. They should be happy that people are doing this, it helps keep Pokemon alive and fresh. Fans are the building blocks to success. The only thing Nintendo is doing is hurting their image, but meh like this is going to stop Nintendo from doing what they want so it doesn't really matter at all.

No they wouldn't, the only thing fan games can do is keep the series alive like I said, and keep people engaged in the original source material. No... Nintendo put the kibosh on Uranium for one reason. (Spoilers) The game features at least TWO Fukishima style nuclear meltdowns in the early going of this game. Let's NOT forget that Fukishima actually happened in 2011. It's just hitting a bit too close to home. The region is still recovering from the disaster.
I'm glad I downloaded this game when I did. I'm only just past the 2nd Gym, but so far I really like the game. Its very well made and honestly helps me get hyped even more for Sun and Moon. Hopefully some time after the release of the 7th gen has passed, these guys will be able to put their hard work back up on the web for download. They just worked so hard and put a lot of love into the game, it makes me sad to see them have to take it down. It is unfortunate but Nintendo didn't really have any other option. If they don't protect their IP now, it will be harder to protect later. And really, the game is still out there. It's out in torrents and the developers are still supporting it with patches, nobody got sued or lost any money, it's probably the best of a bad situation.
I dont understand why everyone is saying it was only a couple weeks the game was up, I downloaded it almost a year ago and got as far as i could and then quit.
The thing is that the presence of fan games or fan materials doesn't per se hurt the pocketbooks of the original IP owners. Real games and fan games are not mutually exclusive and it's very likely the type of people to know about fan games is fanatical enough to play fan games while supporting the series. A lot of game developers have come around to the value of mods, especially for older games that aren't played anymore. Hell some developers like Sega are even providing ways for fans to access mods, all because they realize that this is a form of fan engagement. It's not like a fan game like Uranium (it's not a rom hack btw) is comparable to the content in any up and coming pokemon game. It'd be different if the team stole content from Sun and Moon and used that to make a fan game. And given the distinct nature of each Pokemon game, nothing in Uranium would prevent me from enjoying a future title that Nintendo makes. There's absolutely nothing reasonable about Nintendo's position, it's the same backwards shit they've always done. In the 80s they fought video rental stores over video game renting under the guise of copyright laws. They bullied their 3rd party developers with their practices over the years and that's why their current console is bleeding them cash per unit. They think gameplay videos (let's plays) aren't free press for a game and punish let's players. They have a very traditionalist mindset that has not adopted to the media of this day and age. I'm not saying they should let people steal their IP, but it's clear they're over aggressive. What's going to end up happening is that these fan developers are basically going to take their work,,whether it took 1 year or 9 years, convert that work into a new IP, and create a product that will actually compete with Nintendo 's IPs for attention. That will be way more harmful to Nintendo's bottom line than any Metroid remake or Fakemon game. For example the game Undertale technically started out as an Earthbound hack. Mind you, Toby Fox the creator never got a C&D, nor was he contacted by Nintendo. But just imagine for a second if Nintendo were paying attention to what fan developers were doing and they saw Toby's work on the Earthbound hack then hired him? He would have produced Undertale or the next Earthbound/Mother game for them, they would have been part of one of the biggest indie games this decade. But since, at best, they don't even acknowledge fan works (and at worse they terminate them) they're going to actually motivate more up and coming developers to stay way from Nintendo IPs (which is again free publicity) and move them towards making IPs that are Nintendo inspired but compete with Nintendo in a more direct way.
It's screwed up, what Nintendo did, it took 9 years to make, got 1.5 million downloads, was completely free, had no In-game purchases, or recieved no money through ads, could have actually gotten more people interested or atleast brought back old players who hate the new games, as well as the fact theres MULTIPLE Fan made pokemon game, Released and in production, (Pokémon Cinder & Foam, Pokémon Phoenix Rising [in production last i heard, also sounds amazing with the gameplay ], Pokemon Reborn, Pokemon Rejuvination, Pokemon Ethereal Realms, etc), and this one gets pulled 1 week after full release. also, another thing stated by Pokèmon Uranium team, in the same comment you quoted was that, They have NOT been Contacted by NOA directly, that they had recieved emails from lawyers CLAIMING to be working with NOA.
Looking at how the Uranium developers are responding to this cease-and-desist order by Nintendo I would say that the developers entirely expected to have their game banned but the nature of the internet means that once it is in the wild it is impossible for any court-order to stop it. Since their website is still running and they intend to keep their forums open the fact they're not offering downloads is meaningless as they are still supporting the community. One of the reasons why the game was so polished may be due to the fact that they knew it wouldn't be possible to release patches for the game own it was released as they need to delete all source material now to comply with the order. However Nintendo have just handed them a ton of free advertising so all they did was make the problem worse by doing this. If they had been smarter however, they would have developed a non-pokemon game with identical mechanics and then allowed users to install graphics patches ala Minecraft to get the desired result or took the route of the PokeMMO game and required users to have a copy of a pokemon ROM to play the game since that is also legal.
If Nintendo doesn't protect their IPs, they can become genericised and move into the public domain, meaning ANYone could legally make a game, and it would water down the brand. Nintendo is a company. In case we forgot.

A Pokemon world game could allow new gens and regions to be put into the game via DLC and could cost as much as a Pokemon game or even a bit more for the added value of the game...but this would require change and Nintendo does not like change...

I remember when we asked them for a game where we could pick a starting region and travel the unlocked regions in a Pokemon World game catching them all. While back then I realize this game would have been too big, I feel that we are on the verge of it being way more possible. Nintendo however said, no way. We dont want to make the best Pokemon game of all time. We just want to rehash the same game with better graphics, with the same Anime with different sidekicks and leagues ash will lose at... Its really frustrating to see such a great IP be in it mostly for the money and completely ignore the awesome ideas the fans come up with...
What's amusing, is that I only learned about this game after it was taken down. I will neither confirm or deny whether I have a copy now. In truth, given that we've had to wait two years now. It will be 3 by the time Sun and Moon come out. The fan games make me want to play more, not less.
Nintendo should have just hired the creators of Pokemon Uranium since they took it down. Because they had some really neat ideas that's allot better than sand castle Pokemon.
I think the fan made games are important for the community. They could easily make money off of them by getting permission and adding popular ones to the eShop. I would do that if I was a video game and system developer.

Well, part of it is they have to take legal action once they find out about something (they rarely bother to pursue these things of their own volition and wait till they hear through the grapevine), the reason most pokemon roms or whatever dont get taken down is literally because nintendo doesnt hear about them, this one made IGN news which pretty much gaurentees itll get stomped into the mud because they work with IGN. The laws governing this kinda thing are incredibly vague and companies have to protect the image of the product (even if the product they are taking down is good). If you want to see what happens when companies cant/wont deal with this go check the mobile games market out for games that violate copyright, they are fucking plentiful there.

No way was Uranium a threat to SuMo. I understand why Nintendo did it (I guess), but obviously that just means they do not understand their fans. None of us who actually plan to play SuMo would get Uranium, and then decide not to get Sun and/or Moon due to this. The only people who would play Uranium and not SuMo are the ones who already don't plan to buy SuMo.
Regardless, it's easy to find a download for Uranium still. I'm currently playing it to fill my spare time while I impatiently await November 23rd. It's a fantastic and admirable fan-game that deserves recognition, but even the best of the Fakémon will never feel the same as the official Pokémon.

It's given further credence by the fact they took down the Metroid 2 Remake and released a new Metroid Prime game, when for years there's been an outcry for a new classic style Metroid game. I even enjoyed the Prime series on the GameCube, but a new one just isn't what the fans wanted.
I'm the same, the only reason I own Nintendo consoles these days is the classics from the e-shop, and the (good) sequels to older games, such as new Pokémon, Mario Kart and Smash Bros.
That's not accurate. Personally getting sun and moon would be cool. But if I can get a full length Pokemon game brand new with a new Pokemon type and all for free... Yeah I'm getting the free one instead. At best case, I put sun and moon off for a month or 2 because I can't physically play all three games at once. This hurts their release week sales which is a big number investors and such look at to gauge how worthwhile their investment was.
It makes perfect logical sense from a business stance. It just super sucks for the gamers
Also, they had every right to take down AM2R as well. Even if the man developed it for ten years, what'd he expect? He remade an _entire_ game to release for free. If that isn't breaching copyright, I don't know what is. It would also hurt the sales of Federation Force, because let's be honest, we'd rather be playing AM2R than Federation Force. Of course, everyone forgets the fact the developer was perfectly fine with the take down and probably wouldn't want people spewing Nintendo doom and gloom everywhere.

Actually legally speaking Nintendo had to take it down to protect Pokémon. Maintaining a copyright is an all or nothing deal, if you don't enforce it you lose it. Uranium got too big for Nintendo too ignore so they had to go after it.

If you go on the official Pokemon Uranium discord, they've said that Nintendo didn't even contact them, nor Game Freak. They wanted to make sure their bases were covered if they WERE contacted; the download links being removed were on their own decision.

In order for Nintendo to protect its Intellectual Property, they are required to protect it every single time. If a prior example can be shown of Nintendo not DMCA'ing a threat to their IP, the judge can rule in favor of the defendant, because Nintendo wasn't protecting their IP before.
*It's Use it or Lose It.* Nintendo can't pick and choose who to DMCA. It's either all or none, and if they choose none they lose their protections for their IP.

I'm not even sure Nintendo CAN do much about it. GameFreak and the Pokemon Company own Pokemon. Not Nintendo. It just so happens that GameFreak and the Pokemon Company are PARTNERED with Nintendo.
And considering that they pretty much got AM2R the day it released... there is no reason they wouldn't have contacted the team of Pokemon Uranium personally. Lawyers don't just "dance around" the creators that they want to take down. They go straight to the people in charge.
They need to flex their copyright. If they don't take it down another game with pokemon on it can bybass their copyright because Pokemon Uranium did it and then Nintendo's copyright is pretty much useless.

Copyright law doesn't have any clause that would weaken Nintendo's copyrights if they leave this alone. The rights conveyed by Copyright are absolute until one either relinquishes control (selling the copyright for example) or when the copyright expires (which is unlikely with Disney getting copyright continuously extended).
Only Trademark works anything like that, and even then requires a mark to become generic before anything like that can happen. Even then, it would require the Mark in question become, in the public mind, unconnected with Nintendo. That is, if people didn't see Pokemon as a Nintendo property, then you could challenge it in court, and get Pokemon invalidated as a Trademark. Note that this doesn't affect the copyright, only the mark.
Another thing to note, Trademark only applies in business competition. A free fan game not being sold or marketed as a commercial endeavor is immune to any claims under Trademark law because the purpose of that set of law is to prevent consumer confusion. That is, when you see a mark, you know who made it, and know who you're giving money to, and what kind of quality you are likely to expect based on previous products with the same mark. This prevents some one from claiming to be Nintendo and selling games as though they were, taking advantage of the brand recognition and loyalty that comes with the brand, while selling things that are of low quality, or simply don't work, to a consumer who simply doesn't realize this isn't actually from Nintendo.

You must not keep up to date on Nintendo. They love taking down let's plays (mainly if you have ads on the video) and other content that uses their footage. You can't even show a trailer for pokemon and overlay it with commentary on what's going on in the trailer (which makes zero sense, since a trailer review is only spreading knowledge and hype about the game...which is the entire point of a trailer).
Nintendo has never been big fans of their games being online in any capacity, and this is just par for the course with them.

A good example to point against them is Valve, one of the best efforts on fan gaming I ever saw was Portal Stories: Mel, it is a free mod on Steam, they not only developed original characters, paintings and models for a full scale game that was incredibly well done as a "portal 2 hard mode" that ties in with the canon, they took a scrapped off multiplayer character to be the main one (basically the equivalent of the unused female sprite on RGBY).
You know what Valve did? They not only gave some concept art models to help the artist of the game to paint new pictures of Caroline, they fucking asked the guys to go to their place and use their own movement detection to capture movements like shooting a portal gun. I guess the legal term for that is "not being a cunt", perhaps nintendo lawyers should try sometime.

It doesn't use the same engine since it is not a ROM hack. The game only has about 20 of the original pokemon and over 200 of their own fan-made ones. They composed all of the soundtracks and music in the games themselves. All of the the tiles in the game are custom. Other than the trainer/npc sprites, some sounds and cries the game is almost completely custom which does fall under fair-use. But they do use the name "Pokemon" which is why they can be taken down.

Look, man, the game blatantly ripped off Nintendo's own assets and intellectual property. They titled it "Pokémon," they used some of Nintendo's existing Pokémon characters. It's a blatant violation of copyright law. Nintendo was well within their rights to have this pulled. Same with the Metroid II remake. I don't give a damn how long it was worked on. It was and is IP theft. They should have made it their own thing and not used Nintendo's property in it at all.
Unfortunately, I disagree with the law, personally. Plus, the game was doomed from the get-go, Nintendo was gonna kill it no matter what. Ok, you could say "All they'd have to do is change a couple ways in how battles work and call it a different thing!" Which, sadly, is bullshit. If they made the game just like pokemon, but with a different skin, it'd still be taken down because of plagiarism.

Look at Johto and Kanto. Two of the most beloved regions from pokemon. Each new region you go to, you see this "spike" in technology levels, like Nintendo can't decide what era they're in. Johto and Kanto both had this simple, lovable art style that every pokemon game afterwards totally butchered.
The proof is in the sales. each new game their profits plummet. To the point they're needing to crush these long-standing fan games just to make a buck. At this point, Pokemon should be a public domain IP, because new games are only going to get worst.

Alot of the pokemon looked amazing, the story was pretty good (even if repetitive), and the elite four was possibly the best ive seen yet.
Despite that, it suffers from the "Tech spike" possibly the worst in the whole franchise, team plasma is very bland in comparison to the other evil teams, and the story behind the legendary pokemon was overly dependent on their connection to Kyurem and their ability to fuse, which really butchered the concept of "Every pokemon is unique".

This is MY own funny strange hypothesis basically, I am NOT saying this is why Nintendo are doing what they do.. but gotta admit it makes a tiny bit of sense as to why they'd want to refrain from letting people dupe their game in order to retain authenticity as much as possible. Especially considering they have so many generations of their game already out there. Imagine spin offs made by fans becoming massive and hugely successful using their company name and everything.. feels a bit.. wrong to me idk. It's well made don't get me wrong but he could have used a different name too. Just put the word Uranium at the end and give it his own spin and theme.

if it can cut into profits it's against copyright. also they have the right to protect the IP in any way. cause of this. even tho no harm was intended. also copy right laws promote defending it. if they don't try to defend their IP they will have harder time defending it in the future. because this fan made game could be used against them cause they didn't take action. if it was smaller they could pretend it went unnoticed but since it's being covered by big channels like IGN they cant really ignore it.
Nintendo doesn't lose anything by having fan made games exist. There are fans out there who are willing to make a fully flesh out games just because they are a fan of the series. They should be happy that people are doing this, it helps keep Pokemon alive and fresh. Fans are the building blocks to success. The only thing Nintendo is doing is hurting their image, but meh like this is going to stop Nintendo from doing what they want so it doesn't really matter at all.

The game features at least TWO Fukishima style nuclear meltdowns in the early going of this game. Let's NOT forget that Fukishima actually happened in 2011. It's just hitting a bit too close to home. The region is still recovering from the disaster.

I'm glad I downloaded this game when I did. I'm only just past the 2nd Gym, but so far I really like the game. Its very well made and honestly helps me get hyped even more for Sun and Moon. Hopefully some time after the release of the 7th gen has passed, these guys will be able to put their hard work back up on the web for download. They just worked so hard and put a lot of love into the game, it makes me sad to see them have to take it down.

It is unfortunate but Nintendo didn't really have any other option. If they don't protect their IP now, it will be harder to protect later. And really, the game is still out there. It's out in torrents and the developers are still supporting it with patches, nobody got sued or lost any money, it's probably the best of a bad situation.
I personally think that if they made a version without the real pokemon and the pokemon logo and pokemon music there might not be a problem

actually, the law states the reason, it threatens ownership of the IP which is why ign was in fact a catalyst.
The thing is that the presence of fan games or fan materials doesn't per se hurt the pocketbooks of the original IP owners. Real games and fan games are not mutually exclusive and it's very likely the type of people to know about fan games is fanatical enough to play fan games while supporting the series.
A lot of game developers have come around to the value of mods, especially for older games that aren't played anymore. Hell some developers like Sega are even providing ways for fans to access mods, all because they realize that this is a form of fan engagement. It's not like a fan game like Uranium (it's not a rom hack btw) is comparable to the content in any up and coming pokemon game. It'd be different if the team stole content from Sun and Moon and used that to make a fan game. And given the distinct nature of each Pokemon game, nothing in Uranium would prevent me from enjoying a future title that Nintendo makes.
There's absolutely nothing reasonable about Nintendo's position, it's the same backwards shit they've always done. In the 80s they fought video rental stores over video game renting under the guise of copyright laws. They bullied their 3rd party developers with their practices over the years and that's why their current console is bleeding them cash per unit. They think gameplay videos (let's plays) aren't free press for a game and punish let's players. They have a very traditionalist mindset that has not adopted to the media of this day and age. I'm not saying they should let people steal their IP, but it's clear they're over aggressive. What's going to end up happening is that these fan developers are basically going to take their work,,whether it took 1 year or 9 years, convert that work into a new IP, and create a product that will actually compete with Nintendo 's IPs for attention. That will be way more harmful to Nintendo's bottom line than any Metroid remake or Fakemon game.
For example the game Undertale technically started out as an Earthbound hack. Mind you, Toby Fox the creator never got a C&D, nor was he contacted by Nintendo. But just imagine for a second if Nintendo were paying attention to what fan developers were doing and they saw Toby's work on the Earthbound hack then hired him? He would have produced Undertale or the next Earthbound/Mother game for them, they would have been part of one of the biggest indie games this decade. But since, at best, they don't even acknowledge fan works (and at worse they terminate them) they're going to actually motivate more up and coming developers to stay way from Nintendo IPs (which is again free publicity) and move them towards making IPs that are Nintendo inspired but compete with Nintendo in a more direct way.

It's screwed up, what Nintendo did, it took 9 years to make, got 1.5 million downloads, was completely free, had no In-game purchases, or recieved no money through ads, could have actually gotten more people interested or atleast brought back old players who hate the new games, as well as the fact theres MULTIPLE Fan made pokemon game, Released and in production, (Pokémon Cinder & Foam, Pokémon Phoenix Rising [in production last i heard, also sounds amazing with the gameplay ], Pokemon Reborn, Pokemon Rejuvination, Pokemon Ethereal Realms, etc), and this one gets pulled 1 week after full release. also, another thing stated by Pokèmon Uranium team, in the same comment you quoted was that, They have NOT been Contacted by NOA directly, that they had recieved emails from lawyers CLAIMING to be working with NOA.
Looking at how the Uranium developers are responding to this cease-and-desist order by Nintendo I would say that the developers entirely expected to have their game banned but the nature of the internet means that once it is in the wild it is impossible for any court-order to stop it. Since their website is still running and they intend to keep their forums open the fact they're not offering downloads is meaningless as they are still supporting the community. One of the reasons why the game was so polished may be due to the fact that they knew it wouldn't be possible to release patches for the game own it was released as they need to delete all source material now to comply with the order. However Nintendo have just handed them a ton of free advertising so all they did was make the problem worse by doing this.
If they had been smarter however, they would have developed a non-pokemon game with identical mechanics and then allowed users to install graphics patches ala Minecraft to get the desired result or took the route of the PokeMMO game and required users to have a copy of a pokemon ROM to play the game since that is also legal.
If Nintendo doesn't protect their IPs, they can become genericised and move into the public domain, meaning ANYone could legally make a game, and it would water down the brand.

A Pokemon world game could allow new gens and regions to be put into the game via DLC and could cost as much as a Pokemon game or even a bit more for the added value of the game...but this would require change and Nintendo does not like change...

I remember when we asked them for a game where we could pick a starting region and travel the unlocked regions in a Pokemon World game catching them all. While back then I realize this game would have been too big, I feel that we are on the verge of it being way more possible. Nintendo however said, no way. We dont want to make the best Pokemon game of all time. We just want to rehash the same game with better graphics, with the same Anime with different sidekicks and leagues ash will lose at... Its really frustrating to see such a great IP be in it mostly for the money and completely ignore the awesome ideas the fans come up with...
What's amusing, is that I only learned about this game after it was taken down. I will neither confirm or deny whether I have a copy now. In truth, given that we've had to wait two years now. It will be 3 by the time Sun and Moon come out. The fan games make me want to play more, not less.

Nintendo should have just hired the creators of Pokemon Uranium since they took it down. Because they had some really neat ideas that's allot better than sand castle Pokemon.
I think the fan made games are important for the community. They could easily make money off of them by getting permission and adding popular ones to the eShop. I would do that if I was a video game and system developer.
After nine years in development, hopefully it will have been worth the wait.
