    Samantha was a direct product of immature and selfish parents who never even placed her life and priorities before theirs and what better could we expect even though there may have been some young children whose lives turned out better?

    Who else thinks being a 15-year old kid from a turbulent broken home (divorced parents remarried and try again only to divorce a second time) In the midst of a Christian school with conservative evangelical leanings might create deep emotional and moral conflicts for an adolescent?
    In no way justifying what she did, but there are dynamics at play here that could exacerbate any existing mental health issues.

    The “best interest of the child” factors need revision. It’s common sense that a 50/50 schedule where the child has no home base, is not healthy for anyone, much less for a child who is dealing with the parents divorcing. Praying for those families forever changed by this tragedy. May God guide them through. Amen.

      AGREE!-I taught elem school for 30 years and recall heartbreaking situations - one in particular where the parents had split up. The 3 kids went back and forth-the mother had various boyfriends moving in and out. The oldest boy was in my 3rd grade class-could not concentrate was anxious and distracted all the time. He was smart and saw both parents discarding partners-who would not become anxious? Children need stability!

    • @mmin298
      @mmin298 Месяц назад

      So what would be the correct way to deal with a divorced family? What custody agreement would be best in yalls opinion? 20/80, 100% with only one parent being able to see the child at one place?
      Seems like to me and good choice would be being open with the child and finding a solution that matches the child's needs, 50/50 can work for some children, but not all. All children are different and have different needs. Also depends on the kids age on how much can be discussed with them. So there is definitely a limit. But you can see how a child acts and changes over time to different stimuli. So it's definitely a learning as you go game and it's all up to the parents and there community like schools, peer groups and home life. Mostly home life.

      @mmin298 the “best interest of the child” factors don’t prioritize the issues you’re raising. That’s why there is a call for their reform, as they’re a balancing test of sorts (as opposed to recommendations from a family therapist, for example). The law hasn’t caught up with how humans function developmentally. The law doesn’t even consider mental deficits when looking at violations. It’s more about “objective” measures. You can objectively determine that a child is blind. Courts have been slow to grant the equivalent to mental illness. Mental Health Courts are special courts that are picking up popularity with regard to jurisprudence though, but we are far from where we need to be. To answer your question, it’s actually not a straightforward process in my view.

      - Wisconsin has a law that makes it illegal to loan or give possession of a gun to a minor. If he did not give her possession of it no law broken.

    • @JaneJetsin
      @JaneJetsin Месяц назад +2

      @ I think you are stretching the concept WAY BEYOND the actual law.
      You are absolutely correct that parents are held CIVILLY liable for damages like in your examples property damage, personal injury, theft, vandalism etc. but I know there is no federal law or state law holding the parent CRIMINALLY liable for a minors actions. Civilly liable means they can be sued to pay for damages. There is no incarceration penalty in a civil trial. The only acceptation is if there was gross neglect as in the case of Ethan Crumbly or they contributed to the delinquency of a minor by encouraging an illegal act.
      As I pointed out before Wisconsin has a law making it a criminal offense to allow a 14 year old firearm access or loaning a firearm or allowing them possession of a firearm if they are under 18. Since she was 15 unless it can be proven that the father allowed sole possession of the firearm to her he broke no state law. Specifically under Wisconsin law a 15 year old can be left in a safe environment without adult supervision for reasonable periods of time. Since that is the case they specifically passed the law that a 15 year old minor could have access to firearms to protect themselves at home.
      So you are correct that they could be sued in civil court for damages but you are incorrect that they can be criminally charged.
      I understand your feelings but factually you are incorrect about criminal responsibility just because she had access.
      In fact what you suggest specifically violates our constitutional right to both equal protection clause and due process clause. You can not be prosecuted for the crimes of another unless you directly participate. They are specifically protected by Wisconsin state law because she is 15.

      @ Yes we do take away guns. There are MANY laws prohibiting gun ownership from specific classes of people. Convicted felons is just one of them.
      We were instrumental in getting the Armed Prohibited Person System passed and funded. It seizes guns weekly! Our database tells us we’re guns are and what caliber.
      If you don’t want guns taken away you better get on the laws you feel will stop the senseless shooting. You can bet we’re working on complete ban.

      @ Yes! They are very important but many sheriff departments refuse to enforce them.
