Perhaps the United States Supreme Court should have voiced a strong opinion on this issue which they could have done a month ago but here we are.
I think it may be kicked back for determination between presidential acts and private acts in the hopes that this will take it beyond the 2024 election and if Donald Trump is able to win the presidency everything, everything about the president being accountable for their actions when they leave office becomes moot.

On Nov. 9, 2020, Ginni Thomas emailed Arizona lawmakers after the 2020 election to set aside Joe Biden’s popular-vote victory and choose “a clean slate of Electors,” according to emails obtained by The Washington Post. In sending those emails, Thomas was trying to assist in the extraordinary scheme, known as the “Fake Electors.” The fake electors were only the first of several attempts at overturning the election. Ginni Thomas appears to have been not a bystander to the attempted coup, but a willing and enthusiastic accomplice.
Ginni may find that her marriage to Clarence Thomas could result in her becoming collateral damage in whatever is to come. For example, there are growing calls to expand the court (to curb the far-right excesses of the current body), which would dilute Justice Thomas’s power on the court, alongside calls to impeach Clarence Thomas.
Together, they have flouted the ethical standards of the Supreme Court, including a failure to report $686,000 of Ginni’s income in a required financial disclosure document, and by violating decades of established norms about avoiding even the appearance of political partisanship, by headlining events such as the October 2021 celebration of Thomas’s career on the Court hosted by The Heritage Foundation.

And his supporters in the court figured if they rule that the President has Absolute Immunity, not only looks bad for the court, but also gives Biden the freedom to do whatever he wants with Don the Con. So, they came up with a solution that the court would frame the issue in a way to create Maximum Confusion and Delay and Prevent his Criminal Trials.
Alito and Thomas are woefully and shamefully unethical, and are unworthy of having lifetime appointments in SCOTUS. To allow this corrupt institution continue to erode and disintegrate trust and civil liberties is an outrage!

We are in terrible trouble. While we are fixated on the glacial pace of the courts, local and regional and state apparatus is being altered. Legitimate voters are being thrown from the rolls, civil services further eroded, and our postal service hamstrung in its infrastructure. There are so many balls in the air it's impossible to follow it all.

This version of SCOTUS is the strongest argument you can make for Supreme Court Reform. It is an activist court.
"What do you expect?" as a rhetorical question simply normalizes a great injustice. We expect BETTER. @@kevo6767 it's not about how the SC is *meant* to be chosen. If the president has immunity, whether total or for official acts, there is absolutely nothing to stop the incoming (or sitting) president from sacking them all and replacing them.

Important to note in that 60:1 court record, the one "loss" involving procedures affecting a small number of ballots was later overturned by the Pennsylvania Supreme Court.

Once a presidents term is over, the PRA explicitly states that all presidential records automatically belong to the national archives.

You can break the law performing your official duties (like providing insider information to a bidder so they can win a contract, 1, and taking a kickback for doing it, 2). All of this was done while performing your official duties. Violating ethics rules and the law is violating ethics rules and the law whether you're performing official or personal acts. The answer to that question is NO. An absolute, unequivocal NO. It is not something that needs to be decided. It has already been decided by the authors of the U.S. Constitution.
