'Crossed the line': Darrell Brooks & judge fiery showdown over jury seeing car used in parade attack

  • Darrell Brooks does not understand why jurors should be looking at the vehicle that prosecutors say he drove into the crowd at the Waukesha Christmas parade in December 2021. Brooks argued with the judge over the jury viewing it and whether he has to be present when that takes place.

      Well, I don't see the difference in being a person vs. a human being, but Brooks has raised some very good issues and definitely has a case for appeal if convicted. First, he was railroaded by the police as the questioning officer even admitted to yesterday, and as for the court they never proved their jurisdiction to Brooks, who btw, identities as a sovereign citizen. And her ruling on whether the jury gets to see the vehicle he used to run over people in the parade route requires his consent. I am appalled at how they are treating this man.

    Make no mistake-this judge is in control. Yesterday, before Brooks was removed from the courtroom, he repeatedly asked the judge if she was/why she was holding him in contempt. He did the same this morning. He is actively trying to bait the judge into holding him in contempt. After removing him, she stated on the record that she believes holding him in contempt would reward him for his bad behavior as it would delay the current trial and that she is unwilling to do so. I would imagine his behavior will grow more brazen as the conclusion of the trial nears. This judge is a Jedi master of patience and self-control. Her refusal to be manipulated by his bad behavior belies her dedication to the people.

      apparently the judge mentioned at one point that if he did not attend the viewing of the murder weapon, then she would want him to sign a statement allowing it to happen without him. he was depending on it so that he could refuse to sign off and not go. she probably realized afterward that she had given him something to use against her and dropped the requirement which he tried desperately to revive by arguing with her. that's what it seems like to me. he is very manipulative. it's like walking through a landmine guiding him through the trial. have to be careful what you say because he is going to spin it.

      * You must make all your arguments in writing.
      * You cannot present witnesses.
      * You cannot present new evidence.
      * You usually cannot make new arguments on appeal.
      The appellate court will look only at the record that was before the lower court or agency. For an appeal from an agency, the record is the administrative record prepared by the agency.
      For an appeal from a trial court, the record consists of the papers that were filed with the trial court, exhibits admitted at trial, and the trial transcript.
      In almost all cases, the appellate court only considers two things:
      * whether a legal mistake was made in the trial court; and
      * whether this mistake changed the final decision (called the "judgment") in the case.

    Brooks has a great point. How can the state present evidence without his consent? How can they even have a trial without his consent? And by extension, how can the police arrest him without his consent? This is a game changer. Why has no one ever thought of this before? What a brilliant legal mind. Kudos to Darrell Brooks, a legend in the canons of law.
