- Darrell Brooks returned to the courtroom against his wishes, where discussions about jury instructions in his trial for the Waukesha Christmas parade deaths resumed. Brooks complained that he doesn't understand the legal issues and that the judge is being biased by continuing with proceedings despite his confusion. The judge noted that Brooks has made many comprehensive legal arguments that show he knows exactly what is going on.

The smartest thing this judge has done, and there are actually many things, is to allow this to be televised.

The judge understands what she is doing even if the defendant does not. Her patience is going to bury him in the review of this trial on appeal. I guarantee that a higher court judge will mention her patience with the defendant as a plus in her handling of this trial and her decisions against him.

I don't think he had one particular strategy. Like a obstinate child, he jumps from point to point and then gets fixated on one. In the back of his mind he things the sovereign citizen nonsense will get him off. You can see his face when the guilty verdict comes in. He had real hope of being acquitted.

The judge handled Brooks' constant provocations masterfully.
When she did take the bait, she'd explain to him, like a kindergarten teacher to a misbehaving toddler, exactly what he'd done and how that was hurtful/disruptive. By explicitly calling out his bad behaviour rather than responding in kind, she foiled his attempts to play the victim.

I don't believe it was his strategy to behave like an asshole in an attempt to bait the judge and get a mistrial. I don't think he is intelligent enough to come up with that strategy, or any strategy at all for that matter in regards to the trial. I believe his behavior was merely to stall and interrupt as much as possible. I am sure as a child whenever he wasn't getting his way he would throw these type of tantrums until he got his way. Whoever he would argue with (his mom, his grandmother, a teacher, a girlfriend) would simply give up because it wasn't worth the fight. This trial, however, was worth the fight to Judge Darow.
The irony of him telling the judge she can't force him to stay in a place he's requesting to not be in as she's getting ready to sentence him to over 1000 years in prison is amazing.

It's a common semantic trick SC do. They think saying yes to "do you understand" means that you "stand under" the authority of the person asking the question. That's why he says he doesn't understand.
The judge is actually genius for letting him go on and on because then the record shows that he does actually understand and is playing dumb.
Yep. It's very frustrating to listen to, but in the future when he attempts to appeal, there will be pages and pages of records showing that this court gave him every opportunity at a fair trial.

Yes she could let him ramble on a bit but not for 50 mins. Sue Opper even told her you are in control of this court room not Mr. Brooks. And when she repeated herself 25 or more times there was no need, 5 times maybe but not 25 times or more in different ways. He is not capable of comprehending the Law so yes she should have done what she needed to do but not to this extent and she still would have prevented a mistrial.

I am a high school teacher who works with highly at risk students. This reminds me so much of their behavior when they’ve gotten themselves into trouble that it’s sickening
I left the 4th grade classroom this year because I had a room full of these type people.
I can not give you teachers more love and compassion with the kids your forced to deal with these days. Out of control is an understatement and their parents are just as ignorant if not worse. God bless you teachers and thank you for teaching our youth ❤

WI law says if you waive your right to a Lawyer. You don't get any help. Brooks seems to think he could change the law to suit his needs.

I think that it's amazing how during the trial when he was asking the witnesses questions and they said that they didn't understand what he was asking them his response was "I think that was clear." Or he said "I think that was pretty clear but I'll rephrase." Then when the judge asks him simple questions he says that he doesn't understand. This was a delay tactic and also a control tactic. He thought he controlled everything in that courtroom and he found out that the only person who had control of that courtroom was Judge Dorow, and she sent him where he needed to be and now he's spending the rest of his life there so that he can't hurt anyone else. Judge Dorow is awesome, she's not just a hero she's a shero.

If this judge, at some point, stood up from her podium, wallked over to the defendant, and murdered him, on the spot, with her bare hands, I would consider the action justified, and demand she suffer no consequences as a result of her actions.

@@badazzbarbiePOV I watched some early recordings. He cannot appeal on the grounds of ineffective counsel after he was offered the right to effective counsel and he was asked and advised and almost begged repeatedly to accept effective counsel.
He was also warned that Wisconsin laws barred him from "tapping" public defenders as an ad hoc resource for legal advice if he chose to represent himself.
He chose, over all those objections, and the judge's reluctance and cautioning, to represent himself, alone, on his own wits.
He probably understood quite clearly that public defenders would not mount a Sovereign Citizen type defense on his behalf, because that's legal nonsense and they don't want to get disbarred or fired.
This one decision, on whether to allow him to represent himself, to "waive" his right to counsel (whether or not he likes the word "waive"), lasted at least a day and possibly two days of discussion in court. He also submitted to psychological testing which could possibly override his demands to represent himself.
He met the criteria sufficiently to be able to assert his demands to represent himself.
Under the law, as clearly stated, he cannot backtrack and claim he was railroaded by not having effective counsel.

@@carolynjackson460I'm sure Judge Dorow is aware. As Attorney Opper noted in her closing arguments, what Brooks spoke on was legal mumbo jumbo and that Brooks' characterization if the trial is rooted in contradictions. But all of this was to ensure there was no room for appeal or mistrial.

He tried every trick in his bucket to try and control every aspect of this trial. He failed, constantly, and that was one of the most satisfying things to watch.
