Jet Skies fault. They may have failed to see the incoming vessel but they did fail to move aside. They aren't even supposed to be there in the first place especially considering that the inlet is a main passage for boats!

This is a heavy traffic area with rough water. A real dumb place to play around on a jet ski because of the combination of rough water and heavy traffic going multiple directions. If a boat is in your starboard bow, they have the right of way.
In an inlet, boats entering and exiting have the right of way.
My understanding is in Canada it is the responsibility of the overtaking boat to avoid the other craft. Not sure about US rules
