    Hi there smart drivers. Rick with Smart Drive Test talking to you today about right-of-way and stopping when in doubt on a road test.
    Now one of the things that I tell students on road tests in terms of right-of-way, even though you have the right-of-way doesn't mean that you can go.
    Because the right-of-way is always given, it's never taken.
    So if another vehicle is going to push through and go forward, do not go because you're going to risk a crash.
    As well, remember you can be right or you can be 'dead right'.
    Because if you go because you think that you have the right of way and the other vehicle should give way to you, they may or may not.
    And remember, failing to give the right-of-way to other traffic on the roadway is one of the top reasons for crashes.
    So it's better to stop and wait and let the other traffic proceed - the other road user go and then proceed.
    And finally, I caught this on dashcam here at this intersection behind me...There are other road users there and I just simply stopped and waited, even though when I came up to the intersection--as you'll see in the footage here--I had the green light.
    I could have gone, but there was a vehicle around the corner that had stopped and pulled up on the sidewalk; there was a pedestrian; and there was a vehicle in the intersection making a left-hand turn.
    All of that created a complex traffic situation where I simply stopped and I waited and I figured out what the other road users were doing before I proceeded.
    And I got eye contact with the pedestrian on the side of the road before I proceeded around the corner on the right-hand turn.
    So without further ado, let's go to that footage.
    And now we're going to turn right at the next intersection here. You can see the solid line. Now you cannot cross into the bicycle lane.
    So you've got to go right up to the corner. And of course this guy's pulling up onto the sidewalk here.
    And I just waved that guy on because he was sort of sitting in the intersection and the light was going yellow to red.
    And I've got a pedestrian here.
    And I don't know whether the pedestrian's going or not. No, okay. And that's what you do if you're not sure.
    And as you saw I waited right until I got to the intersection. You almost have to do a 90-degree turn there to not deviate into the bicycle lane because of that solid white line.
    You cannot deviate into that bicycle lane. And as you saw there, I wasn't sure what other people were doing.
    So you saw that I just stopped and I waited. And that's what you have to do for the purposes of a road test.
    If you're the least bit unsure of what other road users are doing, just stop and wait for them to clear, or for them to get eye contact with you to ensure that you're going to be safe.
    That you're not going to go around there and that pedestrians going to step out.
    And she got eye contact with me and sort of nodded that I could go then I proceeded around the intersection.
    As well, the other guy that was turning - he was already sort of committed - his vehicle was turned slightly so I didn't turn in front of him because it's a defensive move on my part that I was waiting to see what that driver was going to do.
    CONCLUSION
    Quick review of right-of-way on a road test.
    If you're in the least bit of doubt in any traffic situation, particularly at complex intersections like this one behind me here simply stop and wait for the other road users to clear the intersection.
    And then proceed and make sure that if there's a pedestrian or cyclist or some other road user on a scooter or whatnot that you get eye contact with them.
    Because remember, you can be right or you can be dead right.
    And as well, the right-of-way is always given, it is not taken.
    If you take the right-of-way and expect other road users to give you the right-of-way you're going to be in a very high-risk situation where you could be involved in a crash.
    Because failing to give the right-of-way or failing to yield is one of the top reasons for crashes.

    When I was in my last year at grade school, about 12 yrs. I was on my way to school and about to cross the street at a residential intersection with stop signs but no traffic lights. I was going straight across a one way street, and there was a car on the cross street behind me, and he's at the stop sign. I looked over my shoulder behind me and I could not see into the car, and I did Not see a turn signal on and assumed he would go straight. I'm not sure that car could have seen me though because I was a short kid, and there was a mailbox and a trash can and bushes, but I had no idea he was going to turn. I saw no signal. So I walked into the road to cross this little street. But there he is making a right turn and he almost hit me. If I hadn't realized he was turning, and jumped back about a foot, I'd be dead. So drivers, there's a lesson here for you. Signal even if YOU don't see someone to signal at, because the person who sees your turn signal may be someone you didn't know was there.

    Evening Rick, I'm proud to say I've passed my road test this time. Again I thank you for all you've provided on your channel. And while I was taking a lesson there was an incident where I gave the right of way to pedestrians but I ultimately had the green light. The situation ended up with me and another driver sitting in the middle of an intersection waiting to make opposite left turns.

    Now, it makes me think if this was the reason I failed my first driving test. I still yet to take my 2nd one and now I need to gain all of the confidence I can get to pass.

    I have not really had anyone fail to give the right-of-way in traffic to me before. I have had people drift into my lane, though.

    A few years ago I was heading home after getting a Prescription for Antibiotics at my Pharmacy. It is in a Residential area. School had let out and a Man was waiting on the Sidewalk for the Kids. A Young Girl riding her Bike came to the Intersection and waited for the Man to signal for her to cross. As she did I watched in shock as a Truck came from across the street, did NOT stop and kept on going.
    As He drove past Us, he was yapping away on his Cellphone, completely oblivious to the fact he came within inches of hitting a Child. He had this "WTF is your problem?" as many People honked at him. One Man turned onto that Street and followed the guy.
    Even though She wasn't hurt, I put my Hazards on and asked her if she was Okay. She was shaken up but okay. So in my oh so wise "Aunt Safety" I said "Just be careful as you can't rely on Drivers to pay attention.". In short, a lesson a Bus Driver told me in 1992 "You have to drive as if Everyone Else is an A----le and are out to get you and kill you. it is called defensive Driving."

    I used to cross a highway at the crosswalk. The crosswalk is at an intersection. I noticed 99% of the time, if somebody was turning left onto the highway, they would not yield to pedestrians crossing the crosswalk. I think it's because they have to notice the people waiting at the ends of the crosswalk and anticipate them crossing. And the highway is wide, so the people at the far end of the crosswalk are a bit small to notice with all the traffic whizzing by on the highway, and a guardrail & telephone pole sorta obscures the closest end of the crosswalk from drivers on one side. Plus drivers might want to beat the traffic signal since it's on the shorter side.
    When the crosswalk is activated, it will say "WALK" but the pedestrians should really wait because chances are the turning cars will turn and go over the crosswalk. Activating the crosswalk doesn't change the traffic signal, soi think drivers are given the full responsibility to notice and yield to the pedestrians but don't always notice .
    Thankfully there is a crossing guard there on the school days, so he goes "AAAAYYY" and walks out with the Stop sign whenever kids are crossing. Except late after school he will be gone.

    i go for my drivers test this november. i been practicing and i'm getting better. turning right on red can sometimes be free at intersections. at some intersections. there will be a no turn on red sign. most people be ingoring the sign and just do it. may you do a video on that.

    i've seen conflicting reports on right turns from bicycle lanes. i've seen a videos of multiple people getting marked down on their drive test because they either don't enter the bike lane at all or not soon enough. clarification would be great.

    Hi Rick, I really like your informative videos, but one thing i cannot find an answer for, for illuminated pedestrian crossovers, here is the scenario, you approach an activated illuminated crossover where the lights are flashing on top of the crossover sign but no pedestrians are crossing or going to cross, do you need to make a complete stop before we proceed, then if the road is clear proceed? or shall we stop and wait until the flashing lights are OFF then proceed? or shall we proceed with caution? which answer is correct?

    I remember in heavy traffic at an intersection, a row of cars was turning left at the Green arrow, then they had a solid green light which means they should yield to the opposing traffic. They should wait to make the turn, but the row of turning cars kept following each other and turning left. I think they were either blindly following each other or rushing to turn and avoiding the wait.
    I think that in this case, the opposing traffic should wait even though they are supposed to have right of way, else there could be a crash. I have seen sometimes the opposing traffic will start moving into the intersection while the cars are turning left in front of them, but they have to stop and honk. It seems like those drivers are trying to say "let us go, we have right of way" but I think it is probably better to be patient and sit still to avoid an accident.

      This happened with me too. I have the habit of lifting my feet off the accelerator and hover it over the brake as I approach intersections.
      I was approaching the intersection with the green light, going straight, at about 45kmph. I had a car tail-gating me so I wanted to maintain my speed to ensure I was not rear-ended if I applied the brakes. There was a car on the other side establishing to turn left. I don't know if that car saw me approaching, but they decided to continue with the left turn. It was such a dangerous situation as I was trapped from both sides. Luckily, I applied the brakes and skidded a bit. The person behind tail-gating me was vigilant enough to notice what was happening and they also applied the brakes. All the other cars honked at the car that turned left even when they weren't supposed to. Some drivers even gave them the finger. But damn, was that scary!
      I wonder what would have happened to me if this happened on my road test.

      @@satyam0303 sounds really scary! I feel like you'd earn a good score on the road test. Sometimes when people tailgate me I refuse to speed up if I feel unsafe driving faster and try not to get too distracted by them. I'm not sure if that's a good idea, though. I just figure if they rear ended me it wouldn't be as serious as getting in a crash from speeding, but I don't know how severe of a rear end that would be.

      @@satyam0303 a rear end accident could still be bad, if I see somebody tailgating me I'll pull off to the parking lot on the side to let them go because I drive down a two lane country road so they can't pass normally. I'm not going to speed there because it's too curvy and there are hidden driveways so it's not safe.

    Thanks for the helpful video. I have a question. In an uncontrolled intersection where east-west bound road is four lane road and north-south bound road is 2 way lane road - no lights or stop sign etc. If car A going northbound needs to make left and a car B going southbound needs to make right, does car A needs to yield to car B even if car A gets to the intersection first? This is what confuses me. Looking up the right of way rule for my state, it says the car that gets to an uncontrolled intersection first has right of way. So, which right of way takes priority in this case?

    Hey, Rick. I decide I have to subscribe you. I want you to help me to become a better driver. Last month, I failed the driving lesson all of a sudden and my permit is expired. I was really pissed off for not having a car and license. Now I have to walk all the way home and catch a bus. I was so damn exhausted. My life is hell.

    question. at a 4 way stop, if a car to my right is turning left and i’m going straight, do i have the right of way because i’m going straight or does the car turning left have the right of way because they’re to my right?

    Yes it happened with me but quite the opposite.. i have failed to give right of way as it turned green for on coming traffic i turned left thinking its my turn but traffic hasn't moved so nothing happened.. but i learned a good lesson 😌

    Kindly advise. So during a road test could it be a reason of failure, if I have right of way and I act defensively on my part to give way to others who drove offensively or I just am being cautious. As my instructor always tells me to push through if I have right of the way, or I will fail.

    Hi Rick..in my recent DMV test instructor failed me for my decision at 2way stop intersection. I stopped at stop sign as per rule n was supposed to go straight but I couldn't see left side traffic in the through lane due to lot of big cars parked. I attempted safe n started slowly at 5mph to be sure that I could see left side incoming cars before going straight with full gas pedal. He perceived it as stop after stop in intersection n failed me. I was like what's my fault if I couldn't see through traffic n so started slow after stopping at stop sign. I could see nobody was coming from right side clearly though. I think left lane might be little curved or due to big heighted cars parked I couldn't take judgment may be.. Your advise would really help to clear it next time.

      Hi Umar Ali - thank you for your comment. That utility truck works for the City of Vernon. The guy that operates that truck has been working on those traffic lights for some time. It is not legal to drive on the sidewalk, however, the guy gets a pass because he's a city work and working on the traffic lights. If there is anything further we can do, drop us a note.     One day I had my green light and other car went through the red light!! If I wasn’t paying attention we probably could have a bad accident. Now even when I have the right of way I pay more attention to what the other car is gonna do.

    I've had a test examiner rush me to make a turn when cars waiting were in the intersection and turning in the same direction. They gave me oints for that too

    Hey Rick, just a question on right of way. When you're turning left, someone turning right onto that that same road has the right of way over you. But if it's 2 lane street, does he still have a right of way? would I be entitled to the left lane, and him entitled to the right lane?
    Also, to change the scenario slightly, would it make a difference if theres a car parked in the right lane of the 2 lane street?

      Basically if that person has the right of the way turning right into the same street that person will turn to that lane on the right which is the 2nd lane from you. So you will turn into the lane right in front of you which is the first lane. The main idea is you turn you vehicle in the closest lane.

      @@smartdrivetest Yes, as I was behind the wheel. I could see her from the corner of my eye just putting stuff down and I kept making complete stops at intersections with no signs or traffic when I should of kept going but scanning the area to make sure I was good to continue moving.

    Hello Rick,
    I have a G road test scheduled for July 19, 2019. I have been practicing daily and I am uncertain as to what would be the best decisions to make in order to pass the road test. I have 3 questions:
    1. When making a left-hand turn at an intersection (one with lights/pedestrian crosswalks etc.) I am uncertain if I should enter into the intersection and wait to make my left hand turn. Normally, I would not question this too much but I live in a small country city, and in the downtown area (especially during the summer) there are a lot of pedestrians. So my question is should I enter into the intersection and hope that I might get an opening from all the pedestrians or is it alright to not enter the intersection and wait for my opportunity to safely make the left-hand turn? I often feel pressured to always enter the intersection, but if the light turns yellow before the pedestrian crosswalk has cleared I may cut some pedestrians off and fail the test. Perhaps it would be best to not enter the intersection and wait until the green light turns red (despite potentially aggravating drivers behind me). So, really would it be alright to stop at the green light (and wait for the red) when when attempting a left-hand turn to yield for pedestrians?
    2. At an all-way stop (with 4 stop signs) If I was about to make a left-hand turn and another vehicle was approaching the intersection across from me, who would have the right of way if I got there first? Must I always yield if I am making a left-hand turn, even when I got to the stop sign first and the intersection is not a light intersection (just an all-way stop)? I wouldn't want to fail because I believed this situation would give me the right of way.
    3. If I entered an intersection when the light was green and could only perform a left-hand turn safely when the light turned yellow, would this be acceptable on the G road test? Sometimes upon entering the intersection, the only safe opportunity is to wait until the light has turned yellow (to ensure all traffic has stopped). Again, I wouldn't want to fail because I could only make my left-hand turn safely when the light turned yellow (once already having entered the intersection on the green light).
    I would really like some clarification on these types of scenarios before I take my G road test. I would feel much more certain when to time my maneuvers and what would be acceptable during the examination.

      1. My recommendation is to stay put, any time you have your doubts, when yielding to turn left on a green circle. Unless it appears likely that you will have a chance to turn left during your cycle of green, I'd stay put behind the crosswalk. No sense in pulling into the intersection, only to get stuck with no opportunity.
      2. If two oncoming vehicles approach a stop sign on their respective sides of a street, then the one who isn't turning has the right-of-way. The left turner takes a turn after the straight travelling vehicle. If both vehicles are straight travelling, or both vehicles are turning left, then they are not in conflict with each other, and can both proceed simultaneously. If you are turning left, while the oncoming vehicle is turning right, and you both have the same destination lane, then the right turner has priority. This is opposite in left-drive countries. The sidewalk-side turner has priority over the cross-traffic turner.
      3. If you enter on green, you can exit on yellow, as long as you can clear on green or yellow. This is why it's best to stay put when you have a left yield on green. The entire intersection should clear before the traffic light cycle changes.

    Hey Rick , I’m going for my road test this weekend I wanted to ask do you have a video that Explain The lanes you enter from a turning lane I find myself getting confused about what lane to enter coming from a turning not sure if I should be entering the mid lane or the left turning lanes I get really confused Especially when the road line marks are rubbed out

    Hi. I have a question. If I'm turning left and the vehicle on the opposite lane turning right. and there are 2 lane (enough for my and their vehicle to turn), who has the right of way? or do we turn at the same time?

      The right turner has priority. Since right turns take less time to complete than left turns, the right turner will complete their turn and inconvenience the left-turner a lot less than if it were the other way around.
      Two oncoming vehicles meet at a stop sign:
      1. Both go straight, or both go left = both can proceed simultaneously, since they are not conflicting with each other.
      2. Car A goes straight, while Car B turns left. Car A has priority.
      3. Car A turns right, while Car B turns left. Car A has priority.
      The above assumes right-hand traffic like in the US and Canada.

    Do u have a video about making a left turn on green but you have to yield first? I was unfortunately in a car accident (I wasn't very experienced with these types of things because I was driving with my learners permit) where I didn't gauge how far the car coming was, and turned because I thought I had enough time, and hit the other car coming. No one was seriously hurt or anything, but the accident like completely turned me off driving for like two years, but now I'm getting back into it so I can get my license finally. Also do you have anything on driving anxiety? Because mine was severe at one point but it's getting better but I'm still scared when I get on the road.

    I was confused on my right of way because as I was getting ready to turn into the big streets after the stop sign, there were two cars that were very far away on my left and right and I failed because my examiner stopped me and was like "do you not see the cars?." Which yes, I clearly did see the cars but I thought they were far enough for me to go, so I am very confused. Please help.

    is it better to give someone the right away than to take it? Do you fail a road test for waiting when you should go? cause I saw someone fail for not waiting.

    I saw a car exiting on the same right lane I was driving during one of my driving lesson so I kinda slow down because I wasn't sure if the driver is gonna stop or go through. But my driving instructor reminded me I am in the right of way, the other other driver has to stop and wait for me to pass, but darn the stupid driver moved forward when I was close I had to break real hard, that was close! And my driving instructor shouted at me Be careful! Didn't you see the car! I said I saw it that's why I stepped on break! I lost my mood that entire lesson!

    Hi Rick, When driving in the back little streets (not the back Allies, ) there are many Cul de Sac signs. I actually live in a Cul de sac. My examiner told me to stop during my drivers test to tell me something, he pointed at the Cul de Sac sign to our right (I was not inside the CdS, just driving through), and said that " You can't drive at 50km/hr in these back streets, those guys have the right of way" . I never thought people coming out of a Cul de sac would have the right of way, haven't found that in the book. So, is there a proper way of driving through a street that has a Cul de sac Street to your right; slowing down , checking and yielding to them? No one does that in the street where I live.       Smart Drive Test . Thank you. I'm not sure where I was, since it was the Advanced Road Test, and hour driving to areas I didn't know. Your answer makes sense. . The examiner gave me 10 points three times for passing what he called a T intersection failing to observe conditions, which he pointed to be the Cul de Sac. I think he must have meant to reduce speed to be cautious. Thanks.

    Hi rick! What do you do when it is a 4-way stop but there is only one stop sign? No other stop has a stop sign ? Who has the right of way and how long does the person who stops at the stop sign should wait ?

What leads you to think it's a 4-way STOP if there is only one stop sign? It's like a roundabout - if there aren't 4 give way signs, than it's not a roundabout, in the technical-legal sense.     The thing I don’t like with pedestrians is they shouldn’t stand right at the crosswalk if they are not going to cross. That lady was standing at the corner like she was going to cross it really confuses drivers if you are just standing there but not crossing

      Hi billytheking2 - thank you for your comment and query. I stopped because the utility truck in front of me turned right and immediately pulled up on the sidewalk. I stopped because I didn't know if I could make it around the corner, and to be sure I could before I committed to the turn. And as I was rolling to the stop the light went to yellow and that's when I waved for the left-turning vehicle to proceed ahead of me. If there is anything further we can do, drop us a note.
