    I decided to purchase your bundle; I definitely don't feel comfortable going into something without any legal knowledge and it definitely sets off red flags that some UGC creators neglect this aspect of it. Just because most people are doing something doesn't make it safe or okay. Thanks for also providing free resources on top of that :)

      Omg, yes!!! It makes me so nervous for creators that don’t take the legal side seriously…they just don’t know what they don’t know. Props to you for taking charge. Proper legal training will truly empower you and allow you make better deals.

    i’m so glad i stumbled across your page! i wish while encouraging people to pursue their UGC journey, more people stressed the importance of legal protection, even if it comes across as annoying! i’d rather it be hammered home, haha. anyway, i’m haven’t made a thing for my portfolio because i wanted to study this portion of building my ugc presence more intensely. grateful for your service!

      Agreed!!! There are legal considerations for running a business and for paid content creation (like licensing), knowing about copyright/trademark/privacy laws, and advertising/disclosures. Good to know beforehand so you don't misstep. Happy to have you here. Lots more on my IG and TT. 🤓

      Hi! I can most certainly do that - is there something in particular you were looking for? What issues are you facing as a small brand looking to hire UGC Creators or ambassadors? Or, are you unsure of the legal issues and would like more awareness around that? Thanks!

      Hey! Typically, the brand will want to use their own contract, which is where the legal training and pointers like this come in. You'll need that working knowledge to edit the terms in their contract. Just make sure you know what you are agreeing to before you sign it. A contract is great at limiting your liability as well.

  • @TheG-Calmar
    @TheG-Calmar 5 месяцев назад +1

    Very nice video! Sorry for the question, but for you, how much pages for a contract ? Avoiding brands to think that their reading a full book, and for the UGC creator to stay attractive ? 😁

    • @legaldoer
      @legaldoer  5 месяцев назад +1

      That's a great question. I don't think length is crucial, but a clear and concise contract that covers all your legal bases is key. A well-written contract, regardless of length, should be straightforward and include all the necessary legal clauses for your protection. Legitimate businesses care about clear communication, not page count. Just make sure you avoid redundancy or the use of excessive or misplaced legalese that takes forever to decipher and edit, which will slow down the negotiation process.

      @@legaldoer Okay! Thank you very much for your answer 😁 So 9 pages can be okay if it is well written, or 9 pages is too mucha ?

    This is super helpful, thank you so much for sharing! I recently discovered you on tiktok and love the work you're doing. I've been doing the research and I really want to start ugc, but the legal side freaks me out (especially after the whole iconic London thing). I want to be safe so I've been looking into buying your bundle, but what does it include? How do I benefit from using it? As you're saying, I don't know what I don't know and its so easy to just imagine all the worst case scenarios. I want to be informed and realistic about this, also sorry for rambling in your comments lol

    • @legaldoer
      @legaldoer  Год назад +1

      Yeah! I am so happy that you found it so helpful and that you're loving the content. I know the legal side of paid content creation can be super scary - but it doesn't have to be. That's why I'm here (as a lawyer for over 10 years) - to help empower creators like YOU with the legal know-how.
      The UGC Bundle is my pride and joy - it includes soo much information and I'm constantly updating it to stay current. So what do you get? The UGC Bundle (Legal) includes: 1.) a Creator's Outline - that breaks down the key legal terms and items to be negotiated with the Brand (so you know what to discuss during your negotiations, what to fill-in in the contract template, and/or terms to double-check for in the Brand's contract); 2.) an annotated/fully customizable contract template - templates are worthless unless you know how to use them, so I've included notes about when to include or not include certain terms and highlighted/fill-in selections for you to add the brand deal details; and 3.) legal training - I've included a video guide where I go through the outline and template to explain everything. This also includes how to stay legal - like considering the music, copyright issues, trademark issues, privacy issues, etc.
      How do you benefit from using it? You'll know how to avoid bad brand deals that expose you to legal liability (and that take advantage of your time/money), how to legally protect your money and hard work, how to edit the Brand's contract, and negotiate better deals (because you'll know how to license your content and make more money). You'll no longer be afraid to start UGC, but empowered. I could go on... hehe.
      Let me know if you have any other questions. Best of luck!

    Please explain to me why would I legally bind my client to use the content I created for them for a certain period of time? Whats the value in that?

    • @Lissyloo29ful
      @Lissyloo29ful Год назад

      It all depends on how you want to get paid. Because you own the content - you get to decide how you want to charge for it. It is all about knowing your rights, how to license those rights and your creativity, and negotiating a fair deal. You can charge them to create the content and then a monthly usage rights fee for organic or paid ads. Some creators breakup the fees and add monthly charges to be paid on an ongoing basis or create one upfront payment (that was calculated based on content creation plus the term). If the time period is limited, say to 1 year, then you can renew the license/usage and get more money for that renewal. Some creators don't like keeping track of the time period for organic usage, and will offer an unlimited time period (which is different than into perpetuity, because you can still revoke their permission to use it) while charging for time for paid ads because the brand is making money off of their voice, image, likeness, and creativity and they want to be compensated for that. You get to decide.

    Hi Alyssa! Could you please explain to me why at 02:45 you say "this is not legal advice" while you are a lawyer and you know what you're talking about, plus you offer a bundle that is made for all when in the beginning you say " legal for all is truly legal for none". I'm asking with kindness while trying to find a good agreement template that I can trust.

    • @legaldoer
      @legaldoer  6 месяцев назад

      Hey there! This is a great question and I'm really glad that you asked for clarification.
      Yes, I'm a lawyer, but I cannot be your lawyer without officially working together. I am qualified to provide legal education, but I cannot give legal advice directly to you over the internet without knowing your exact situation and giving you a personalized plan. Legal education provides general knowledge about the law, while legal advice applies the law to your specific situation. It may seem like semantics, but the differences are important. Legal education and spreading knowledge is one thing - as it allows you to take that information and apply it to your own situation. But, legal advice means that I'm learning about you and your business and provided legal advice based on your unique situation and needs - that would require that you hire me to be your lawyer.
      When I say that "legal for all is truly legal for none" - I mean that generic contracts will be missing key legal terms that are meant to protect you and generic cookie- cutter legal advice is dangerous. There are nuances and important legal considerations to think about for each niche and situation. For example, a UGC Creator is going to need a completely different contract than an Influencer because they have different licensing needs and legal obligations when it comes to advertising rules and regulations. Even further, someone hiring a UGC Creator (or Influencer) is going to use a different contract as well and will include different legal language than a UGC Creator (or Influencer) would use. So, an indemnification clause might be included in all of their contracts - but it is going to look different when written in favor of a UGC Creator versus an Influencer versus written in favor of a brand. The UGC Bundle (Legal) is not made for all - it is written specifically for UGC Creators (not for brands or anyone else) who are engaging with brands to promote the brand's products. It is very specific and the terms are written in favor of and to protect the creator. And, more importantly, I've included legal notes and if/then scenarios so that the creator is able to modify and customize the template for each brand deal, as no two brand deals are alike. Hope that helps!

    so let's say i gave them time 6 months for usage rights to my video after 6 months would they remove or delete my video from their ig or tt page? or how does that work?

    • @legaldoer
      @legaldoer  7 месяцев назад +2

      hypothetically, if a creator provides a brand with 6 months of organic usage rights (so a license to use their content), and after the 6 months the brand does not renew that license (and pay the creator more for the right to use their content organically), then yes, the video/content would need to be removed/archived from the brand's grid/profile or they are in breach of contract and owe additional licensing fees.
