    Hello Atty. dito ako sa Ca. at lagi nanonoud sa channel mo which is very informative I have a question pray you can enlighten me. Deed of donation pinagawa and notarized sa municipal judge 30 years ago now we are working for transfer ng title and settle yong taxes problema sabi ng local BIR hindi daw siya registered dahil hindi daw puede mag notarize yon municipal judge worst is namatay yon lawyer pati mga witnesses gusto ko maka avail sa estate tax amnesty ano ba ang best na gawin namin thank you

    1. First scenario: What if I want to buy a property, pay the real property tax and delay the transfer of title since I want to sell it in the future like after 2 years or sell it through installment. What are my options to make sure that there will be no double sale? Should I put an annotation on the title?

    I based it from one of your discussions which explains that MACEDA LAW provides for grace periods, refunds, cancellation rights, and nullification of onerous clauses in contracts. Are there better workarounds or better options to avoid complications on the transaction? And how do I make sure that the buyer is willing and will not default?

    2. Second scenario: What if I bought it through home loan (30 years to pay) then I decided to sell it after 5 years. The buyer will return the amount I paid for 5 years plus a small interest through installment and at the same time pay my monthly mortgage (The buyer will do a combination of subject to and seller finance because he will pay the bank and the me (seller) monthly).

    BIR computation of estate tax;
    Owner died dec2005.
    Taxdec in effect as of time of death is 1994 which was revised in dec 2005 but took effect only on 1st qtr 2006.
    Is it correct to compute estate tax based on 2006 taxdec instead of 1994 taxdec?
    BIR reasoning..it is the nearest tax dec at time of death.

    Is it safe to say that this process is beneficial for people (buyers) who cannot qualify for bank loans but the only risk (for those who did a home loan and sold it again) is the credit level/credit score? :) Salamat po attt. sa pagtugon.

    Atty good day po, kami din po ay may kasong pagpirma ng aming ama ay patay na at ginawan ng subdivide ang aming lote. Patay na po ng higit sa 10 taon ang aming ama noong gawin nila ang pagpirma sa nasabing subdivided ng aming lote. Ito po ba ay legal o illegal? Mampapatitulo poba ang ganitong gawain?     Is it okay to add on the Memorandum of agreement that if the buyer defaults due to personal reasons, I will not return what he paid me just how banks don’t process a refund. Will the MACEDA law be still applicable in this kind of transaction even if the primary process is through home loan?

    Atty ako po ay binentahan ng house and lot na under pala sa pag ibig at d na nila nababayaran at foreclosed na pala.
    May criminal liability po ba dito atty.kaunti lang yung isinauli nilang mag asawa sa amin.after that wala na po.sabi po ng brgy small claim daw po pero sa pagkaalam ko mga gamit nila inalis na sa loob ng kanilang bahay at inilagay na sa kanilang kamag anak
