    Guys like you were helping me get through all the BS I have to deal with
    I would sign up to be a member of Civ div or Jason's site but I don't let anyone have access to my bank account...I have a houseboat over in Kuttawa ... Needs a lot of work...Once I get her squared away we can do some Vets PTSD fishing trips next summer..Semper Paratus

    I also had a denial for secondary upper right radiculopathy because I wasn’t diagnosed for “bilateral”. I did get left side.
    (My fault on that for assuming the “Implied” medical note documentation where it said “ARMS”, plural.
    And they said yes it is a secondary to my neck. I fixed that with a more solid evidence and actually getting the “BILATERAL” diagnostic code.
    They’re all about the fine details people, remember that, it’s a LEGAL PROCESS.
    I will still retain my original effective date also.

    What’s if your favorable findings say you have been diagnosed with the disability Do you only need a nexus at this point ?

      You need the Big 3 always. In-service event, current dx, nexus

    Very timely. Insomnia diagnosis by a C&P examiner but stated causation incorrectly as long work hours on sea and subsequent shore duty and not my tinnitus as I express was the cause. How to I have the VA correct this?

    Can I use a nexus letter to tie my tinnitus to migraines which have favorable findings?

    So when VA uses the statement in favorable findings like “Your condition DID have its ONSET IN SERVICE” yet still deny the claim.
    Gets very confusing.
    BTW- this was a denial on OSA
    They also don’t recognize OSA as a chronic Condition as per 38cfr 3.303.
    So yes, they can still deny.

      With the ONSET verbiage, it seems like if you have a current diagnosis, you would have all three, but sometimes the VA doesn't see it that way. typically, that is enough, but sometimes you have to give them more than the symptoms started in service, which, in my opinion, is not right.

      @@TheCivDiv tell me about it. Yes have DX when claim filed, but wasn’t DX’d in service.
      Multiple complaints (daytime sleepiness,fatigue,trouble sleeping) in Service and Symptoms.
      That statement still haunts me,
      🤷‍♂️
      I could wait until they change schedule, get rated at 0% using same evidence and their statement as new evidence, then fight the effective date. 😂😂😂😂
      $20 bucks they’ll start approving claims once they change schedule.

    I have favorable but got denied i need to submit more information may be my orders stated i was there Ft. Dix which is missing in my records, can i send the information at anything or first submit for higher leave reviews.

      Remember, for a higher-level review, they will only look at the information already submitted. HLR is usually used when you know you have the evidence in your records and the VA has made a mistake. What you want to do is submit a supplemental with the new and relevant evidence you wish to present to the VA to bolster your claim.
