Veterans Beware: Red Flag Phrases at C&P Exams

  • One of the most critical aspects of receiving veterans benefits from the VA is completing C&P exams. These exams are used to evaluate your disabilities and determine your eligibility for benefits. However, it's essential to be aware of red flag phrases that may arise during these exams, as they can significantly impact the outcome of your claim.
    What are Red Flag Phrases?
Red flag phrases are statements made by C&P examiners that could potentially discredit your disability claims. These phrases may suggest that you are exaggerating or fabricating your symptoms, which can negatively impact the VA's decision on your benefits.
    Examples of Red Flag Phrases
Some common red flag phrases that may arise during a C&P exam include:
"You seem fine to me" or "I don't see any evidence of disability": These statements suggest that the examiner does not believe you are experiencing the symptoms you claim and could lead to a denial of benefits.
"Your symptoms are not severe enough to warrant disability compensation": This statement implies that the examiner believes your symptoms do not meet the criteria for a disability, which could lead to a lower disability rating or even a denial of benefits.
"You didn't mention this symptom before" or "You didn't report this during previous exams": These statements suggest that the examiner is questioning the validity of your claims, which could lead to a denial or reduction in benefits.
It's important to note that these phrases do not always indicate dishonesty on your part. They could simply be misunderstandings or misinterpretations by the examiner.
Being aware of red flag phrases at C&P exams can greatly benefit your claim for disability benefits from the VA. By understanding these phrases and how to respond to them, you can increase your chances of receiving the benefits you deserve. Remember to stay calm, be honest, and advocate for yourself during these exams. Thank you for your service, and best of luck with your claim process. Now let's continue serving you as you have served us!

I waited 10 months for my C&P exam, had to drive 3 and a half hours away to go to it. I was in massive pain from my back and hips from it. I wasn’t trying to be rude with the lady in the beginning, just trying to be nice. She was a Muslim women and was one of the most nicest providers I’ve meet. She was concerned about my drive back and was very thorough. She started me with the small more provable issues like my lungs and eczema. After she saw with her own eyes that I had issues she blew past the rest and was very helpful. She said that she would get vets who would lie on the exam severely. But “it seems like you have real problems” and she basically half way through the exam tried her best to get me the best chance for disability claims possible. During the bend over for the back she said go until you feel pain. And as soon as I grimace she was like yup don’t go farther just till you feel pain. And that was it

I had a great Examiner. My wife was allowed to join us during the exam. The Examiner, asked me and my wife about all that was going on.
This was a HUGE PLUS for me. My wife was able to answer the questions more completely. I have quite a few small and larger memory gaps from surgeries. My wobbly legs and walking showed up and the examiner ADDED them.
My O2 tank and cane along side.
Now we are rated 100% P&T.
My exam for COPD was a "Hoot". The Examiner lived about ⅓ of a mile away from me. We both drove 75 miles for an interview and PFT.
    Then drove back.

My experience obviously does not apply to everyone, however, if you served in a Ranger Battalion or Special Forces and have combat experience ‘service connection’ for joint and spine issues is almost a given. If you are a special op’s guy and either retired, as I did, or just left the military and years later began having issues, it was actually reasonably easy to get in the system and gain disability payments. As far ‘service connection’ just my service file of units served in took care of that. Also, airborne status was mentioned often when talking to c&p people. I was a bit amused by the airborne thing, how hard is it really to fall out of an air plane. My point is if you are Spec Ops and are having trouble later in life don’t be afraid to file claims.

It didn't take long until she told me how she was going to do her part and try and make sure it was linked with my other mental health issues. I got excited and submitted it, because the VA originally didn’t catch it. I have a right total hip replacement. I went to a C&P exam months later and the moment I came in, I was interogated and you could see the obvious signs that the examiner allowed her biases to impact her job. I knew she would write a bad nexus letter. Her demeanor changed when she asked me what I do for a living and I said I was a cop. I was devastated. I did a higher level review for now and I guess I’ll get an attorney after. I am going to a C&P exam tomorrow for 31 contentions. My claim was filed 13 months ago.
There is no human way possible to fill out 31 DBQ's and give a thorough exam in one day. It is unfair to both myself and the examiner. Additionally it is 115 miles from my home (I live near 3 big cities that are within 5-25 miles).
The salt on the wound is, I've submitted thousands of pages of records from a 20-year career. Dozens of diagnoses, hundreds of notes, enough evidence to where this exam should not have to be conducted.
If I've submitted that much evidence, how can this exam be that important? I'll give one example; migraines. I have been seen by more than 10 doctors and for neurologist in the last 15 years and have tried almost every medication out there for migraines that exist. How can this exam mean anything when I have 4 in of medical evidence submitted?

I claimed GERD & ISB claimed secondary to my PTSD. Denial based on cited literature being “Pathophysiology.” Cause or certainty is not claimed by vet, only an on going aggravating connection or relationship to PTSD.
“Pathophysiology” -or- “meta analysis.” Do you know of any precedents to fighting this rational “Pathophysiology” based denials?
Defination: Pathophysiology: the physiology of abnormal states
specifically the functional changes that accompany a particular syndrome or disease.
Correct me if I’m wrong but this sounds like the evaluator is playing semantics in trying to make it sound like I’m claiming that one causes the other which I am not.
A doctor I know offered this… Pathophysioloogy is the study of abnormal changes in body functions that trigger disease processes. Metanalysis is the combination of multiple research findings into a larger summary finding. This is different than a single focused research finding but often more powerful and insightful. A denial of your claim on this basis alone is bogus. Get a highly regarded expert to validate your claim.

Great advice from CC as always. Major rules at exams and VA facilities. 1. Don't get too friendly. When they ask how you are dong just smile and say something like "I am here." 2. When discussing major symptoms and problems with physicians record audio and let them know that you would like to record audio. Some times this can be a stickler as the VA does not want some recordings. But they do record you. Don't stress if they say no. But if you have my Healthyvet, type the information discussed to your primary care physician on what was discussed and if you were allowed to audio record or not. if you are allowed to record you will not have to use Myhealthy vet. The next major defense mechanism is to also use a an outside physician. Many of us go to the VA to avoid the outside insurance and medical bills. If you can afford it, an outside doctor with the same knowledge about you as the primary care doctor at the VA is worth the investment. If one cannot afford another doctor, then the telehealth services like CC recommends to vets is the next best thing.
What I learned the hard way, as many others have, the Va doctors are not paid to help you with your VA claims or any benefits you deserve and earned. They are only paid to address your immediate needs. What happened in service or how the ailment is connected is not part of their salary. Some doctors will give some great advice but beyond that don't expect much more. You will need some type of help outside the system help at some point if you have many low rated ailments. And that is the get over point for the US government because most of us veterans come from families that make less than $100k year. We don't need life long ailments that we need to come out of our own pockets to pay. But that is what will happen to many if not most that are injured. Combat Craig continues to give on point advice.

You can get the form online (I think file online as well maybe?) for your C-File. You should do this immediately after your C&P exams are completed (supposedly takes 3-6 months) for reasons I won’t go into mine was 3 1/2 years to receive (after IG and congressional intervention when my lawyer was unable to make any headway in obtaining it).
Anyway, when you get your C-file, it will contain everything the VA has about you, including C&P results, nexus letters, non-VA doctor’s submissions, everything.
Go through it and check for any obvious errors. I’m not positive, but I think Combat Craig did an episode about this.

The Compensation and Pension evaluator should use them in their exam as well. If denied, the Questionnaires can then be submitted as rebuttal but why not just submit them with the initial claim?
