    Its hit or miss with C&P exams. I got extremely lucky with my Nurse Practitioner. I had 14 in one day with her and I left that session feeling that she cared. Go in and be honest and just talk to them about your issues. I came out with a 100 P&T from her. Six months start to finish.

    During my C&P exam for a heart problem, the examiner ask me directly what I thought was the cause of my heart condition. I knew it was a loaded question and answered: exposure to Agent Orange. I also stressed who it has affected my stamina and my ability to walk long distances with out getting winded and having to sit down and rest. I feel that this won the day for my claim.

    The best advice I would give is to keep a journal of your day-to-day activities of how your claimed conditions effect how you go about your day. Example: morning headache. sore knees pain in back at the end of the day. ect.... I broke out the journal and impressed the nurse. All claims were granted.

      So was your daily journal inclusive of each of your claimed injuries, or did you keep separate journals for each individual injury (e.g., back pain journal, migraine journal, etc.)? The journal thing seems like great supporting evidence to go along with a medical diagnosis.

    My C&P examiner was a Gynecologist. Last time I checked, never had one of those. He was doing disability screening with no handicap access, 2 doors down from a massage parlor. Good luck with these "exams".

    C&P are the gatekeepers which means: The Veterans that DO have valid disabilities get the shaft. I had a severe injury while serving in the military, I had an ACUTE lateral dislocation of my right leg, meaning an incident I suffered completely separated my femur from my tibia and pushed my patella to one side of my leg. It took years, I went from 10% with the VA citing that there was nothing wrong with my knee, to: "Oh wow you've got a problem. It took years (Even with Medical proof from having my military records had surgery in a Military Hospital, had rehab etc. It actually took a lawyer's office (Chrishom, Chrisholm and Kilpatric ) appointed by DAV to go after the VA because they were trying to pull a fast one. My C& P examiner was a crackpot. To this good day I still have problems with my right leg, but it took 6 years before I saw any compensation to help me. Now I have to have a total knee replacement. Veterans shouldn't be subjected to this kind of crap and with my evidence.

      How long, if any, time passed after discharge did you file claim, and did you seek "continuity of treatment" and keep reporting the issue to the VA in the interim time? That seems to be something the VA uses: "It's been 5, 10, 25 yrs and you never made VA med complaints or sought treatment."

I had to stop him to tell him my issues and how they were getting worse and was effecting my daIly life. He looked up my records and saw my CIB I got in OIF and said ""Oh, you're getting increased for sure, the proof is there" I want to believe these guys, but something in me feels like these guys just yank our chain to get us up and out of their office. @@InvestingwithNickCowles Man that sucks. At least you started to educate yourself. I also underreported when I was referred to PTSD treatment and somehow still got a diagnosis. Thank G I saw these videos about NOT doing that, so by the time I got called for C&P, I had started opening up to VA in sessions about SI, real reasons for job losses (anger, choked boss out, flashbacks, scanning everyone and everything...etc etc., so i had some of it on record besides the usual light reporting stuff that I was doing earlier And I had heard about DBQ's and got a look at one early. Also got ahold of what i can only describe as the "examiners dbq" (with notation), so i kind of knew what they were looking for after they ask the Qs. I was being honest anyway, so it didn't make a big diff. in the WHAT, so much as HOW I responded. But since there are no guarantees, I'm not even going to get smug on that. Anything could happen.

A slight disadvantage is that all my medical records are with the VA. I have no outside physician reports. A representative of the VA made an interesting statement in an interview. If it's involving a new claim such as heart, cancer, skin conditions etc. then make sure you cover all this info that you have experienced and seen another doctor for so they get your records released to them. If you plan to upgrade then, this is critical too. I have a condition called cervical spinal stenosis and extreme arthritis in the torso and cervical that has increased that was from a previous military injury but it leaves me unable to stand for more than 15 min. and sit in any comfortable situation. Constantly moving to find relief but sometimes impossible.since the only pain relief I have is Alevee which doesn't do the job. I was in the office on July 18th and the doctor was very clear with his questions and listened even while I was in pain and even my arms, back and neck were hurting. I think there were at least 4 doctors that a release of info sent the same day. Oh, they will be getting a blood and UA so don't go to the bathroom before this is taken. My doctor showed me where the restroom was after our talk but failed to tell me a UA was going to be taken so when I got to the point for blood and UA the blood could only be taken. She told me the UA could be taken on the next visit since that was the circumstance. I found my whole experience while at the VA were good and the staff were very nice and concerned to help get your info in whichever dept you were in.

      I do know how patience can run thin at times and we all want answers NOW but even with the civilian doctors we don't always readily get all the answers NOW. With anxiety, it's hard to understand all this as well. It took me 20 years to find the initial cause of my heart issue by then they were implanting a pacemaker/defibrillator due to the heart wall couldn't beat for me. I was upset that only this one heart doctor gave me the test I needed to understand why I was experiencing such chaos and pain. He checked every nerve to the heart and BAM found it. Now, I am bionic due to the long stretch of trying to find answers and the heart wall will not work. I could be very bitter that this happened to me but I am not. I see things no matter if good or bad to be blessings but again, that's me. As for your husband, I will be praying for you both and pray he has resolution to his questions. As for the PTSD, those symptoms seem to never go away and then triggers can also set them off again. Most of us have PTSD in one form or another but how we manage the mental aspect is up to us as soldiers and of course, our doctors medical and mental health. Again, my prayers are for you and your husband since I know what's it's like to be a military wife because you will be one for Life as he is a Soldier for LIFE; I was a Soldier and Military Wife.

The lead said, in a rather derogatory manner, "Yes, we have ALL of your [too much for me to read within the limits of the VA payment] file."
      At no time was I provided with an opportunity to talk about two important issues to me: NIGHTMARES and SLEEP DISTURBANCES. Option A: wait and get the VA (Viperous Aggravators) Denial, then launch my 2nd expert witness "Independent Medical Opinion" rebutting the denial. Option B: send an objection to an incomplete examination, then wait for VES to set me up for another C&P Exam. Option C: Wait and see if somehow VA awards Service Connection for PTSD, then have 2nd expert witness only address level of impairment.
      Afterwards I jotted down what I recalled from the interrogation. I would not say it was intense or particularly unpleasant, just missed the point of my PTSD Claim! I went in recognizing "they are the new enemy," replacing the VC and the NVA in my mind. So, not so bad and probably a total waste of time. I recommend searching RUclips for "C&P Exam" and watching the many good suggestions you see there.

    When I retired from the AF (2001) I went to the VA for, what I think was, a C&P Exam.
    I had a list of things I believed were wrong with me -I had had a brain tumor -and had had surgery; I had had an accident at the airport -and suffered a broken tibia and fibula -and had been medevacd (from Africa to Europe), etc.
    I was totally naive and ignorant about how the VA worked, and the examiner did his ‘thing’ and told me that there were too many things on my list and that I could only claim a limited number of disabilities. He asked for my ‘rough’ list (to keep) of what was wrong with me - and eventually gave ma a rating.
    In retrospect, I believe he was very dismissive of my case and even ‘low-balled’ me!
    Do you think I have a case and can you represent me?

      Hopefully, you got this settled & got your rating back or increased. If that happens again, you can always request a hearing thru the VA, where they assign you an evaluator & you can plead your case to them person to person. If you show there has been any improvement whatsoever, the VA can & likely will reduce your rating though. Goes for everyone. They are only looking for ways to reduce the amounts paid out to Veterans.

    I am a 72 year old Vietnam and Cold War vet that is filing my first ever claim. I have never been to a VA doctor or facility. All of my post service health care has been through an extremely prestigious Clinic that everyone would recognize the name. My wife was an RN there and now retired. I assumed that I would be submitting my records when I submitted the claim. I went to the state VFW service officer today and he all but told me don't bother and he proceeded to file a claim for 3 out of my 7 conditions. He did not even complete the form where it asked for treating facilities. I am concerned I will get everything denied and have to fight to get my records included and my case reviewed. He told me to not bring records to my C&P exam as the examiners do not look favorably on that. I mentioned that I am filing for PTSD but was meeting later with a psychiatrist who will be writing a Nexus Letter for me and possibly completing a DBQ for PTSD. He dismissed that idea as not needed.
    Also, in my 45 minute appointment I found out more about him than he did about me.
    Should I be concerned?

    I reported my shoulder problems from rotary issues I sustained in service & was rated at 0%, 9yrs later it had gotten much worse. In a follow-up C&P for increase, I limited my motion to where I have extreme pain occur, based on advice given to me, & the examiner claimed I was not fully cooperative, but the VA still in raised my rating to 20% for each of my shoulders. Just odd how examiners are able to say you’re half-assing when you’re really not. Sadly, the VA doesn’t care about your pain levels, just if you have range of motion or not. I was a firefighter in service & was told my knee problems are not service related & was told it was because I was overweight.

    • @Maab32
      @Maab32 Год назад

      What kind of documents did you provide with your increase, if I may ask. I'm at 10% for each shoulder currently. I would think if it's service connected, maybe just a personal statement?

    • @Gaming_Biker
      @Gaming_Biker Год назад

      @@Maab32 So, for my shoulders, I specified what was going on & had to state that they have gotten worse. Doesn't matter if they are the same as before or worse, if you don't say they're worse, then the VA won't entertain a re-evaluation. Keep in mind that VA Benefits are paper pushers that are black & white on regulation & they're the part of the VA you're evals are going to, NOT the medical side. You & someone close to you can fill out supporting statements to push your case & explain how this impacts your day to day life, be thorough & detailed. Don't try to down play or "man up" your statements. Really say what is going on & it may feel like you're fluffing it a bit, but that's a side effect of our conditioning & there is no shame in saying how it is; they cannot say anything about your pain levels because that is subjective to you & only you. If you claim pain, then I would suggest getting w/ a free representative that can help you navigate the VA system. DO NOT PAY for services, you've paid enough w/ time in service.
      The form for a supporting statement from yourself is VA Form 21-4138 (shortened to VA Form 4138). The form for a supporting statement for a witness, i.e. your spouse, family member, friend, etc, is VA Form 21-10210 (VA Form 10210).
      Get w/ you local VFW or ODVA rep or whomever is free. I got w/ my local ODVA rep at our local Veteran Center & signed over power of attorney, so they could file for me where needed. As long as it's service connected/rated already & you have those forms turned in for a new claim, NOT an appeal, then you'll just need to go get evaluated by LHI/Optum (3rd party that VA uses in my area at least). Keep in mind that you may need to file for multiple shoulder issues in order to have one of them stick, which is where having a free rep assist you may be beneficial.
      Now here's where some will say you're working the system & be elitist or whatever, but all of that is ppl trying to make themselves feel better for screwing themselves over & wimping out of fighting for what they earned. Your range of movement needs to stop where the pain starts. The VA doesn't care about your pain, they only care about your ability to move. If your ability to move causes pain, you stop when it starts to hurt to indicate that you can't go further w/o aggravating the injury. It will feel like you're lying, but they want to exploit that feeling, so they can say you're exaggerating & not pay you what you really rate. This is the govt taking advantage of your conditioning again.
      If you can't find the forms, let me know & I can get them to you somehow. I also have example letters for PTSD that have personal info redacted. The letters are to show you how to word your explanations to elaborate on what caused the issue & how it impacts you daily. If you have PTSD, then you can use that as a reference for that as well. I went from 50% PTSD to 70% PTSD by using these forms w/ my wife's statement in support, which is a huge jump.

Based on many comments on RUclips, warnings by Combat Craig, CC&K and others, I would say our experiences are the norm, not the exception! They are paid by repeat business from the evil masquerading as the "Compensation & Pensions" silo of the VA (Viperous Aggrevators)! As long as these so-called C&P Examinations are permitted by our collective dildos called Congress it will continue. Make sure you meet the Appeal deadline, retain a good law firm and good Independent Medical Opinion to support your diagnosis, nexus & impairment. Keep on fighting.
