      I've been arguing my rating or lack thereof for 50 years and they keep sidetracking the issues recently I accused them of failure to assist in my 1970 claim because they did not obtain all my service records that cumulatively prove that I was totally psychologically disabled while still in service and is basically why I was discharged although it was an administrative discharge because Vietnam war was ending and they were bum rushing hundreds of thousands of troops out and not giving them proper medical examinations for their distress! To make a long story short er the VA recently determined that they did indeed fail to assist me in my 1970 claim and scheduled to C&P examination specifically to determine what my PTSD rating should have been upon discharge. Shortly thereafter they basically ignored the failure to assist in my 1970 claim and whatever the psychologist said about it. Only determining that there was a cue in relationship to about an 8-day delay in the recent determination of PTSD. I had explained that since they did not get the records I requested in 1970 until 2020 that it should be retroactive. They denied that part, having ignored the determination of the failure to assist in the 1970 claim. I requested a copy of the c&p exam and the VA kept ignoring my request finally telling me that I needed to fill out a freedom of information act in order to obtain it! I had also requested the previous two CNP examinations when they were done a year ago and about 10 months ago relative to the examinations. I never got those either, so I also requested those in the freedom of information act form. I called a couple of days ago and they stated that February 19th I believe it went in for a determination and process to purportedly furnish it to me. In this request I told them that I did not have the equipment to play a CD and figure it out what was necessary that I needed it in written form, which I had requested of the VA in an official request two years ago, and none of that request was ever performed. The VA is acting as if they are hiding all this information to try to pass off their decision as being legitimate! I need to know what to do about this as well. I have just recently submitted this information to you and try to explain the above. Hopefully you can help me with this situation and get this VA to follow the regulations concerning this and the Court's statutes relative to retroactive claims! Thanks. Sincerely, John R Panek Jr

    Thank you very much for posting and your time and knowledge. I'm 67 and just got my tinnitus 10%. But I never knew about other claims that I could apply for. It is interesting, the VA never tells you anything. So after 45 years, I am now going to file a few claims. It's really sad. Thank you again for your time.

      The same as me and many others in our situation and era. Except I got my tinnitus awarded but a lot of other denials. I am now going back with some help on the best way to file. I started this all over again because my older sister spent 8 months active and got out and filed a claim after 55 years and got 100%. Claim was for sexual Trauma.

    I wash that I new about all this. It took me about 5 years to see a VA Judge. I tried to do all this on my own, with other vets telling me about this and that. Some things work and some didn’t. It was a BIG and frustrating experience. NEVER GIVE UP. I never new about getting all the paperwork and reading through it. It did get my 100%. The VA Judge said I was due the increase and unemployable with NO more C&Ps. I was a 10 year fight.

      Remember everyone's claim is different and it took me almost 8 years to see the judge with another 6 months (2007-2015) of remand and C&P exam. I used that time to get educated and not frustrated on the VA claim process. Everything worked out fine and now I am able to educate other veterans and spouses. God is good!!!

    My C&P examiner stated that she was going to write me up for PTSD and MDD.
    I am glad my struggle with my symptoms were recognized.
    I hope the VA recognizes this as well.

      @@imveryhungry112in my case it was speeded because of my age. 90’s. Took a year to a partial. Had to file several times. Still fighting.

    I’ve attended a few exams where the doctors didn’t review my records before the exam. I also had to struggle to explain all of the issues I’m having. My injury was on duty and documented so it seems straight forward. Although I’ve been strung along for almost three years by a bad VSO and I still don’t have any rating.

    Thank You for providing free information to us Veterans-I really appreciate this. I watch many of your videos so I can understand my up coming claims before i submit them.. Please Try to record your Audios at a higher lever and we can turn it down on our end.. so many of the CCK videos have very low audio and I am maxed out on my end. Kevin You are very much appreciated but I would like to recommend you do a short test video and play it back for yourself. no disrespect intended, I am a sound engineer for the government your Mic etiquette is bad.. You need to be closer and be aware when turning your head etc the projection of your audio is reduced. This is a very very very common mistake. I work with politicians who honestly do not listen or care!? Lol sorry but it's true.. You are a smart guy and If someone explains this to you, I would bet you will listen and correct it.. Thank You Kevin and Lady's

      I wouldn’t say that…unless you have a lot to prove. If your military medical records back up what you’re claiming now, it’s a breeze.

      Not really. If you have severe symptoms that are legitimate. It could be a fast examination.

    I requested my 2 C&P exams for PTSD. I received both of them within 5 business days from my VSO. My C&P exam in 2020 was negative and my claim was denied. I was requesting an increase from 30% to 50%, 70% or100%. That examiner took many notes but those were not reflective in his medical opinion. The C&P examiner stated that my PTSD did not occur while in the military, then where did it happened. My second C&P exam went well. The examiner review my entire file prior to my arrival. I am waiting on a decision.

    I just found copies of my military records from Walter reed Medical center. Had a TBI that I could not claim that is being claimed now. I also am claiming TMJ and Sleep Apnea for the past 10 year just received a remand for it but with these records from Walter Reed it clearly states what I have and that it occurred in service.

    My examiner just straight up told me I was one of the worst she had ever seen. It probably aided my case that I had to drive an hour through traffic to get there and managed to spill coffee all over myself because my hands were shaking so much. So I showed up sweaty, irritated, covered in coffee, disheveled, and I couldn't find the right floor in the building so if they were observing me at all through security cameras, they would have seen me cowering away from people, paralyzed with indecision.

    Recently had 2 C and P exams. No results yet,. QTC and VES take forever to turn in. I did however have one C and P NP say she reviewed my C file and she is putting as least likely as not and I will be receiving a percentage for it. So, I guess that one went well.

    A friend had one yesterday that they think went well except for being observed by the "patient" who arrived 30 seconds after him, parked bumper to bumper across from him in a near empty lot, listened in while he checked in, and then waited in their car and watched him leave 🤔

    I have attended enough CP exams to know time will tell and examiners will be deceptive. Veterans receive little help through this process and our only recourse is to appeal and wait.

    1800 line told me to fill out some form and mail it to my regional office to get a copy of the C & P exam/report.

    My regional V.A. OFFICE will not give out a copy of a C&P exam verbally, they require a FOIA form. In that form is a question as to if payment is due for its creation will you, the submitter, be willing to pay? Is this right, I am simply asking for a copy, not a file?

      Actually, the bit about sending VA a FOIA Request to obtain a copy of the C& P exam is incorrect. You should send VA a Privacy Act Request to obtain a copy of that C&P exam.

    I have had a couple examiners indicate they gave me a favorable exam. Those two turned out good. I had another examiner tell me they gave me a favorable exam and she totally lied. I have had a few examiners that did not hide their hostility toward me for claiming my benefits. I hate C&P exams. I always had the elements in Caluza v. Brown but some examiners flat out lie and the VARO is just fine with their unfavorable opinions even when those jacked-up opinions contradict favorable medical evidence. I usually win but have to endure big delays due to the lack of ethics in the VBA system.

      I had 3 C&P exams last month through LHI, I received a letter from my second exam from LHI comfirming my injury. I havent received a letter regarding my 1st exam. But my 3rd exam was for PTSD/Major Depression. The exam lasted 2 1/2 hours, when I was finish the Doctor told me she would note in her report that I should be taking "Prazosin" and that she is recommending for "Individual Unemployability". Now, Im wondering if she lied to me, but she did write it down on paper and gave it to me.

    My damn examiner got my DBQ paperwork mixed up with another person! There were people/ words/ doctors ive never came into contact in my life with! My veteran service officer had me write a letter to the senator! And we are in the process with the VA. Anyone else went thru this?

    I just had my exam for an increase. Based on what the examiner said he didn't review my records at all and flat out said he would do that AFTER the appointment. Which I find quite weird, how can you know what to ask? The reason for the claim is that my symptoms are worse, so how can you know what to ask if you don't even know what my symptoms are. The appointment lasted 10 minutes and he didn't really ask many questions relating to the criteria for 100% of my disability. I have a part-time job that I fear I can no longer do due to my symptoms, so that is why I filed, but I can tell my having a job at all was viewed against me. I'll have to wait to find out I guess, but I was not happy with this examiner in the slightest.

    I just had my c&p for an increase in my mental health, currently at 50% the interview we said so let’s no go back let’s start more recently. She said I do need to see a psychiatrist as soon as possible. Does that sound like an increase?

    Hey ,, I have a question. So i went for my C&P exam yesterday and it was with a private party Doctor /Audiologist for my Tinnitus claim. It went astonishing well and he told me he was ruling in my favor and giving me the "service Connection". I was given a hearing test and he said it exactly matched the private party hearing test I was given months ago, and he said that's impossible to fake. But he also said that I have hearing loss and further said I should've filed for that along with my Tinnitus claim. He also said that if I decide to add the hearing loss claim within 3 months it would be approved and service-connected due to yesterday's C&P report he prepared and the fact that I was a NAVY Builder (BU) which is on the DOD Tinnitus presumption list. But he said it MAY not get me above the 10% threshold. So is it worth it to add the hearing loss claim and having it approved even if it doesnt raise my percentage? He also said I should go to the VA and get hearing aids. Thank you for your time .

      The 0% for the Hearing loss is still very good because you got the service connection . The zero is kind of irrelevant. Because most don’t get the service connection and now that you have it you can use both service connected injuries for secondary claims.

    I have had C+P exams and although my conditions were noted and seen by the Physicians, they were seen as Not Service related because they weren’t in My Records. The problem with that is I wasn’t issued a ETS Dental or Medical exam before or after service. How can they deny it when they don’t know what I had at ETS? Nobody can answer this question.

    So my question is this. I filed sleep apnea secondary to ptsd and i sent in a lay statement, nexus and medical studies. The cnp examine says less likely, because ptsd is mental and sleep apnea is physical. She also says ptsd can aggravate my sleep apnea. MY question don't they take account my evidence or will i be denied?

    When the contracted examiner admits there is no way he can look over all the material for 2 different items in 75 minutes, let alone make any connections. That is when you know the exam is a joke and they are about quantity for money

    How much weight does an outside specialist have toward helping to get increase of disability. VA said everything was normal no problems, but large University specialists found different results. How can you prove VA was wrong?

    Can you guys talk about a C&P that’s done over video? It’s a review for increase PTSD. This is the second time I get a video C&P. First time it was very short and got 70%. I just filed for increase and it’s another video C&P.

      Hey brorher... I'm getting ready to go to the VA in regards to what I believe to be ptsd. It's been 11 years since I left the military and I haven't been to the VA since. Any recommendations on how I should go abouts this? Should I go see a doctor at the VA first? Or should I file a claim first?

      I am interested in this too. How did your increase claim go? I just had my C&P with QTC today for increase and I have to say, I am not happy with how this examiner handled it, but I'll have to wait and see how it shakes out. The guy didn't ask any of the questions relevant to 100% PTSD criteria, he just said he would review my medical records, which he should have already done, but these are worse symptoms, meaning what may have not been very present before is now, so how are my records going to help? I was in shock at how short the appointment was that I couldn't form the thoughts to get these things out at the end.

      @@MacguffinsTV You rated a 70% the first time?
      Regardless, What were you missing the first time that you have now?
      In other words, what changed? It would have to be something more serious and severe...?
      For example, the difference between 70 and 100 would mostly be Homicidal intention accompanied by delusions. There was a guy, an Army veteran back in L.A. who used to walk around McDonalds in speedos, a tank top and a Harley Davidson leather Stetson (awesome hat by the way). His eyes were wild and he would talk to himself. One day he sat across from me and didn't have his hat so I asked him "where's that cool hat"?. He answered: "Oh.. uh.. it's back at my camp".
      Then he started babbling incoherently about being on duty and such. The next time I saw him, he was walking around McD's with a Spear and mumbling angrily. He stepped outside and McD's mgr locked him out. He stood out there banging on the door and trying to see through the tint, pacing back and forth with a 6ft tall spear.
      So, I think that THAT is the condition for 100%, vs 70%. Homicidal behavior, incoherent speech, persistent threat to self and Others, lack of even minimal personal hygiene, unable to communicate and unable to handle personal day to day affairs like food selection, bill paying....etc.

      To get a copy of the final report from your exam, you can:
      - Contact your local VA regional office; www.va.gov/find-locations/?facilityType=benefits
      - Call VA at 800-827-1000 and request an appointment to view your file; or
      - Have your representative request a copy on your behalf
      Regardless of how you choose to request a copy of your C&P exam, it is important to remember that VA will not provide a copy unless you do so.

    Hello
    I just completed by first C and P exam yesterday and the first question I ask was did she (the examiner) get a chance to review my VA file and she said no, she didn't have access and it wasn't needed. Any information she would need, she would get from me during the examination. I had also brought with me the QTC (contractor the VA got to perform the examination) protocol evaluation form (DBQ type form) that was sent to me by QTC headquarters prior to the exam date to be completed by me and I had proceeded to give that to the examiner and she refused to take it even though, it was her copy to keep.
    She still stated that any info. she needs she will get from me and I could simply use the form as my reference for any questions asked of me. She said that she didn't need the paper and she would simply input the answers to her questions into the system, as she got them from me. She appeared to be doing that at the time but I wasn't sure how detailed those answers would be in her system.
    It just seem kinda odd the way she didn't want any more paperwork and did the exam without reading my VA records ahead of time. In any case, I was kinda pissed that I worked on that QTC form for hours and she didn't read it so I converted it to a pdf format, logged into my VA account and uploaded the completed QTC form that was for the examiner into the system as medical evidence.
    I wasn't sure what she had written but I wanted to cover all my bases. Since my claim is based on PFAS contamination of the water. Therefore, presenting me with certain health conditions from that, I know that she couldn't possibly know that since she didn't see my file, according to her. So how could she possibly even state that its service connected to PFAS if she haven't read my VA file.
    I guess now I just wait for the decision to be made by the rater. But while I am waiting, I will follow your advice (call that 800 number) and see what the examiner wrote just in case the decision is negative.

    I have had 2 recently. Both examiners have said that my conditions were more likely than not related to my military service. It has been sent to the raters. I guess that's a good indicator it went well. I'm not sure how long it will take for me to get a rating or if I will be properly rated.

    When you disagree with the decision by the examiner do they send you to another Cand P examination? If they do will they send you back to the same examiner?

      @@CCK_Law I called the VA and they told me to mail the Freedom of Information Act form # 20-10206 for a copy of the report. However I have watched several Lawyer videos and read other resources and they say to submit a letter requesting copy of report. So I am trying to get the correct Info. 🤔

    You dont know as the c and p examiner will just change your diagnosis from 46 years ago and say you had the problem when you joined.

    Yesterday I went to my C&P examine for presumptive Agent Orange hypertension. My blood pressure was taken right away, and it was 214/110. The examiner, and her intern, became very concerned, canceling the exam and wanted to call 911. I ended up in a hospital with IV medication to lower the BP; took hours. Another C&P exam will be scheduled per the examiner. Strong case?

    The VA conducted my C&P exam and the examiner indicated on my mental health claim that i am "Total Occupational Social Impairment." They also stated atleast as likely as not and also said More then likely then not for both of my mental health diagnoses. Does this mean i am likely to recieve 100%?

      I'm no expert, just a fellow vet applying for benefits but I would think that's probably likely. Did you submit a DBQ with your claim?

      Hi I had a C&P Exam about three weeks ago how long does it takes for them to send and letter money? The exam said I had PTSD in service just waiting to hear from them.
