    I got 90% right out the gate. Working on 100%. If my Mental Health C&P examiner hadn't have screwed me Id be there already. Filed for and increase with better evidence including a news article from a search and Rescue case I was on with a picture of me on the front page and the award I recieved. Thank you Clay for all the help.

      @@Slb5988 I truly think mine got looked over. I had 18 claims in. I got discharged Jun 24 2022, entered my claims in November 2022. They finished most of my claims and gave me 70 percent with 5 left over in October 2023. By January 2024 I had 90 percent (89%) as long as I get a 50 for mental health I will be at 100(95%). I entered my increases and a couple secondary claims in June and had the C&P exams pretty quickly. I am currently in step 5 the decision phase. I dont know if everyone's took this long but I know if you were recently discharged you go to the front of the line. The backpay was quite a bit. And the least amount of claims you have seems to go faster.

I have just been diagnosed with sleep apnea secondary to my lung issues that I have 10% on and I have a CPAP, so hoping to add it a claim once I get my device in hand ill start that process

      Are you SC for MH? If so, that article doesn’t mean anything. What matters for an increase are your CURRENT symptoms. CURRENT as in…your symptoms right now.

      @@TheCivDiv I have a current diagnosis with a Nexus. I guess they just wanted to prove the events happened. I was able to submit the award and showed it to my new C&P examiner. Also had a very good C&P examiner this go round. The last one I had has a history of only giving 10 percent. Thanks to you I made it bullet proof this time. Thank you so much.

    I have mental health at 70, migraines at 50, tinnitus at 10, sleep apnea (with CPAP) was denied service connection but I appealed to VBA with thorough sleep-and-psych doctor-specialist IMO. At 87% combined. If sleep apnea is granted, it'll be under the old rating schedule and would put me at 94%.

      70% mental health,
      30% Tinea Corporis,
      30% left knee,
      10% left knee,
      20% left ankle,
      10% right knee,
      The Tinea I’ve had since 1995, filed for it in 1997 and 2007 both times denied, 2023 I finally found a sick call document stating I got it in 1995 while in service, so I got screwed out of that 30% (give or take for 26 years, VA said I should’ve appealed it at the time but I didn’t have the proof until last year). 😡
      82nd Airborne tore my legs up
      and I’m90%,
      less than he’s at (according to VA math)

    Prostrating is used as a medical term that means: A condition in which a person is so tired or weak that he or she is unable to do anything.
    In laymen's terms it is called, laying down. Do not tell your C&P Examiner or anyone else that you "prostrate"

    I've been rated 10 for tinnitus/ 0 headaches - do I take a chance of filing for a rating myself or hire someone to help me ? I really don't want to flub this - my migraines/anxiety are through the roof. Help with any advise would be great!

    Prostrate is pronounced "PRAW-straight". Usually on the stomach, as it comes from the Latin to lay flat before, usually in reverence or submission to God.

      Did you do OSA as a direct service connection? Doing OSA secondary to Mental Health is how we connected mine. Mental Health caused weight gain, weight gain caused OSA.

    I do not understand how do people get nexus letters written and signed? I know I can pay to have one written but how do you find doctors who will sign them, and will they sign pre-written ones? I know the va doc wont do it and my primary civilian doctor also wont do it. Who does it? Thanks.

    Yo I’m at 80% rn. 70% for PTSD, TBI, Major Depressive and 30% for migraines and 10% for tinnitus. I’m getting paid at 100% TDIU and considered permanent and total. Should I push for all out 100% or just let sleeping dogs lie since reopening my case could get me reduced?

      How long does TDIU last? Can you receive TDIU and then when you for example turn 62 collect both SSI and TDIU ?

      @@noddyroddy4841 as far as I know tdiu is permanent? My letter says total and permanent at least. I won't be receiving much SSI as I started receiving TDIU at like 25 so haven't paid much tax outside of the army haha

    I am finally working on my claim but I am having trouble understanding the DBQ and 38 cfr for Narcolepsy. The VA uses epilepsy as a guide, everything is based on seizures. I don't have seizures, i have sleep attacks.
    Will a rater see that i have multiple sleep attacks per week and count those as seizures or am i going to get screwed?

    I received 90% on my first try. Can’t seem to get to 100 I no was service connected with a 0% for migraine this is my second time getting denied 🤦🏽‍♀️ not sure what to do at this point.

      Your total % needs to be 95%. The question isn’t how do I get to 100. The question is…what else can I be SC for by submitting evidence-based claims? Torture that out, and go for it. Use the 5-step process.

    I took the sleep apnea test and it came back negative... But what I also found during that test, was my sleep was terrible. Out of the 10 hours of "sleep" I was actually only getting 3 hours of sleep. (this is according to their chart) This still seems like an issue to me... I am always tired.
    Is there anything that can be done for issues like this?

    When I did my C&P for my headaches I told them my tension headaches are completely prostrating prolonged attacks and they affect me more than once a month and economic adaptability is difficult for me in school and family life . Does that sound relevant for a 50% rating?

    Any ideas what is best to service connection Migraines as a secondary. I am 70% Mental Health, 50% Sleep Apnea, 10% Tinnitus, 10% left leg. I have diagnoses from my doctor for Migraines and I have a letter from a neurologist for a tiny waiver due to severe migraines. I will also have a Nexus letter connected to whichever disability. What is best to use to attach migraines as secondary?

      Whichever disability is causing your migraines. I know it's not the answer you're looking for, but for instance, in my situation, my migraines are generally caused by anxiety/depression and the panic attacks I get because of that and from road rage or whenever I have a stressful argument with my wife.
      Whatever causes your migraines and if it's service connected can be used to connect secondary. If your tinnitus causes your migraines then claim that, but make sure you submit a well thought out personal statement that describes how your service connected disability is causing your migraines and I believe they will schedule you for new C&P exam for whichever Service Connected disability you claim as causing your migraines. So keep that in mind.

    I had a HLR C&P exam last Thursday. The RN (I believe that’s what she said she was) acted very friendly and stated “how can I (she) show to VA your right hip and ankle are secondary to your left side injuries” and she noted the 3 letters (1 from VA doctor, 2 from P.A.’s) stating it was connected to my left side injuries (overcompensating).
    I have sever anxiety and I’m stressing out.
    Would it be out of line for me to call the Examiner to find out how the exam went?

      @@markcowan3366 I did, I got 10% for each, ankle knee & hip. Which is great.. however that puts me at 94% (it didn’t change my 90% rating)
      the RN didn’t use the goniometer so I filed a supplemental appeal and I have that C&P on 18NOV, which is UNBELIEVABLY quick, the first appeal took 10 months before I was scheduled.

    Hey Clay! Thank you for sharing this info! Can you provide other examples of common conditions that can get you to a rating of 90% or higher?
    I have Sleep Apnea; Reactive Airway Dz; Oxygen dependent; MDD / Anxiety; Insomnia; chronic pain; some ortho stuff; chronic fatigue; a few other Yada Yadas. No Tinitis or Migraines.
    Hubs has the MDD/ Anxiety / Anger / Suicidal Ideations; Ortho stuff w/ chronic pain; GI stuff - probably Gulf War Syndrome; Hypertension; AND T2 Diabetes.
    Yeah. I do not expect you to work our Claims (although I WOULD love you more 😘). Just curious about some of the Good conditions. Thank you so much for all you do!

    I am at 60% currantly for hernia. Non operatable. And 10% tinnitus. I believe i have meneirs. All the symptoms are there. Do i go to a va doctor , or private? Going to claim this connected to my tinnitus.

      Go to whichever doctor you can see first. Start getting a diagnosis and treatment for whatever your doctor diagnoses you with and then move forward from there.

    Great advice! Should we be conveying the symptomolgy to the C&P examiner and/or in a personal statement?

      Your personal statement should lock in your symptoms, and just make sure your story doesn't change when talking to the examiner.
      Your personal statement may or may not be read by the examiner, but hopefully will be read and considered by the rater when evaluating your claim. If you list out 15 symptoms in your personal statement and the Examiner only lasts 4 minor symptoms, it should cause the Rater to push back and ask for more information.

    I have depression from my tinnitus and anxiety for going out because of my IBS. If I filed both as secondary’s isn’t it stacking? If so which would you do? Depression from tinnitus or anxiety from IBS? Thanks

      Do both, let the VA figure out the rest. Just remember they will probably do another C&P exam for the service connected disability your claiming is the cause of the secondary. But I would definitely claim depression secondary to tinnitus and anxiety secondary to IBS. Also do you have a current diagnosis for depression or anxiety? If your already seeking medical treatment for depression and anxiety; are you talking to your mental health provider about the cause of your depression and anxiety? I mentioned having migraines, IBS, Gerd to my Psych doc and she said oh yeah those are extremely common in people with anxiety and depression, when you're stressed it's not just your show muscles that get tense, but also your internal muscles.

      ​@@jaxripper251Bro, we all know that Clay never advocates for lying. But if you have these symptoms/diagnosis, then you should 100% file and fight for your rating. It's a double edged sword in my opinion. You can be uneducated and not know how the VA works or what they are looking for and just screw up your claim and be under rated or denied, OR you can be educated and know the rating criteria and what the VA is looking for and get the highest rating you can get by submitting the proper forms, and knowing what symptoms are caused by which disability and what to prioritize.
      Is it wrong that I now know that secondary claims are a thing, and that migraines can be caused by mental health issues and therefore the fact that my migraines routinely correspond with anger management, anxiety, and extremely stressful situations I'm in, can be service connected to my mental health? Can someone use that for nefarious purposes? Sure but those people were going to anyway. Educating veterans is going to also educate anyone looking to falsify claims.

      This scenario is 70/50/50 in which…you do not have. But…94% only requires another 10. So close yet so far away.
