      @@josephmejia3756 not very easily. You'd still need to know the Google/Samsung or IPhone account username and password and some sort of device management feature needs to be enabled.
      There are ways of course to hack into anything but it takes a forensics expert and a lot of time. Anyone remember the san bernardino shooter? FEDs couldn't unlock the phone and tried to compell Apple to install backdoors. They did eventually break into it but they had to remove the chip that handled encryption from the phone and it certainly was not easy or straightforward. I find it somewhat hard to believe local LE would extend the resources needed.

      Matt Wolfe - that sounds wrong. When I broke my phone and being me couldn’t remember what name or password I set up, the woman at the mall kiosk was able to simple copy and transfer everything to a new phone ($25 fee), then I just set up the new phone with the temp name and password they gave me. And I had all my info open and available.
      So I find it hard to believe that cops don’t have that same ability.

      @@dericksmith2137 well yeah the carrier can transfer everything on the SIM over...for LE that would require a warrant served on the carrier.
      If you store data on the SD card or internal storage then the phone must be unlocked. You can defeat the pass code with specialized software like Grey Scale but like i said I don't think every LE agency has access and im sure its not cheap or easy.
      If you lock yourself out of your phone, specifically Android, then you can enter the wrong pin 5 times and then select the forgot pin feature and you'll need to provide your Samsung or Google account credentials to unlock it. And im pretty sure this feature needs to be enabled in the device management settings. I can unlock my phone from my home PC for example. But LE can't. My phone is also encrypted when I turn it off and requires a separate pass code to turn it on and load the operating system.

The fact that it didn't is dumb luck. You don't give someone time to read the warrant to his lawyer to get advice or erase evidence. He could have destroyed it. Plain stupidity or corruption.

He was involved with all this warrant phone searches and as they started getting evidence pointing to him and must of found some good dirt on him they arrested him also and took his phone.       Yes it should. I dated a cop who I sincerely believe thought he was 'above the law'. He might go out in a day & arrest drug users, dui offenders & so on but that same evening drive around drunk af, with open containers, off duty and drunk but still carrying weapon, talk openly with colleagues about intentionally setting up people he didn't like, tell me to drive even when I stated I was too intoxicated to be driving telling me to just follow him & I'd be fine, not to worry. He'd stalk. Other women complained about similar incidents even labeling him a predator bc he'd use police resources to invade others privacy or force actions via threats.
      I even filed complaints about being harassed & he straight up informed me that they'd never be taken seriously & laughed in my face! He was addicted to prescription pills, abusing them & illegally distributing them & even that prompted no disciplinary action.
      Meanwhile, he was celebrated as a 32 yr veteran when retired and everyone 💙'd him because he was such a 'good guy' 🤮
      It's BS.

      Idk if I entirely agree with that statement. I believe special privileges should not be allowed for a fellow service member wether military, law enforcement or medical unless it's a circumstance that's a outcome of the job. Let me explain. Say a military or law enforcement is in a shootout and has to take a life. And during there ride home after talking with all they have to get a ticket for running a yellow. Something like that should be given special treatment. Or if a medic has to treat a friend or family memeber. I think on minor infractions do to circumstance maybe a little professional courtesy is given. But a officer out and out breaking the law speeding talking on there cell phone while driving dui or obstructing justice like we have here HELL no.

      I know right. That's pretty bad when the sherriff can't differentiate between investigative detention and a interrogation. Which then and only then is when you're able to invoke your right to legal counsel to which only means that they can't question you. It don't prevent arrest. It's clear that the sheriffs has gotten quite used to thinking he's above the law and throwing his weight around. He's not liking getting a taste of the same thing he's used to dishing out.

    If you’re just tuning in, this guy is not the one who stabbed someone. The description is kind of confusing. This is Ramon Vigil, who’s phone they are getting. In a previous video a man Phillip Chacon stabbed someone and then ended up in a stand off with the local police and swat. During the standoff Phillip kept calling and texting his buddy the Sheriff (who’s crooked as hell) AND Ramon. During the investigation of the stabbing and standoff it was told to the police by a wife that Phillip has more assaults on his security camera footage, which is saved on his cell phone. It was made clear that the sheriff and Ramon knew of these assaults and were in on covering it or something. But the sheriff and Ramon’s phones were seized bc they have a lot more evidence of more crimes and them trying to cover it. I’m sure they will find a ton more crap and I can’t wait for the next chapter. If u haven’t seen the video of the sheriff getting his phone taken u should check it out. He’s a shaddddyyyyyy man. He also showed up drunk to the standoff and tried to take over, which is also shady and creepy. And then for Ramon to call the sheriff as soon as the cops show up.....way to make yourself look even more guilty. Smh

    This pissed me off. Would any of us get to refuse to hand something over like this? I've saw members of the public complain about no signature on a warrant and basically be told we're taking it anyway. The police would never get someone to run to the office and print the signed copy out for us. They would never wait on us phoning our lawyer. Who do these people think they are. I'm so sick of people like this that think AND get treated as if they are above the law

      I think that they have to try to obtain the physical phone; then they just go back to the judge and get a warrant for their phone. It's all in Denver in the big data vault. EVERY WORD WE SAY AND DO ON OUR PHONES IS RECORDED AND ARCHIVED.

This is not a known violent offender, it is a city official so the risk is minimal. They had to wait around because they brought an unsigned copy of the warrant.       @@ernestoherrera7912 I know you probably have instant gratification issues, but this is a step in the right direction, don't fall prey to never seeing the good, you reward the good and hold accountable the bad, public officials need to be treated like children, you can't correct all the behavior all at once, but over time with constant nagging and the ever growing ability to hold these people accountable for not only civil rights violations but also when they break the law too! If we want real change we must recognize and celebrate the good jobs that the actual decent public officials do, not just focus on the bad begging for some sort of victim-hood, you should give respect where respect is earned and the fact that this County is actually doing something about it, should be recognized. just like a sheriff in my state choose to stop allowing a certain police departments arrests because of corruption, or when Florida went for that cop for planting drugs and actually did the right thing releasing and reversing some 600+ cases he was involved in. There are problems in every profession, there will always be some good, some bad, but this is clear headway, baby steps in the right direction. Slavery didn't end over night and it took decades and decades for not only black people to be afforded civil rights but women of all color as well. You keep the pressure on and be an example of what you expect. And if you really are a constitutionalist willing to die for it, you need to trust in it and trust that others no matter what, no matter when, will make sure it will prevail. True American's believe this. That's why we celebrate memorial day. People die day in and day out upholding and fighting for that document, and we need to uphold the dignity for which it stands for. Stuff doesn't change overnight but America has always done one thing taken huge steps in the name of betterment for the people it serves and to improve and ensure human rights for all that it serves, yes we have always taken steps backwards but when we get our crap together after some bumps in the road we always end up making major leaps forward, so yes I will keep dreaming of a future where our human rights aren't infringed on and we are truely free, and I will keep bleeding for that document that so many others have bleed for. And I will never lose trust that when push comes to shove and things go down that not only will the constitution prevail but True Americans will ensure that it will!

      The technicality is that he was not served a signed warrant to begin with. He legally had every right to do whatever he wanted with his phone until being served a warrant signed by a judge. The officer asking him to stay present and not mess with his phone while waiting, was not within the boundaries of authority at the time to be asking that without a signed warrant being present. For all the defendant knew, they don't have one. I agree, it sucks that cops have to go through a ton of red tape to get results.

    I live in Albuquerque, about an hour and a half from where this whole sheriff situation took place. Whenever anything is reported in Rio Arriba county is it usually law enforcement misconduct, one of their local politicians or school staff doing some illegal nonsense, or reports of the highest heroin use in the country. The biggest city in Rio Arriba is Espanola. Espanola has a lot of poverty, a lot of crime, the kind of place it's best to drive right on through and not stop. Lots of drugs there.

      Factory reset literally would not have done a damn thing. Using Cellebrite, or other forensic tools, they can recover pretty much any data you want to erase.

A hard disk drive for instance saves a magnetic 'image' of the information stored on it. Erasing data merely makes the 'image' dimmer or harder to read. The more times it is erased or written over the harder it is to read, but can often still be recovered after many rewrites.

      The warrant was invalid. Further, it is a violation of his 5th amendment right to demand the password. This has been upheld time and time again via the courts. Only in rare circumstances can a federal judge or a grand jury request it. This warrant is a magistrate, about 15 levels below that.

The second one that showed up 30minutes later was signed. That one was valid. Nevertheless, it is a dumb warrant to issue. Your passcode and biometric is "testimony". So unless they can break into the phone, which is unlikely with current phones the warrant is useless since retrieving the data violates his 5th amendment rights.

      As to the passcode, if it is a personal cell phone then they can ask for it but they cannot compel the passcode, nor use their fingerprint, nor their face to unlock it. That doesn't mean they are prevented from accessing the contents, it just means they would have to go to some extreme methods. If it is a phone issued to him as a member of the council then he would have to give up the passcode, or the IT team would need to do so. If it is a border crossing they can compel you to do so, or at least it's a grey enough area that they do so.

    These people think cause they throw out “my attorney”, that the process will stop until they go to court. 🤦🏾‍♀️ the search warrant IS a court order signed by a judge. If it’s illegal, people will win law suits. The criminals need to learn to stop using their phones for illegal business and get the throw away phones for that.😂😂😂

      Well he'd be really stupid to do that. They'd tack on an EXTRA charge for tampering with evidence. They can RECOVER the data and match it to the phone stating that the data had been DELETED in which the department was FORCED to recover it.

    It's quite obvious that avoiding a court order or making it difficult to comply says there is obviously some damning evidence on the phones.My only displeasure is how much time they gave this guy initially and then allowed him quite some time in the house out of view to delete stuff.Same thing happened on the initial confrontation at the Sherriffs office,they allowed him to pass the phone off and walk around,VERY sloppy work.

    If you are going to serve someone MAKE SURE IT IS CORRECTLY DONE and you have a SIGNED copy to give otherwise it is just some paper. This would have cut the time down to serve the warrant and prevent others interfering with the due process.
    In regards to the Sheriff something smells off with him, he keeps getting involved in other peoples business way too much and also the types of people who have his "direct" number to call him to ask for help.

      When they go after John Doe citizen they aren't too concerned if the case gets tossed out over some technicality as they know they will have more opportunities. When going after a Sheriff and Council member they play it differently because they want everything to pass muster in court. Further they can use the non compliance and the fact the council member reached out to the Sheriff for help to nail them both.
