Out of Control Rio Arriba Sheriff Tries to Take Over Active Scene While Allegedly Drunk(Pt 1 of 5 )

- @Copwatchtv obtained lapel footage from different officers of a March 26th, 2020 incident, Española Police and New Mexico State Police were executing a search warrant of a suspect who stabbed and beat a man. The suspect was Phillip Chacon. When officers arrived he retreated inside his residence.
Officers from both agencies established communication with Chacon via text message and phone. At first Chacon said he was in Santa Fe, New Mexico but officers heard the PA system in the background asking him to come out.
Rio Arriba Sheriff James Lujan arrived on scene and ordered everyone to pull back. In the lapel footage and police report officers mention Sheriff Lujan smelled of alcohol.
At one point Lujan walked into the "hot zone" of the standoff with his cell phone in hand and walked up to the residence of Chacon.
Eventually, Chacon was taken into custody and weapons were recovered from his residence.
The Española Police Department has charged Lujan with resisting, evading or obstructing an officer.
Rio Arriba County Sheriff James Lujan was arrested Thursday 5/21/2020 for refusing to comply with a search warrant in relation to an earlier charge of obstructing an investigation in this incident.

I dont know the laws in this state but in the state that I reside in the only person who can arrest a sheriff is the coroner. No city has the authority to arrest a sheriff. I think that's a little old fashioned and would like to know if they have the same sort of hand tying law that prevented them.

Any law enforcement officer with probable cause and jurisdiction can arrest them, except If it's a deputy within his own jurisdiction they would have to detain the sheriff until someone with the authority to assume the role of interim sheriff arrives, usually the coroner, but they absolutely can detain him.
Hell in many places a citizen can arrest the sheriff if they witness him commit a felony.
People need to learn the actual laws/rights instead of repeating myths. That's how rights are taken away and certain people are held above the law.

This entire Investigation is EPIC! I called the now convicted sheriff and talked too him as this was investigation was concluding. He freaked out when I called him out. EPIC!!!!
Sadly, most of our cops are EGO MANIACS just like the one you spoke to. Cops only protect cops and this case is a prime example. People need to also realize our cops are human and they have problems in life too and they face formulations of negative variables at times in life just like we call do. No one goes through life worry free or stress free their whole lives. No one, not even cops. And many of them are addicted to alcohol and other substances. Cops are not perfect and their big ass EGOS need to stop. It ridiculous cause they're no better than the people they arrest off the streets and they know it, that's why he flipped out on you.

Police ARE civilians, dummy. They are peace officers. I cringe when I hear people call non-cops "civilians"..
They likely act this way because they know a lot of the higher ups are the same types and could be worried about retaliation for calling out one of their own, no matter how egregious the behavior.
The body cams and increased scrutiny from the public do seem to be helping and there are certainly officers that are the real deal. Unfortunately though, a lot of these guys that followed and put these old practices in place are still calling the shots. They didn't wake up one day and decide to be better police, they're being dragged kicking and screaming into transparency and accountability. Guys like this sheriff are a prime example.

This video shows the sheriff getting in the way, which leads to his warrant for his cellphone(s).
When he didn’t turn over ALL THREE of his phones, they popped him for obstruction.
What I don't understand is why from this video they got probable cause to get his phones. I don't see the why's in this

Watch the next 4 videos, he does get arrested, just not tonight. There is a playlist that starts at number 2 in the 5 part series. I love this Police Department, the Sherrif and his crew look seriously shady throughout this series. I don't know what happened after he went to jail though, probably got bail right away, don't know the outcome of the entire story yet. Still looking for the next video!
J Bug Sheriff spent the night in jail after his arrest, there was an immediate hearing, he was released, and the trial hasn’t happened yet.
