Sonora, CA --- On February 27th, 2024 at around 11:05 p.m., Tuolumne County Sheriff’s Deputy Alex Zanini conducted a traffic stop near the intersection of Merrel road and Harper road.
The vehicle was a white pickup truck with multiple vehicle code violations,
including an obscured license plate and a non-fonctioning left brake light.
The driver did not have any form of legal identification. The passenger also said he did not have an ID. The driver gave deputy Zanini a name, but a check of that name resulted in an expired California driver's license.
After the incident, it was determined the driver gave deputy Zanini an alias and the driver did not have a California driver's license.
Using the driver's name, deputy Zanini ran a computer check on local database which provided a photo, but the match was inconclusive.
Deputy Zanini also asked dispatch to pull a Calphoto to try to identify him.
Calphoto is a DWM database utilised by law enforcement.
With the driver identity unconfirmed, deputy Zanini asked the driver to exit the vehicle.
The driver consented to a search, and the deputy Zanini found a vial in his pocket containing a white residue.
Deputy Zanini had developed probable cause to search the pickup truck for controlled substance and forms of identification to verify the driver identity.
The driver consented to the search of the pickup truck.
In post-incident deputy Zanini statement, deputy Zanini said that he believed that the nearest backup to his location was approximately twenty minutes away.
For deputy safety, he wanted to secure the passenger later identified as 42-year-old Shawn Karr before conducting a search of the pickup truck.
GPS data obtained after the incident showed the nerest backup for deputy Zanini was approximately 25 miles away, near East Sonora.
On the winding rural roads, it takes approximately 40 minutes to cover that distance at normal driving speed.
Deputy Zanini's body camera stopped recording as he laid chest down on Karr, who was actively resisting. Deputy Zanini's body camera was center mounted on Deputy Zanini's vest.
Pressing the center button for 3 seconds stops the recording.
Pressing the center button twice starts recording.
Recording begins automatically when a sensor on the deputy's holster detects the service weapon has been removed.
During the srtuggle, the center button on the Deputy Zanini's body camera was depressed for three seconds stopping the recording.
As Deputy Zanini continued to lay chest on top of Karr, video recording resumed approximately 2 seconds later.
Due to a buffer feature the audio recording picked up approximately 15 seconds before the recording again stopped.
Deputy Zanini radiod in that he was in a foot pursuit, at which time backup units began responding Code 3 (lights and sirens).
In post-incident statement, Deputy Zanini said his intention was to lay on Karr until that backup arrived, which he anticipated would be around 15 minutes.
In a statement, Deputy Zanini said Karr turned on his side and he, quote "saw a revolver in his right hand, and it scared the shit out of me".
Deputy Zanini stated that, quote, "with my left hand, I grabbed his wrist and I could feel him resisting against it. like, in my head at that moment he was trying to point that gun at me to kill me."
Deputy Zanini drew his service weapon which automatically started the recording on his body camera. A deputy-involved shooting occurred.
Deputy Bomer arrived approximately 13 minutes after the Deputy-Involved shooting.
A California Highway patrol officer and additional deputies arrived moments laters.
Using a ballistic shield, deputies approached Karr and secured the firearm which was on the ground within his reach.
A second firearm was found in his left front pocket.
Deputies provided medical aid, including the use of CPR until arrival of paramedics. Karr died at the scene. Two firearms were recovered. Both were loaded.
In addition Karr had 13 grams of methamphetamine in his pocket.

When a vehicle is subject to a traffic stop, is a passenger in the vehicle "detained" for purposes of the Fourth Amendment?

I was a Tuolumne county Deputy for 8 years, and this occurred at a remote Sheriff's Substation near Groveland California. That's approximately 30 miles away from the sheriff's office in Sonora. I worked out of that substation, and depending on the day and time of year (weekend or summer there's more deputies) there could only be three deputies for the entire county. I'm glad Deputy Zanini wasn't killed or injured.
I live in Twain HArte and I know you guys often find yourselves way out in the mddle of nowhere without back up anywhere close. THank you for your service.

Back in 80s a slightly distant reaitive (mom's mom's cousin?) was a Sheriff's deputy in, I think Salinas county and stoped a bank robbery suspect on some backroad. Unfortunately the booger eater was able to get the jump on him and my relative was fatally shot in the face.
There was a man hunt and eventually the bad guy was caught, sentenced and died in prison.
From what I understand, cop killing used be a bigger deal than it is now.
In my home town, there's only one deputy for the imediate area that is stationed at the volunteer fire station. Interestingly, as big as my county is, the majority of Sheriff's stations are located in or just out side of city limits. And theres only three "cities" (there incorporated, but after having been to places like Denver, LA, and Pheonix I feel like the term, while correct is a generous one!) I digress, depending upon where the situation occurs, if it requires SWAT and a Bearcat, it could be at least 27 miles from the station, and thats not including the distance the deputies that are SWAT may need to drive to get to one of the two stations that has a Bearcat.

You're funny, some of these Sheriff's departments are lucky to have two officers to cover the whole county. Let alone patrol cars with two officers at a time. Problem is funding was cut for a lot of law enforcement over the past couple of years, and I don't see the situation changing anytime soon

Not enough officers on the department to do that. Often has nothing to do with funding. Has to do with not enough people applying to be officers, and many of those that do, aren't qualified. My department ( east coast city) was only at half strength. We had maybe 25 patrol officers to cover the entire city, per shift.

For all those saying the passenger is free to go no matter what are completely wrong. In Arizona v. Johnson (555 U.S. 323 (2009)), the Supreme Court held all occupants of a lawfully stopped vehicle may be lawfully detained for the duration of the stop.
That's just for Arizona. There is no California penal code. Case closed. I win.

Late at night, junky pick up truck, two occupants; this was a ballsy stop just to begin with. The LEO was super professional; did not escalate the situation and controlled the driver before dealing with the scumbag. I am surprised the passenger didn't run much sooner knowing what was coming. This is why law abiding citizens need to be extra careful at night. Imagine having a flat tire and have these idiots stopping to "help" you. It is also why many law abiding people in California carry a handgun even in places where they cannot get a carry permit.

I used to be a dispatcher for a sheriffs department. Having a deputy alone on a traffic stop with 2 individuals with priors and back up many times far away is terrifying.
What made you leave dispatching?

Ive rolled45 minutes Code 3 for CHP. Theres a reason they call northern LA County Landscatter instead of Lancaster.
It is not uncommon forTroopers in west Texas to roll an hour or more on calls, I know of one west Texas county that had one trooper and one game warden for it and part of another county. Their cars were replaced about every 18 months just on the mileage.

I was involved in a gunfight in 1974, but as a city cop backup was there quickly. I cannot imagine a similar situation where backup was several miles/minutes away.

I live in a fairly big county in Texas and most of the county is rural. Most of the time there's only 4 deputies for the whole county. We have to take care of ourselves if something were to go down. Thankfully, we live near a busy interstate so there's always a few state troopers within 15 minutes or so.
Can't imagine working those roads alone while nearest backup is 20+ minutes away.
