I feel sorry for people who live in states where in order to pass inspection they can’t have a Check Engine Light. The CEL is extremely sensitive and does NOT mean the car is not safe/drivable/dangerous. $$$
I live in Texas and we have this rule. My car is over 200k miles but runs good. Every year I get so stressed out when I have to get that inspection hoping my light doesn’t turn on because then I can’t renew my tags and then I don’t have a car. I can’t afford a new one or repairs right now. I’m recently widowed and now a single mother to a special needs child so even though my car is fine and runs well, I’m saving every penny I can to get a new car or to use for possible repairs. Whichever is cheaper, just hopefully I can save enough before my check engine light does come on. 😬

Well according to the plaintiffs second mechanic, the part is no longer offered new so the possibility of being a new one rather than a used one from a salvage is highly improbable. It’s highly likely that the first mechanic as he stated bought a useable used part and probably wiped it off. Not knowing what exactly was replaced, if it has a gasket then one might be able to see whether a new gasket was used, however it it used an o-ring that would not be easily seen. It sounds as if the second mechanic either was trying to disparage the first so as to win the plaintiffs business or he wasn’t competent. The first mechanic said that the can HAD to be driven so as to reset the sensors.

As an auto service writer, 95% of the probs between customers and mechanix are from communication probs. The mechanic just doesn't know how to explain in layman's terms how things work. Most of the time the mechanic is right, they just suck at explaining it.

And in most states you get an inspection waiver if you've spent X ($200 in my state) in an effort to fix it even if it's not fixed. Or if it's 20 yrs+ old, you're exempt from inspection. i've been through this shyt. cars are shyt with sensors and multiple computer boxes. you have to have an $8,000 obd tester (most mechanics don't have them) to find out maybe what the problem is. those codes just gives you a clue. leakes could be manifold, hoses, ecg, vapor canister, gas cap, inside the gas tank. after the "fix" you have to drive the vehicle until all the computer systems have gone through its checks. my car was not ready to be checked until after 200 miles. went and passed inspection. 2 days later check light came on again. cars are shyt.

To charge someone $400 for a junkyard part, 2 me, is crazy when the part if available cost $400. I would also think it would be professional to tell customer it was a used part from the junk yard.
No way that mechanic found a $400 receipt for a used junkyard intake manifold. Unless he knew someone at the junkyard that would lie and put a bogus price on it.
As a service writer this is cringe. If the emissions test fails then the tech didn't fix it. It the test rejects then it's fixed but not ready, and like Jose said, you need to drive your damn car! I've seen monitors reset in 20 miles I've seen it take 300.
Each car has a drive cycle for setting the emissions monitors. I always see the smog test shop trying to explain this to upset and frustrated customers. They think that they could just reset the light with a tool and pass the emissions test. NOPE!!!!

A car is complex and you might start of with one light but keep getting others codes. It is hard to diagnose problems because a code simply tells you where the issue is and you need to check everything. Even then you may end up with another issue. I never understood this until I started working on my car.
I totally agree with you and my 2008 Buick Lucerne I fix one problem and then a check engine light comes on for another problem I put almost $6,000 into that car and how about this the check engine lights still on for another problem I don't think it's major but it's still on

Once the problem is fixed, then in order to reset the computer, all you have to do is remove the positive cable from the battery and try to start the car. Then put the positive cable back onto the battery and the computer resets itself. You don’t have to drive it. The mechanic doesn’t know what he’s talking about

It's difficult to find reputable people to do the right work on your car if you get into a jam. Most repair shops overcharge at an exorbitant amount when just the smallest things go wrong let alone the bigger things. The plantiff didn't have adequate proof to prevail in this case. But I can understand his frustration.
Speak for yourself. You find reputable mechanics by having friends. I found a mechanic in 2002 who has been working on my vehicles this whole time because a friends husband is a mechanic and recommended them. Hell, when I failed a smog test, a local smog tester gave me the error code, told me "Listen, we've seen this code a lot, it's likely this one thing. You can order the part online for a few dollars and it's an easy fix you can do yourself. Fix the code and we'll retest it for free". Mechanics, contractors, and other fields, especially in small towns, survive by being good and through word of mouth. So it's weird that you always seem to have this "blue collar workers are all thieves that overcharge everyone" when I have a roofer, a mechanic, a contractor, a landscaper, and a ton of other "guys" that do great jobs without overcharging because repeat business for a lifetime is better than overcharging once and losing a customer. Either you don't have anyone in your life to recommend people, or you think paying someone any amount of money is overcharging.
They really do overcharge, and sometimes just to diagnose the issue. It's almost worth it to just go to a trade school program to be a mechanic just to work on your own car lol
If a part is no longer available from the dealer ( after 10 years per federal law), there are other sources that dealer parts departments and parts stores use. Intake manifolds are now made of plastic instead of metal. It's a Chrysler - enough said.

Gas caps have a seal. When the small evap code pops up usually it’s due to a gas cap not closed correctly or the seal is bad on the cap and must be replaced.
The car is never going to get fixed correctly if he keeps picking it up and driving it around and bringing it back. That is what the mechanic should have told him.
The plaintiff says he doesn’t want junkyard parts in his car, but the second mechanic told him it was a discontinued dealer part and there is no aftermarket version. So where does he expect a part to come from, the auto parts fairy!
If the issues were not fixed and the car passed emissions. They passed the car illegally, or the Defendant did fix the car and it just needed to be driven so the computer could go through the drive cycle. For the car to go through all the cycles it needs to be driven a certain way.
Good question only posted 6 hours ago. With everything being virtual and believe it or not, this court room is actually in her house. So you know it's a small team. So it can be quick work and editing. The case had been this morning and 24hrs isn't up yet. Only thing I can think of. The Plaintiff should have called his witness right there and then....I think the Defendant is lying....he seems pretty shady to me.....When my step father had his volvo repair shop all receipts pertaining to the customers car was with the work order and written down...diagnosis and what was done was written on the work order as well....I should know I filled all of them and made sure things were stapled to them...We even went as far as if the part came with a warranty we stapled it to the work order and then filled it ABC order for the warranty.....His business was open for 20 plus years and never was brought court for poor service or workmanship....
An evap code can be various things such as: 1. Purge valve 2. Vent valve 3. Vapor canister 4. Vapor canister leak detector 5. Any of the fuel lines can be cracked loose disconnected leaking fuel or air 6. The gas cap can be loose missing and or bad. Gas caps have gaskets and some cars have a pressurized gas system 7. Bad gas A nice computer can test these sensors or perform a smoke test🤷♀️ The light being reset, resets the computers. Car needs to drive to relearn the system and once all the systems have ran their test and determined everything is good to go aka ready. Then and only then you'll pass emissions ( for cars 2001 and newer )
@@mexicanspec p0456 is an evap code that was the first code and the second was p0457 both evap codes. 1 of those can be a pressure issue in the evap system

Yeah, none of what the defendant was saying made sense. All the monitors stuff is true but I couldn’t understand messing with the intake runners. What’s an intake runner actuator or damper gonna cause an evap leak code? He just threw a used intake on it for no reason… probs had it on the shelf for years from another beater. Then the genius couldn’t even order the right gas cap. The cap has to seal properly… the system uses the engine to put the system under vacuum and watches a pressure sensor to test for leaks. If the gas cap doesn’t seal or if there’s a leak then the system won’t hold the vacuum, the PCM will see that pressure sensor drop and the test fails. If it fails twice then light comes on, if it passes twice the monitor passes and it’s ready for inspection. It sounds like the other tech smoke tested the car and found the leak but it’s hard to say exactly what was done. Some places have a process if you spend X amount trying to fix the problem and couldn’t then you get a waver for the year. Here it’s about $400 worth of parts, doesn’t include labor. It doesn’t sound like they did that though. Maybe the guy put the intake and a used purge valve on it too. Just replaced it with as much ‘new’ stuff still attached. The only reason I can see messing with the intake is if there’s a TSB that says the intake runners fail causing the system to not run the test properly and cause a p0456. Still… the intake doesn’t hold the vacuum, the purge valve does. The test only runs between the purge valve, vent valve, and gas cap. It wouldn’t be able to see a bad intake runner and quantity it as an evap leak.

people pay attention to the car, it's a Chrysler and they suck. small evap leaks are usually gas caps. he has no idea what he is saying trying to explain what was done or not done. he probably got lucky with it passing from having 1 monitor not ran yet, some emission tests can pass with 1 monitor not ready. but you gotta be right there for the test. most likely they cleaned that part and charged him all that money and all they replaced was the gas cap.
Your wrong. In some states the readiness monitors have to be ready to run the emission inspection. When you manually reset the check engine light the monitors all get reset. This technician is correct every vehicle has a different drive cycle to reset the monitors.

If your vehicle is older there is a chance that you can no longer get parts for it, after market or dealer parts. Never, turn down a part from a junk yard, you should be grateful the guy even found a part for you. I've had many parts come from junk yards and if the Defendant padded the bill a little the Plaintiff is still getting his part, new or used. It's like anything that is no longer being manufactured, the Seller can put ANY price on an item they want, whether it seems FAIR or not. You should be happy that you even were able to get the part.
I know I have an older vehicle and it needs work i went to him plenty of times before that and didn't even hesitate on the prices he charged me 300 for fixing a window and found my car with a flat there so get your facts t before you make yourself look like a crook

Each car has a drive cycle for setting the emissions monitors. I always see the smog test shop trying to explain this to upset and frustrated customers. They think that they could just reset the light with a tool and pass the emissions test. NOPE!!!!

A car is complex and you might start of with one light but keep getting others codes. It is hard to diagnose problems because a code simply tells you where the issue is and you need to check everything. Even then you may end up with another issue. I never understood this until I started working on my car.
I totally agree with you and my 2008 Buick Lucerne I fix one problem and then a check engine light comes on for another problem I put almost $6,000 into that car and how about this the check engine lights still on for another problem I don't think it's major but it's still on

Once the problem is fixed, then in order to reset the computer, all you have to do is remove the positive cable from the battery and try to start the car. Then put the positive cable back onto the battery and the computer resets itself. You don’t have to drive it.

It's difficult to find reputable people to do the right work on your car if you get into a jam. Most repair shops overcharge at an exorbitant amount when just the smallest things go wrong let alone the bigger things. The plantiff didn't have adequate proof to prevail in this case. But I can understand his frustration.
Speak for yourself. You find reputable mechanics by having friends. I found a mechanic in 2002 who has been working on my vehicles this whole time because a friends husband is a mechanic and recommended them. Hell, when I failed a smog test, a local smog tester gave me the error code, told me "Listen, we've seen this code a lot, it's likely this one thing. You can order the part online for a few dollars and it's an easy fix you can do yourself. Fix the code and we'll retest it for free".
Mechanics, contractors, and other fields, especially in small towns, survive by being good and through word of mouth. So it's weird that you always seem to have this "blue collar workers are all thieves that overcharge everyone" when I have a roofer, a mechanic, a contractor, a landscaper, and a ton of other "guys" that do great jobs without overcharging because repeat business for a lifetime is better than overcharging once and losing a customer. Either you don't have anyone in your life to recommend people, or you think paying someone any amount of money is overcharging.

If a part is no longer available from the dealer ( after 10 years per federal law), there are other sources that dealer parts departments and parts stores use. Intake manifolds are now made of plastic instead of metal. It's a Chrysler - enough said.
auto manufacturers and politicians made a deal behind closed doors to force people to get rid of perfectly running vehicles after about 10 years and the way they pulled it off is designing vehicle computers to show problem codes that can never be turned off , forcing people to junk their otherwise good running vehicle because with the engine lite on then the state wont pass inspection and they may impound the vehicle . its all a scam to force people to buy brand new vehicles every 10 years .

Gas caps have a seal. When the small evap code pops up usually it’s due to a gas cap not closed correctly or the seal is bad on the cap and must be replaced.
If the defendant bought a used part it would be no record of the purchase only at the place he got it from.

If the issues were not fixed and the car passed emissions. They passed the car illegally, or the Defendant did fix the car and it just needed to be driven so the computer could go through the drive cycle. For the car to go through all the cycles it needs to be driven a certain way.

Good question only posted 6 hours ago. With everything being virtual and believe it or not, this court room is actually in her house. So you know it's a small team. So it can be quick work and editing. The case had been this morning and 24hrs isn't up yet. Only thing I can think of. The Plaintiff should have called his witness right there and then....I think the Defendant is lying....he seems pretty shady to me.....When my step father had his volvo repair shop all receipts pertaining to the customers car was with the work order and written down...diagnosis and what was done was written on the work order as well....I should know I filled all of them and made sure things were stapled to them...We even went as far as if the part came with a warranty we stapled it to the work order and then filled it ABC order for the warranty.....His business was open for 20 plus years and never was brought court for poor service or workmanship....

An evap code can be various things such as:
1. Purge valve
2. Vent valve
3. Vapor canister
4. Vapor canister leak detector
5. Any of the fuel lines can be cracked loose disconnected leaking fuel or air
6. The gas cap can be loose missing and or bad. Gas caps have gaskets and some cars have a pressurized gas system
7. Bad gas
A nice computer can test these sensors or perform a smoke test🤷♀️
The light being reset, resets the computers. Car needs to drive to relearn the system and once all the systems have ran their test and determined everything is good to go aka ready. Then and only then you'll pass emissions ( for cars 2001 and newer )

Not an EVAP code, the plaintiff said it was a VAP code many times.
@@mexicanspec p0456 is an evap code that was the first code and the second was p0457 both evap codes. 1 of those can be a pressure issue in the evap system
it all depends on the car, you might have to drive a car days or 100's of miles b4 the monitors reset. and it depends on the driving conditions.

Yeah, none of what the defendant was saying made sense. All the monitors stuff is true but I couldn’t understand messing with the intake runners. What’s an intake runner actuator or damper gonna cause an evap leak code? He just threw a used intake on it for no reason… probs had it on the shelf for years from another beater. Then the genius couldn’t even order the right gas cap. The cap has to seal properly… the system uses the engine to put the system under vacuum and watches a pressure sensor to test for leaks. If the gas cap doesn’t seal or if there’s a leak then the system won’t hold the vacuum, the PCM will see that pressure sensor drop and the test fails. If it fails twice then light comes on, if it passes twice the monitor passes and it’s ready for inspection. It sounds like the other tech smoke tested the car and found the leak but it’s hard to say exactly what was done. Some places have a process if you spend X amount trying to fix the problem and couldn’t then you get a waver for the year. Here it’s about $400 worth of parts, doesn’t include labor. It doesn’t sound like they did that though. Maybe the guy put the intake and a used purge valve on it too. Just replaced it with as much ‘new’ stuff still attached. The only reason I can see messing with the intake is if there’s a TSB that says the intake runners fail causing the system to not run the test properly and cause a p0456. Still… the intake doesn’t hold the vacuum, the purge valve does. The test only runs between the purge valve, vent valve, and gas cap. It wouldn’t be able to see a bad intake runner and quantity it as an evap leak.

people pay attention to the car, it's a Chrysler and they suck. small evap leaks are usually gas caps. he has no idea what he is saying trying to explain what was done or not done. he probably got lucky with it passing from having 1 monitor not ran yet, some emission tests can pass with 1 monitor not ready. but you gotta be right there for the test. most likely they cleaned that part and charged him all that money and all they replaced was the gas cap.

Your wrong. In some states the readiness monitors have to be ready to run the emission inspection. When you manually reset the check engine light the monitors all get reset. This technician is correct every vehicle has a different drive cycle to reset the monitors.
You can clear a code before going to do inspections to pass. Driving a car they’ll come back on if there is an issue
This was literally just proven by the plaintiff himself when he said the other mechanic drove it for 68 miles, so I believe the defendant.

If your vehicle is older there is a chance that you can no longer get parts for it, after market or dealer parts. Never, turn down a part from a junk yard, you should be grateful the guy even found a part for you. I've had many parts come from junk yards and if the Defendant padded the bill a little the Plaintiff is still getting his part, new or used. It's like anything that is no longer being manufactured, the Seller can put ANY price on an item they want, whether it seems FAIR or not. You should be happy that you even were able to get the part.
