How would he know she was speeding if he wasn't outside and close enough and be pissed off enough to whip a piece of wood at her car. I believe he did it all day long. The freezer wasn't made of wood, it was sitting on a pallet so it could be moved easily. This guy didn't even know, what a dork.

I'm of the opinion that he intentionally threw it at her "Speeding down the reload". There are a lot of cases on People's Court talhat have that exact phrase.

I believe it was the right call as the damage was by both parties caused by his garbage/wood. He never denied it was only that he didn't throw it there. His story kept changing slightly every time he told it hers didn't. He started out saying it was up on the sidewalk next to can and was asked about that again by judge, then it was partially in the street set down while he opened up the lid to can. If he had just carried it down to do such he would have been at the curb also and not back up by the garage. Rather he threw it or set it partially into the street and her tire caught it and flipped it up he is still liable. He could have set it at his lawns edge or completely on sidewalk and it wouldn't have resulted in what happened. Even if someone had tripped on it on sidewalk he would be liable because that is a public walkway and you can't obstruct it.
Not a stretch to think that a piece from the pile he was carrying to the curb fell to the ground, he went back and turned around attempting to toss it into the pile, but was flung a bit too far and hit her. Nothing malicious, just an accident. Doubt if he played baseball 😉
