  • I video taped my argument with this cop after he pulled me over for VC #23123 (Hand Held Wireless Telephone Prohibited Use). The argument was not over the fact that I did indeed have my headset in, but that I "touched" my phone to turn it off.

      A police officer has a job to do. Wouldn't you be upset if a cop took his time getting to an emergency for you or a loved one because he/she could not respond until they pulled over and parked? LOGIC PLEASE!

      Really dude? You grab a walkie talkie without looking at it, you press a button without looking at it, you talk into it without looking at it..........Do I need to explain how vastly different it is to operate a cell-phone in this day and age that will lead to anybody even with a headset to fall under a violation like the one this lady is being accused of or do you get the picture???
      In short, the only lawful way to operate a phone inside of your car its by only using voice commands and nothing else, any more than that and you have violated this law.

      one cop up north literally rode over a bicyclist (the Founder of Napster!) while SHOPPING on the internet... and the department backed up his homicide, his UNLAWFUL homicide with 'he was using equipment within deparment policy...' - yet normal drivers CANNOT HAVE A VIDEO PLAYER OR TV DISPLAY WHERE THEY CAN SEE IT, THAT IS ILLEGAL!!!       For doing their jobs. People get angry for any kind of ticket but we have the highest road fatality level of any developed country despite the lowest speed limits. If she wasn't texting she would not have been ticketed. She also has no understanding of the law, you can't hold the phone and drive in California. Because San Francisco has the highest number of pedestrian falatalities of any U.S. city she was ticketed. The idiot was admitted to holding the phone and lied about just turning it off because she was texting. She has the right to contest it in court after acknowledging the ticket so hopefully was arrested and had a nice night thinking about it in SF jail

      Chris my Psychology teacher, once told me that, if the person you are speaking to is shrugging their shoulders, that tells you, they either lying or they don't care about that particular situation.       She admitted to touching the phone to turn it off, probably meant she was ending the call. I mean she is actually guilty here. You can touch your phone for lots of things but not to operate the telephone feature which is exactly what she admitted to.

      I was in court dealing with a moving violation ticket years ago, and before they got to me this older black gentleman was contesting his ticket. He’d been cited for “ operating a vehicle without corrective eyewear “ or whatever because he parked his car, took off his glasses, put them on the dash, noticed a nearby cop glaring at him, and started his car to make sure his wheels were curbed. ( meaning he turned the key, turned his wheels, turned car off.) Case was dismissed but he had to pay a ten dollar processing fee. Even that was robbery.

    As soon as he said “you’re allowed to touch your phone” and “I didn’t see you use your phone any any way” she should have signed, went to court, and countersued. He just admitted that he observed no infraction or violation.
    You can’t talk your way out of a ticket, but you might be able to get a cop into talking his case out the window.

      @@alex-279 actually, all states allow cops to simply write "refused to sign" on the ticket as all pertinent information was already gathered when ticket issued.
      To arrest someone for not signing at ticket is immoral and corrupt. There is no reason or justification.

      Montel Malik He repeated the law but couldn’t tell her what her violation was. Those are different things. You even proved the cop (and yourself) wrong in your response. He said she couldn’t even touch the phone. He couldn’t explain how she was in VIOLATION of the law. No “I saw you texting” or “you were playing Pokémon Go”... nothing. Just “I saw you using your phone in a non hands free capacity” and “I observed a violation”....which doesn’t explain the violation. Seems you need to learn the difference in the words “violation” and “law” my friend. Lol. Whether she is guilty of breaking a law is of little importance to me. The fact he couldn’t explain how she was in violation of the law is the issue. Cops should have a high priority on making sure people understand what they are claiming they did wrong. For all we know, she was texting when he pulled her over. But he couldn’t explain the violation, and that’s the issue

      Cody Evans he clearly said if it is in your hands that is a violation, which is consistent with the aforementioned law. He gave her the section and sub section it’s not up to the officer to lecture you on the law, his job is to enforce the law. His responsibility ends after he has told you what you’re being charged with, the onus is on the driver not the officer to understand the nuances of that specific charge in order to mount a defence in court. The officer is not your lawyer. What you’re describing is irrelevant semantics.

      Yeah, here in Md you see it all the time. I once caught a female cop talking on her cell phone while driving and she gave me the nastiest look. She slowed down and got behind me trying to intimidate me, but the shit didn't work. I just laugh and keep on driving.

      gingermystery no it's not lol....the ticket is worth a lot and bad for ur record (depending on job applications). take it to court, show up the first time plead not guilty (obviously), and that first hearing along with the other 50+ people costed over thousands of dollars (which our tax go to), second hearing they will mostly just drop the charges and send u to the DA's office where they will givebu a piece of paper saying if u violate again they will bring this xase up along with it as well, cuz the court is not gonna waste its time or money on a stupid piece of shit violation (especially in california), cuz they are more concerned about real crimes cuz even county jails are being used to hold people that are suppose to be in prison but the prisons are over flooded so they gotta do their time in county........so no it will not cost her 400$ to fight it, it will only cost her gas money and a 2 time visit to the court

      ***** hahahahahahaha even if she got arrested she cant get charged for it (that's even if she got arrested). All they would do is take her in for an over night stay to make sure she appears in court (for not signing the ticket), she would see the judge by like 11am along with others (group by groyp) plead the same as i said before (not guilty), and she will be out by 2pm and that over night stay will deduct 100$ off her ticket or court fees (ONLY IF FOUND GUILTY) hahaha cmon lady ive been ticketed plenty of times for real crimes and always fight it cuz i know they arent gonna waste their time and invest money on investigations for something they know they might lose. Hahaha

      He was being a unprofessional smart ass. She didn’t ask for the code, she asked for him to describe the act he claims to have seen. Like when a cops says you ran the red light at the last stoplight. Him saying I saw you operate your phone in a non hands free mode is very specific. He would need to know, before initiating a traffic stop, how your particular phone operates hands free. Other wise the affirmative defense is easy. Ok, tell me in detail what mode my phone was in and how it wasn’t in hands free mode.
      Because the cop is unprofessional, unpleasant, and likely a liar (she was wearing a headset and he admitted as much).
      Citizens are not required to be passive and submissive.
      However, that is almost exactly the state all cops should have when engaging citizens. Every citizen can see cops have guns. They should be the most chill, relaxed people on earth. They have real power.
      Instead what we see so often are guys who act like they’re walking the yard at pelican bay.
      Roided up, raging maniacs spoiling for a fight, yet more nervous than a house cat in a room full of rocking chairs.

      Actually if a cop wants to they can pull you over for "distracted driving" and the DMV classifies it under endangered driving because youre actions behind the wheel arent consistant with attentive driving. I narrowly escaped sr22 insurance bc I got 3 of these tickets bc the same damn cop sat in the same spot around the corner from my work for a month and kept pulling me over for having a water bottle that had a flip straw & he said I "took both hands off the wheel while vehicle is in motion", I "wasnt looking at the road" thats bc I used one hand&my cupholder to open it, and finally that I "was drinking and driving a non alcoholic drink from a large container and it obstructed my view" which seems exaggerated but also, technically against the law. And thats what the police operate off of in most cases, especially in terms of tickets, technicalities. I couldve walked to my car with the straw already open, spilling on myself, I couldve waited the 45min drive to have a drink, I couldve changed the cup but technically, Im an American citizen and its within my rights to chose, no? 😏

      Neither time does she dispute that the phone was in her hands. She changes the subject to the headset and asking him about touching the phone.
      Could he have told her a third time and a fourth and so on? Yeah, sure, but he did tell her the infraction at the beginning and she essentially tried to gaslight him from there.

      It is not against the law, the court of appeal ruling in 2012 would be understood to include turning it off after using it handsfree for conversing to be within the law. The ruling means it is only illegal to use the phone for conversing in the normal hands-on sense i.e. without headphones.

    I got a ticket in Tennessee for using
    my telephone while driving. May 15, 2023.
    I had never heard of such a law ever before.
    The insurance companies have bought
    Congress and the state legislators everywhere it seems.
    Seat belts, 21 yr old drinking laws, liability
    insurance requirements, center mounted
    brake lights, air bags, side mounted turn signals,
    bumpers with shock absorbers, collapsing steering columns....
    all laws passed at the behest of insurance companies.
    It'll never end. There's a push now to install alcohol
    breath detectors in every new car.

      That is in NO way the law. You are fully allowed to use your phone as a GPS or even a radio, or to hit the call button, etc. You just aren't allowed to hold it up to your ear while talking, or have it occupy one of your hands.
