- I video taped my argument with this cop after he pulled me over for VC #23123 (Hand Held Wireless Telephone Prohibited Use). The argument was not over the fact that I did indeed have my headset in, but that I "touched" my phone to turn it off.

In short, the only lawful way to operate a phone inside of your car its by only using voice commands and nothing else, any more than that and you have violated this law.

For doing their jobs. People get angry for any kind of ticket but we have the highest road fatality level of any developed country despite the lowest speed limits. If she wasn't texting she would not have been ticketed. She also has no understanding of the law, you can't hold the phone and drive in California. Because San Francisco has the highest number of pedestrian falatalities of any U.S. city she was ticketed. The idiot was admitted to holding the phone and lied about just turning it off because she was texting. She has the right to contest it in court after acknowledging the ticket so hopefully was arrested and had a nice night thinking about it in SF jail

I was in court dealing with a moving violation ticket years ago, and before they got to me this older black gentleman was contesting his ticket. He’d been cited for “ operating a vehicle without corrective eyewear “ or whatever because he parked his car, took off his glasses, put them on the dash, noticed a nearby cop glaring at him, and started his car to make sure his wheels were curbed. ( meaning he turned the key, turned his wheels, turned car off.) Case was dismissed but he had to pay a ten dollar processing fee. Even that was robbery.

As soon as he said “you’re allowed to touch your phone” and “I didn’t see you use your phone any any way” she should have signed, went to court, and countersued. He just admitted that he observed no infraction or violation.
You can’t talk your way out of a ticket, but you might be able to get a cop into talking his case out the window.

He gave her the section and sub section it’s not up to the officer to lecture you on the law, his job is to enforce the law. His responsibility ends after he has told you what you’re being charged with, the onus is on the driver not the officer to understand the nuances of that specific charge in order to mount a defence in court. The officer is not your lawyer. What you’re describing is irrelevant semantics.

gingermystery no it's not lol....the ticket is worth a lot and bad for ur record (depending on job applications). take it to court, show up the first time plead not guilty (obviously), and that first hearing along with the other 50+ people costed over thousands of dollars (which our tax go to), second hearing they will mostly just drop the charges and send u to the DA's office where they will givebu a piece of paper saying if u violate again they will bring this xase up along with it as well, cuz the court is not gonna waste its time or money on a stupid piece of shit violation (especially in california), cuz they are more concerned about real crimes cuz even county jails are being used to hold people that are suppose to be in prison but the prisons are over flooded so they gotta do their time in county........so no it will not cost her 400$ to fight it, it will only cost her gas money and a 2 time visit to the court

Other wise the affirmative defense is easy. Ok, tell me in detail what mode my phone was in and how it wasn’t in hands free mode.

Actually if a cop wants to they can pull you over for "distracted driving" and the DMV classifies it under endangered driving because youre actions behind the wheel arent consistant with attentive driving. I narrowly escaped sr22 insurance bc I got 3 of these tickets bc the same damn cop sat in the same spot around the corner from my work for a month and kept pulling me over for having a water bottle that had a flip straw & he said I "took both hands off the wheel while vehicle is in motion", I "wasnt looking at the road" thats bc I used one hand&my cupholder to open it, and finally that I "was drinking and driving a non alcoholic drink from a large container and it obstructed my view" which seems exaggerated but also, technically against the law. And thats what the police operate off of in most cases, especially in terms of tickets, technicalities. I couldve walked to my car with the straw already open, spilling on myself, I couldve waited the 45min drive to have a drink, I couldve changed the cup but technically, Im an American citizen and its within my rights to chose, no? 😏

It is not against the law, the court of appeal ruling in 2012 would be understood to include turning it off after using it handsfree for conversing to be within the law. The ruling means it is only illegal to use the phone for conversing in the normal hands-on sense i.e. without headphones.
So signing it is not an admission of guilt but not signing it is an arrestable offence?

She's obviously lying. You don't even need to touch your phone. That's why they call it "hands-free"
That is in NO way the law. You are fully allowed to use your phone as a GPS or even a radio, or to hit the call button, etc. You just aren't allowed to hold it up to your ear while talking, or have it occupy one of your hands.
