cop - "There were about 5 driveways you could have pulled into." me - "Is a driveway an intersection? Because you said go to the next INTERSECTION and take a right. That's what I did."
Not to beat a dead horse but the deputy said there was a community he passed if there was then that's an intersection. Also, the driver was aware that the deputy reactivated his siren and air horn which requires the driver to stop. The deputy decided he wanted the driver to stop then and there not anywhere else. Also, did you notice the driver moving around in the car shuffling things which can imply he was moving a weapon or contraband within the vehicle. This kind of activity is not a joke and is very dangerous I don't understand why people continue to do that type of moving around in a vehicle that is involved in a traffic stop unless an officer asks to locate something such as registration, license, insurance card etc. I've already commented about other things so I won't repeat them again but I might suggest you take a look at what the Florida supreme Court ruled on as well as the United States supreme Court concerning traffic stops. Traffic stops are extremely dangerous and nothing to be played with you do that in court not on the side of the road. The driver of this vehicle under Florida law could have been arrested for resisting an officer and transported to central booking with his car being impounded. I'm not referring to not answering questions that he was not required to answer. If the driver presented his dash cam video during a hearing concerning this traffic stop it would be extremely incriminating. The deputy was extremely chilled out. Please take care.
Yeah but you have the right to remain silent so no he doesn't have to awnser anything he is asked the cop is infact making it harder by trying to ask him questions after he said he was going to remain silent
Undead Gengar The right to remain silent and the 5th amendment protects you from self incrimination. Asking if your address is current is not incriminating, therefore, not protected under the 5th.
Justin Little I guarantee that it is true. That’s why you can be arrested for failure to provide information upon request. (In WA the code is RCW 46.61.020, or federal code is 18 USC 111 for impeding an investigation) The 5th amendment protects against self incrimination. In order for it to be triggered, you need detention and incriminating questions. Even if you request a lawyer or say you don’t want to answer questions, police can still talk to you as long as it’s not about the offense. Not trying to argue, I just believe knowledge is power. People should know their rights, but when they think they know their rights and act like this, they just look stupid.

No other questions necessary. I can see why people get frustrated. When I was trained 50 yrs ago I was trained to protect and serve. Things are different today
silverback802 as a retired cop u should know that question like these will give u informations about his wellbeing (maybe he is on drugs or u smelled something) U don’t care about what he says it’s about how he says it...
This is why people are scared of cops, this is why everyone feels like cops are out for them and not to help, they hurt the United States more then anything. Also they break the law more then anyone.
Some things are just common courtesy, like answering some questions such as where are you going, where are you coming from, etc. I understand that he didn’t have to answer things like his phone number and if there is a firearm in the vehicle. I believe that the situation was handled fairly well until he received the citation and became extremely hostile. I think that people should still respect the authority of the police and respect them as a man/woman until they give a reason not to. If everyone involved just followed the law, and respected each other, this would be a way different country man.

Agreed, the Deputy got nit-picky about that for no reason. However, the detainee stated the Deputy was violating the law and he never did that. This guy was just being difficult on purpose. The deputy made the right decision to issue a notice of infraction. People like these need to be issued infractions, because he's clearly not amenable to the education process, and being ticketed protects the Deputy's initiation of the traffic stop when this guy inevitably complains.
Flip Wright cruise control doesn't stop a car from speeding upto 65 mph going down hill unless the drivers holding onto the brake. Doesn't mean that happened, nor that it didn't. Unless you have a transcript of that case or had been there, you wouldn't know the details either.
@@OGKenG yes, but in America no one calls a driveway an intersection. Only two drivable roads that meet are commonly considered an intersection. @@cowboy2006 WRONG...... Watts v. Under this conception of criminal procedure, any lawyer worth his salt will tell the suspect in no uncertain terms to make no statement to police under any circumstances." In this case, a defendant was subjected to rigorous interrogation methods, including being forced to sleep on the floor, resulting in a confession to having committed murder. The Supreme Court ruled that the confession was involuntary and reversed his conviction. Terry v Ohio 392 U.S. 1 "Of course, the person stopped is not obliged to answer, answers may not be compelled and refusal to answer furnishes no basis for an arrest, although it may alert the officer to the need for continued observation." “The Supreme Court has repeatedly held that refusal to answer law enforcement questions cannot form the basis of reasonable suspicion. cop - "There were about 5 driveways you could have pulled into."
me - "Is a driveway an intersection?
I think it's rude to pull into somebody's driveway, but the cops told the guy to do this. Why? Oh yeah, because he's a fucking prick cop.

@@danielvance18 absolutely not true sir. You have the right to remain silent and its that simple.
No other questions necessary. I can see why people get frustrated. When I was trained 50 yrs ago I was trained to protect and serve. Things are different today

In his defense, a driveway is not an intersection.

A driveway intersects with the road, doesn't it?
@@OGKenG yes, but in America no one calls a driveway an intersection. Only two drivable roads that meet are commonly considered an intersection.
If the driver had pulled into a driveway, then the cop could have easily asked, " I specifically did not say driveway, why didn't you pull up to the intersection?". If he wanted him to pull into the driveway, he should have said driveway.

Indiana, 338 U.S. 49 (1949), was a United States Supreme Court case in which Justice Robert Jackson famously opined, "To bring in a lawyer means a real peril to solution of the crime because, under our adversary system, he deems that his sole duty is to protect his client-guilty or innocent-and that, in such a capacity, he owes no duty whatever to help society solve its crime problem. Under this conception of criminal procedure, any lawyer worth his salt will tell the suspect in no uncertain terms to make no statement to police under any circumstances."
In this case, a defendant was subjected to rigorous interrogation methods, including being forced to sleep on the floor, resulting in a confession to having committed murder. The Supreme Court ruled that the confession was involuntary and reversed his conviction.

"Of course, the person stopped is not obliged to answer, answers may not be compelled and refusal to answer furnishes no basis for an arrest, although it may alert the officer to the need for continued observation."

He did that just because he wanted to be above the law and get pulled over for stupid illegal acts.
lol
@@reececod3191 thank you someone knows how to respect the officers
Pay close attention 3:53 he asked for a 94, if that is police code which I believe it is that means "Illegal use of weapon" If I understood correctly that is insane.
It's part of a code for requesting routine personal backup which is actually 10-94. He just shortened it which is normal. I listened to it and I heard the 10 although as I said shortening it is not unusual.
Bro you are denser than a neutron star filled with osmium. You do realize police codes vary in different departments for this very reason. 10-94 means back up in this department.
@@kurt9994 thank you for not being a douche bag like kriskit and being mature in your response. Much thanks for the clarification.

Not yours thoo🤣🤣
@@dchoney9435 absolutely no life at all
And what does that say about you if you watch videos made by a guy with no life. Should read your comments out loud before you post.
Lev It was a question not a comparison. What Im saying now is the comment you made was asinine and It makes you look ignorant or unaware to the fact that your life must not be too exciting either if you’re are taking your time to watch a guy who you say has no life.
He likes comments that are made on his own videos ( you’re supposed to interact with your fans and/or people watching your channel no matter when you made the video ) that’s part of being on RUclips and the fact that I had to break all that down to you makes me believe you’re some lil kid and I just wasted a day of my life giving you knowledge that you’ll prolly never receive, but you welcome anyway
I’m going to try this...wait I’m black

Don’t do it.
You'll be fine just don't throw a fucking hissy fit as is so common
