    The rider is under no obligation to help the officers with their investigation, and he doesn’t have to answer any questions. If it were me, I’d give them my license and registration (this is not a traffic stop, i.e. the rider is not suspected of any violation, so that may not be required), and that would be IT.

    The way I see this is 1) You dont have to pull over and do what the law says which is kind of cool in a way as its all about freedom... but 2) who the fuck cares about having to do a quick DUI stop?? They're keeping drunk drivers off the road. Your actions show that you are against the prevention of drink drivers... What matters more: 5 minutes of your time, or preventing road accidents? You should thank the officers for the job they're doing, they're helping you to stay safe! Especially on a motor bike. If it the DUI checks were forced on you brutally than fuck yeah fuck the police but these guys were friendly

      I don't see where the driver indicated a thing about caring if it was there.

      Opinion. I see that his actions show that the driver is willing to follow the law.

      Declining to answer questions here is legal. I don't see a correlation to doing something legal causes road accidents, unless you want the play the what-if game.

I've come to realise that they could actually still check for drunk drivers even if they decline questions.     Those of you calling the biker various names should consider that it is possible the true answer to the question of whether he has recently had a drink might be 'yes'. Doesn't mean he's DUI, but he is not obliged to give the cops that info, and he'd be a fool if he did. But he'd be just as big a fool to lie and say no, because it's possible he was observed by other officers exiting a bar. The best policy is to exercise his right to remain silent, and not assist the cops in their fishing expedition.

    Could things have gone faster if he answered, sure. But can't he check how the cops behave when a person uses their rights at the same time they do their checkpoint?
    The argument that "if you don't have anything to hide, why hide things" is stupid. Your rights are yours to exercise as is, your privacy is your responsibility to try to maintain.

    To anyone who thinks this guy should’ve just said no, you’re wrong. First off, whether this questioning is legal is questionable because there is no probable cause or even reasonable suspicion that he’s drunk. Second, when police are trying to talk to you about a crime, nothing you say can help you. Third, if he said no, the police could have continued to ask more questions, and anything you say during questioning can and will be used against you. Even innocent people will inevitably say something incriminating during questioning. Lastly, remaining silent does not make you look guilty. Doing so cannot be used against you and for the reasons above is the best course of action even if you’re innocent.
    The douchebags in this video are the cops who are trying to convince people to waive their rights.

    Idk who actually is a certified law enforcement officer here but I am. We don't do these in the city I work in. The city council tried to make us do it once because we have a lot of drunk soldiers driving around but our chief refused. It is illegal. If I don't have a reason to stop you then I can't LEGALLY stop you. I can't just assume everybody is driving drunk and start demanding licenses and vehicle information unless I have probable cause. The majority of the time its the political figureheads who order this kind of stuff to fill their pockets with your money and it makes us look corrupt. For some reason everyone just refuses to question stuff. I've been told my whole career to stop questioning stuff and just follow orders. I just go full 6 year old and ask why a hundred times. Lol. It took a very long time to make Sergeant.

    I get the feeling that certain law enforcement agencies are specifically taught how to violate Constitutional Rights.

    1. Us citizens have constitutional rights.
    2. DUI checkpoints are unconstitutional and inefficient (in what they should do, catch drunk drivers), they're purpose is "fishing".
    3. Public servants are not your friends, they're trained to make you believe they are.
    4. Everything you say (even the most innocent things and simple answers) can lead to truly awful stuff.

Why should you care?” They don’t think about the origin of that quote, which is a piece of Nazi propaganda from Joseph Goebbles. Privacy is the foundation of all other rights. Arguing that you don’t care about privacy because you have nothing to hide is no different than saying you don’t care about free speech, because you have nothing to say.
    It would behoove us all to be weary of the phrase, “the innocent have nothing to fear.” For the innocent have everything to fear, an mostly from the guilty. But in the long term even more from those who say things like, “the innocent have nothing to fear.”

      Honestly, catching drunk drivers is a good thing. But so is standing up for your rights. If they took a drunk or two off the road it probably saved taxpayers over the cost of an investigation into a deadly car crash. Based on when this was posted it was probably 4th of July weekend.

    My parents were almost killed by being hit by a drunk driver. America has a serious drinking and driving problem. However, I also don’t believe in checkpoints either as this runs constitutionally thin on people being able to freely travel without probable cause being utilized justly (no weaving, slow/fast driving, no impairment shown, etc).
    I truly think officer resources are better used looking for drunks where they are usually found and displaying bad behavior. All DUI checkpoints do is waste people’s time, gets them upset and makes departments look bad in the public eye. I appreciate what all law enforcement do to protect the public but DUI checkpoints are not a wise idea for the public good. It comes across as a fascist style of law enforcement.

    This is exactly how to handle this type of stop. A citizen has a right not to answer questions. The police know this very well. They had no indication he was impaired and cannot simply demand answers. The driver was polite but firm. He asked if they ordered him and then complied. The reason to ask if it is an order is that later their commands can be challenged in court if arrested. The conduct of the police may not be legal but don’t fight it at the side of the road. He did very well and remained polite at all times.

      What a pile of meaningless garbage. In my entire lifetime I have followed the rule of being polite, respectful and cooperative with the police.
      I have NEVER had a problem, but then again I have never had anything in my car that would cause a problem.
      On the few occasions I have been stopped, it has been for something like speeding and the best thing to do is to ADMIT IT, any arguing gets you NOWHERE. don’t forget that you are not the only JERK that police officers have to deal with.
      I can only imagine my own attitude if I had to deal with smart mouthed idiots like you EVERY day.
      Police officers are only human and not saints, treating them with respect and being HONEST IS THE SMART THING TO DO.

They were there to remove drunk drivers from the road thats why the majority of people were sent on their way because a majority of the people were sober.     A lot of people here licking the boot. I can only assume they think that police officers are naturally good people. And most of them are! But, as the saying goes, a few bad apples spoil the bunch. Here we see a classic bad apple situation.
    A man, who has literally done nothing wrong, is stopped by police. That already should not happen. The police do not have the ability to just pull you over whenever they want. They need to be able to articulate exactly why, otherwise it's an illegal stop.
    Next, the officer punishes this man for not providing documents. Being secure in your papers is your 4th amendment right. The officer has no reasonable suspicion that this cyclist has committed any crime, and as such has no right to ask for an ID or driver's license.
    Finally, the officer clearly does not understand the 5th amendment. Our cyclist here cannot be forced or compelled to speak to an officer. Even if he has committed a crime, even if he had performed a traffic violation, he does not need to answer or respond to the officer in any way.
    This man was unlawfully detained and unlawfully searched. These police officers committed crimes. Now, sure, they probably did it for a good reason. They probably did it to make sure no drunk drivers were on the roads. But it's still a crime, and good intentions don't make good excuses for committing crimes.

      If he is driving a vehicle police can legally ask for a drivers license. How can you go on such a rant and not know this? Driving a vehicle is not a right. If he is just walking down the street and a cop asks to see ID for no reason then you would have a case. The motorcyclist was an asshole but at least he knew this - you don't.

      However, police do not have the ability to pull you over for no reason. When an officer asks you to identify during a traffic stop, they're doing so because a traffic violation is a crime. This man committed no crime, nor did he do anything that would initiate a traffic stop. As such, he should not have been stopped and detained, and they had no right to ask for his driver's license.
      I'm not a sovereign citizen talking about how road pirates just stole his soul or whatever. Cool your jets, and maybe learn the law and your own rights a bit.

    The sergeant says he is sorry to inconvenience the driver. But of course he isn’t sorry. Which illustrates a characteristic of American cops: They are habitual liars and will do so even when they gain no benefit from the lie and when the lie is trivial to detect. Both apply here.
    It clearly is insincere to claim to be sorry for the brief detainment when it is being repeated 100s of times an hour at this one check point.

    What everyone is missing, is that the ruling in Miranda v Arizona was that the police must advise you that you do not have to answer questions, before they start asking any questions! So any questions at a DUI check point, must be prefixed by a warning that any thing you say may be used against you, before asking you if you have had a drink!
    The Court held that “there can be no doubt that the Fifth Amendment privilege is available outside of criminal court proceedings and serves to protect persons in all settings in which their freedom of action is curtailed in any significant way from being compelled to incriminate themselves.” As such, “the prosecution may not use statements, whether exculpatory or inculpatory, stemming from custodial interrogation of the defendant unless it demonstrates the use of procedural safeguards effective to secure the privilege against self-incrimination. By custodial interrogation, we mean questioning initiated by law enforcement officers after a person has been taken into custody or otherwise deprived of his freedom of action in any significant way.”
    Moreover in Robbins v City of Des Moines, the Justices ruled that a detainment is a arrest, if you are unable to freely leave!
    There is a misunderstanding by the Cops that this only applies to a person who has been arrested for criminal offence, that is not true!

      It was 4th of July weekend (check the upload date) so I'm glad they had such a checkpoint. But this guy handled himself and stood up for his rights well. And the cops were able to see he was sober so in a way it was a win-win.

    Why would you talk to someone who has the legal right to lie to you and records your words to use against you?
    In the jurisdiction in which I live the statistics show that regular patrols catch DUI drivers at a rate 4x higher than check stops. What a waste of resources, 4-8 officers at one location. But we think the real reason is to slowly turn us into a "Papers, please!" society.
    All we need to do to stop this is everybody exercising their right to remain silent. But it's far easier to simply comply.

The cops don't have the "BLANK CHECK" right to do a DRAGNET search & survey of the citizenry. They wanted him to raise his visor so they could smell his breath and look at his eyes. That's illegal search & survey. They didn't have probable cause or any legal reason to pull him over. He wasn't speeding, he didn't have any malfunctioning lights. Listen, people.       Nope. They usually lie but when someone is inebriated from alcohol their will be physical indicators present.
      Alcohol has a strong odor, the person may slur their words or their eyes will appear glassy.
      The person may also have a difficult time keeping their balance or following basic instructions.

      The plain language is very clear. A driver "shall display the [operator's license] upon demand of any police officer ..."
      Any other time a cop must have reasonable articulateable suspicion (RAS) you have committed a crime or about to commit a crime to ask for your ID.

    The cop asked the U.S citizen if he had anything to drink today. The biker should ask the cop if he brushed his teeth today and showered. Stopping anybody who has not broken the law is illegal. Cops are law enforcement officers and can only enforce the laws. If you did not break a law then the cops can not detain you and interrogate you.

    Without probable cause, these detentions are illegal. You have the right to travel unmolested. As soon as he said he didn’t answer questions, the next response should have been “you are free to go.” Because that is so foreign to the people in the comments, it’s easier to vilify the guy riding the bike. He didn’t do anything wrong.

    This is how you respectfully assert your rights as there is no reasonable suspicion to believe the person in the video had been drinking at the time. There are lots of videos like this out there and a good majority of them consist of the civilian actually being a dick, raising their voice, having a rude tone, etc. There were a couple times the person in the video asked "is that an order" and when the cop said "yes" he obliged and obeyed the order. Most of the videos like this one that I've seen, the person being detained is being belligerent, rude and condescending and almost every single time it leads to an unnecessary confrontation. This incident did not lead to a confrontation, the biker was able to leave not 5 mins after being detained unmolested. If your goal is to assert your rights, be respectful but stern. If the situation escalates, let it be because the cop was the one who escalated it, not you. As others have pointed out, it is reasonable to believe that maybe these cops didn't know or realize these checkpoints are unconstitutional. Educating them of that by respectfully asserting your rights is also reasonable. If the cops in the video did know these checkpoints are unconstitutional but participated in them anyway, shame on them!
    To all those who don't like this video, how do you feel about how the police are treating the Freedom Convoy Protesters in Ottawa right now? Should they just lay down and lick the boots of the cops and obey their orders without question? I have a feeling that you will more than likely have a different impression of the Freedom Convoy protesters than you would this guy when BOTH are asserting their rights.

      You comply and provide them with ID; and politely say when asked a question, "I don't answer questions" or "any statement I make I want my lawyer present." If yojndontnsat anything, they would have to arrest you based on what they witnessed or someone else witnessed. But you didn't incriminate yourself. Very important.
      See police are trying to figure out if they are going to arrest you. Once they put you in custody, you get Mirandized. Any incriminating statements you make before the Miranda warning are certainly admissible if relevant.

    Why is it that so many are willing to give up their Constitutional rights? Just because you are willing to give up your rights in the name of a supposed "safety", does not mean I have to give up my rights. It has nothing to do with supporting drunk driving, being difficult, or any other rediculous accusations that will be brought up. I don't drink alcohol or take drugs and I hope that anyone operating a vehicle in such a manner is stopped and does suffer the consequences of such actions. It is a matter of government over reach and loss of Constitutional rights. It's that simple, stop taking the easy way out and giving up your rights in the name of safety. Look up a wise old bird named Benjamin Franklin and see what he has to say about it. The founding fathers knew a thing or two about this very issue.

      My guess is that the founding fathers had something this guy didn't. They had respect and decency. Wasn't it Abraham Lincoln that rebuilt the south after the civil war? George Washington that stood for the middle class? John Adams that made sure the Constitution was established and respected? The list is endless of how much respect was shown by the founding fathers and the men that came after. The problem is these days you have a group of self important and self entitled people who think they have the right to be what they want and act accordingly.

The fact that the Supreme Court has ruled that this kind of stop by law enforcement is legal does not mean that you have not lost your Constitutional rights. The Supreme Court has ruled many times on issues in the past in which the rulings have gone directly against the Constitution. Many of the rulings have been overturned at a later time and many are still in practice today. I'll just throw out a few to make my point : Dred Scott vs Sanford in which black people, slave or free, were not intended to be citizens and had no rights.
      Buck vs Bell in which forced sterilization could legally by performed on persons of intellectual disabilities for the "protection and health of the state", Justice Oliver Wendell Holmes.
      Korematsu vs United States where Japanese Americans were forced into internment camps during WW2 without being charged with any crimes solely on the fears of espionage and the thought that they may support Japan over their home country of the United States.
      Plessy vs Ferguson that basically went against the 14th amendment and allowed all kinds of laws based on race, better known as Jim Crow laws, that took Constitutional rights away from citizens.
      Let's look at laws closer to modern times: Smith vs Maryland that allows government to have access to you private information without your consent that violates the 4th amendment.
      Harlow vs Fitzgerald, aka qualified immunity, in which the Supreme Court decided on its own to shield government from being held accountable for violating your rights no matter how bad the behavior. Amazingly enough, no such law was crated by Congress. The Supreme Court has no legal ability under the Constitution to conjure up such things or to make law. This violation of the Constitution is still going strong and is the subject of lawsuits and debate to this day.
      Bennis vs Michigan, aka civil asset forfeit. The government can seize and keep you property by mearly claiming that they suspect you of a crime. No proof needed, no charges filed, and no conviction of a crime required. A violation of the 5th amendment.
      Kelo vs City of New London, another violation of the 5th amendment that greatly changed and perverted eminent domain.
      I'll wrap this up by saying that just because the Supreme Court has ruled on something, does not mean that they have not directly ruled against Constitutional rights. Trying to reverse those rulings is extremely difficult and few politicians want or dare to call the Supreme Court to task and to fix these rulings. Many politicians, governments, and law enforcement agencies greatly benefit from these unconstitutional rulings. So Mr Go Brandon, you can claim that these DUI check points have been ruled legal by the Supreme Court, but that does not mean that your Constitutional rights aren't being violated. I have done my research and provided multiple examples of such violations throughout history and I will add that there are more if you care to do some research yourself. I will also add that I do support law enforcement when it is followed within the confines of the Constitution, but that seems to be something that is less and less these days. I would also hope that you would fight for your rights, otherwise you will loose those rights and have to live with the consequences. I would hope that you would research the founding fathers and understand why the Constitution and the Bill of rights was created and why the additional Constitutional amendments were written. Next time, leave the name calling out, it's beneath you and takes away from an intelligent conversation and exchange of ideas.
