It's unusual for a grown man to video an installation in the middle of the day. Maybe he's a burglar, maybe he's a terrorist, maybe he's a stalker. The female P.C.said the photographer "matched the description" of a man who had been seen walking around in a balaclava........NOT doing anything unlawful, just taking pictures. So he was detained for matching the description of a man behaving lawfully. This is truly outrageous behaviour by the police involved. PLEASE sue them for this CLEARLY unlawful;l use of Section 1 (PACE). To invoke this Section, a Constable has to have "reasonable grounds for suspecting that he will find stolen or prohibited articles" - Her ONLY 'grounds' were that he was taking photos and was wearing a 'balaclava' - both of which are entirely Lawful, and which it is extremely unlikely a Judge would consider as "reasonable grounds". This appears a very straightforward win if taken to court.

Kev - If the cops retained the height restrictions you mention initially - they wouldn't need the fancy handcuffs, metal batons, tasers, pepper sprays, CS sprays, body armour, etc. ......In the Dixon of Dock Green days, with the height requirements, and the women cops dealing with lost children, etc the men patrolled with only a wooden club about 15" long. It's unusual for a grown man to video an installation in the middle of the day. Maybe he's a burglar, maybe he's a terrorist, maybe he's a stalker. The police are not to know until they interview him. Having wasted their time, I'm not surprised that they chose to cuff him while carrying out a search.

What needs to happen is.. Make the cops personally accountable for their actions and responsible for the settlements and costs from their own salaries, savings, assets or pension fund.
Then watch their attitudes change.

The female P.C.said the photographer "matched the description" of a man who had been seen walking around in a balaclava........NOT doing anything unlawful, just taking pictures. So he was detained for matching the description of a man behaving lawfully. This is truly outrageous behaviour by the police involved. PLEASE sue them for this CLEARLY unlawful;l use of Section 1 (PACE). To invoke this Section, a Constable has to have "reasonable grounds for suspecting that he will find stolen or prohibited articles" - Her ONLY 'grounds' were that he was taking photos and was wearing a 'balaclava' - both of which are entirely Lawful, and which it is extremely unlikely a Judge would consider as "reasonable grounds". This appears a very straightforward win if taken to court.

Kev - If the cops retained the height restrictions you mention initially - they wouldn't need the fancy handcuffs, metal batons, tasers, pepper sprays, CS sprays, body armour, etc. ......In the Dixon of Dock Green days, with the height requirements, and the women cops dealing with lost children, etc the men patrolled with only a wooden club about 15" long. None of the stuff I mention was needed. So much for "progress"!
