      The harsh reality is that many Black South Africans find it difficult to accept the truth. It sounds harsh, but when he mentioned coming to South Africa to sell drugs, it's evident that we must acknowledge our role in allowing these issues to persist within our country. If South African police and authorities performed their duties effectively, unjust accusations towards foreigners would diminish. Likewise, if South African parents adequately educate their children, there would be fewer kids engaging with drugs. It's essential to take responsibility and address these underlying issues so they can be thoroughly resolved. We are one Africa, and we need to unite in our efforts to combat crime and any harmful activities that threaten our communities and children

    Imagine standing in street corners selling powder for ten years, then turn around and say I now deserve citizenship.
    The constitution should be read in the context of its spirit and not just the words (letter), meaning that when it was crafted what was the intent and what was envisaged and what was happening at the time, and what are the unintended consequences. The courts should then eliminate unintended consequences in their judgements.
    There’s something wrong with our judges, if we see this and their learned selves don’t.

    They need to reinstate the regulations Malusi Gigaba had put in place when he was the minister. They were meant to protect South African women and children, but they were removed after he stopped being minister there.
    The most import one was that foreigners had to return to their countries to apply for marriage visas at the SA embassy in their own country, if they married South Africans, and even if they found jobs in South Africa they needed to apply for the work permit in their home country… it was a major deterrent.

    I'm aware of Mauritius, Portugual does the same by offering citizenship if you have a certain millions and opening business.
    I hope South Africa Home Affairs will not offer the Nigerian or any African foreigners after 5 years of marriage when they divorce their South African women. Some they decide to remain in the country, but will bring their Nigerian woman to South Africa to enjoy the citizenship the husband would have acquired by using a South African woman.

    It's time we get rid of these 5 years threshold across the board and increased it to 10 years. If they decide to go to another country, they should be stripped off of their SA citizenship, period, we cannot be taken advantage of like that.

So, try and not be so judgemental of an African party that has done so well for it's people despite all attacks. This is my suggestion
    The country should have a grading system for migrants. Not all countries behave well. So countries like Botswana and eSwatini should have free border crossing while lower rated countries with a history of bad behavior should be banned from any type of citizenship or residency or even banned from traveling to this country.

    I agree with you on women married to the foreign husbands, think kids must be allowed to become SA citizens but husband can only be SA citizen if he meets the naturalisation terms contributing productively in SA through scarce skills or is a tax paying business owner of X amount tax being collected in last 3 years eg ZAR 1mil tax paid per annum, which employs SAns or is an investor. Also I’d make the citizenship through marriage to be discretionary and be investigated with interviews if family in both sides, children, employers, neighbours, friends etc to prove validity of marriage and it must have a minimum of 7-10years of marriage living together in 1 household in SA before applying
    Please also the investment amount needs to be higher amount eg 400k USD vs 250k USD as that’s easy money to get for drug dealers and it must start at permanent resident and not automatic citizenship for investor citizenship route

    CD.. this question is directed to you and all who have insight. All this judges against the immigration laws of South Africa.. who is holding them accountable ? - and if they blunder are their decisions revoked and they themselves castigated for wasting tax payers money or do they just get off ? This judges seem to always be on the chaotic and corruption side in SA. Who are this judges and who do they account to ?

    • @OasisSilvaMillion
      @OasisSilvaMillion Месяц назад

      I don't think Judges are to blame. Judges are doing their job which is to interpret the law, how it was written when passed by Parliament is how the law is interpreted. If there is to be any meaningful change, it first has to come from the legislature via ammendments. Judges can't change laws. It's not corruption at all. The law is just being interpreted. The ones failing us are legislators who draft laws with having South africans in the hindsight.

    • @desmondqoza123
      @desmondqoza123 Месяц назад

      @@OasisSilvaMillion So the law says " South Africa is for all who live in it " then this judges assume that everybody including foreigners. So we must interpret that this law means only South Africans - whites, coloureds, indians and blacks not foreigners

    • @OasisSilvaMillion
      @OasisSilvaMillion Месяц назад

      @desmondqoza123 The law doesn't necessarily state that. Laws on immigration and refugees come into play, the duration of the individuals stay in the country, marital status to a South African and so forth. This case is different with illegal foreigners. But the law allows for a certain degree of "protection" to immigrants and refugees or asylum seekers. As I said the judges can't do anything but interpret the law. If the law had said we should allow all illegal foreigners in the country then the courts would interpret the law in that way. The only way to have meaningful change in the discourse of law is to take it via the legislature, as the new minister is doing. Fighting it in court is meaningless. The Constitution is the highest law in the country so it becomes very tedious Fighting in the courts instead of taking it to parliament for a referendum or amendment to a law
