If today’s judges were still patriotic, they would go back to what problem was being addressed when they wrote birthright into the constitution. It was the same as in South Africa, addressing an injustice and the subjects were black South Africans, just like in the US it was to give citizenship to black Americans. My Legal 101 course at UKZN taught us that judges are supposed to also consider the spirit of the law, not just the letter. The spirit is what I have mentioned above, and is the reason our judges are very wring when they keep finding in favour of illegal non-South Africans on things that are meant for citizens.

What I've learnt from Boston Legal is that the best way to change a law for the country is to take it to the Supreme court of appeals. Maybe that's also Donald's strategy. Remember, in the US each state is independent and is not bound by the decisions of a court from another state, so THIS IS A WIN FOR DONALD. He's going to the Supreme court.
