As Mr. Spock once remarked “sauce for the goose”. I don’t know about the EU but in the US we have had antitrust laws for at least 100 years. Companies like AT&T and IBM were forced to open their platforms to their competitors. Companies like Apple and Microsoft benefitted from that. It is fine to hold a position against all antitrust laws and actions but not to apply the same laws only to some companies and let others get a free pass.

    • @neobow1
      @neobow1 8 месяцев назад +24

The problem lies in the potential consequences of allowing side loading on the number 1 phone in the U.S. When this happens, it opens the door for companies whose primary business model revolves around tracking and monetizing user data, such as Meta and Google. They can circumvent the App Store, which is known for its stringent privacy regulations enforced by Apple.
A notable example is when Apple implemented changes that required apps to request user consent for tracking, resulting in a significant blow to Meta's stock. Meta, like other data-centric companies, would go to great lengths to avoid such privacy restrictions.
The concern here is that we may end up with a situation similar to a cluttered Windows gaming PC, where different game launchers like EA, Epic Games, Riot Games, Blizzard, and more are scattered all over. This could lead to a fragmented and less secure user experience on our smartphones, which is far from ideal.

Sideloading can be a good thing! Emulators have been banned on the platform and those can make their debut. It’s also great for Open Source apps too! There could be a collection of FLOSS apps finally available too! Plus it’ll be disabled by default anyhow so Sideloading is no big deal for those that don’t want it. I’d love to see some good Music players for those that want to use MP3s without iTunes.
EDIT: Yes, Sideloading can be dangerous, and I'm sure Apple will have pop-up warnings that attempt to dissuade users from enabling it. These users may heed the warnings and back down. The rest of us will use Common sense and avoid "modded" versions of proprietary Apps.

What's weird is that if you look back, Apple implemented (and helped develop) USB-C fairly early, but for some reason they expected everyone to continue to use USB 2.0 speed Lightning cables. Even the iPad got USB-C 5 years ago!! It sure was nice when even if I didn't have a phone charger handy I could just plug in my iPad charger instead. They deleted the headphone jack. They have been anti right to repair. They refuse to implement RCS (rather than switching to SMS) when Apple users text anyone other than Apple users. Tim Cook snarkily told someone to buy their grandmother an iPhone.
Surely if user security was a top priority they would be concerned about their users texting the majority of the world without iPhones. I applaud their refusal to break encryption for any government, or share private user data, but they left this huge vulnerability in place.
The point I'm trying to make is they have given their haters SO much ammunition. They failed to think tactically and now it's coming back to bite them. I do not support what the EU is trying to do, even though I was glad to see USB-C in the iPhone a reality.

It hadn't started in 2021 by EU mandate. It was the voluntary agreement in 2009 that "standardized" USB connectors in phones (first micro-USB, then USB-C). Almost all adopted it, but Apple. That is why it is just Apple that needs to change now; that is why it had to be a mandate. The rest of the market adopted standard USB connectors a way ago.
There is a major flaw in the USB-C line in this video. Apple hasn't been the only one targeted by this regulation, and it didn't start in 2021. The idea is way older than that.
Do you remember the time before the iPhone? Phone manufacturers like Nokia, Ericson, Siemens, Motorola, and so on all had their own charging/data ports. In 2009, the biggest mobile phone producers of that time made an agreement with the EU to use a common charging port, the micro-USB. Since around 2011, most of the market has adopted standard micro-USB connectors. No hard regulation, no enforcement. Almost all but Apple ...
Instead, Apple came with the Lightning. Basically, the proprietary two-sided USB 2.0 with added accessory identification and licensed by Apple. Technically, there is almost no benefit to the user over micro-USB (apart from the two-sided design). However, there is a huge benefit for Apple - license fees and a higher price tag. Anti-customer behaviour in my book. Also, it was a bit funny to hear from Apple that the USB-C mandate would hold innovation when they are the ones still using USB 2.0 (in their connector).
As for the sideloading, it is just an option. If you want to sideload, you will be able to do so in a few clicks. Android does have sideloading, but it doesn't mean that most users use it. We will see how it will go - the EU doesn't like to get screwed, and this halfway compliance usually ends up with fines.

There is no reason why they shouldn't allow sideloading apps for enthusiasts who might want that. In fact, they could become a viable option for many users, for who, not beeing able to side load is allready a dealbreaker, by doing that. Some nerds want to programm their verry own apps just for themselfes, so why stop them from doing that?
For everyone else, the feature could be disabled by default. They could even say that you lose the security promises and what else is unique to their ecosystem, software wise, if you activate the feature.

It's OK for you when it's for something you want or against a company you dislike, but when those governments come after something you care about. Also, regarding Apple's walled garden: if you dislike walled gardens, just go with Android. The EU have no business demanding Apple change their principles.

Great video. While I understand (and partially agree with) your point, I think that the option of sideloading applications would be great for some users. Perhaps the best implementation that would satisfy most users is if it were disabled by default with an option in Settings to enable it after going through a security warning prompt.
I don't think this would strip Apple of its "Appleness"; Mac OS has allowed the installation of non-App Store programs for years. This definitely is a pro-consumer move, and it's not like the EU would target Apple simply out of spite: rather, some of the actions Apple takes are simply anti-consumer. As someone who has owned Apple products for over a decade, I believe that this change as well as a possible integration with RCS-if handled correctly-would result in a better user experience.
In my opinion, the proposed changes seem perfectly reasonable. Having said that, I believe that there is a fine line between beneficial government regulation and overreach. While I support the EU's current legislation regarding Apple, if future mandates cross the line from pro-consumer regulation into the territory of unreasonable overreach, I hope Apple puts its foot down and refuses to comply.

That means no repair shop can switch the glass plate without Apple approval. They act like they own the iPhones, but the owner is the consumer. Apple will also force ALL smartphone manufacturers to make batteries easily replaceable by the consumer. Apple days that would harm protection against water, but that is a lie. A great video excluding the part where FPT complained that Apple actually gave in to using a better port and how companies can actually be answerable to government oversight.
Look, I agree that the recent EU consideration to simply tell Apple to open up its platform for 3rd party apps is straying from the actually good pro-repair laws and I get that this is the main point of the video. But to liken the USB-C port to something as nefarious as the beginning of the "giving a mouse a cookie" is stupid when it is, in every way, superior to the lightning port it replaced. Heck, Apple contributed to most of the engineering prowess behind USB-C. And 9:10-10:00 just sounds like every company when its trying to defend questionable practices - "Oh, this is how we work, why do we have to answer to laws?"
EDIT: After having done some reading on the Digital Markets Act, I think FTP actually has less points going for him than before I did the reading. DMA applies equally to all big tech companies, includes clauses that prevent monetisation of data and uphold privacy (which is FTP and Apple's main complaint), and does some pretty important work in making sure bigger companies can't just toss start-ups off the technology train before they even get a good grip. It seems to me that FTP has just bought into Apple's eternal claims of superior privacy, although I may be reading DMA wrong.

I do agree with your message that a line must be drawn for governments abusing their power in this case. But saying side-loading is not pro-consumer is quite a reach. You want them to show you how side-loading is beneficial but you don't really say how no-side loading is beneficial other than saying you don't want an android like experience (which it doesn't have to be). No side loading just let's apple control and baby you on how to use a smartphone, virtually taking away your freedom of making your own decisions when you want to explore other options. Imagine buying a car, but it's designed to only take gas from Shell, I doubt anyone would appreciate buying from Shell when other gas stations may be cheaper. You haven't mentioned Macbooks which allows side-loading just like windows, if control top to down is what makes apple products great, why would they allow side-loading on a Macbook. I would wager you downloaded something from Safari rather than from the app store, according to your ideology you would prefer it if apple took away that option and only allowed you to download how they see fit. What if you need a driver to be installed? What if the app you need is not on the app store? I just don't see how not having freedom of something you purchase and own is better for you.

Just by having the option to sideload doesn't mean you have to. This can also be beneficial for users looking to get more out of their phone, for example, if someone wanted to install an emulator and play classic games such as Gameboy games on their phone, they'd have the option to do so. This can actually be beneficial to smart users, so I think it's unfair to assume that this would be bad for everyone, and it may even help some people become more tech savvy by introducing options that weren't previously available on their phone. Don't blame the phone for getting a virus: blame the user for downloading it. Who knows it may even teach some people accountability. I also think that this won't impact people that won't want it to, for example, android gives you the option to sideload, but it gives you a warning message before downloading something off that internet, so if a user doesn't feel comfortable with the download, they can decline the download. This does not force the user into downloading unwanted/malicious content onto their phone, but rather opens up the platform for those that feel restricted by it.

I love your videos Jon and I’m a big fan of Apple, but this time I have to say that I don’t agree with you and I believe you leave out too much relevant information.
You make it look like the EU wants to take Apple down with rules, regulations and restrictions. Apple has indeed always been a stubborn company and was the only tech company that refused to switch all of their products to USB-c (even though they did want to switch some products to USB-c for some reason, because otherwise the product wasn’t ‘Pro’ enough?).
The EU simply wants to prevent companies like Apple from having too much of a monopoly when it comes to things like App Store. Other companies and developers can hardly compete with Apple, because Apple decides everything inside the App store and therefore also inside the iPhone. Since billions of people are using iPhones these days, developers and companies simply have to comply and accept Apple’s condition and overpowering market position.
As for USB-c, a lot of consumers and tech-enthusiasts showed excitement when the rumours starting floating around that Apple would switch to USB-c, even you, so don’t act like you never wanted this. USB-c and opening up to third party app stores are needed to save the environment, create more convenience for the consumer and create healthy competition to the big tech companies which also always benefits the consumer.
Don’t interpret this message badly, please. I like your videos and will continue to do so, but I just wanted to share my thoughts and concerns on this video. Keep up the good work Jon!

I don't think Apple's hardware and software ecosystem being opened up is a bad thing. In fact, open sourced technology tends to outperform closed source tech.
This will ultimately play into apple's favour as time goes on, especially on the software side of things seen as how Apple doesn't manufacture 1 billion variants of the iPhone every year unlike say, Samsung or Huawei.
Android for the longest of times was clearly the superior OS for mobile devices, this was due to users being able to flash custom rom's and tweak the source code of the OS directly. This led to a proliferation of bustling online communities dedicated to producing the best and most feature-packed android distribution for a particular device and group of devices out there. The OEM's then caught up to what the custom rom guys were doing and started to implement some of those tweaks and features into their own standard android distribution. Look at how Samsung's One UI has become so great, it literally took features that many custom rommers were creating and coming up with and implemented them into the base phone's system. As such, nowadays on android, one doesn't need to even install a custom from due to the whole thing being open source and a 2 way street between users and OEM's.
Apple in recent years has gone on to increase the customizability of iOS, one could say these were things seen on jailbroken iPhones finally being implemented but nonetheless the OS is developing and can be seen to be on par with android. If it does get opened up we could see stores like Cydia and all make their way onto being officially supported in so far as one can install them without needing to jailbreak or do any funny things to their device. This is going to be good for the user.

I don’t see how the option of downloading programs outside of Apple’s is a bad thing, considering as you say, most people aren’t going to take advantage of that feature to begin with. Genuine iOS on budget devices with native side-loading is exactly what everyone has been asking for from Apple for over a decade, but now everybody’s jumping ship just because a larger entity than Apple is the one trying to make it happen. This is literally everything people were asking Apple to do just a few years ago. The literal reason actual fans that are tech oriented jailbreak their devices. Official side-loading will change the game and make so many android users (like myself) make the switch. It’ll probably be off by default like android and be just as secure as now with the 3rd party install setting off. I use an iPad for music production and the OS is amazing feeling. If I could natively side-load without using a developer account, it would be the best OS both in look and feel, and in its customization and expandability. And I’ve personally been saying for years that if we had 3rd party phones “powered by iOS” along with the iPhone it would be an insane increase in their profits. Just like how there’s the Google Pixel and then 3rd party phones “powered by android” which Google owns. It would be a huge win. Genuine iOS on genuine budget devices with native side-loading is exactly what everyone has been asking for from Apple for over a decade, but now everybody’s jumping ship just because a larger entity than Apple is the one trying to make it happen.

I'm an apple user all round, but I want to be able to install apps without having to worry about losing a wifi connection (or not being home) when trying to refresh an app over the network or paying an extra 100$ a year in order to not be limited to the week long signing certificate (even then it only ups the limit to 365 days). I want companies to be able to make apps and not be limited by apps obsurd regulations of not even being able to redirect users to a seperate website to sign up for the service. This can also open the door for more developers to distrubute there apps elsewhere, for beta testing or any other reason, Apple's Beta Test program limits the amount of users who can be signed up to it at once. Until the EU makes a clear attempt to go against what would generally be better for everyone, I see no issue here. This is the first time that the government has actually made a good substantial change, and I hope the right to repair laws also follow this.
That being said I do understand your concern, and comment beyond this point is uncertain as I do not have enough knowledge regarding the topic, but doesn't government have to go through a bunch of different votes with a bunch of different people involved? Some of whom are probably also users of said products? Wouldn't they themselves be making votes towards a better product, things being open overall could lead to more innovation.

    Sideloading IS more choice.
Nobody worth their pants in the software world would dare argue otherwise
Apple doesn't let us, the actual consumers and an OWNER of one of their devices, preform basic admin functionalities and specifically disallows the end user from being able to control iOS to any significant degree w/o zero day exploits of the software that they technically own a license to. The issue is that by the inherit design of their lockdown layer, like only allowing executable applications be downloaded from their AppStore, though the underlying software would otherwise, is the mechanism to how they've been found guilty of anti-competitive practices, and this is undeniable.
This is certainly not good for Apple, but a move they had to make and will have to adapt to in order to remain relevant (which they'll almost certainly be lol, but definitely different from how their devices run the software layer now)

If EU wants to try to force apple to allow multiple app stores they may allow it knowing they have already trained consumers to use app store, or add a setting to lock down the iPhone by default, or stop selling in the EU all together. Apple is savy they will find a way to continue their business despite regulation. I honestly vehemently disagree with you here, but I can at least say you made your point well. I personally am not a fan of private companies wielding their power in these ways (or really, in most any ways). And I don't think the "just go somewhere else" argument works when the titans of the industry have enough power to basically kill any competition. I'm not really a believer in the idea that the "free market" allows for innovation when we let companies get this big.
I also don't think that "what if they forced Android to be more closed?" is a valid hypothetical, because it misses the point. The guiding principle here is consumer choice and freedom. It's not just a matter of "government says company should do [x]". It could be a more valid argument if it was meant more like "giving a governmental agency the power to do this is not good because that power could be used for ill". That would be more compelling, but arguably any power can be used for ill. Why does Apple get a pass for the power it wields? Because it put in work? Technically, governmental agencies put in work to get to their position as well.
But really, this personification of companies really just makes me feel gross. A company is a machine for profit for shareholders, full stop. Anything good that comes out of it only happens if it's in the best interest of shareholders. Personifying an impersonal machine and imbuing it with things like "principles" and "ideals" is honestly just license to give these companies more power because we like the "people" we see them as. And I'm very much not a fan of that.

Ur not gonna ask every other phone company to change ports it makes sense to just change the 1 phone that does it different. It's less of a hassle to convert 1 phone over than to do it the other way and convert android to lightning charger. That's too many phones to change. Apple can abide by a common thing like the rest of the world so it's easier for everyone. Just because they change the charger doesn't make it an android phone with an apple logo on it either. If apple had the technology they would get rid of the port an just make it completely wireless charging but it will charge slower than every phone on the market. Ports allow electricity to flow so its always faster with a cord. Plus to carry around a magnetic back charger in ur pocket is crazy no one will carry that around everyday. Apple as a company isn't really innovative either they have the same phone every year with an updated camera nothin really new. They don't take risks as a company an switch it up it's been the same product.

Humans really cannot comprehend scale and I perfectly understand. Throw this deep into the future, you are going to find out that leaving the battery more exposed is actually bad for you as the user.
The best way is to make them bring down the price for repairs and replacement parts. It shouldn't cost more than 10% of the original unit value during assembly.

My iPhone lasted me 3yrs (12) before the back glass broke down to a bad case… I only consider windows because of steam gaming, but Mac supports the few games I do want. So it’s a battle in my heart but I lean towards apple more because with windows 80% of the market is computers that’ll bust within a year, overheating etc while apple does focus on quality of their products. Microsoft surfaces are the only windows I support, not razor, or third party stuff.

The vision of Jobs would be lost if apple continues down this path is what I feel like

They are gatekeeping, if I switch today from android to apple I have to repurchase everything that is not transferable again on the app store and they make sure that you only use their Marketplace I mean imagine you buying a house but when you buy that house they tell you, you can only shop at the walmart down the street not publix or whole foods just walmart how would you feel not only that why can't I get my apps straight from the developer or be able to install my own apps that's why it's such a pain in the ass to install Netflix on iPhone

100% Facts. Gate keeping is the NICE way to put it. They make it IMPOSSIBLE to transfer apps, but thankfully allow regular files to be transferred. Regardless like you said, you’d have to rebuy EVERYTHING that came with your phone if you buy an android. And no, I don’t want to buy 2 fucking phones. Apple should be the first company to make gatekeeping redundant, and they would make WAY more when everyone knows they can upgrade to iPhone but it will support android apps, or android backup

10:28 It is qualitative different saying if you think it is ok for the EU to force a company to open up and let people use however they want their software than saying that they need to close up. If an Apple user only wants to use Apple apps, continue using Safari, not sideloading any app, they are more than able to do so. However, if a costumer wants to develop a personal app for ios, it can't due to Apple limitations
