It's simple. The prosecutors have no standing under the law.
They are ruling on whether or not a former president can be convicted or accused of a crime for something they may have done in the office of the president. This is a matter of whether or not a former president has the protections in a criminal case that he would have in a civil lawsuit within the bounds of acting in the office of the president. Example being could Nixon have been tried for Watergate had he not been pardoned by Ford being that Nixon left office before he was actually impeached.

People in the incoming Bush administration wanted to charge Bill Clinton with Perjury, but President Bush thought it was a bad idea for one president to charge another. Because if this is allowed, you could see Former Presidents indicted every time there is a new president of another party. Why not indict Obama for murder for what happened in Benghazi.

Trump is permanently disqualified from elected office for inciting an insurrection to illegally stay in office - a clear violation of the 13th Amendment and something the Supreme Court majority would rather not rule on. The current Supreme Court is inhabited by a majority of religious fanatics who do not believe in separation of church and state, and who want Trump back in office. They are traitors to the U.S. Constitution and to what democracy stands for.
Trying to imprison Trump prior to the election is not democratic at all. They want to take the choice away from the people and it’s backfiring badly. The poll numbers don’t lie.
I don't want them preserving democracy, since that form of government is something we never had, ergo can't preserve it. Furthermore, democracy was rejected at the Constitutional convention, as democracy is tyranny of the majority where minorities rights are crushed without recourse.

I always thought it was Congress that makes the laws, not the SCOTUS! I also assume that Congress will make laws compatible with our Constitution according to their oath of office. SCOTUS will simply rule as to a presidents immunity while in office as laid out in the constitution. An immunity which all presidents have had unless impeached AND convicted while in office. Trump was never convicted and his impeachments were political garbage as proven by no conviction. You may not like that but that's facts.
Congress did make the law -- the 14th Amendment, that was supposed to keep insurrectionists from holding office. SCOTUS may or may not uphold that law that Congress made.

The problem is that democracy, with honesty, has no choice but to move toward becoming a more and more unworkable kind of government when people genuinely believe that it is against the US Constitution to teach in all American schools, from primary education to college Jesus' teachings regarding our duties toward God and our fellow citizens. For instance, when President Trump was elected in 2016, many of his supporters were not interested in complying with Jesus' teachings according to Matthew 7:12 with non-documented aliens who had good moral character and were more productive than many born American citizens (able to vote) who are not jailed in California whenever they stole things that are less valuable than $940.00 within the state of California.
Because "it is the law" that thieves born in the USA and living in California have more rights than non-documented foreign citizens with good moral character to live in the USA, we are evolving more lawless people born in the USA. Only after it is declared that it is not illegal to recite Jesus' teachings in our public schools (and all American teaching institutions) according to Matthew (5:43-47, 7:12, 19:18-19, 20:25-26, 22:21, and 22:37-39), then we will have more Americans respecting American laws and the US Constitution as it was drafted during the birth of this nation.
