      A similar example of what just happened here is pawn shops. They purchase items that are believed to be "clean and clear" of any encumbrances. However, when it is brought to their attention that it was stolen, they get to give the item back to the rightful owner no questions asked. The big difference here is they did NOT pay for the barrel from Sazerac but they profited by selling the bottles (at what was surely an inflated price). Bourbon Junkies is now out what they paid for the barrel with no way to recoup those costs. (Of course, they now have 40ish bottles they could sell, but that part is logistically problematic.) That store owner KNEW what he had and took advantage. He deserves whatever backlash he gets in return until he makes those that have been shorted whole. I'm sure he made out well enough on the sales of the bottles he stole to reimburse and still have some profit leftover.

    • @robnew808
      @robnew808 10 месяцев назад +4

      The sales rep wouldn't have known it wasn't for their account until after it was delivered and they saw the stickers. They also probably wouldn't have been the one to release the allocation to the account. Allocations are almost always hidden from inventory for regular sales reps and allocation decisions are almost always made by a district/regional/area/product/... manager or higher. Also, within the last few years most sales reps for big distributors like RNDC and SGWS were moved to salary. The only monetary incentives most of them have left is to make X number of placements at X number of accounts of for example Jameson Orange, Wheatley Vodka, or whatever stuff the producers are trying to push into the market.

    IMO the distributor should be disciplining the rep and the store. They knew exactly what they were doing and likely underestimatd who the barrel pick was made for. The EHT pick is way better IMO though so that's awesome! Hopefully it will be a large yield. Problem is that it, by law, does belong to them. The laws need to change to get them to be a function of distribution at the behest of the distilleries and not their own say. e.g. - get rid of the useless middleman.

      @@LeatherDaddy97 It's not a grey area, otherwise there is easy route of litigious recourse (which isn't an obvious option). The laws are old and outdated. They only benefit the middle man nowadays. The laws were made on a precedent of ease of monitoring alcohol sales prior to the internet for the sake of taxation (didn't want you brewing your own) and under the guise of "moral" heresay. There's no real need or convenience for the distributor anymore. I wonder how much money goes into lobbying to keep the status quo at the cost of the distilleries and the consumer... Both the generator and the consumer in this instance would advocate for law changes because the greed and theft have become outright stupid and obvious. You think the Bourbon Junkies would've gotten their EHT barrel pick if they didn't have the exposure that they do? NOT. A. CHANCE. I call bullshit on the "mistake" and bullshit on distributors creating and supplying secondary markets by proxy (your local guy who has boxes of BTAC ain't getting that from his local so that only means one thing). The Reps for those companies make commission and have a salary. At least here in CA they do.
    Sometimes allocated items just show up in their system. (It's called Red Truck for RNDC) Allocated items aren't supposed to be open like that but sometimes they are by mistake. When that happens Reps are supposed to notify management. "Aggressive" Reps sometimes place the orders before the system can fix the issue because it makes the store owners happy and they make the commission.
    I was with a RNDC Rep a few months ago and Jack Twice Barrel popped up as an open item to order for anyone. The Rep took advantage of the mistake and made the sale right in front of me.
    My guess is when the Bourbon Junkies Barrel showed open in Red Truck system he probably called the owner and asked if he wanted it and the owner said yes not knowing it was for the BJ's.
    My money is on the Rep that represents the Sazerc portfolio in that account that caused this problem.

    As a recent subscriber and person into the whiskey hobby, this is sad to see happen. I'm interested in joining the Patreon and would like to get in on the picks when they release. What is usually the best tier to have availability for those?

    You know it's funny this happened to you guys. A similar thing happened with a local liqour store in my hometown in AZ. Saw they had gotten in some eagle rare, noticed the sticker as a store pick... look at the sticker and see "safeway and Albertsons" which obviously the local store is not a grocery store. Owner there has some sort of connection with the distributor and snaked away a barrel pick from them. I know things may be slightly different between what group pics and what a large retailer pics but man what a scumbag thing to do with a product that in my eyes should be a guaranteed thing you guys get. And stores wonder why you would rather buy from a large or chain retailer.

    The owner knew he didn't have an Eagle Rare pick, and that was a very underhanded thing to do. He then wanted to play the victim because he got caught smh

      And it’s gotten worse because BT decided to only work with one distributor in the state, and they picked the worst one. They literally picked the one who had been caught selling straight to the secondary themselves.

    Lame that it happened, and how the store responded BUT silver lining is the admission of guilt from the distributor, and a better pick from BT. Not to mention i feel like this should be a message to the industry. Do the right thing, and dont mess with the BJ fam!

    is it possible for someone to join patreon and get in on that EHT pick (and future picks) or are those bottles basically already locked up?

    • @brandon_sprague
      @brandon_sprague 10 месяцев назад

      Picks are dropped tier to tier starting higher and trickling down. Anyone in a tier that it’s dropped to has a chance to snag one while they remain for sale. Link is dropped to bourbon outfitters and it’s first come first serve. I’ll be honest this pick is 100% going to sell out in the 15 dollar tier.

      @@G1ft3dConfus1onyup. It was the "One Stubborn Barrel" that was picked by Repeal bourbon and burgers. They ended up getting another barrel pick, and I tried them side by side. The first one was significantly better in my opinion.

  • @007JRP1

    The store owner steals the barrel and is mad at being caught. The distributor owns this issue as well through gross incompetence if nothing else.

    That's likely a defamation of character lawsuit since the store's unethical action of accepting your product resulted in your name being now associated with secondary pricing, potentially leading to less subscribers and less add revenue on youtube. I highly encourage you to consult with a lawyer on this, especially since the store owner is being so unprofessional with you
