In fact, the mayor's license for selling alcohol got suspended for this incident, and he got chewed out by a bunch of people during some meetings for impeding on this investigation.
UPDATE: Mayor Willy Walker is facing 2 charges and has had his liquor license suspended and maybe business license suspended. Refusing to cooperate with authorities is in direct violation of his liquor license. One is for 30 days, the other 60 days. He was admonished at a city Council meeting and citizens verbalized their disgust of the mayors behavior. Small victory so far!

What you just witnessed is the law. The mayor is actually lawfully (nor morally) correct. Private property laws are extremely strict and for good reason. The founding principals of our country were built upon the premise that the government must not be able to interfere with the freedom of its people. That the government be afraid of the population not the other way around. When you set up a camera inside of your home the police cannot demand to have that footage (you can outright deny them). Its your property, the government cannot seize your property. Its your fifth amendment right against arbitrary search and seizure. For the people to be secure in their persons, places, papers, and effects from government intrusion. The same applies to a persons place of business. The camera cannot be seized without the owners permission or upon a search warrant. Additionally According to the united States constitution "No Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized." ~ 5th amendment of the US Constitution.
Technically the cop could not have even gotten the warrant since he had no probable cause. (Probable cause is prima facie evidence (irrefutable hard evidence)). Since the man declined to be tested the cop only had reasonable suspicion and circumstantial evidence. Without the Probable cause part if the equation he would not be permitted by law to search without a warrant that constitutionally cannot be issued by any judge.

This cop failed to do his job properly in a way that would implement a guaranteed arrest. When this cop engaged the suspect in the first place the only evidence that he had was to support a public intoxication. He didn't see this man operate a motor vehicle. He should've walked in, walked past him, smelled the booze on his person, said hello or something, or otherwise leave the man's sight, go back outside, and watch him start the vehicle. There's your evidence. Instead he tried to intimidate the clerk, and guilt the mayor into getting video that they have zero obligation to give. These police don't follow the law unless the law abiding citizens have the ability to hold them to the law. Asking for cameras and all that came off like the cop was trying to make them part of his pre-emptive guilt operation which may have double-pissed them off too.

I feel like I escaped prison from a life sentence. I will never go back to that life. I would rather die than drink again. I have nothing against someone ELSE using alcohol responsibly. I do know if I use alcohol my life will fall apart. It took a long time to repair the damage addiction does to your life. It CAN be repaired. I got my family back and an excellent job again. It’s called reasonable suspicion, which is enough to detain on. However he wasn’t able to gain PC, which he needed to arrest, because he wasn’t able to see the camera footage.

The business license to operate the liquor store has a clause requiring they cooperate with police performing police duties on business premises, that license can and should be revoked over this (though it hasn't). This mayor is in a couple of other issues with the city, while they allow city employees to take part in the towns health insurance they have to pay the premiums, they found out the mayor was just taking the insurance and paying the premiums with city tax money, $10,695 worth. And he says he's going to move for impeachment of a member of council he didn't name to be impeached for some reason. It seems most of the town thinks there are some illegal shenanigans happening at his gas/liquor store. Makes you wonder how this schmuck got elected mayor.

Since I haven't confirmed it myself and it sounds like you can point me to the pertinent bit of state code pertaining to alcohol licenses I'd appreciate it if you would. But I do believe the officer had probable cause between the phone call, the state of the man when the officer spoke to him, the statements from the clerk and the fact his vehicle was somehow at that gas station to believe he may have been and may be about to drive intoxicated. At that point the cop had every power to be there. He had no authority to force the mayor to show the tape, but he certainly had the authority to investigate a possible criminal act.

They aren't required to provide the video without a court order. Which the cop didn't threaten them in any manner, so didn't do anything wrong. The owners just way overreacted. It's just kind of astonishing to me that the value their sales to drunk drivers over peoples lives.

Many people in these southern Missouri communities think DWI isn’t a serious crime unless there is an injury (to someone other than a the driver). Prosecutors in many of those counties don’t even file charges on DWI’s.
Same in parts of Mississippi. In 2017 I was “detained” for DWI. Slept the night in Scott County jail and left. Never ordered to go to court, pay fines, probation, suspension, etc.

I can certainly appreciate the mayor’s position about the cameras, but that means his cameras have zero value. When someone comes in and robs the store at gunpoint, is he suddenly going to change his mind about showing the footage to officers ? I would guess, yes. The guy that was screaming should have been arrested for impeding an investigation, but my guess is that the police department has an ongoing feud with the mayor and his entourage and they do not want all their time wrapped up in a bunch of minor offenses that keep them from dealing with more serious criminals.

Id rather loose a few drunk driving customers than hear about some death on the news caused by a customer who I knew was drunk prior to them killing someone. The mayor of that town condoning such activity is disgusting.
The mayor is choosing money over the life of a person! That is absolutely pitiful! I am a business owner and I feel more secure when a cop is nearby! If he thinks the cops are making him loose business then he must be selling illegal stuff! The other guy barking out loud is like a dog, the smaller they are the more they feel the need to bark lol
@Miki Miyazaki it’s a gaz station/convenient store that also sell alcohol. I doubt someone wanting to buy bread, gas or milk would be avoiding the place because of the police parked nearby! Even buying alcohol since it’s legal! I would agree that a cop parked in front of a bar might be bad for business but a convenient store/ gaz station???? And by the way, a great % of robberies are done in convenient stores where sometimes the employee behind the cash register gets shot…I believe that a cop nearby would discourage any robbers on acting out.

In fact, the mayor's license for selling alcohol got suspended for this incident, and he got chewed out by a bunch of people during some meetings for impeding on this investigation.
UPDATE: Mayor Willy Walker is facing 2 charges and has had his liquor license suspended and maybe business license suspended. Refusing to cooperate with authorities is in direct violation of his liquor license. One is for 30 days, the other 60 days. He was admonished at a city Council meeting and citizens verbalized their disgust of the mayors behavior. Small victory so far!

What you just witnessed is the law. The mayor is actually lawfully (nor morally) correct. Private property laws are extremely strict and for good reason. The founding principals of our country were built upon the premise that the government must not be able to interfere with the freedom of its people. That the government be afraid of the population not the other way around.
When you set up a camera inside of your home the police cannot demand to have that footage (you can outright deny them). Its your property, the government cannot seize your property. Its your fifth amendment right against arbitrary search and seizure. For the people to be secure in their persons, places, papers, and effects from government intrusion.
The same applies to a persons place of business. The camera cannot be seized without the owners permission or upon a search warrant.
Additionally According to the united States constitution
"No Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."
~ 5th amendment of the US Constitution.
Technically the cop could not have even gotten the warrant since he had no probable cause. (Probable cause is prima facie evidence (irrefutable hard evidence)).
Since the man declined to be tested the cop only had reasonable suspicion and circumstantial evidence. Without the Probable cause part if the equation he would not be permitted by law to search without a warrant that constitutionally cannot be issued by any judge.

I'm sure you've dealt with a lot of condemnation throughout your journey, alot self imposed even. People are more likely to say the bad but when something good happens they ignore it. I started out with a great government job and ended up unemployed with a bad criminal record, all because of alcohol and drugs. Mostly alcohol. I was an alcoholic and addict most of my life and I am no spring chicken. I only had two options. One was going to happen, I was either going to quit drinking or die trying.
I feel like I escaped prison from a life sentence. I will never go back to that life. I would rather die than drink again. I have nothing against someone ELSE using alcohol responsibly. I do know if I use alcohol my life will fall apart. It took a long time to repair the damage addiction does to your life. It CAN be repaired. I got my family back and an excellent job again. It was a rough, long journey but so WORTH it. Thank you for your compassion and kind words Thryss. I will never forget our conversation. Thank you and wishing you and yours the best!😊🏆

It’s called reasonable suspicion, which is enough to detain on. However he wasn’t able to gain PC, which he needed to arrest, because he wasn’t able to see the camera footage.

The business license to operate the liquor store has a clause requiring they cooperate with police performing police duties on business premises, that license can and should be revoked over this (though it hasn't). This mayor is in a couple of other issues with the city, while they allow city employees to take part in the towns health insurance they have to pay the premiums, they found out the mayor was just taking the insurance and paying the premiums with city tax money, $10,695 worth. And he says he's going to move for impeachment of a member of council he didn't name to be impeached for some reason. It seems most of the town thinks there are some illegal shenanigans happening at his gas/liquor store. Makes you wonder how this schmuck got elected mayor.

Since I haven't confirmed it myself and it sounds like you can point me to the pertinent bit of state code pertaining to alcohol licenses I'd appreciate it if you would.
But I do believe the officer had probable cause between the phone call, the state of the man when the officer spoke to him, the statements from the clerk and the fact his vehicle was somehow at that gas station to believe he may have been and may be about to drive intoxicated. At that point the cop had every power to be there. He had no authority to force the mayor to show the tape, but he certainly had the authority to investigate a possible criminal act.

As an elected official I would hope that he would want to keep drunk drivers off of his roadway for public safety.... and to his comment about sitting across the road. I would have no problem buying alcohol while a cop is sitting across the road. The only people that would have that problem are drunk drivers. Many people in these southern Missouri communities think DWI isn’t a serious crime unless there is an injury (to someone other than a the driver). Prosecutors in many of those counties don’t even file charges on DWI’s.
Same in parts of Mississippi. In 2017 I was “detained” for DWI. Slept the night in Scott County jail and left. Never ordered to go to court, pay fines, probation, suspension, etc.
Should be a felony.

I have had to pull my legally carried firearm four times in self-defense. Haven't had to shoot anyone yet, but came damn close one time. Cops just do what the Citizens used to do for themselves.

I can certainly appreciate the mayor’s position about the cameras, but that means his cameras have zero value. When someone comes in and robs the store at gunpoint, is he suddenly going to change his mind about showing the footage to officers ? I would guess, yes.

Even buying alcohol since it’s legal! I would agree that a cop parked in front of a bar might be bad for business but a convenient store/ gaz station???? And by the way, a great % of robberies are done in convenient stores where sometimes the employee behind the cash register gets shot…I believe that a cop nearby would discourage any robbers on acting out.
