    #8 is wrong. Not all states require two party consent for recording.

    • @boxofwine8001
      @boxofwine8001 6 лет назад +21

      It would be easier for me to list states that require two party consent since there is only 11 of them. California, Delaware, Florida, Illinois, Maryland, Massachusetts, Montana, Nevada, New Hampshire, Pennsylvania, Washington. Lyft actually suggest using a dash camera or other recording device as long as you follow state guidelines.

    • @boxofwine8001
      @boxofwine8001 6 лет назад +11

      In the video, you say it’s a US law. Which implies it’s a violation of a persons constitutional right, or that the US Supreme Court has made a ruling that two party consent is required. Now another question would be, is a Rideshare vehicle considered a public place? Yes it is a private vehicle, but open for public use just like a store.

    • @TheRideshareHub
      @TheRideshareHub  6 лет назад +2

    • @TheRideshareHub
      @TheRideshareHub  6 лет назад +1

      well, if you think of it this way: no one can just jump inside another person's vehicle. When you order a vehicle, you are ordering that a spot for yourself and possibly somebody else. You are not expecting that just anyone can get in. Also, that car is owned by someone not for use by the general public. Going back to your point, a store has the expectation that anyone can just walk in. Sure, you can get kicked out of a grocery store, but you can't just walk in a car as you could a grocery story. I don't think the two compare. But good insight!

    The Lyft rental program is far from free. It costs $255 a week, with a bonus of $60 if you drive 75 rides. Which is hard to do unless your driving long hours every day. So even if you make that your paying $195 a week for the car. The rental people are rude and don’t seem to value the custom and try to keep you in the same car for the duration of your Lyft driving experience. I just want to let people know the truth, their are some nice things about the rental program if you are driving full time, like free tires and oil changes. The only problem with that is that you often have to wait around for a long time and that into driving time, which stops you from getting the bonus. Honestly it’s very stressful trying to achieve 75 rides just to hit that first $60 bonus. Drivers achieving the ultimate 110 bonus do get $145 off the $255 a week price but they must be living in their car to achieve that. I have made that full bonus twice during busy weeks but it’s not a healthy or safe way to live and Lyft should not be enslaving their drivers to such an ordeal to pay a fair amount for the rental car in my humble opinion.

    Guys, a great point was made in a post down below about picking up teenagers. I had an experience with a teenage female that requested a rideshare and I was driving Uber at that time. It was after closing time at the local mall here and when I arrived to pick her up, I didnt know it was a young teen female. I told her that I was not gonna take her due to the fact that she was underage and my policy was I dont pick up young teenagers so late at night. I cancelled the ride but I offered to call her parents to have them come pick her up which was barely a less then three mile ride. I told her that I wouldnt leave her stranded per say for obvious safety reasons for her but she needed to have her parents come get her. Well after I cancelled the ride, sure enough, I got a call from a concerned parent and was wanting to know what was going on with his daughter and why she wasnt on her way home.
    I kindly explained to the parent that I have a rule about picking up young teenagers so late at night as recent headlines in media outlets were citing rideshare drivers raping women and what have you and I was not gonna get blamed for something I didnt do. I told the father, I was not gonna leave his daughter stranded but If he didnt come get her, I was gonna be forced to call the local police and advise them of what was going on. He tells me he will call another Uber driver and hangs up. I called the police and they showed up within less then 10 minutes. I explained to the officer what was going on and he asked the teenager to call her dad. That's when the other Uber driver shows up. He gets out and sees what's going on and I walked over and told the other Uber driver what was going on, he basically said I ain't having that either, not in my car, no way and drove off.
    The officer calls the dad and told the dad to get off his lazy ass and come down to the mall and pick her up.
    The motto to this guys is, be careful about picking up young teenagers. If they have someone with them like an older friend or family member, then fine, but it's your discretion on it. I have a dash cam in my car so if the young teenager wanted to try and say I tried to make a pass at her, my dash cam woulda proved otherwise. For those that have a dash cam, make sure that audio is recording at ALL TIMES!
    Drive safe everyone....cheers from San Diego!😀😀🍺🍺🍻🍻🥂🥂

Long story short..there is an absolute agenda going on with the same type of people. No one wants and doesn't pick up these passengers! They are the ones with entitlement attitudes. They treat you and your car worse than public transportation. They all do the same crap. I am so tired of earning what a server in a restaurant and to be treated like crap. I'm trying to scratch out a living and to be treated like this is totally unacceptable! If I see one more walking casually to my car after the time is up, I'm cancelling the ride and drive off! I would agree to both based on my experience. Lyft riders can tend to be pickier about minor things, like the type that don’t get you deactivated, while an Uber rider will take a 45 minute ride and then make up everything short of that the driver was smoking a blunt and shotgunning beers while driving yet even though after the ride they make it seem like the driver almost got them killed a dozen times during the trip but during the ride didn’t feel endangered enough to compel them to end the ride early.
      I had my Uber account places on hold twice for BS complaints. It would have been a third time however that rider had tried that trick many times I came to find out from a Green Light Hub visit the first time I got that dreaded “A Message From Uber” and they suspended her and immediately reactivated me. After that I decided to just stick with Lyft. Uber wouldn’t even accept dash cam footage from me in defense of the allegation. Lyft on the other hand has removed at least a few ratings after sending in proof that the rating was unfair (these were mostly cleanliness flags and I sent pics of the car around the time of the rating). My ratings range between 4.89 to 4.97 and currently 4.94 on Lyft. The only two safety complaints I got with Lyft happened to be on the same day and both were for driving too slow and one also stated I had weaved slightly. What they didn’t report was that we had very heavy rain that day and that it would have been imprudent to even drive the speed limit and the weaving the one mentioned was steering around significant water ponding along the curb.

You have to put through a lot of traffic, stress and then bad attitudes. Lyft often offers cheap ride for thier passengers, even during rush hour, for example, I picked up a passenger from down town la to Inglewood, 47mins, 16miles and only $13 WTF!!! I don’t care what you say, most passengers don’t tip, Lyft gives cheap rides which attracts cheap passengers.

    Steereo is in Austin and New York no where else. Drivers are paid as soon as they earn $100 in music miles. Once that happens, drivers cash out on PayPal. I hate that they have added stops. I think it is ridiculous to expect people to wait at such a low rate of pay. There should be a 2 minute limit to stops. I actually called Lyft a week or two ago because I was waiting for 10 minutes outside a hotel in what I thought was a very unsafe situation. Seemed like it could be a drug deal. I called Lyft and said I only had to wait 2 or 3 minutes so I cancelled the ride and left. I was rated 1 star by that person, the only rating I have ever had below 4.
    When someone asks me if I can wait for them without adding a stop I say yes but only if they complete the current ride and request another. I tell them I will wait outside until they are ready as long as I do not get another request and they can just input a new request when they are ready to leave.

And, Uber's long pickup fee is a joke - on the driver!

Please avoid long rides or try asking for cash instead or you'll end up driving for almost 2h for $20. Also avoid trip requests by using airplane mode while the app beeps. Thinking about starting to drive? Please expect 4 azzholes in your car for a $3.75 minimum fare. MOST trips around the city pay the minimum. If the driver app can show a "star" or something to KNOW its a rider who loves you, it would be worth driving a longer distance since A. tipping is more likely B. you get matched, countering the algorithm and basically (legal) private clientele and C. build up enough favorite riders and you won't wait as long between rides sometimes.

      I wouldn't necessarily agree about Lyft customers being better than Uber customers because lift allows customers to use prepaid cards so sometimes you get more shady customers with Lyft. IE drug runs for 6 hours like what I had. I just recently heard about getting paid for long pickups haven't confirmed that yet. No you can't put a wrap on your car if you're going to do Rideshare because they may have a conflict of interest between Lyft and the company that you are advertising. Keep in mind if you do the express Drive where you rent the car for Lyft you cannot use that same rental for Uber.

    You GLOSSED OVER details. Lyft Drive Express is a BAD DEAL. The cars are through Hertz Rental. You must have a Credit Card to rent the car. They hold a deposit on the rental. Your choices of cars are limited. You must hit all of the requirements AND you cannot turn down or not accept any rides. If you do not hit the daily requirements then you will be charged $21 per day for the rental car. While on Drive Express you CANNOT use Instant Pay. Your pay is sent out once per week so you have to wait to get paid. If you do not drive full time then do not use Drive Express because you will not meet all of the requirements and be charged the daily rental car fee which is deducted from your pay with you receiving what is left over.
    Where I am at the Car Wash charges more for Uber/Lyft Drivers. They have unlimited Wash Program but if you are a Driver the fee they charge is more vs a person who is not a Driver.
    Audio Recording on a Dash Cam is legal as long as the Driver is a party to the recording. It is illegal and eavesdropping when the the Driver is not there in the car and it records conversation between the passengers only. I post the warning stickers that there is recording inside the car. Recording what happens to the front view of the dash cam is legal because it is in a public place and there is no expectation of privacy on the streets in public. To audio record only one party must be aware and that party is the driver. The dash came is clearly visible and there are warning stickers posted around the car.
    While most people get their dash cams so they record the view through their windshield, dash cams often record audio from inside the passenger compartment as well. ... If your dash cam records a conversation between people in the car that you are not a part of, it would be considered "eavesdropping" in many states.Jan 3, 2017

      As far as the dashcam goes, recording video is no problem at all. The one or two party consent has to due with the audio recording portion. By having the dashcam clearly visible that alone should be sufficient however posting notice on the door or headrest stating that rides are recorded for the safety of all parties involved would certainly be adequate. Maybe even adding a comment that dashcam footage will only be shared with the rideshare service company and/or law enforcement to assist with investigations of breach of service or unlawful activity may help avoid riders objections. Regardless or single or dual consent, from a legal standpoint the recording isn't so much an issue as what you do with same. Divulging recordings of private parties without their consent to the public or any other entity that does not have any legitimate need for same is where you become liable for the outcome of doing so. The simple version to all this is record it, archive it and only share with the rideshare company used and/or law enforcement if necessary to defend/protect yourself against an improper allegation made towards you or in legal situations to prove that you were not a party to any illegal activity in which the rider may have been involved.
      Several other of these tips are incorrect mainly because of the significant variances between markets. This list may be mostly correct in a specific market.

      I will clarify a few points for you. The Lyft Driver in New York who video the passenger yelling and cursing at him while he sat there silently, that video went viral. The passenger tried to get the Driver fired. The Driver posted the video on RUclips and the Passenger got Fired. The video was recorded on the Driver cell phone to defend himself because the passenger was yelling and cursing at him.
      I had a passenger who refused to put on his seat belt so I cancel the ride. All was recorded as proof to DEFEND myself. The passenger was yelling and cursing at me as he got out of the car that he would have me fired..
      Remember the Doctor who assaulted the Uber Driver, she kicked his car and put a big dent in the side, threw his papers and documents in to the streets, she was drunk, yelling and cursing at him? Once she was outside the car NO CONSENT TO AUDIO RECORD IS NEEDED BECAUSE SHE IS IN A PUBLIC PLACE. Once she began her assault the Driver had the right to record as EVIDENCE to use against her in CRIMINAL proceedings. She was Fired.
      Remember the DA from Texas who was drunk and made threats to get the I am not sure if it was a Lyft or Uber Driver Fired? He had the right to record at that point to protect himself because this Woman was making the threat she would have him arrested and fired. She was the one who was fired.
      In San Francisco a Uber Driver hit and killed a 4 year old Asian Girl. Her Family hired a Lawyer named Christopher Dolan who sued and they were awarded $4,000,000 The Driver did not have a dash cam. On evening in 2017 I picked up Mr. Dolan and his Wife but I did not know who he was. He introduced himself to me and gave me almost 1 hour worth of free Legal Advice. I rushed out and got a DASH CAM because this was possibly the Counselor who will be sitting across the table from me deposing me in a Law Suit so I heeded what he was saying to me.
      Civil Litigation is REAL, there are so many things Lyft and Uber do not tell New Driver about. There are so many mistakes I made and wish I knew those things.. I am so thankful I did not get SUED. One example is in California it is ILLEGAL to pick up a MINOR with out an ADULT PRESENT. The Parent or Parents can call the Police and say you abducted their child with out their permission or you drove off with their child with out their permission. Now you are in Deep Sh+t and Screwed trying to do what a $7.00 ride, NOT WORTH IT. Lyft and Uber say nothing about this to New Drivers, when I inform them they are in disbelief.
      Finally is the car seat and booster seat. I cannot tell you how many times I see Drivers who are not from this Country who are Immigrants picking up passengers who have children which by law require a car seat or a booster seat. One time I refused the ride but someone lied on me reporting to Lyft that I did the ride so I told them to check again and they will see I cancel the ride. This was before they had the option to state ride cancel due to no child seat. After checking they apologized for the mistake/misinformation.

      I have been a Lyft driver since May of 2017 had a car but I bought it from a bad dealership here in Austin. Tried Hyrecar.com but the rates are way too expensive for me as a full-time driver. I signed up for Lyft Express Drive today and put down the $250.00 deposit using my debit card which they accepted. No credit check unlike Uber's Hertz program because I talked to the lyft Hub just to make sure and they said no credit check. After I signed up with Express Drive I was given a Friday appt to go in and pick up my car either a 2018 chevy malibu or Nissan Sentra (hope it's the Chevy) said in email bring credit card or debit card (My debit card is already on file with them) for payment purposes, along with drivers license and have the Lyft app installed which I already do. Yes, you have to try and get I believe 45 rides during peak hours and 110 total rides including peak rides and if you can then the rental is basically free except for tax and fees. They just started recently if you do a certain amount of rides they do unlock the express pay so you can start cashing out at end of the day.

    Please give me advice. What happens when someone wants a pickup and they are already running late to school and they expect you to haul 4 big teen football players that are 200 pounds each to high school? The option wasn’t even available to mark that 2 people at the same time needed a ride when I arrived. Are they taking advantage of me? That’s like 950 pounds that my v6 would have to hall and I’m not ok with that. Isn’t there Lyft XL with bigger v8 motors where they can choose that option for more heavier passengers instead of trying to add wear and tear on my v6 motor? The father who coordinated this ride got mad that I took 2 teens instead of all 4. I got approval from the 2 other teens that they would rely on another lyft to get to school eventually. But then half way on the ride to school that wasn’t the case. The father called me to turn around and bring them back so that he could bring them to school even more late himself while harassing me that he will report me to have me fired. I agreed to do the decent thing and turn around because they are minors. Then when I dropped them off he should have not done this but he imposed by opening my front passenger door and condescendingly argued that I was wrong for not taking all 4 teens to school and that Lyft drivers do this for him all the time on the average car. He added that this is causing the teens to be late to school and he was gonna report me and get me fired. I implied “ok” in a passive way. Then he slammed my door hard!! I gave him a 1 star ⭐️ rating to warn other drivers about him. I was very Courteous to the teens after I had to deny 2 out of the 4 passengers. Lyft accuses me of being derogatory. I just don’t understand why he took his frustration out on me before telling the Lyft costumer service app about me.

      First of all. It is not okay to transport minors ever on Uber or Lyft. It will get you deactivated. Secondly, you are always fine to deny people if you think it's gonna damage your vehicle. Just tell them that. You are fine, don't worry about it :)

      That's a great one. I think I decided to leave that one out as most people know that one and it's not really a secret. It's more something that a lot of drivers don't follow. Maybe the secret would have been to ask for ID. Thanks for the input, I'll have to include that in a future video. Where do you drive?

      @@TheRideshareHub I don't remember seeing anything about not taking unaccompanied minors in the introduction videos I had to watch for Lyft before I started driving, maybe I missed it. It wasn't until I had to rent a car while mine was in the shop when I overheard a new driver being told "no unaccompanied minors." And it seems Uber doesn't make you watch any introductory/training videos before you drive for them. Hell, Uber didn't even ensure that my last name and email were correct before allowing me to drive and start earning money (there's no way I typod that r where a b should have been in my name). It wasn't until I went to cash out that I realized the info was incorrect, I then had to call Uber "Support" 3 times before we figured out what was wrong and needed fixed. Lyft and Uber care more about the passengers and the money than the drivers taking all the risks. This seems to be a very paid for ad video for Lyft. Just sayin.

    Cargo is cool.
    You have to send screenshots of your lifetime miles, rating, and most recent weeks rides (how many you did ). If approved Cargo will send you a box that sits on your middle console which has items that cost, and free items. All products are shipped to the driver at no cost.
    Driver earns $1 for every customer order (even if they only order free items) . You also get a 25% commission on all paid items. I average $70 a week. Pretty much pays my car note, and my rating remains 5 ⭐️ s. Riders love free items.

They tagvn release you, bottle neck you if you're close to getting your bonus. Cherrypick surges.. Drop rides, change rides in the middle, multiple destination changes, dropped group ride. Counts.. They freeze your app, play cat and mouse!! They rented me a car 980 a month, but made it bottle necked. So i had to work 50 hours a week to make 800 and put 300 in gas... It was awful n fixed. And when the fan belt broke, they took my car, and left me stranded on the side of the road 3 hours from town. That was it. No replacement, no bonus, no money. I hate lyft!

I drive at night and am usually already out on the road when I go online so it's hard to get a good picture. I have to pull off wherever I can find a spot. The app says its too dark, my face isn't in the circle when it is, my glasses reflect. This wastes so much time, sometimes I give up until morning
