Someone taught me a lot about irrevocable or complex trust years ago! Most does not know that a trust is a three party contract: Creator/grantor, Trustees, beneficiaries. "Living" trust is not a valid contract until the Creator/grantor died. Article 1, section 10 of the US Constitution stated 'right to contract' hence one does not need an attorney to get the contract done only the knowledge to make sure the language of the contract is good and the trust has been 'funded'! It is interesting to see you try very hard to avoid liability by all those disclaimers etc but just for knowledge educational purpose!

My sole beneficiary is already listed on my bank accounts as well as my investment accounts. The beneficiary should only have to present my death certificate in order to have my name removed and her name put on these accounts, correct? I'm pretty sure these do not need to be listed in my living trust, correct? My successor trustee will also be the beneficiary. I have a TOD on the title of my car for my beneficiary, so I have that covered, right? The only real property left is my house and its contents. The house does not have a mortgage.

Someone taught me a lot about irrevocable or complex trust years ago! Most does not know that a trust is a three party contract: Creator/grantor, Trustees, beneficiaries. "Living" trust is not a valid contract until the Creator/grantor died. Article 1, section 10 of the US Constitution stated 'right to contract' hence one does not need an attorney to get the contract done only the knowledge to make sure the language of the contract is good and the trust has been 'funded'! It is interesting to see you try very hard to avoid liability by all those disclaimers etc but just for knowledge educational purpose!

Good morning don't do this yourself the Estate Plan mistakes cost my family a million dollars in litigation, although this is a great educational tool to draft a rough copy, there are dozens more steps in an inheritance administration. My sole beneficiary is already listed on my bank accounts as well as my investment accounts. The beneficiary should only have to present my death certificate in order to have my name removed and her name put on these accounts, correct? I'm pretty sure these do not need to be listed in my living trust, correct? My successor trustee will also be the beneficiary. I have a TOD on the title of my car for my beneficiary, so I have that covered, right? The only real property left is my house and its contents. The house does not have a mortgage.

LawDepot forms are NOT free. You have to pay a fee for each form. I paid $29 for a Living Will because I didn't know each form has a cost if you don't buy an entire subscription. I then wanted to create a Living Trust and they wanted to charge me another fee. They have a free TRIAL, but after the trial, you have to pay $35/month for a subscription. They also have an option for $8.99/month where you can use ALL their forms for no additional charge, but you have to PREPAY this for an entire 12 months so it's $107.88 up front. NOT FREE.
