Very nice, very clear in so far as it goes. But let's say I have the perfectly completed trust in hand and a copy has gone to the named trustee. I die. Then what? Who does the trustee go to to make sure the terms of the trust are activated legally? Don't you still need a lawyer to execute the trust? How would the trustee gain control of real estate, bank accounts, etc? I doubt he or she can just wave the document in front of someone's nose and they'll do his or her bidding.

When placing real estate in a LRT, which is the correct deed to use? My research finds a QuitClaim Deed is the best to use. I did a survey of recorded deeds for a county in 2022-2023, and I see the QuitClaim Deed being used for LRT transfers. And ever one of them was drafted differently, the theme was the same, but there was no standardization at all. Some statements and clauses exist in one and are not found in another. Ultimately, its all about what the Title company will find acceptable when the real estate is sold. Based on the survey, its very loose. I would go with the most concise, clear, minimalist version

In other countries you don’t need to go through these bureaucratic steps. By law your house and other assets after death goes to all your children and then they decide for their portion to keep it or to give to other siblings.
Hello Edmund, I went to the country recorders office to file a quit claim deed to transfer the title of the house to the trust name. I was going to use the Trust Certificate, provided by my attorney, as the certificate provided with the Quit Claim deed. The recorder representative noticed that the Trust ID looked like a social security number, which it is. She informed me that because it wasn't noted that the number is a social security number, the Trust Certiificate would be made public. Obviously, I don't want that information public so the question I have for you is if I handwrite "social security number" following the Trust ID number on the Trust Certificate the attorney provided, does that nullify the Trust Certificate document? I called my attorney to inquire but he didn't even understand why I was trying to transfer the title deed to the trust now. I would greatly appreciate your input. Thank you in advance.

Is this correct? I am realizing setting up a trust takes a bit of time to fund it and all. So I was going to make a will to have at least one form of "protection". Meanwhile I will get the trust going and hopefully fund it best I can ASAP. Once I put property in the trust whatever was in the will such as my house would no longer apply to the will because ownership of it would have been transferred over to the trust. It would be no different that if I had a house listed in my will but sold it before I died, and that house listed in the will become null as a force of law?

Just curious, if a person has a judgment against them already when they receive property, they're not going to be able to create a living trust for real estate? It seems to me, those that took out the judgment against the person receiving property would find it out. I didn't hear anything about that in the video. I thought you just talked about beneficiaries having judgments.

Very nice, very clear in so far as it goes. But let's say I have the perfectly completed trust in hand and a copy has gone to the named trustee. I die. Then what? Who does the trustee go to to make sure the terms of the trust are activated legally? Don't you still need a lawyer to execute the trust? How would the trustee gain control of real estate, bank accounts, etc? I doubt he or she can just wave the document in front of someone's nose and they'll do his or her bidding.

When placing real estate in a LRT, which is the correct deed to use? My research finds a QuitClaim Deed is the best to use. I did a survey of recorded deeds for a county in 2022-2023, and I see the QuitClaim Deed being used for LRT transfers. And ever one of them was drafted differently, the theme was the same, but there was no standardization at all. Some statements and clauses exist in one and are not found in another. Ultimately, its all about what the Title company will find acceptable when the real estate is sold. Based on the survey, its very loose. I would go with the most concise, clear, minimalist version

When naming heirs in a LRT, should the full name be used, such a "John David Doe", or should it match how it is on their drivers license? This same question applies to listing beneficiaries on IRA accounts. Ultimately the heir will approach those possessing assets and be asked for ID....seems to me it should match the drivers license since that will be the ID used?

Why don’t you just list your bank accounts’ beneficiary as the trust?
If you retitle the real estate into the Trust. May trigger due on sale and you don't want to search and refinance at these higher rates.

In other countries you don’t need to go through these bureaucratic steps. By law your house and other assets after death goes to all your children and then they decide for their portion to keep it or to give to other siblings.
Hello Edmund, I went to the country recorders office to file a quit claim deed to transfer the title of the house to the trust name. I was going to use the Trust Certificate, provided by my attorney, as the certificate provided with the Quit Claim deed. The recorder representative noticed that the Trust ID looked like a social security number, which it is. She informed me that because it wasn't noted that the number is a social security number, the Trust Certiificate would be made public. Obviously, I don't want that information public so the question I have for you is if I handwrite "social security number" following the Trust ID number on the Trust Certificate the attorney provided, does that nullify the Trust Certificate document? I called my attorney to inquire but he didn't even understand why I was trying to transfer the title deed to the trust now. I would greatly appreciate your input. Thank you in advance.

If you are the beneficiary of a trust and receive real property. Can you transfer that directly into your existing trust? So you receive real property as a beneficiary from your parents trust and immediately transfer that to your trust?

NICER Simon says as long as you County Fund and NICER Record it with a New Warrantee Deed so inheritance thieves can't steal it.

Is this correct?
I am realizing setting up a trust takes a bit of time to fund it and all. So I was going to make a will to have at least one form of "protection". Meanwhile I will get the trust going and hopefully fund it best I can ASAP. Once I put property in the trust whatever was in the will such as my house would no longer apply to the will because ownership of it would have been transferred over to the trust. It would be no different that if I had a house listed in my will but sold it before I died, and that house listed in the will become null as a force of law?

Just curious, if a person has a judgment against them already when they receive property, they're not going to be able to create a living trust for real estate? It seems to me, those that took out the judgment against the person receiving property would find it out. I didn't hear anything about that in the video. I thought you just talked about beneficiaries having judgments.
