The judge was following the rules in a standard, procedural sense. The solicitor here is merely explaining the process and the procedural facts which are correct. Well you state Enoch's imprisonment isn't because of the views he holds. But that is exactly the reason he has been placed behind bars. He wasn't fired. He was suspended with full pay for harrasing and intimidating the school principal at a public event. His behaviour was so threatening that other staff members had to intervene. He wasn't even teaching the child in question. So he wasn't being forced to do anything that conflicted with his religious beliefs. Im sure him and his family are loving the publicity. No problem. 1. An employer is entitled to suspend an employee on full pay to carry out an investigation into allegations of misconduct 2. Once the employee is suspended he/she is asked to stay away from the premises until the investigation is concluded. This is for many reasons, including influencing witnesses, causing disruption in the workplace etc. 3. The employee in this case did not stay away and was, according to the school, a disruption to the children's education, cost to the principal in terms of the running of the school 4. The employer went to the High Court to get an order to get the employee to stay away 5. The High Court granted the order 6. The employee continued to attend the school in breach of the High Court order 7. The High Court jailed him for contempt of court as the whole shooting match of legal system and democratic rule in the country would come tumbling down if any individual can simply pick and choose the laws and High Court orders he/she will adhere to 8. That's why he was jailed

I have great concern that the First Court Order was made by the Judge accepting that the charge of "Gross misconduct" being brought against Mr Burke and is the basis of the Disciplinary Hearing has no basis in fact. It is evidently NOT a School Policy to use "they" etc but was "recommended" by a Principal. Also, as the First Order expires today, can he be released AFTER the School closes for the day? There is one thing that the law will not stand for and that is for someone to defy the law. The most important thing about the law is the people who work in it and they make sure that they will beat you into the dirt if you defy them. They're just human beings like you and I but they believe they are more important and don't let them tell you that it's the law that's what's important - it's the individual egos but they hide behind 'the law' so they can't be held to account for their draconian decisions. Mr Burke should request the court to look at the founding values as laid out in documents and deeds. They will outline the Anglican ethos and the values of the school that are expected to be upheld and fostered. If he is correct that teachers can only be suspended for gross misconduct, then obviously the injunction was granted without merit. He has described himself as a prisoner of conscience, as he believes the injunction was granted on an incorrect basis. Very admirable that he is willing to go to prison in ''The Joy'' for his beliefs, where he could potentially be raped by a big, black, sexually-frustrated inmate. SO the court sentences that teacher Enoch Burke stays away from the school as though of a predator were about, sentence taken by a judge, yet a human person who though it was fit to do so because he is a judge. He takes this decision following the refusal of the jailed teacher to call a student by the pronoun "they" and pushes him to fall into the trap of the law. Now that a case was made and a legal bounty is on his head, it doesn't matter what brought him not to obey the court decision. What it matters is that he disobeyed the justice's order. One action is a consequence of the previous ones. Instead of simply assess and understand the reason of the teacher for refusing to call that student "they" he was duped into that called "contempt of court". That was a deviation from the root cause of his decision and it cannot be sentenced as an act apart from the original and outstanding cause. Without it, neither the sentence nor the contempt of court would have existed at all. On the other side, how are the parents of that student sleeping today knowing that their brat, whom and whatsoever that is, is the root cause of jailing a person whose mission is the future of the children and youth? How is that brat feeling about his "victory" and sense of dignity knowing that he has prevailed over the name of the teacher, Mr. Enoch Burke, the real one, his dignity and values assigned to it by his real and full conscientious knowledge of moral values and deep respect for his students, now despised, proudly and vehemently by that lad's ignorance. How does the school react to this and what are they doing to defend him? What about the mental health of the teenager at the centre of this debate? He kept attending to teach, and since he did not follow that disciplinary order, then they made the order to the court. What was the reason for all this? His beliefs. I notice, in this discussion, that no one has considered the welfare of the student who wishes to transmission from male to female or the feelings of the parents of the student who wish for the school to not to refer to the student as he or she, but they. The basic fact is that Mr Burke was suspended from an Irish school for refusing to use imposed and unreal pronouns in the classroom. Why would a school have the right to tell a teacher how to speak? In a normal world, they should focus on school subjects. Of course, Mr Burke could have stayed at home, but still why you should be suspended for that? Not sure if this juridically goes against freespeech but EU Article 11 of Fundamental Rights says: "Everyone has the right to freedom of expression. Was Mr. Burke released on bond? pending trial at a local District court, how did this case wind up in the Irish High Court. Why was this case not heard where the alleged incident took place? How did this case wind up in the Irish High Court? Was this case outside the remit of the local District court, probably, due to the fact there is no legislation in place to deal with the due process of law clause concerning a legal remedy for cases like this. In fact many loop holes exist in Irish Law, particularly when it pertains to International matters involving the department of foreign affairs and the U.S. immigration system. Mr. Burke was jailed for failing to comply with a High court order handed down in connection with the outcome of a pending investigation from the High Court. If Mr. Burk was suspended from the school by the school Principle on the advice of the Irish High Court Judge until the investigation was complete, this is a reasonable outcome. Mr. Burke was ordered to comply with the Hight Court ruling and ordered to stay away from the school until the investigation was complete. This is a reasonable outcome. Was Mr. Burke on suspension pending an investigation by the school Principle? Obviously to be in contempt of court he violated a court order of record. So the High Court is the court of record. The High Court judge suspended Mr. Burke? This is a different matter. In fact it presents a very complicated situation, because from what I understand, from the information I have seen. The Judge in the Irish High Court is imposing an indefinite confinement sentence before there is a legal resolution to the complaint. Which is this Gender identification argument. This is basically a case where some individual is criminalized and sentenced without due process of Law. This happens frequently in Ireland because the Irish Criminal Justice System is not fully litigated. In fact many corporations come to Ireland because there are basically no laws in place to deal with complex issues where otherwise these companies would not be tolerated elsewhere. It is not uncommon for Judges in general to abuse their position of power and in many cases Judges refuse to deal with legitimate cases, simply because these cases never get to court. Consider the number of families seeking justice for the atrocities committed by the British Government on the people of Ireland during the troubles. Some people are subjected to outrageous crimes in Ireland, and fail to taken seriously by the Garda or the lawyers who practice law in this country. In Ireland like the U.S. and everywhere else there is a system of Justice which is selective. Everybody is not equal under the law. This is Orwellian Double speak for Everyone is equal under the law. If all people were Equal we would not have to resort to pronouns and this case would never get to court and what is more, Mr Burke would be an exemplary teacher doing his job. Cases that get lots of media attention are an opportunity for the legal profession to strut their stuff and advertise their profession in print media and television and social media. The judge was following the rules in a standard, procedural sense. The solicitor here is merely explaining the process and the procedural facts which are correct. He wasn't fired. He was suspended with full pay for harrasing and intimidating the school principal at a public event. His behaviour was so threatening that other staff members had to intervene. 1. An employer is entitled to suspend an employee on full pay to carry out an investigation into allegations of misconduct
2. Once the employee is suspended he/she is asked to stay away from the premises until the investigation is concluded. This is for many reasons, including influencing witnesses, causing disruption in the workplace etc.
3. The employee in this case did not stay away and was, according to the school, a disruption to the children's education, cost to the principal in terms of the running of the school
4. The employer went to the High Court to get an order to get the employee to stay away
5. The High Court granted the order
6. The employee continued to attend the school in breach of the High Court order
7. The High Court jailed him for contempt of court as the whole shooting match of legal system and democratic rule in the country would come tumbling down if any individual can simply pick and choose the laws and High Court orders he/she will adhere to

I have no doubt that Judge Quinn acted in accordance to Law. I have no issue with that. I have great concern that the First Court Order was made by the Judge accepting that the charge of "Gross misconduct" being brought against Mr Burke and is the basis of the Disciplinary Hearing has no basis in fact. It is evidently NOT a School Policy to use "they" etc but was "recommended" by a Principal. Also, as the First Order expires today, can he be released AFTER the School closes for the day? There is one thing that the law will not stand for and that is for someone to defy the law. The most important thing about the law is the people who work in it and they make sure that they will beat you into the dirt if you defy them. They're just human beings like you and I but they believe they are more important and don't let them tell you that it's the law that's what's important - it's the individual egos but they hide behind 'the law' so they can't be held to account for their draconian decisions. It's simply one human imposing his will on another human and they will use force if they have to!!! They will outline the Anglican ethos and the values of the school that are expected to be upheld and fostered. If he is correct that teachers can only be suspended for gross misconduct, then obviously the injunction was granted without merit. He has described himself as a prisoner of conscience, as he believes the injunction was granted on an incorrect basis. Very admirable that he is willing to go to prison in ''The Joy'' for his beliefs, where he could potentially be raped by a big, black, sexually-frustrated inmate. I hope he succeeds in showing that the injunction should not have been granted. Irish prisons are hellholes.

SO the court sentences that teacher Enoch Burke stays away from the school as though of a predator were about, sentence taken by a judge, yet a human person who though it was fit to do so because he is a judge.
He takes this decision following the refusal of the jailed teacher to call a student by the pronoun "they" and pushes him to fall into the trap of the law. Now that a case was made and a legal bounty is on his head, it doesn't matter what brought him not to obey the court decision. What it matters is that he disobeyed the justice's order.
One action is a consequence of the previous ones. Instead of simply assess and understand the reason of the teacher for refusing to call that student "they" he was duped into that called "contempt of court". That was a deviation from the root cause of his decision and it cannot be sentenced as an act apart from the original and outstanding cause. Without it, neither the sentence nor the contempt of court would have existed at all.
On the other side, how are the parents of that student sleeping today knowing that their brat, whom and whatsoever that is, is the root cause of jailing a person whose mission is the future of the children and youth? How is that brat feeling about his "victory" and sense of dignity knowing that he has prevailed over the name of the teacher, Mr. Enoch Burke, the real one, his dignity and values assigned to it by his real and full conscientious knowledge of moral values and deep respect for his students, now despised, proudly and vehemently by that lad's ignorance.
How does the school react to this and what are they doing to defend him?
There ought to be moral compensations and financial as well so that it be known that we are not in times when people were burned in the marketplaces for their believes.

What about the mental health of the teenager at the centre of this debate? Based on his actions up till now I can see no other outcome to this other than him being dismissed from his teaching job. If he cannot comply with an order of the court, because of his religious beliefs, he surely will not comply with any direction given by his employers, if it runs counter to his religious beliefs.
He could, of course, comply with the court order and respect the wishes of the student and the school and everyone could move on with their lives, but I doubt if that will happen.

The basic fact is that Mr Burke was suspended from an Irish school for refusing to use imposed and unreal pronouns in the classroom. Why would a school have the right to tell a teacher how to speak? In a normal world, they should focus on school subjects. Of course, Mr Burke could have stayed at home, but still why you should be suspended for that? Not sure if this juridically goes against freespeech but EU Article 11 of Fundamental Rights says: "Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers".
It would be interesting to ask: would a teacher be suspended for imposing the use of trans pronouns? Would he receive the same treatment as Mr Burke or they would give him a crown? Something definitely went wrong here

This is a pronoun issue concerning gender I.D. in Ireland. There is an allegation pending investigation where the investigation into the allegation has not been completed. There is a complaint at this stage, that is all. Mr Burke was not indicted or charged with any criminal offense, or was he? Did Mr. Burke get charged, arrested and booked into the county jail, processed, such as gathering relevant details, name, address, who are you, picture, fingerprints, deloused with DDT and in the case of a convicted felon DNA will be taken. Was Mr. Burke released on bond? pending trial at a local District court, how did this case wind up in the Irish High Court. Why was this case not heard where the alleged incident took place?
How did this case wind up in the Irish High Court? Was this case outside the remit of the local District court, probably, due to the fact there is no legislation in place to deal with the due process of law clause concerning a legal remedy for cases like this. In fact many loop holes exist in Irish Law, particularly when it pertains to International matters involving the department of foreign affairs and the U.S. immigration system.
Mr. Burke was jailed for failing to comply with a High court order handed down in connection with the outcome of a pending investigation from the High Court. If Mr. Burk was suspended from the school by the school Principle on the advice of the Irish High Court Judge until the investigation was complete, this is a reasonable outcome. Mr. Burke was ordered to comply with the Hight Court ruling and ordered to stay away from the school until the investigation was complete. This is a reasonable outcome.
Was Mr. Burke on suspension pending an investigation by the school Principle? Obviously to be in contempt of court he violated a court order of record. So the High Court is the court of record. The High Court judge suspended Mr. Burke? This is a different matter. In fact it presents a very complicated situation, because from what I understand, from the information I have seen. The Judge in the Irish High Court is imposing an indefinite confinement sentence before there is a legal resolution to the complaint. Which is this Gender identification argument. This is basically a case where some individual is criminalized and sentenced without due process of Law. This happens frequently in Ireland because the Irish Criminal Justice System is not fully litigated. In fact many corporations come to Ireland because there are basically no laws in place to deal with complex issues where otherwise these companies would not be tolerated elsewhere. It is not uncommon for Judges in general to abuse their position of power and in many cases Judges refuse to deal with legitimate cases, simply because these cases never get to court. Consider the number of families seeking justice for the atrocities committed by the British Government on the people of Ireland during the troubles. Some people are subjected to outrageous crimes in Ireland, and fail to taken seriously by the Garda or the lawyers who practice law in this country. In Ireland like the U.S. and everywhere else there is a system of Justice which is selective. Everybody is not equal under the law. This is Orwellian Double speak for Everyone is equal under the law. If all people were Equal we would not have to resort to pronouns and this case would never get to court and what is more, Mr Burke would be an exemplary teacher doing his job. Cases that get lots of media attention are an opportunity for the legal profession to strut their stuff and advertise their profession in print media and television and social media. This is one of these controversial cases. The Criminal Justice System needs to be overhauled and made relevant for the times. The Lawyers are too busy making money and the legislators do not want to hurt anyone's feelings who have the money to keep things exactly the way they are. It this was the Engineering profession we would be still in the stone age.
So if my 12 year old identifies as a queen should his teachers refer to him as your Majesty and if they don't should they all be suspended.
