- Solicitor Sinead Marmion explains how the Illegal Migration Act was disapplied by a Northern Ireland court due to concerns a migrant would not be processed.

The Government says they will not allow Northern Ireland to be the exception to the UK’s Rwanda scheme after a court judgment in Belfast.
The ruling delivered in the High Court on Monday would disapply large sections of the UK’s Illegal Migration Act in Northern Ireland.
Mr Shapps said: “We will ensure we will do everything that’s required to make sure … that Northern Ireland can’t be in this position. Because we believe firmly in being able to control our own borders.
“We are absolutely going to appeal that ruling.
“We won’t let Northern Ireland be an exception - exemption - to the rule in the United Kingdom.”

The Irish government in Dublin are making a law that the can send them back to the UK (ie Northern Ireland). So the majority will still end up in the UK (ie Northern Ireland)

This was a case in a Northern Ireland Court. The ECHR is part of the Good Friday Agreement and any changes to the Good Friday Agreement must be agreed to by the Co guarantors of the Agreement, the British and Irish governments and the parties in Northern Ireland.
