    I think that once a pro-se defendant says, "I don't understand..." the judge should say, "if you don't understand, you need an attorney, because what you are asking for is something any attorney would understand."

    • @ShizukuSeiji
      @ShizukuSeiji 2 месяца назад +5

      They should also say "Then you need to understand. It is YOUR DUTY to understand if you represent yourself. If you do not understand how this court works and the charges against you then that is entirely your problem. The trial will proceed without you understanding what is going on and there is a high likelihood that you will lose your case. Its entirely up to you sir."

    • @tylerkinley268
      @tylerkinley268 Месяц назад

      @ShizukuSeiji if we just printed laws in basic English language, there'd be no room for excuses. But as long as people have a right to represent themselves they will have the ability to impede and disrupt the process. Any attempt to reduce that would start a slippery slope towards anyone that the court seems 'problematic' or even just wants to run roughshod over.

      I think it’s that the judges feel that with enough work, or enough of an explanation, they will break through to one of these individuals and get them to abandon their false beliefs. I think they are searching in vein for a “win”. They are probably the type of judges involved in educational work in their spare time.
      It’s the same mentality as anyone indoctrinated into a cult. Logical individuals believe they can just locate the root divergence in thinking and then convert the individual into the correct path of reasoning.
      Deprogramming individuals doesn’t work this way. It is not a matter of pointing out logical fallacies as their abilities to reason themselves has been skewed. Ties have to be made depending on emotion, human connection, experience, etc to create a support foundation in which to slowly rebuild proper logic and reason again from the ground up.

      It depends how deep down the rabbit hole they go. There are ones that just grab the citations and the paperwork, and then there are those who go to the core theory of it all.
      Emory Law School has a good analysis. The core is based on the belief in 1933 when the gold standard was changed the country ceased to be a country and instead practices as corporate entity. There are competing fringe conspiracies as well relating the moorish empire treaty, or that re-interpret the word “incorporation” from the framework of incorporating to form the Union, to instead reference incorporation as a company.
