      I agree that he was completely professional, but when it comes to sovereign citizens, is it really worth being this patient? I just tried searching to see if they ever change their views on their beliefs and couldn't find anything. • @dsphillips16
      @dsphillips16 4 месяца назад +66

      @@sirpsionics You aren't necessarily being too harsh. In my humble opinion, when defendant's are polite and respectful, Judges should reciprocate. This defendant was attempting to be respectful but he had the mistaken belief that he was correct. It's wild that this man with zero legal training or education would argue with a Judge that graduated from Harvard law. As far as sovereign citizens go, I've only ever represented one. If you're watching this channel you probably know that most sovereign citizens don't want an attorney b/c they believe the court has no jurisdiction over them. This is nonsense b/c a court has personal jurisdiction over anyone physically located in that jurisdiction. If you're in Cobb County, Georgia, the Cobb county court has jurisdiction over you. Period. Every law student learns this as a 1L in civil procedure. The only sovereign citizen I represented went about as you would expect. His family hired me and I had no idea he was "sovereign" or I would have told his family to find someone else. I didn't find this out until I met with him in county jail. I told him he should let the guards know he was sovereign and he shouldn't be in there. He told me he already did that. I smiled and said, "well it looks like you aren't as sovereign as you thought. He fired me shortly after that which was EXACTLY what I was hoping for. LOL.

The supreme court has ruled that the sovereign citizen arguement holds no weight, and that law enforcement and the court system should not waste its time and resources playing the game with them. There are many judges who shut the argument down effectively, and all in differing ways. But a judge should hold an extraordinary level of decorum and honour and fairness no matter who they are, whilst also not playing along with these insincere, conniving, skeevy tricks to try and get away with committing a crime.

      Obviously there's more than one John Smith so it is incumbent on the court to prove that this man is who they claim him to be. He wants to be called by the secret name on his lawyer and God knows which is his right. If Jesus wasn't available to attend the court hearings, he should have sent his representative, the Pope. I definitely think he should ask the court for a mistrial due to a lack of competent representation. This will probably be one of Trump's request and he has plenty of evidence in every trial that his lawyers were just as incompetent as any religion.

      The judicial system is a derivative of the Christian morals and ethics, to claim to use the "lord" as your defence against a system derived from the teachings of the Lord is blasphemy and heresy. I would guarantee that the Lord would prosecute him even if he was his defence attorney. The Lord forgives if you admit remorsefully and beg for forgiveness with the promise of changing your ways, He does not forgive by invoking His name to defend your wrongdoing entirely.
      Sorry for the rant, I'm not a very religious person, but it does very much annoy me when people try to use a theology/religion incorrectly, and in fact according to that theology/religion, uses it in full opposition of the same theology/religion they are claiming to be defended by.

      I did some research... First, his last 5 years on probation are already set to be served outside of jail, but he has to make the entire five years without committing a crime, not likely imo. Second, the parole success rate in Georgia is close to 50%, so he'll probably be truly looking to get out around the middle of the 32nd year of his sentence. But he's a certified YSL gang member, so that means he also has to stay out of trouble for 32.5 years... not likely imo haha so I will predict that out of the next 35 years of his life(5 of the 40 already being served while waiting for trial) he will spend approximately 23 months out of jail on parole/probation, and the rest of the time will be spent inside. I have no love for the guy, so let him rot for the entire 40!

      I don’t think that’s 100% true although I’d need to look into it more to provide specific examples. The legal theories of sovereign citizenship are of course not sound; however my recollection is that there was a point at which, for more minor offenses, sovcit basically provided people with manuals to be as obstinate and obstructionist as possible and they were effectively able to act as the legal equivalent of a kid who argues with his parents until they’re out of energy and give up. The state decided prosecuting them for whatever criminal traffic offense they’re there for wasn’t worth the trouble. However this allowed people to think they could do the same with stuff like tax evasion, DUIs, and violent crimes where the government is not letting you off the hook no matter how long the trial takes, which sort of allowed for enough awareness of the issue among the legal profession that the legal system as a whole became more robust against sovcit tactics meaning now they’re just more likely to get you in more trouble for your infraction anyway.

      He's an adult. His mother didn't force him to commit crimes. She didn't force him to act disrespectfully in court, and even if she did, he can make the decision on his own to not act that way. Sometimes crappy parents are to blame for crappy kids. And sometimes those crappy kids realize that they don't have to be a piece of sht like their parents. Unfortunately this guy chose to be a piece of sht.
      Using your logic, if you had a kid and they grew up to commit crimes, you, the parent, should take responsibility and the consequences. That's insanely stupid.
