    Copyright vs. Trademark
    Image copyright and trademarks can be very confusing. You see a design online and think it's fine to use on your project. They're all over the internet, especially in Cricut Facebook groups. People give away SVG dumps and free SVGs that they don't actually have the rights to. You could be committing copyright or trademark infringement. So how do you know which designs and fonts are safe to use, and which ones are off limits? I'm here to help you learn!

    Copyrights and Trademarks are not the same. They are so legally distinct they're managed by two different offices within the federal government.
    Trademarks are handled by the U.S. Patent and Trademark Office, while copyrights are handled by the U.S. Copyright Office.
    What Is A Copyright?
    Copyright is a type of intellectual property, so something you thought of and made. In order to qualify for copyright protection, an original creative work must exist in tangible form. In other words, it must be written down or in a form you can physically touch. So if you create a unique design to put on a shirt, that design can be copyrighted.
    Generally, copyrights protect creative or intellectual works, and trademarks apply to commercial names, phrases, and logos.
    What can be Copyrighted?
    A lot of things can be copyrighted including paintings, photographs, illustrations, musical compositions, sound recordings, computer programs, books, poems, blog posts, movies, architectural works, plays, and so much more! (www.copyright....)
    Who Is A Copyright Owner?
    Everyone is a copyright owner. Once you create an original work and fix it into something tangable, like taking a photograph, writing a poem or blog, or recording a new song, you are the author and the owner.
    Things That Can't Be Copyrighted
    1. Ideas, Methods, or Systems
    2. Commonly Known Information
    3. Fashion
    4. Names, Titles, Short Phrases, or Expressions
    While not protected by copyright, if it pertains to your business (for example, goods and services), it can be protected with a trademark.
    Also exempt: Names, Titles, Short phrases or expressions, Product descriptions, Pseudonyms, Titles of works, Business names , Recipes
    What Is A Trademark?
    Trademarks protect the use of a company's name and its product names, brand identity (like logos) and slogans. They protect words, names, symbols, or devices used in trade with goods or services.

    I am wondering about the personal use of things though. If I find a design I like and make and wear it and keep it for myself, is that illegal?

      Well if you make a Nike shirt for yourself, for example, technically that's illegal. But if nobody knows then who cares. But if you post on social media that you're doing that so everyone knows and they tell someone then you could get caught. Basically just don't brag about making counterfeit stuff.

    But how do we know the images/fonts uploaded onto creative Fabrica by 3rd party sellers, wasn’t stolen? I have a membership but I’m so hesitant to use it because if the person who uploads images doesn’t have the rights to, then we still get in trouble if caught using it :/

    So if you use the subscription, then cancel the subscription say a year later, is everything you downloaded still yours to use and the liscense is in tact? Or is it only good while you pay the subscription? thank you.

    What if a person make ears on head bands ( you know the ones but call them something else and change colours and design slightly would that be ok I have heard that if you chànge a design up that's ok.But I really don't know

      No people can cut whatever images they want. It's their responsibility to know the laws
