I can't blame the lawyer for quitting in protest afterwards. For the judge to get such a slap on the wrist and a warm welcome back, it shows a complete disregard for the rights of the accused and a blatant level of corruption. He was right to be frustrated and disillusioned, and I'm glad that the judge eventually got permanently removed.
Something strange happened that day. The people judged the judge, they applauded his return and then and there, the court decided unanimously that the lawyer must have been just one giant pain in the ass. It's super wack he didn't just get fired then and there but I must admit there's a beauty to the story. I mean, some of those people were there to be sentenced by the Judge, yet they were pleased by the spectacle? Maybe they saw the judge as more human and somehow trusted him more for whooping some ass? 😂 just wild thoughts but the reactions are so strange it makes one wonder 🤔

Judges usually get a slap on the wrist. You can't sue them and they can override the verdict or go against the law with sentencing. No way courts should have this much power.

What scares me more is not the judge getting into a fight, but the fact that he proceeded to make judgments and verdicts on seven of the public defenders clients - _without_ council present. That would almost immediately get any lawyer salivating for not just getting the charges waived for those clients, but possibly even a lawsuit for the breach of their rights.
Does anyone know what happened with those seven cases by chance? I couldn't find anything on them.
People have a right to a public defender, they are not required to have one if they do not wish too. They likely waived public defence

It wasn't a trial. Just pleadings and setting court dates. Strictly clerical.
@@stevenschnepp576they were probably arraignments . They hafta formally charge you of something then set a court date. In the meantime is when you hire a lawyer or apply for public defender. Chances are with those people he simply continued their court date a week or two. He might have done something stupid out of anger, but I don’t think he would frivolously mess up the remaining cases. If they were traffic related or some misdemeanor with no jail some just plead guilty and take their fine right there. Appearing is a formality.
Imagine you got a jury summons, you are dreading it for weeks. Reluctantly go in and sit down to be treated with this. You'd be on cloud nine, You now don't have to finish jury duty due to being contaminated and you got to see a lawyer and a freaking judge step out to duke it out.
The jury wouldn't be present during this process. They'd be in another room waiting to see if any of cases scheduled for resolution that day actually went to trial (as opposed to a plea bargain). My jury duty involved getting some training, waiting around for a couple hours with the other jurors, and then going home. Never even saw in the inside of the court room.

The fact that the judge asked that dude a question after his lawyer was assaulted and arrested basically ensured he was a free man.
It turns out that the right to an attorney can't be deprived because a judge decides to step out and bang it up with said attorney. Especially for the act of disagreeing with him.
Tbf, the lawyer at least winded the guy, I think he has a good shot if the judge doesn't get his second wind
@@hossdelgado626 pretty sure - by the audio - the judge and the lawyer squared up and scuffled. My best guess is that the bailiff or sheriffs instantly apprehended the lawyer and the judge came in "winded."

I feel like if you challenged someone to a fight, and they took you up on that (meaning both parties consented (I'm not sure of that was true in this case)) and security let you do it, then I don't think you would go to jail. I don't think the judge should go to jail (which it sounds like you might be implying).
I do think the judge 100% deserved more punishment than a paid vacation until the media got on him. He may never have been punished at all if this didn't become well known.

This guy was deemed reasonable and sensible enough to become a judge and the people clapped when he came back in because they saw him winning this mindless fist fight as something to be proud of rather than a shameful display of idiocy during a trial

I love this; this is an extreme but clear case of a public defender actually defending a member of the public and doing it in a way that is extremely disrespectful to the court on one hand but almost hero level when it comes to standing up for the individuals constitutional rights. Most public defenders aren’t like that one bit and depending on the situation the public defender is nothing more than a mouth piece to deliver the necessary law jargon most people see as almost a second language

Most public defenders are friends with the judge and function as passive prosecutors, he fucked up when he tried to do his job the right way

It wasn't that he asked for speedy trial but the idiot could not even answer a question directly. Not a guy you'd want defending you.
100% right. The judicial system isn't really made for everyone to get a trial. It would bog down completely if everyone insisted on a trial. That's what pissed the judge off about this lawyer, he refused to cut deals and free up the court docket.
That's why you have to be weary about taking a public defender's advice about a plea bargain. They are usually in cahoots with the prosecutor and judge to keep the system moving.
I don't know about that, from my experience, a lot of defenders tend to hate the prosecution and vice versa
@@rickjames8317 Its advice, not a requirement. Its not like the public defender can change how a trial is likely to go and they know how the system works. They tend to be pretty brutally honest about the situation and the chances, so if, like in one example, their client was caught on camera robbing a store and was found with said stolen items, its not like they have a lot of options. But client was part of the Sovereign Citizen movement and wanted that to be his argument, so the defender was forced to go with what his client wants rather than the best deal and it didn't work out well.
Back in the 80s there was a criminal court in southern California where, somehow, a gun fight between a defendant and court security and including the judge, broke out. His Honor ducked behind the bench and got off a few shots. Sometime later gunmaker Taurus brought out their Judge line of revolvers, although I'm sure there was no connection.

How frustrating is the law system in America?
@@FluidThinker Honestly, it's not as bad as people say. It has a lot of protections for defendants built in. For example, speedy trial is intended to allow a quick resolution to the issue so it doesn't linger and destroy the defendant's life in case he'snot guilty, but the defendant can waive it for strategic reasons. The 5th Amendment means that you can't be compelled to testify against yourself. The 6th Amendment guarantees you a lawyer to assist you in your defense, and there are a lot of similar protections: jury trials with the defense and prosecution both picking the jurors together, a high burden of proof on the prosecutor, no burden of proof for the defense, broad discovery for the sharing of evidence between the parties, 4th Amendment protections requiring a warrant signed by a judge to search your property, reasonable bonds for pretrial release are required (depending on many factors, including the seriousness of the charge and the defendant's criminal record), etc.
Most cases end in pleas, but from my experience, that is usually the best option for the person taking it.
Honestly, the hardest parts about it are the residual issues. Suspended driver licenses for certain offenses are a very common complaint.
Another issue is that the system is set up in a way that can be abused by the prosecution overcharging and then offering to drop several charges to bully a defendant to plea; however, if those charges are baseless, then the defense can, and should, file motions to dismiss with the court. I've resolved more cases through morions to suppress evidence and motions to dismiss than through trial.
There are a lot of misconceptions about the American criminal court. I've thought about making a video series to explain American law, including criminal, administrative, appellate, civil, and others I've practiced, but finding the time, and making it quality enough to be impactful, is basically like taking on a second job.
Edit: I forgot Double Jeopardy. Once acquitted at trial, the prosecutor cannot appeal and the case is closed. In the US, the prosecutor can appeal a legal decision by a judge (like for evidentiary motions), but a not-guilty verdict is the end of it.

That judge's behavior was utterly unprofessional. Physically striking the attorney or not, his behavior was unacceptable. The "paid leave" (i.e., vacation) "punishment" was ridiculous. Glad he was later permanently removed - though it shouldn't have only occurred because an outcry followed.

That would be the judges seven counts of violating somebody's constitutional rights by going on without a public defender. He should have served a minimum of 20 years in prison. But we all know that's not how our court system works anymore.

As a native to Florida, maybe I can give some insight as to why the entire courtroom didn't erupt in chaos when the lawyer and judge left the room: Two law enforcement officials getting into a physical altercation with each other is just another Monday in Florida. Everybody in that room is used to weird stuff happening (it's FLORIDA) and so the prevailing thought probably was: "I am NOT missing another court date." So they just stayed put and patiently waited for things to resume.
I've seen this footage a number of times, and it peeves me because no one brings up the rights of the accused and how this defendant was deprived his right to due process in so many ways...
The State Supreme Court literally cites this as the extraordinary reason for his unilateral firing and having him disbarred.
The fact that the judge asked the defendant to commit to any legal proceeding after being deprived of his attorney via PHYSICAL ALTERCATION OF THE JUDGE cemented his fate.
It turns out that the "right to an attorney" isn't negotiable.

In my opinion, judges have too much power. Because it’s “their courtroom” they’re simply allowed to do or say whatever they want for the most part. The judge shouldn’t have any power whatsoever beyond handing out the final judgment, period.
For some Judge's it's a total ego/power trip. I fought a traffic citation in court and the Judge treated the whole process like she was starring on an episode of Judge Judy, belittling everybody and cracking jokes. It was sickening.
I’ve always thought the concept of judges seems extremely archaic. The fact that we still have to refer to them as “your honour” is ridiculous.
They should of course be highly respected, but the amount of legal power they command is not justified when you consider how frequently a judges personal interests end up swaying the outcome of a trial.
Western society likes to take pride in the diffusion of power from one to the many, and yet the central factor of our legal system is the consolidation of a massive amount of power into a single subjective individual.
Of course, the way our legal system is built, we don’t really have a good alternative, since needing anymore than 1 person to do much of the responsibilities a Judge does would take way too much time. Having to convene a council for every single little thing like setting bail would be realistically impossible.
@@confucheese Are there any specific things they have too much power over that you can share? Because all I can think of is contempt charges and decisions on motions (which can always be appealed by defendants if it ends up not going their way)
Couldn’t the judge just hold the attorney in contempt, and order him out? I know in the UK judges are a law into themselves. They shout at people in the gallery if they have a hat on and threaten them, they can order someone taken into custody if they want.
@@gregthomson2299 In US the system is backwards for contempt. Criminal Contempt is usually a fine, but can be imprisonment (which requires a burden of proof from the judge that the accused disrupted tribunal or prejudiced the trial).
Civil contempt, the more common, is a sanction that includes incarceration. Civil contempt is more common and does not need due process, as the person "holds the keys" to their incarceration (i.e. the incarceration is lifted if they comply with the order)
It's usually a non-issue as the Judges court room rules can be challenged pretty easily, after someone is found in contempt. Sometimes they have weird rules, but since no one has been found in contempt of them they go unchallenged.

It wouldn't be efficient in the slightest. Efficient means it's also good. Just beating someone up in a court case about someone being assaulted is biggest irony and shows how fucking dumb it would be to just have people fistfight instead of an actual trial.

I bet the judge heard a lot of people talk about how they only committed said crime because they were in a very stressful time, had a mental illness such as PTSD, or both, and said, "that explains your behaviour but it does not excuse it", and threw the book at them.
Bet those people wished they had had a judge who understood. Oh well. I'm sure they're fine now. It's not like the American prison system has done anyone any harm
