- The family of a New York man claims he was killed by his Peloton bike just six months after buying it, but the company insists that his own negligence caused his death, according to a lawsuit filed in state court. NBC News' Marissa Parra reports.

Absolutely insane they are trying to blame peloton for this… tragic scenario but simply a freak accident and nothing more
i agree, like he was using it as a hoist to get up not even was ridding it. That lawsuit is gonna desmissed.

This is tragic…however… no different than if he would have grabbed a handle on on chest of drawers and it toppled over…or the edge of a bookcase…a full sized adult man relying on a stationary object not bolted to the floor to pull them up from the floor is taking a big risk. Very sad and untimely death for that man…but I don’t think it’s a Peloton issue.
I totally agree with you. This is negligence by the USER, not Peloton. There's a reason why cranes topple over sometimes. It's simply the laws of physics. Disobey them, and you can be a victim.
@@tompetrie1676 EXACTLY! Great example! I’m an Engineer in heavy construction 😉 the load being heavier than the counter weights = disaster. This was a tragic accident and very sad for the Victim. But that’s what it was…a very terrible accident.

Unfortunate accident, but it wasn’t being used as intended. It’s not suppose to support an adult getting up off the floor. And the company shouldn’t have to put a safety warning about something so common sense. People do not follow safety protocols, which is the cause for most of these accidents, as in the cases especially involving children. It’s equipment intended for adult use, and leaving children unattended near the machine is a recipe for disaster, and a risk the consumer assumes.
Exactly, who left the bike on or wasn't watching the child. I could see more a fault in the design of the treadmill, however using the bike as a hand up seems more like an unfortunate event and not the fault of the company. Overall, it's a sad story in this world of litigation.
I concur, as it should be filed with this... "The main concern about the use of hair dryers in bathrooms comes from the potentially hazardous mix of water and electricity. You should never use a hair dryer near full bathtubs or sinks, or showers, and it is always advisable to unplug the appliance (not just switch it off) when it isn't in use." Yet they could've taken notice that escalators at the bottom and top of those are designed for safety as they could be. Thus a sensor could conceptually be installed to stop a treadmill device once it has a safety threshold point of time and resistance.
It's America, someone could use the bike as a parachute and die and family would sue saying it wasn't built properly.
@@thunderkracke1550- 👈🏽👈🏽 This is exactly the issue here! Aside from being a country where we sue for everything, we’ve created a situation where people blame fault and claim foul on unrelated circumstances.
As a business owner, I have to think of disclaimers for disclaimers.
The Peloton was a defective handlebar and wasn’t issued with a list of 200 different scenarios that it should not be used for.
It looks like the consumers are to blame. I'd buy one.

I'm sorry but it's a piece of equipment. It's up to the owner to keep the kids away from EQUIPMENT. not the company. This case, we aren't being told who or what failed.

Exactly, from McDonald's coffee being to hot to Burger Kings Burger being to small seems like an easy way to make a buck. I feel sorry for the family for their loss but the bike wasn't used as intended. It's like a dunk blaming a whiskey company for his D.U.I. .
@@jessyhavron2548The McDonald’s coffee incident was legit. It was way too hot. So hot it fused thy lady’s labia and all she wanted was her medical bills covered. When I’d just got out the Air Force back in 2012 I worked at McDonald’s while waiting for something better and became a manager and now even McDonald’s has a safety course about the coffee even though they denied any wrongdoing back then
Seems like a freak accident. The kid getting sucked under the treadmill was negligence for sure, but this guys death is like anything heavy that falls on you can severely hurt you. Feel bad for them though, i understand they are upset.

the bike is very stabilized to NOT fall over this isn't making sense didn't they say New York man, there you go, a small apartments 5000 dollars per month in New York, sounds to me it was self inflicted
The bike is SO HEAVY...this was very odd, sad but being an owner..no way did he just hold the bar and easily swung..peloton is one of the best investments I ever made. Im also a mom sad re the treadmill, however any parent that has a little one or dog even that doesn't either have a gate around either (bike or tread) or have it in a no kid access is sadly not very bright.

Sadly peloton provided keys to lock the thread which was part of its safety feature. It’s easy to scapegoat Peloton because they’re popular but many people don’t know or have forgotten even Bowflex machines and caused some death and they weren’t as stringent on overall safety as Peloton

I don't think their should be a case unless they can show the bike is excessively dangerous. For example you can die in a car accident, but to sue the automaker successfully you would need to show that the air bag malfunctioned, the seat belt didn't work, they auto maker chose not to include an active stability mechanism that was commonplace at the time of manufacture, used defective materials ect. What about the bike made it more likely for this guy to die than every other exercise bike? Was it getting off the bike as part of the workout and doe s having him do that constitute negligence on Pelotons part?
If you listened, the video says he was doing a floor workout and grabbed the bike to pull himself up. He wasn't getting off the bike.
@@ananse77 He did get off the bike because the workout told him to get off the bike. I understand he pulled the bike onto himself getting up. But maybe they should not have added that to the workout. I really doubt the family has a case.

@@ananse77It’s the Bike Bootcamp workouts and no they don’t recommend using the bike to get up and the instructors never use the bike to stand. Only for maybe stretching hamstrings but that’s about it and even then only about 20% of your weight are in one leg

I learned from some Combat Controller guys when I was in the Air Force that some of their sharpshooters, Navy SEALS and Marine Recon snipers will aim for the base of the skull to sever the spinal cord which is know to cause near instant death. Outside of that and being crushed by something that weighs multiple tons I can’t think of anything else that would cause instant death so no you’re not really wrong but like everything in life there’s some exceptions

I also have a peloton bike death story - I had to melt it down after this because I just couldn't stand to look at it. Damned peloton bike stole my car, drove to the store and bought a gun and came back and slaughtered my whole family! peloton bikes are sentient people! be warned! (sarcasm for anyone that missed it)
