    Disability Attorneys Gregory Dell & Stephen Jessup discuss short term and long term disability claims administered by Sedgwick Claims Management Services.
    Sedgwick can be a very difficult company to deal with for disability claimants. This video discusses some of Sedgwick's disability claim handling techniques and some of the methods they will rely upon to deny a disability benefit claim.
    Sedgwick will capitalize on any potential inconsistency in a disability claim in order to deny a disability claim. Attorney Dell discusses a recent claim denial by Sedgwick and their unreasonable basis for denying a claim. Sedgwick is notorious for saying "That's our company policy".
    Disability claimants must be cautious when dealing with Sedgwick Claims Management Services.

    I was an employee with Sedgwick and I was fired from the company by my supervisor in retaliation for making complaints about the unprofessional behavior of several employees.

    My husband was fired because Sedgwick closed his claim.
    Lie one- we didn’t get complete paper work from his dr. Went to the drs office and they have a recording of Sedgwick thanking his dr and saying they need no additional paper work for the next 12 calender months.

    I cannot stand Sedgewick and the way they operate. A rep there admitted to me she didn’t have medical certificates when making claim decisions and caused way more trauma on me with what they had put me through. I’m glad I had copies of my calls with them, except the one where a rep said “well you don’t sound disabled to me”. They are terrible, always have been.

    I was out of work in 2016 for injuries to both shoulders. About 2 months into my disability, I got a notice that I was scheduled for an IME. I live in a rural area so I had to drive 6 hours round trip to the exam. The exam was on a Friday. They shut off my disability benefits that same day. To me calling the exam Independent is ridiculous. Who pays the IME doctor? They aren't going to find in the employees favor if they are being paid by Sedgwick and ultimately the company that sedgwick is working for.

    Lie two. We sent paper work and you didn’t fill it out. We never received any such paperwork
    The next one was. Someone from his HR Department called us and said they told them he was playing the system.
    We lost out health insurance and our life insurance.
    We had been to a surgeon and my husband had 6 herniated disc in his neck and needed a nerve block and if that didn’t work he would have to have surgery. He fell off our deck 6 years ago and in May 2018 started having a migraine that would not go away. Neurologist has tried at least 10 to 12 medications and nothing touches them. Sedgwick needs to be closed.

    Aon Hewitt was my initial short term provider appx. 5 weeks when I was notified Sedgwick was taking over. I had neck fusion and they were on me about my return to work 4 weeks ahead before PT was to start. I filed for disability less than two weeks after they took over because I knew they were going to try to bend me over the barrel. Our company has 3 day no call no show, same as quitting policy. So, while I was medically cleared from work Sedgwick called my employer to say I was medically cleared, which they denied when I called my case mgr. My boss was calling me to report to work Sunday night 3rd shift and in the morning get with our EHS rep to sign papers to be cleared to work. So, 2 ways they were trying to get a technicality were 1) I didn’t show up and the days start ticking for unexcused absences 2) I worked illegally Sunday night before being medically cleared by EHS rep. As an employee 19 years with the same company I was prepared for the backlash and was in contact constantly with my lawyer, Sedgwick and the rep at HQ of my employer. I recorded conversations as well. Sedgwick disrupted my pay periods up to 6 weeks when I was on a biweekly pay cycle, they even broke up my last 56 eligible hour on 2 checks do all my deductions reduced my net pay. Sedgwick are plain evil. The operations manager of my surgeons office told me Sedgwick are the bullies of the block when it comes to dealing with disability insurance. Be prepared to fax your doctors reports from multiple sources because they claim that they haven’t received anything from the surgeons office. Best advice, keep your cool, be direct, take notes and record all conversations. Good luck if you’re dealing with Sedgwick.

    Workers are always losing in this, like with “Independent Doctors”, how their opinion can have so much weight if they get paid by the insurance companies?, many just work doing this waiting for referrals from them. Guess on what side most of them are?

    diagnosis, sagittal sinus thrombosis, with multiple seizers secondary to that. been fighting with them for 4 months, winning each fight, but still having to fight after each doc appointment. will be going on long term disability with liberty mutual soon. i have made a miraculous recovery considering my condition, still not able to go back to work yet. have equilibrium issues and on a high does of anti seizure meds which also have some side effects that limit my ability to work. seeing neurologist earlier than doc wants me to because sedgwick pushed him into it. he did make a note that sedgwick has undermined his decisions and put patient unecessarly through stress. i think the doc got fed up with them and rattled them because i got approved till next appointment faster without any lost paper excuses than ever, actually the next day after appt. my question is when i go to long term with liberty mutual, what problems will i have to look forward to then. by the way i keep records of everything, all emails, phone conversations, i am just lucky i had not damage to the part of the brain i needed to do that. it was a struggle for a while because i forgot how to type, had to hunt and peck for the first 6 weeks, and could not look at computer screen for more than 15 minutes without dizziness. but here i am 4 months later. better, not 100%, but so tired of fighting every move, doc said it makes it hard for my brain to heal as well. kind of scared what i have ahead of me with liberty mutual. i dont expect to be on long term long, but i dont know. i have not made much progress in the last month with my equilibrium problem and right now not sure how much better i will get. work for walmart, full time last 7 years. i may end up calling you yet. got your web site from a friend to call in case sedgwick did not turn around.

    I sprained my ankle in 2017 and missed 5 weeks of work, my Doctor faced them my paperwork over 10 times until they finally wouldn’t anymore. A few times Sedgwick would find additional information to ask for, other times they’d say they never received it. I had an Achilles surgery this year and they threatened to deny my claim ( my paper work didn’t show up until after that deadline 5-6 weeks after I requested it and they’re in the same state as me) luckily I called my union hall and they ripped Sedgwick and were able to get the paperwork printed. They’ve been easy to deal with for FMLA but LORD you have to fight for your disability which in my case was only 60% of my 40 hour check. Does anyone know if I can sue for my money from 2017? Thanks

    • @DisabilityAttorneys
      @DisabilityAttorneys  2 года назад +3

      Ms. Bandy, I am sorry to hear of your struggles with Sedgwick. They can be very difficult to deal with. Remember, it is always best to submit all the “proof” of your claim yourself and it is best to send it multiple times in multiple ways (fax, certified mail/FedEx, etc.). Insurance companies often play the “we didn’t receive it game”, but if you have proof of their receipt (fax confirmation or signature from FedEx), it makes them difficult to utilize the lie. Regarding your 2017 claim, the time period you have to file a lawsuit depends on the governing policy. Most policies give you around 3 years to file a lawsuit, though some offer more time. You will have to review your policy to see what governing time period is to calculate if you can file a lawsuit against your employer for the 2017 benefits.

    • @sandyhaycraft2846
      @sandyhaycraft2846 2 года назад +1

      They will not connect you with either your claim rep or supervisor. They will just say they are unavailable and connect you with their voice mail. So here's another little trick they have, the voice mail tells you to leave your name, number, etc after the beep. But if you hang on you'll see there's a long pause, and I mean really long pause, and then it instructs you that you have to 1 to send. I just happen to hear this when I had laid my phone down while leaving a message. I called then over 60 times! No one available. I called a few days ago and there was a 20 minute wait. Finally a service rep answered but said she couldn't me because she didn't have access to my claim. Put me hold again for another 20 minutes, then it went straight to their survey. The next time I called there was a 60 minute wait I kid you not. I hung up. That's ridiculously unreasonable to expect people to hold for that amount of time. I get two 10 minute breaks and 30 for lunch...can't do it. Its the most ridiculous thing I've ever had to deal with. And what's even more ridiculous, is they get away with it. Getting ready to lose my job of 15 years and its entirely because of this company's incompetence and deliberate tactics to sabotage your efforts to follow the guidelines required in filing a claim. The stress you encounter dealing with these criminals is through the roof. Im all in and totally for a Class A lawsuit if and when it ever happens...

      Disability Insurance Attorneys Dell & Schaefer -Had cervical surgery one year and a half ago. It is only partially fused and having all sort of pain and issue. We are hoping is not psudoarthrosis. ?At the sane time developed facial twitch and droopy eyes which my sedwick surgeon not sure if it’s industrial. My neurologist on workers Comp team not sure either, so I been using my own insurance seeing different doctors to try to get answers. Now, I been declared P & S by my sedwick surgeon due to numbness, unsteady gait, cervicalgenic symptoms etc... he also stated “ he will not be working for sedwick anymore” and he gave me 32% rating ? and also signed my restrictions paper for social security for permanent restrictions and states “ you can’t go back to work” Ok , so I agree, and now I have long term insurance coverage. But in two months I have to see Qme, and if the Qme send me back to work I will loose my long term disability and an inability to file for social security. It will totally be ridiculous for anyone to send me back since I can no longer drive, cant walk right, dizziness, facial twitch and eye droop. If Qme doc ( many times I heard they are hired by sedwick to get you back to work) send me back, which will be cruel, can my own doctors I been seeing override the decision if they think the twitch, dizziness, eye droop etc..is a medical problem non related to industrial, meaning if they think I have medical issue along with industrial will I still be forced to go back by Qme and then loose my long term disability coverage? Feel like they might set me up to get me back to work so my employer will fire me. A few of my co workers got terminated once they went back to work, they said sedwick set them up! Also not sure if my sedwick surgeon that told me he no longer works for sedwick anymore is being paid to stopped being my doctor. He knows I’m not able to go back to work, and even said so himself. But my attorney got paperwork today stating the sedwick doc gave me 32% rating....??? I have a feeling the Qme might rate me low due to sedwick manipulation of all of this to set me up to get me fired and loose the case. If they play this game I may loose my long term insurance coverage. Can my own medical doc have a say so if they feel what I’m going thru is a medical case also....? Please I just need this one answers.... please help.... thank you....
