My disability benefits state that we get paid at 60% of our base weekly pay, but in actuality we only get paid at 27% of our base weekly salary because the employer put a cap in place limiting what we get paid weekly for STD. Can they do this? What we get paid is not 60% it’s 27% of our salary weekly, is this legal? Is this allowed. Shouldn’t the employer let the employees know or say STD is paid at 27% and not say that it’s paid at 60%? This just doesn’t seem right to me.

I’m a stage 4 breast cancer patient out on STD. I’ve exhausted my FMLA and my job partially approved my ADA . Their reasoning is me being out on leave beyond a certain date will cause them a “undue hardship.” I’m currently in chemotherapy and the side effects after chemo is excruciating. There’s no way l can get back to work before my job will terminate me. Can l still get LTD after being fired?

Vikki: Yes, you can still transition to LTD as long as you satisfy the definition of disability. Termination will not impact your right to pursue LTD.

My nurse at my general practice had stage 4 breast and is ned for 17 years and counting. From my understanding people have short, long, and permanent. Might want to look at social security permanant. You might qualify for that because of the cancer. God bless you.

It's absolutely frustrating, I'm transforming to LTD It's a joke the Hartford can't tell you the hoops you have to jump through, you have to fill out the same paperwork over and over, why because they say they didn't get the paperwork, lol! But not. So tired of the Hartford please contact me I would like an attorney

Yes I work for WAL-MART and I cannot work in the freezer and I got caught at home all day told me I cannot go back to work but I can watch someone else in the store but they will not let me go back to work so right now I’m waiting to see if they don’t take me out in the short term disability I’ll be able to cut the 25 years
