  • Disability insurance attorneys Rachel Alters and Gregory Dell discuss about whether you can collect workers' compensation and disability insurance benefits at the same time. There is an overlap between workers' compensation and long-term disability insurance. Usually, the long-term disability insurance lasts longer than the worker's compensation, because each state is different and workers' compensation is difficult to claim in most cases.

01:50 - You always need to put your long term disability company on notice of a potential disability claim in a timely manner.
05:09 - If you have an employer provided long term disability policy, then they will almost always deduct the amount of your workers' comp payment from your LTD monthly payment amount.
07:01 - You may be able to structure your workers' compensation settlement so that you don't have a long term disability offset.
09:42 - Your workers' compensation doctor may not support your long term disability claim as the standards for eligibility are different.

I want to mention I filed a claim with the insurance commission when they denied my disability insurance claim through my employer. I kept getting denials even though workers comp legally denied the claim. Always remember to go to your states insurance commission. Hope that helps

You know what I don’t like is when a person is injured on the job . The employers insurance totally decides who or when a person gets into short term disability or long term. The only thing one can get approved on is employee medical leave act or fmla based on treating doctors reports . Other than that employers insurance holds almost all the cards on this decision. I know because I was blocked from this status . WC benefits is on hold as well until settlement is made . So one is handcuffed from
These benefits. The injured employees are at the mercy of the insurance decision status .
