Do you even know what happens in an arrest? Force is always implied unlawfully. If the police were to move forward with an arrest, they would have violated very basic constitutional rights as well as case law. Gavin was within his rights. Police officers in the United States are not conscripted. Every single one of them files a job application, takes the interview, performs an evaluation based on their physical and mental health, and if they pass they earn their badge and start the day at work.
I can't believe you of all people believe this "cops are thugs" mumbo-jumbo. Do you seriously think the majority of police in the United States indiscriminately target victims of what are labeled "hate crimes" or do you have enough common sense to know that being a police officer is a very dangerous occupation, in fact one of the most dangerous occupations there is?
The main problem is that most police officers, usually a staggering 80% or more suffer from PTSD. When they believe their life is in danger their first instinct is to defend themselves. Usually that involves reaching into their holster. The problem is that sometimes they forget which is their pistol holster and which is their taser holster. They're trained to defend themselves. Not to waste their time deciding what's what and possibly ending up on a slab at the morgue.

In some cities of Australia the cops are a lot worse. They will even pull you out of the car if you argue with them. I've seen cops going overboard with their control, and losing their temper many times.
One cop even snatched my phone out of my hand for taking a picture of their badge, and attempted to smash my phone on the ground. The only reason he stopped was he realised there were many witnesses at the scene at the time.
That particular cop was blocking his badge number with his notebook (which was illegal)

The constitution says seize of property is lawful if there's probable cause. It also says states are allowed to maintain local laws. If you break a local law ie not paying traffic tickets its constitutional for the police to arrest you. Now on the other hand it's a 1st amendment right to record police. Props to Sargent. He technically didn't have to sit there and converse (and do it calmly at that). Stayed professional and didn't allow things to escalate. If more cops acted like him, my opinion on police as a whole would be very different.

I've call called for assistance twice, and both times they turned and wanted to come at me. Once when I called bc there were about 100 kids at the park near our house, all gathering to watch 2 kids fight. As I was watching, the cop came and chased the kids away. As he was leaving, he saw me observing the whole thing and he came up to my face yelling at me to leave. I told him that I made the call bc I thought someone might get hurt, and the pig told me I will get hurt if I don't leave the park. I was nowhere near the kids. I just didn't want anybody to get hurt. This was first time I ever called a cop for assistance.
There was a second incident I won't go into, but now, I teach all my cousins, nieces, nephews, neighborhood kids, . . . their rights and how to assert them when confronted by cops. They are not the good guys and kids need to learn that.

If there were good cops, there would be no bad cops.
How does that make zero sense? When you see a cop brutalizing somebody, you also see other cops just standing around. So who's the bad cop, the one brutalizing someone, or the ones just standing around letting him brutalize someone? They all are! Good cops would stop someone like this, and/or report them. But cops don't turn each other in for this type behavior. They don't even try to get violent cops dismissed. That's why I say, "If there really were good cops, there would be no bad cops." Their indifference makes them complicit.

in the land of the daily mass shooting, it's totally reasonable for police to be nervous when someone shows up out of the blue like that. and you might consider not confronting police when your family is with you. you could accidentally get the whole lot of you shot dead if you catch some cop in the wrong mood. that being said, though, what you're doing is a valued public service and i sincerely hope nothing bad happens to you while you're at it. you're absolutely right that policing in america is out of control and people like you who are willing to take these risks for the rest of us should be commended. keep it up and stay safe.

Braxton he shouldnt be putting his kids into that situation. there was no supicious reason for him to even stop. especially with his kids in the car. hes a terrible dad and that bs he was saying if he tried to resist he would be killed. what a terrible dad to sit there and say that in front of his kids. that had to terrify them. if he wants to film cops, he should take the kids home with their mom, then go film police. He shouldnt be putting his family in that situation of risking getting his kids put into children services. Never once threatened his or his family’s life. Talk about brainwashing.. he’s obstructing justice and it can be a matter of officer safety. If they have to continue to talk to him, they are losing continuity of the detained person. Also you could be anybody behind them, so they constantly have to look behind them at you to make sure you’re not a threat. You’re a pest man

the fact that he was already less than 10 feet away in the first place meant the cop was in the right to ask him to back off. you can record all you want but you need to be at minimum 10 feet away, he even said in the video that he backed away to 10 feet because he felt threatened. why did he feel threatened? because he was closer than he was legally allowed to be in that situation

Police officers have very important jobs. Even though pulling someone over might be considered "unconstitutional" it does not mean they will go to jail. They are just under investigation.
It's better to cooperate with the law, because refusing to only makes their jobs harder and is potentially dangerous. None of them are trigger happy. Sometimes they use intimidation, which I agree is frowned upon, but most of them wouldn't have to reach for their sidearms or tasers if people would just listen and not be stupid.
