Before all of the hullabaloo online, it would have been really smart for Gia to do that previously.
But at this point with what Gia has inadvertently admitted to, and what her and Jess's texts both prove:
she gave a slam dunk slander case to Jess's lawyer, hook, line and sinker.
Gia not signing the paperwork would only be done for one reason. If you did not want a legal backing for a student to come after you.
Unfortunately for Gia's plan to keep scamming unknown artists, Jess took the risk to her own name and career as an unknown artist, to whistle blow metaphorically on a shitty boss. Gia is acting all high and mighty, but I'm wondering if it's genuinely a mental health issue, because that's delusions of grandeur, she doesn't actually have any of the legal standing she is saying.
There are multiple paper trails of her repeatedly doing this to unknown artists and trying to bully them into silence.
Legally speaking, Gia screwed the pooch on this one.
The only person who has legal backing to sue, is Jess.
And Jess/ all of us, only have the proof and legal backing to do so--because Gia kept running her mouth in an ego trip online.
She would have done perfectly fine after this if she had either said I'm so sorry I really messed up, I've been having a really hard time and refunded Jess, or if she had said nothing from the beginning and let a PR and legal team handle it.
A professional PR campaign and a really skeezy lawyer can make all sorts of stuff go away.
Gia would have been perfectly fine with a big sob story released- spun only focusing on her health and other struggles........you know, the things that only truly affected her a fraction of the days she lied to Jess, and told her "oops sorry, you're 3 hours into your 5-hour drive, turn around, it's too hot" 🤣😂🤣😂
I'm going to see if I can come up with both of the options for the sob story speech that Gia is going to be told to use-- BEFORE she releases it.
      🤣😂🤣
A fun little game for myself

    • @B.Harper7

Absolutely, Gia hasn't had to take responsibilities for her actions from scamming previous unknown artist students.
The other apprentices stayed silent for fear of the backlash, that she apparently has a paper trail of evidence of.
She was betting that throwing in comments of the industry and sponsors would be enough to get Jess to back off.
Jess, however, is betting that the law is going to uphold the law, rather than just sitting back and taking it on the nose that she got scammed out of $6,000 from someone she thought she really admired.

Even doing a fast-track program with college credits to get certified as an EMT-Basic in my state doesn't cost that much!! I'm not sure how many days a week that 3 months was for, and I know it obviously probably includes days where they just video chat/share their work/do homework etc. But seems that keeping like $1000 and refunding the rest would be the right move here.

At risk of sounding like a whole hippie (I’m a clinician in oncology, case management, and an educator, and have faced the “you’re weird” stigma until I proved it untrue). People, in general, have lost humility, empathy, our human connection. At its core, our society encourages frustration and apathy. It sometimes is very hard, but much can be resolved and understood by compassion in the face of adversity. Simplicity can be complicated.
It’s hard, being a sub culture of our own to see “infighting” being so commonplace. Particularly so publicly. There are people and practices that do need to be exposed I suppose, but the tit for tat, hate boners are wild. I’m thinking a lot of people who have been physically harmed and scarred by people that do not belong here vs financial legal battles, but alas… I might be talking idealism rainbows right out of my unicorn ass 😂😂😂!!!!

You’re so damn right. I’m convinced that a lot of relationships could be repaired and wrongs could be righted just by us learning to say those exact words; “I messed up. I was wrong. I’m sorry.” But those words involve one of our most messy attributes.. the ego. I’m trying hard to say that phrase to my kids when I need to. So many parents never say sorry to their kids and I really think that learning how to say sorry (and mean it! And then act accordingly, of course) needs to start at a young age.

Agreed, this is all about ego and narcissism.
How Gia Responded was a reaction to "someone challenging her greatness", "the amazing and powerful Oz" type of ego and narcissism.
Although it stems from insecurity, and comes about as a well-built distraction from the lack of belief in oneself, and imposter syndrome within the industry.
Do I feel bad for her clear impostor syndrome?
Yes, absolutely! Gia should feel very comfortable in the work she does, and embrace the position!!
Do I also think she acted completely foolishly, let her ego get the better of her, and made herself the current microscope specimen?
      Oh 100%!!
I know Freud, Jung, or somebody else Is laughing in their grave as Gia projected ll of her issues onto Jess, and hypocritically acused her of everything that she did to Jess.....
But coming from the opposite direction.
She is 'used to bullying unknown artists into this', as there is apparently a well-documented track record spanning many artists, over years of time. 🤷‍♀️
So yeah, I feel for her; it seems like she legitimately has some stuff going on.
But lying, passing the blame, and running scams on unknown artists knowing that most of them wouldn't risk standing up for themselves and calling her out.....
      Is really really really icky.
      Is this a character flaw?
      Okay then fix it.
      Is this a trauma response?
Then this needs to be brought up in therapy, and have medication discussed with the trusted provider.
This is inappropriate behavior, and very reminiscent of a friend's, when she is unmedicated.
I don't believe in armchair diagnoses, but the the behaviors that line up are pretty staggering.
The simultaneous depression and insecurity, saddled with a touch of delusions of grandeur.
The automatic twisting of reality is either Gia being an asshole manipulator, or Gia showing what she genuinely has led herself to believe.
So, I don't know if I should be 'hoping for' either option..
Gia being a lying asshole egotist, or Gia being an unmedicated person who I feel for, but recognize it is their responsibility to get themselves medicated
We get to choose how we live the world in our bodies, but those rights stop at the line when affecting other people's lives.
While they decide to experience their life without their mind and hormones in check; the people in their life have the same right to walk away and say 'you aren't allowed to treat me like this'.
Instead of sucking it up and trying to work her way into the industry despite unhinged Behavior, Jess stood up and nicely said hey, this really stinks.
I really wanted this to work, but this artist is doing something really shady and I don't think I'm crazy thinking this.
Jess threw no ad hominem attacks, didn't return any slander, and wasn't creating cyclical arguments to distract from her scamming.

      @B.Harper7 3 месяца назад +16

      @Celestial_Kumiho 100%!! Gia did a very good job on doing Jess's lawyer's job. 😂🙃
She set herself up, lied, taped herself lying, did it again, legally attempted slander of Jess, was truly trying to Gaslight her and use her position in the industry to bully her into silence as she had the other artists, and tried to pull the scam that she perfected.
The fact that Gia hadn't signed the contract or had it notarized, shows that Gia had pre-planned (and its actionable proof) to screw over Jess.
Gia has ZERO legal standing for suing Jess for showing her pages online, and she lost that claim to damages to intellectual property when she set Jess up and didn't sign the contract!!!! 🥳🎉🤣😂🤣😂🤣😂🤣😂
It's genuinely and completely poetic; absolutely hilarious!!!
This is why people say what happens in the dark will come to the light, it might not be from your situation, but someone else is down the line will bring everything to light and you will get your chance to see Karma collecting on the world's closet skeletons.

If you take money you have to also give the education you've promised. Non-refundable doesn't mean you can not fulfill your part of the deal.
If you don't want to get harmed, maybe don't try to scam people. Might be an idea.
Gia also cost Jess money on top of what she paid by having her close shop for a teaching day, then having her start to drive to her and then cancel the day of (or shortly before so she would also probably not have been able to book a client).
She may not handled everything perfectly but she probably felt very much alone. And by how Gia reacted you can see she doesn't intend on giving her back any amount of money, probably thinking she is safe from having to refund even though she didn't uphold her part.

I'm pretty sure I remember from the first video Jess saying that some of these cancellations occurred when she was already on the road. Yeah like doesn't it have to be that Jess was deliberately lying about something that didn't happen about Gia to ruin her character and affect her business when the fact that she flaked on the mentorship and made off with 6k for barely over a week's worth of work is true? It really does sound more like trying to subtly threaten Jess to take the videos down so she either seems to be in the wrong or to stifle more people knowing about it.

If Gia really really feels she should keep the money figure out the % that was 8 days and keep that. So keep $ for the actual training she gave and return the rest.
With Gia being flaky with appointments and having health issues it boils down to attitude and communication. She is clearly well off enough to have a secretary to handle that if she can't. The "appointment is cancelled and we will work with you to fulfil our commitments and apologise for the inconvenience" is much better that cancelling no acknowledgement of the effect on that person and leaving them hanging when they have already paid.

Also, I do wanna point out, just because someone tries to negotiate with you doesn't mean you have to accept that negotiation. If the terms are not suitable and youve expressed that, theres no reason to continue talking with them. If anything Gia's 'negotiation' was a legal threat, Jess was the one who actually suggested afair resolution.

It's quite poetic isn't it: the proof that Gia was intending on screwing another unknown artist over, expecting them to buckle under the pressure, is exactly what's being used to show her malintentions.
Gia didn't sign or notarize the paperwork even after Jess did, and it was in Gia's possession, solely!!!
For over a month after receiving Jess's Signature.
That is clear proof of it being intentional, and if people want to get real picky about it, since it was in Gia's possession for that long, it doesn't matter whether she was trying to screw over Jess or not, she was being negligent of her own businesses best practices.
You can't blame that on somebody else 😂🤣😂🤣😂🤣
Since Gia never signed the paperwork, there is no legal backing to her going after Jess for intellectual property damages.
Gia herself proved that she was lying, but truly seems to be having delusions of grandeur and has written her reality differently in her or head.
Which is why I'm still giving room for grace on this might be a mental health issue that Gia is not taking responsibility of, that has now piled up fallen domino's from her inaction.
Instead of of being an asshole egotist that's intentionally and maliciously scamming artists, which is not unheard of in the industry, maybe she is a crappy business owner that is floundering from not taking care of their Mental Health, also not unheard of in the industry 😂🤣🤣

Now someone can actually speak up about her and she's shocked there are others when in any kind of situation this happens. Someone is the first to break the seal and the others follow.
She's asked it be handled by lawyers and not thrown around publicly but she constantly makes jab remarks at Jess so I guess it's just Jess that's not allowed to discuss it publicly? I refuse to believe she is this stupid and actually thinks it's blackmail what Jess is asking. Jess is reasonably asking for her money back because she did not get what she paid for.
To put it in another example, if I go to a movie theatre, pay for my ticket sit down to watch and after 10 minutes the movie stops, do you think the staff would say "lol sorry you saw some of the movie tho so we're keeping the money". Absolutely not. They'd be quickly trying to fix the issue or refund the money because I did not get the full experience.
Also kind of showing that she has a shitty lawyer when they openly admit they've not looked through any of the claims and evidence of Jess supposedly doing these things but they give a jab "hey keep your client in check okay? :)". Gia is just making herself look worse.

I went through one hell of a depression episode because of this. One minute you’re the “go to” person who everyone comes to for assistance whether it’s at work, friendships, at home, and all the sudden you realize that even though you’re giving MORE effort than before, you just can’t do as much. Things that were so simple before you now need help, the look of frustration on the faces of others because you couldn’t get what’s expected done, but they don’t say anything because they know it’s not entirely you’re fault. And then you notice tasks you’ve always done flawlessly are now delegated to someone else…even if no one is horrible to you about it (which is best case scenario) you can still see it in their faces when you have to admit that you couldn’t finish something… I still struggle with accepting this even now and I’ve had nothing but support since my diagnosis 5 years ago. It’s a really hard pill to swallow 😞 But it is reality. And as hard as it is to accept it’s better to be honest with yourself and set realistic expectations instead of agreeing to too much and hurting someone else as a result

Not to be mean, but as someone with 2 chronic conditions, any time I have gotten a new employer or am mentoring someone, I IMMEDIATELY make it known that I have a few conditions which may cause problems with the schedule. I also make sure to put it in writing and have it signed off on so that people can't come back and say that "I'm not fulfilling my responsibilities and didn't know that there may be problems which could extend the job." Now, this doesn't happen often with me but is still something that I make people aware of. They don't need to know what those chronic conditions are but they should be made aware and it should be in writing. If Gia didn't disclose that this was a possibility, then she's at the wrong. I don't know if she's always in pain or if her medication makes her sick but it is still important to disclose. If it's something that happens more than 7 days per month, then she needs to consider not being a mentor.

From what I understand a lot of the cancellations were because of times where the church/studio had lost power, was too hot, had plumbing issues, etc. Which also raises the question of whether it was even safe to be working and tattooing there to begin with. But in any case I think Gia simply wasn't in a position where she could realistically take on a mentorship - she could simply admit her mistake, return the money minus the cost of the eight days that were done, and they could all move on from this.

The argument that Jess can’t “unlearn” her experience just doesn’t really hold water for me. Because I’m assuming the “mentorship” was about having that rapport with a teacher while documenting your progress over time! While Gia seems to be a really great artist, imagine your literal only claim to fame is I was on Ink Master, yeah I got voted off and I didn't win, but they put me on the show........ then I scammed a bunch of unknown artists in the same copy and paste play, with a tag team from my lawyer claiming I bear no responsibility for my own choices......
I'm great at scamming unknown artists that want to learn to hone their tattoo skills from me, I have them prepay me the salary, move up the payment deadlines without delivering the first amount of instruction hours, and then I'm going to be super insecure yet simultaneously hella egotistical about it -- needing to reassure myself as much as everyone else, that I'm a real artist and not an imposter.
Like GD Gia, you created your opponents argument, argued it and proved them correct, and then slandered the person whom you were just claiming was the slanderer 😂🤣

It is absolutely ok for someone with health issues of any kind to be transparent with their clients and postpone an appointment when they need to. But the issue here isn't the this, it's the fact that Jess paid for a certain amount of days most of which were not given to her and she received no compensation. Regardless of the reason for these missed days, this is unfair.

@@evasheridan6026 Gia is making her illness Jess's problem and that's not fair. I'm also chronically ill. I no longer am self employed, but the heat where I live has taken the piss out of me the last week. I didn't even leave the house Sunday because it was close to 100F. To make sure I recover enough for going back to work, my dude made sure we had enough food and snacks for the family and that I didn't have much to do. My job as a nurse is exhausting at it's base level, never mind being ill and the weather just stomping me into the ground. But I learned when I got sick, and especially once it was apparent this is going to be the life I have forever, that I need to PLAN.
I'm not self employed anymore, like I said earlier, but when I was and early on in my illness, I had a lot of days where I coulsnt get out of bed or had to go to the emergency room or was admitted to the hospital. But I worked it out with clients and even my dad helped me get things sorted out when I was too sick to even lift my head up. I returned deposits and rescheduled or set them up with someone else to get services done. I did that because it was the right thing to do, even if I needed the money. Why should I keep money for something I never did? That's wrong and that's what Gia doesn't care to understand.

Gia is sounding incredibly self important, like “don’t believe Jess, she’s not even a well known artist, I’m a celebrity” I’m with Jess on this, Gia is p,aging the sympathy card with her illness but in my opinion it’s backfired. Personally I think Jess is the bigger person because she could have reacted a lot worse (I know I would if someone had stolen 6k from me) which is effectively what Gia has done.

I really admire how accepting and inclusive you are, and how you always make sure to hear everyone’s perspective on issues. Without trauma dumping too much, I am someone that lives with several chronic physical and mental illnesses including PTSD from domestic violence in my past. The way you so gently and protectively discuss issues like SA and LGBT+ issues makes me and many others feel so safe and accepted with you. You have also created an amazing community with your Facebook group where everyone just wants to support each other and share art and advice.

Well she's going to lose far more than $6000 she stole from jess now, deservedly. She's trying to cry victim but she's the bad guy here, just give the girl her money back. Gia seems to be the one on the threatening and harassment side, she needs to just claim she took advantage, never meant to give tgat young lady a proper mentorship, she is asked for a job but instead offers to make u pay to work with her. She's an entitled bully and thief

Gia seems to fundamentally not know the definition of SO MANY words. Like I think in her head
"defamation" = saying anything about me I don't like
"blackmail" = anytime someone does not immediately do what I request and instead askes for something in return
"extortion" = someone I don't like is asking me for something I don't want to do
"negotiation" = this person has to do what I want
"intellectual property" = the same as when people put on their sonic the hedgehog fanart ORIGINAL CHARACTER DO NOT STEAL but this time it has ~magical legal properties~
None of this is true in the real world. She really gives off a vibe that she is living in a fantasy world where anyone who doesn't obey her is a vindictive antagonist hellbent on ruining her life....like girl kitty up and face reality Everything she has posted to prove that she is in the right only makes me doubt her and her integrity more.
I really think she doesn't understand that the way she handled the initial mentorship was WRONG she did not properly schedule her own time and at the end of the day she just does not understand that she really DID have responsibilities to Jess.
To your point about her health and "does she owe anyone anything" I understand the sympathy and frustration, but as someone who is also chronically sick (both mentally and physically) you DO owe people somethings sometimes even when you are unwell. If you make a promise to someone and charge them money for it and repeatedly break it while fully expecting that no consequence should ever reach you then you aren't some "struggling with illness" your an arshole who wants an excuse to get away with it.
Jess's whole issue was that she paid full price for a fraction of a service. No where in their initial conversations did any discussion about chronic illness come up, an unreasonable amount of late/same-day cancellations were due to inclement weather and that is just something that Gia does not think she has to take into account or plan for, which is not true. I agree with others that even tho I would like to extend sympathy, I do think she is bringing this up entirely for pity points and not out of an honest attempt at building trust and understanding
In her own posts she seems to be admitting that she's very comfortable with being a UwU High Profile Popular Tattoo Girl and is perfectly happy to act like this was all some hate mob cancel culture nonsense that she doesn't actually have to think about, address or come to terms with in any way. Her whole rant about "finding a resolution" is a self report - Jess tried multiple times to fix the situation, especially in the moment to ensure she had the quality of education she paid for. Gia was just not interested in any resolution or meeting in the middle because she childishly does not understand that she really did fck up

Gia really screwed herself in the pooch on this one, legally speaking.
The only thing that she legally COULD HAVE DONE, (with a signed contract, Gia didn't sign it, remember) is claim intellectual property damages for Jess showing a few book pages.
    However :
Just like "Jess doesn't have a 'proper', legally binding' contact, with everything notarized"-- since Gia didn't sign it; guess freaking what!! LMFAO
Gia doesn't have protections on shit, either!!
The only reason you wouldn't sign the contract is if you knew ahead of time that you didn't want to uphold your end of the bargain.
Only if Gia pre-planned to misuse her privilege in the industry, and play legal footsie to bully Jess into silence (as we watched along and saw her attempt to do)- as Gia destroyed a new artist's place in the industry, before it even breathes.

Gia's lawyer is PISSSSED right now 🙃🤣Gia has nothing that says "Jess can never show her property", she was running her mouth all over social media and making herself look even worse!
Whereas if she let the legal and PR teams do their job:
They'd smooth her bullshit over with a sob story version of Gia's reality, focusing on the health implications-- which truly would have only covered a fraction of the times she employed excuses!!
"You can't come over because of the weather?", "Oh not today either because it's hot????"
      The fuuuuuhhhh?!
The absolute MOST Gias lawyer can do, is to ask Jess, pretty please, to take it down.
Jess's lawyer, however, is dancing around and ordering a new shipment of Omaha Steaks. 😂🤣😂🤣
There is no legal backing to attempt to negotiate some sort of payment --just because Gia's work was shown.
She directed both a social media retaliation from someone asking for their money back, AND is attempting to legitimately gaslight and slander Jess.
She has given Jess's lawyer a sealed and shut case, this truly from a legal standpoint-- is ALLLLL on how Jess wants to do this.
Unless Gia somehow has a lawyer that's got legitimate black mail on Jess's lawyer; Gia legally did everything she shouldn't have done. 🙃🙃
Imagine showing your entire ass online-- and then trying to blame the person who was begging for you to do your part of the bargain.....
I know Gia wants to be butt hurt and act like people seeing a couple of configuration pages is going to ruin her business; but in a completely non-snarkey intended way, it's not original work for tattoo skill strengtheners.
Looking on RUclips we'll see full courses that Gia's will look exactly like, whether by intent or not.
The mental gymnastics she's performing in order to justify to herself...... just, wow.
How she thinks any of her behavior is appropriate-- is fascinating, frankly.

Clients won't start leaving in droves if you explain that for a couple of months your illness is gonna take priority, and may need to take more time off than usual. As long as you have open and honest communication, most humans will be quite forgiving and give allowances.
I do think she needs to be more upfront with her clients if her illness impacts her work or ability to go to work, or work effectively, rather than letting it all build up and blow up in your face, and only THEN do you say 'but but i'm chronically ill and this is how it all impacts me' ... when left too late it can feel disingenuous. It shouldn't, we should all be given grace for our pains, but thats not how this works if you don't communicate with your people. Put together with the word drops of 'industry' and 'friends in industry' and the bullying language it just feels like she's scrambling for any 'reasons' she can to excuse why the service was not fulfilled, while taking absolutely no responsibility.
Gia took money for a service she did not fulfill. Regardless of the reasons for the lack of fulfillment, the service *was not* provided. It would be the morally right thing to do, to refund Jess.

If anything, the only possible mediation worthy to resolve this situation would be to divide the $6000 into the days of all 3 months that they were going to have this mentorship, subtract the 8 days of mentorship Jess received, add the calculated expenses Jess made (gas) for the days she was abruptly cancelled midway to Gia, and call it a day. You could add on other things like wages lost for Jess on the days she was supposed to be at the mentorship where she couldn’t book anyone, but that’s only if you want to get picky. Either way I’m all for Jess; be it Gia or another random artist, they have to know when they’re clearly in the wrong side of the situation.

I said something about this on the last video. A syllabus might be considered intellectual property. It has to be creative, either printed or posted online somewhere and original. I am a professor of studio art. I paused the video and looked at the syllabus. Obviously I can’t say whether it is original or not. But in my opinion it’s not creative. It outlines what she is going to teach about but it does not go above and beyond what my syllabi say and I would never consider them intellectual property. On this point I think Gia needs to get over herself. To me the part of the syllabus that I read seem like topics that would be covered in an apprenticeship. If Jess recorded Gia in the act of teaching her something and/or posted notes that Gia had written out that would be intellectual property assuming the notes were original.
Also, myself and most professors that teach online have video lectures posted. If someone else posted it to their channel I wouldn’t care. While I wrote the notes and everything the information in the lectures isn’t a secret and could be found through reading books, articles, reading/watching interviews ect.
Additionally, you aren’t infringing on copyrights (basically that is what intellectual property is, something that has copyright) if the person who originally said it or wrote it. That is why papers have citations in them. Using other peoples words so long as they are cited is not a copyright violation. 🤷🏻‍♀️

If you know you have a health condition like that, maybe telling the person who is considering to pay for a three month mentorship that you might have days where you will have to cancel last minute for medical reasons and propose a way of how to work around that could be a way to avoid this kind of a messy situation. Also if you're working from a space that can get so hot that it's unsafe and you still offer a mentorship during summer, you should disclose that and have a plan on how that's going to be handled. That way people know what to expect and can make an informed decision.
Knowing she has so many things going on that may result in her not being able to provide the service she was paid for and on top of that making Jess sign a contract saying it's non refundable feels incredibly predatory. Both parties deserve fair conditions and respect of ones live circumstances. I kinda feel like if Jess had something happen, forcing her to cancel some days, it would have been a "that's your problem" situation.

  • @Tankekraft

The fact that Jess didn't recive a cease and desist immediately kinda makes me think that Gia doesn't want to take Jess down. The thing is though, if Jess doesn't stop she could be sued for defamation and/or slander, and she could be convicted of that even if her claims about Gia is true and she's in the right when it comes to the mentorship program. Because they are different legal cases. What interests me, about all the online drama theese days, like with Illuminaughty, is that people are turning to the public in order to get some kind of psychosocial accountability. And now, all of us, people from all around the world are becoming this massive jury.
Jess said that her laywer told her that the contract is not in her favour, that the mentor could easily just flake out and Jess wouldn't be able to do anything about it. So the legal and economical protection has failed her. Also I think it's important to point out that a legal conviction has a different accountability outcome than a psychosocial one.
And that's why I don't think either Jess or Gia has taken those "standard" legal actions. I think Jess would've been open to taking the economical loss and removed the clips if Gia took her critique to heart and made changes to improve the mentorship for future mentees.

I am sympathetic to Gia’s health issues, HOWEVER, she didn’t say any of this before.
2 things can be true at once. Can her health get in the way of her work? YES. Is that the situation between her and Jess? Absolutely not.
She did not respect Jess’ time and is not taking ANY accountability for her actions. Not even a little and to take it further, she paints Jess as a villain rather than it being a simple misunderstanding.
From the texts, Jess was trying really hard to make things work while Gia only saw it as an attack.
Jess is definitely salty about the situation and you see it in how she is reacting. While she may be unwise in how she reacts, she is still, in my opinion, in the right for her contract situation with Gia.
