I was involved in an accident. It was work related. The insurance didn’t want to pay so I took them to court and I won the lawsuit. The trial lasted two years and the bills went to collections. The judge said the insurance has to cover all the medical bills but there’s a collection agency trying to collect one of those bills from me. I already explained to them that I won the case in court but they’re still trying. I’m in Kansas by the way.
Your Kansas lawyer probably has some good advice for you on how to handle that.
Very informative video!
Concerning 1692e
So does a dispute and validation
Letter
To the debt collector
Result in an FDCPA
Violation without
Disputing directly
With the CRA’s?
Do they often Mark the debt in dispute?
Thank You!!!
It can, yes.
Hello I have a debt that was sold to collections but it was never on my credit report because it was a CDL training form a job a didn’t end up staying at I don’t have the money at the moment so I can’t pay it, should I wait for the collections agency to put it on my credit or do they sue to begin with ?

Very helpful Video!!! My brother received a letter addressed “The Debtor's Exam” from a debt collector in CA. How could we do now?
Glad you liked the video.
it sounds like your brother has already lost his court case and has a judgment against him, which means he's in it pretty deep. He probably needs legal help right away.
Need help in California
In California, call Mike Cardoza www.cardozalawcorp.com/ or Jay Rahimi: www.jrahimilaw.com/
Do you have any recommendations for lawyers in Texas? Want to know if I possibly have a case against the original creditor & the collection agency that the debt was sold to?
In Texas, we recommend Bill Clanton and Daniel Ciment.
Does the suing process take a long time
We handle them pretty quickly in most cases.
Quick question. I paid off/satisfied a loan, but it is still showing as an open account on my credit report. Do I need to write a letter to the creditor asking for them to show the account as closed/paid, and have it reflected as such on my credit report? Thank you.
You can send a dispute letter to the credit bureau, (not the original creditor or the debt collector) for any account on your credit report that is inaccurate, obsolete, or incomplete. They have a duty to make a "reasonable investigation" and correct inaccurate information, and to remove information that is obsolete or cannot be verified. If they fail to make this investigation, or fail to correct or remove information that's not accurate, complete, and timely, you can sue them for any damages suffered because of that failure.
My landlord charged me with repair bills for damage not caused by my or any other resident. I've disputed the charges and they sent it to collections a few days ago. I'm planning on disputing the collection soon, and also preparing for a legal recourse. Do you have any recommendation for an attorney/law firm in upstate SC (Greenville/Pickens county)?
This directory might help you: www.consumeradvocates.org/attorney-directory/?_attorney_directory_license_to_practice=sc&_attorney_directory_area_of_practice=landlord-and-tenant
hi , i have 3 separate collections on my credit report and have been sitting there between 1-4 years,i live in New York City, i will like to resolve these reports and make payments, but i have no idea where to start. If possible any information on your end will help.
Thank you
Making payments might be the worst thing you can do as it strips you of all leverage.
In New York, call NY lawyer Subhan Tariq: 718-674-1245 Let him know I sent you.
If I sent Midland a Cease & Desist months ago, they've acknowledged it, sent a letter saying they MAY move to litigation and now have Johnson Mark LLC mailing and emailing me trying to collect the balance--is that a violation? Can Johnson Mark LLC be contacting me through written communication to collect the balance for Midland after I sent the Cease and Desist via certified mail? Should I send a C&D or Debt Validation to Johanson Mark LLC, too? Thanks!
It's hard to say from this information whether there's been a violation without carefully reviewing the letter they sent you. If you're in Florida, give us a call: ricardolaw.com/contact/
I was given a check on SMB (southwest missouri bank) and went to cash it and they made me wait forever and then said that because I owed them money in 2002 before my bankruptcy, that I had to make a payment before they would cash the check. So I gave them $5 and they gave me the balance on the check. But was that legal?
Doesn't sound like it. Check with your bankruptcy lawyer.
I'm in Illinois but I hope you can give me just some quick advice. MCM has sent a pre-legal email ($20k I owed to Comenity since April 2023). It is definitely valid. Should I even bother sending a dispute letter asking for the charges if I know for a fact it is valid? Or just accept their $170/month payment plan offer that I see on the online account they created for me? I have not responded to them in any way.

I received a pre judgement interrogatories. I answered them but i want to reapond with my own interrogatories. Do you have any advice on what questions to ask? Also, how long do I have to send my own questions?
That's a very case-specific and state-specific question, so there's no way I could answer in a comments forum.
I got a pre-legal notification they haven’t made much contact with me and it says if you live in California this applies to you and it just says california license number pending. I can’t afford a lawyer I’m behind on my electricity of $2000 and midland wants me to pay $4,256.78 I really don’t know what to do.
In California, call Mike Cardoza www.cardozalawcorp.com/ or Jay Rahimi: www.jrahimilaw.com/
If you have a case, most lawyers won't have to charge you up front unless they recover for you.
I just received a letter for a medical debt from 2020. How do I respond to this letter? They have not put on my credit report yet. Not the original creditor either.
If the letter is from a debt collector, check out our FREE dispute letter kit: rwlaw.gumroad.com/l/letters
Is it possible to dispute old collections? Let's say 4 or 5 years old?
The dispute letters I’m talking about are all responses to collection communications you’ve received within the last 30 days. So if they’re still trying to collect, then yes, send a letter to the debt collector.
Hi Sir I am being sued by LVMV in district court, I’m disabled and I am at home 25/7 I have never gotten served with a subpoena, never got a phone call, and have no mail from them. I was unaware of the court date obviously and it was in may and I just found out. The public record says “strike conditional accepted submission” as the last thing listed under that lawsuit. What does that mean and what do I do? I just received a letter from a lawyer offering help that’s how I found out. In addition I don’t even know the original creditor. Any suggestions from you and anyone who can help reading this
Thank u
Shahnaz
Unless you’re in Florida, we’re not going to be able to tell what’s going on in your court case. Call us if you’re in Florida, or try talking to the lawyer who sent you the letter if not.
Do you ever address Zombie debt? We had a good credit score were about to buy a home and then this Zombie Debt came along and our scores plummeted. It's not small debt but long since gone. We're not in FL
If it's been more than seven years since the last payment, that debt shouldn't be appearing on any credit reports and shouldn't be affecting your score, unless there's a judgment against you.
My neighbor was summoned to court but the server gave it to me, and I didn't read it carefully or learn that the Jasper County Sheriff's server had made a mistake and I never gave it to my neighbor who missed the hearing and the judge gave away IMMEDIATE POSSESSION of the poor woman's $31,000 3 bedroom mobile home! Can she sue the County and/or just the server? As well as the people who have scheduled to pick up her house on Dec 3 and any contents she still has in it!? Can the landowner who the poor woman is renting the lot from -- stop the trespassing?
Your neighbor needs to speak to a lawyer ASAP.
Sir i have a question Im 65 years old senior im now retired and depending only on my SSS pention..debt collector sue me can they garnish my SSS pention? Thank you sir

How about if they aren’t sending letters at this time but are on my credit report and calling and texting
Sounds like a possible lawsuit.
@@RWlawFL really? They may have sent a letter or two in the past but I really havnt got many letters or certified letters ever. I recently got hit with a lawsuit for one of the things in my credit report that I really was unaware of from mot checking my credit report. I may be jumping into chapter 7
I am in Pennsylvania and have just started National Debt Relief couple months ago Have not received any letters Do they go to NDR?
@oldtownblues I have no idea how NDR handles letters, but we never send anyone to them.
What can I do after a call asking them for information and the reason of the debt, but they are asking me for my SS. Can I give them my address so they can send me every thing they have?
Hang up the phone right now and watch this video before you do anything:

I am heavy in debt. So i called theee of my credit card issures and said: i want to settle before i have to get a bankeuptcy lawyer. So if you will stop billing me $300 + a month AND stop adding interest to this account, i can send you 150$ a month via direct deposit until it is Paid off and explained i kost my job and have since been placed on disability S.S.
Two said ok. The rhird one said no way. About amonth later i tied ro reason with them again, and got rhe same results.
So now a moth has gone bye and i have missed my first payment so next month i will owe them 800. Obviously i cant pay this.
I also cannot afford a bankruptcy attorney. Is there any way to get them to accept some kind of deal that i can deal with?
I wouldn’t have done any of that.

@@RWlawFL well I did so that's why I asked... I am a man I borrowed the money I am obligated to pay my debts. I'm just not able to unless I can work out an agreement. I'm not out to screw anyone
So what about the debt they owe you?
