She didn't even bother preparing very well for the Virginia trial, submitted shoddy evidence eg the same photo of a hallway for 2 supposed different incidents, filed stuff late etc etc

Sadly for AH and her ridiculous unprofessional team , there is a clause that states that any errors with jury member information will not be a cause for mistrial or appeal . That clause does exist . Her team knows that .

Va Code 8.01-353 ..."Any error in the information shown on such copy of the jury panel shall not be grounds for a mistrial or assignable as error on appeal, and the parties in the case shall be responsible for verifying the accuracy of such information."
OBVIOUSLY, her team had jury consultants who would have caught it right off. Aside from that Elaine admitted they knew he wasn't born in 1945 before the trial officially started.

It's actually pretty common for people with similar names at the same address to get mixed up for jury duty. It's on each team to field/vet the jurors during jury selection.
A forty-something and a seventy-something will look markedly different.

In Virginia, anyone 70 yo or older is exempt from jury duty. So, naturally, the son assumed it was him. Aside from that, AH's team would have hired jury consultants and they would have caught it. Elaine ended up admitting they knew he wasn't born in 1945 before the hearing began.
AH legal team recognized the discrepancy from the get go. They deliberately tucked it away, thinking they would automatically have that as grounds for appeal if they lost. Just more evidence of how unethical they are.

Elaine can actually be disbarred for this. She knowingly solicited perjury when she asked Amber why she couldn’t pay the donations. She then knowingly misled the jury by doubling down on the lie during closing arguments. Elaine knew full well that she was not being paid directly from Amber. In fact, the policy had a 2 million dollar cap that Elaine blew thru in 2021!! So they EXTENDED the cap but made Elaine lower her hourly rate! Before the trial even started, in April of 2022, Amber had already blown threw over 5 million dollars!! And she still had the gall to ask the other insurance company to pay Johnny the 8.3 she owes!! The ball’s on these people are ridiculous 🫠🫠

-Elaine can't file any new motions after July 1st, but did anyway
-The juror has the same name and address as the one on the list, so no fraud on the juror's part.
-Elaine had the information during voir dire but did not object, or speak to the judge via sidebar on it
-Elaine claims the problem 'was obvious', which implies she knew at the time
-However, Elaine either didn't notice or did notice and held onto the info as a 'get out of jail free card'
-Elaine selected this juror herself during voir dire
-Virginia law specifically says that these kinds of errors are not grounds for a mistrial or appeal
-Virginia law also says checking info is the responsibility of the attorneys, not the court

It’s because AH cited having to pay 6mil in legal fees as the sole reason for not being able to fulfil the charity donations. Elaine’s closing was completely unhinged, jumping from one topic to another and for some reason she included this lie about the legal fees. I feel like her closing argument was a last ditch attempt to sway the jury because if it had worked and AH won, none of this would have been questioned. For some reason Elaine seems to be happy to sink her career for this witch, why that is I don’t know.
The funny thing was Rottenborn did a quite good closing argument, but Elaine completely dismantled it with contradictory statements and even lies in her closing.

The so called problem with denying the legality of juror 15 is that 1) when jurors are impaneled they are unaware of whom is being tried and 2) both sides have a chance to approve/deny EACH juror during voir dire.
They had juror information. If Heard's team can't differentiate a forty-something from someone who's in his late 70's they're either incompetent or that juror has lived a life that Keith Richards would think debauched.

They knew from the start of this that there was an issue with juror 15, they said it's OK, he can be on this jury panel anyway. Elaine did this purposely for a "just in case" moment, and that moment is here and it's not going to work, BECAUSE she knew and said no, continue anyway. I'm not saying Elaine should be disbarred, but something else needs to be done against her for acting like this.

If I remember right all lawyers interview the jurors. Long before the actual trial happened the lawyers would have this opportunity to object to this particular juror. Let’s just get over it! Whenever I’ve been asked to sit jury duty there is a process where the attorneys question the potential jurists for any prejudice, knowledge of those on trial etc. I can’t imagine that the State of Virginia doesn’t do the same.
Amber’s team knew about the age discrepancy before the verdict and decided it wasn’t a problem until after the verdict. But it took too long for them to decide it was a disadvantage and their statute ran while they sat on that information. Someone in their office needs to go take some kind of a legal eagle refresher course.

Important and relevant note that wasn't mentioned here, Elaine and AH mislead the jury w/ comments about how much she spent on legal fees when it was being supported by her Insurance carrier. Elaine then reiterated it during closing as a means to sway the jury and garner additional sympathy when it was false information. Was this shady and underhanded or good law tactics pushing the bounds of what is allowed?
Imagine if she used the lawyers her insurance initially chose for her. Maybe she could've won. Too bad that woman is just addicted to making bad decisions. Unfortunately, those bad decisions don't only affect her.
She would rather have someone just like her (Elaine) that believes her 100%, instead of a competent legal team.
If her homeowners insurance paid her legal fees then she didn't pay 6 million in legal fees, not very undisputed is it huh. Yet she still didn't pay what she pledged.
Even if the insurance hasn't paid for her legal fees, there's the fact that she had the $ 7 mil in her pockets for 13 months before JD sued her. She had plenty of time to donate them but she didn't.

As far as the insurance policies, it might state there is coverage for something, but as long as there are no exclusions to it. Attorneys write the policies and there are exclusions to certain things if they arise. Intentional acts or willful acts are one of them. Its like fraud!

Personally, I think they did notice. I think they cahtted about it and decided to make that juror their own little "insurance policy" so to speak. They decided that they'd let it ride and see how it played out. They figured if she lost then they could use it just like this. If I'm right it's the only smart move they made this whole trial.
Actually they have to pay the full judgement amount as a bond before she can even file an appeal. If she doesn't have 10.35 million dollars to post, she can't appeal. I don't think Elon is going to bail her out of this one either.
