      I believe that in the court hearing the officer tried to claim the auditor was responsible to the actions of his viewers and under that claim wanted the judge ordered it removed from youtube.

      He wasn't lieing. You can't walk around a prison randomly. It's one thing to be in town, but prisons aren't usually that close to the general public. Contraband had been found hundreds of time inside a prison that was thrown over a fense. He unfortunately FA in the wrong area and is FO

      yeah cops do out of line shit like that, not saying it's right. A decent, don't even have to be good, lawyer can beat that easily with the body can footage. Unfortunately him simply being on grounds with a highly sensitive facility and refusing to leave is against the law. Also him being there caused there prison to go into lockdown. That means correctional officers, who are considered police that don't have arrest capability, have to stop their normal job of dealing with inmates have to stop to deal with the over all security of the prison. Obstructing an officer of their official duties. You can also tell it was in fact a crime because he had to plea no contest in order to get it dismissed.

      Well they had him on Trespass it's just cops default to obstruction because just like how this auditor doesn't understand Trespass laws, most cops don't understand obstruction laws. It's a symptom of the blind leading the blind.

      A quick google search shows that the public access/easement goes several hundred feet into the road that he was on. The houses across the street need to be fenced off as well, because they can see the entire prison from their windows.
      If this guy was disrupting prison operations, they are extremely delicate. Also, flat out liars, with a strange perspective of what actually happened.

      ​@@ericcastle380 even if he is a "sworn peace officer" he still can't stop & ID people. My husband was a deputy jailer and he was a sworn peace officer and he didn't have the right to stop and ID people outside of the jail. And neither does the warden.

      He's not likely going to win the court case lol. If he does, he's not winning much.
      He was trespassing, he refused to leave upon an officer's order and the only thing that the cops did wrong was hotbox the dude. But given the lack of interaction between the officer and the criminal the cop has plausible deniability. Especially given that conversation in the station, it seems like the criminal didn't think to bring up the temperature during the 30 minute drive. I'm sure defence are going to bring that up if he starts crying about how cruel it was. If someone's suffering, surely they'd speak up about it.
      There was a false charge thrown in there with the failure to identify leading to an obstruction charge. But the arresting officer can't have expected a prison warden to lie. That charge would get dropped, but nothing will happen to the cop for it and it's not likely the state is going to pay up much if anything over that.
      Nah I doubt they are going to write that guy a check. They did rather good in this minus the warden lying. And given that the arresting officer conducted himself well, I'm willing to give him the benefit of the doubt.
      If anyone's wasting taxpayer money it's that fool who trespassed and ignored officers warnings to leave. He's going through court proceedings for what? Wasting taxpayer dollars for what? What did he expose here besides a Warden saying the wrong thing once. That criminal auditor is truly wasting taxpayer money. Auditors should know the law otherwise they're just a part of the problem.

I’ll top of that he’s already filed the lawsuits against the officer for false arrest etc. On top of that the officer tried to silence Reno 911 first amendment right to upload videos the officers behavior etc through a restraining order he filed against Reno 911. The TRO was denied of course because it would violate the 1a. Also Reno 911 has already returned to the same prison and did a walk around the publicly accessible places and recorded without any issue since his arrest. He has a very good chance of winning his lawsuit. Especially because of the hot boxing. There is a special vent that supposed to feed the back cabin with air using a hose that runs to the back that hose was removed and redirected so it would blow directly on the officer.

      The arresting officer is a piece of shit who tried to silence Reno 911’s first amendment right by filing a restraining order against him for uploading videos about Bruno to RUclips exposing him for the tyrant he is. In court Bueno lied and perjured herself multiple times. Even with all of Bueno’s lies in court his restraining order was still denied. During court the piece of shit officer even allude to the fact that he’s trying to get criminal charges brought against Reno 911 because of his videos he’s publishing on RUclips.

    The warden, who I’m sure has the job because he’s the very best warden they could find, treats the videographer like an inmate. The cops get together to come up with something to charge him with. None of them bother to check to see if he actually did anything. Then, of course, a little hot boxing to top off the day. How can we be anything but proud of these professionals.

      The videographer was not supposed to be there and was trespassing. The warden additionally is not a part of the sheriff's office and not a police officer (probably has policing powers, but not the same exact ones), warden didn't really owe him any sort of treatment like identifying himself or whatnot, warden told him he wasn't supposed to be there, and he remained there, and then the warden from that point turnt to the cops to deal with everything. Not really the warden's fault, guy shouldn't have trespassed. He didn't deserve to be hotboxed, but the rest is merely the videographer's fault here.

    5:11 It's a public road, not a restricted access road that is closed to the public. There's an auto shop open to the public at the end of the road.

      Well it depends. There auto shops in air ports too however they arent't open to the public and you need clearance to even get in. As it's a jail. I'd imagine is simply a repair bay for emergency vehicles.

      ​@@robertrogers6021 there isn't an auto shop in airports. There are mechanics and there is a bay but a shop means you can do business there. So if there is an autoshop it's public but it's possible you're correct and it's just a bay. No signage would allow a reasonable person to believe they could go there

      Even if the guy was wrong, and there is no public property at where he was taking pictures from, what I don't understand is why cops are still not trained to de-escalate? The first guy was refusing to explain anything or to even talk - he just barked orders like a derailed robot. All the other ones even though were less power-hungry, still failed to explain anything. Like a simple explanation - hey man, you are wrong about this being a public property and we don't have to have the "no trespassing" signs by the XX state law could probably resolve the whole thing and the guy would just leave. No, lets gather the whole county worth of cops and try to make a huge fucking deal out of this.

      To be fair they did say they had to go in lockdown. If I was a cop or a warden and some dude was taking pictures of a prison and not leaving when told I’d assume he’s trying to help someone break out. Hence why they had to go into lockdown, which obstructs the flow of the day to day life in prison, making the prisoners more upset and more likely to act up, could cause some searches or extra monitoring, making more work for the guards. So id say that’s obstructing the flow of business. Maybe not in the common form but business can also refer to day to day stuff. He did then charge him for obstruction but I’d say that’s not connected from what I saw and also how it was explained

      ​@@RussTheTuss i will say this is a great take/ perspective that i didn't consider. & specifically pertaining to the idea that he could be "scoping" the place, in an attempt to help an inmate escape. in return they were placed on lockdown, & most likely for an hour+....... while i do support auditors & love what they do - i don't think audits should be performed at a prison/jail at ALL! it seems pointless, & most members of the public won't/don't visit jails. AND phones/cameras are always prohibited anywhere near inmates + inside the jails [that i know of] ...
      (im so upset this my third time retyping my content bcus ads keep popping up & removing my text😫 i literally just shed a TEAR)

      As explained, the restrictions on filming are constitutional and the property was under control of the corrections facility.
      He was told to leave and didn't. That is trespass after warning.

      In this case, the auditor is wrong about filming and trespassing, as they regularly are. The cops were correct. The accountability of police had nothing to do with the legalities of that. If the cop intentionally held the person in a hot car as a form of torture, the cops needs to go to prison.

      I think most of them know an arrest for something like trespassing on a public road is not going to stand up in court. So they mete out the punishment themselves, effectively convicting sentencing and punishing the perp themselves. I didn’t write the law nor do I live in Nevada but I think it is fairly clear that by ‘facility’ they are referring to the prison, not the streets surrounding it.

      I don't really agree here. The cops should be willing to listen and answer questions in the field prior to arrest to dispel suspicion and resolve the incident peacefully, but after an arrest is made, their requirement to keep engaging is over unless there's more investigating to do. Once the arrest is made, it's best for both sides to let it go to court and not say something they will regret

    The Google Maps car went part of the way down that road. If the jail does not want the public on that road, I would hope they would make sure that is marked as private access road or that they would put a guardhouse at the road to ask people what businesss they have there with a sign that states only authorized visitors beyond this point. This situation was preventable.

      ^this. If you watched it showed in camera him walking past the signed that told him that he was now walking on to correctional institution property. While he can get access to the property it comes with restrictions and certain procedures that have to be followed to be there doing what he's doing. From what i can see he didnt follow or mention that he had prior permission to be there. That would have put him completely in the right. Now i am not saying the other side was right either. What im saying is that when you do stuff like this you have to make sure your on point so that you have the best chance to walk away with your freedom and if need be have the legal ground to fight the case. Reading a law and understanding its application in real-world situations are two different things. That's where i think a lot of police, auditors, and citizens fail. They read (maybe) but don't understand. Hear, but don't actually listen and comprehend.

    Aren't private roads, which the prison guard is claiming, aren't they supposed to be marked with some sort of "private road" sign? The road even has what looks like a legal speed limit sign of 35 MPH. As far as he knows he is on the side of a public roadway on the public right of way to the side. There is even another sign at the 10:00 minute mark stating "No use of tobacco products beyond this point." I would say that is the point that the prison is claiming it is private property. Even the Google Maps street view goes to just past the tobacco products sign. It really looks to me like he was on public property or at the least property that appears to be public.

      The Carson City GIS maps, property # 01028146, show that the State of Nevada owns and controls the entire road up to the crossroad. It is not a public right of way. The fact that a Google car drove up and photographed it doesn't mean anything other than they photographed it. They also photograph many private parking lots and thoroughfares. That's a danger of using things like Google. Always use public GIS to confirm publicly accessible RoW's.
      All of that said, it is indeed bizarre that they don't have the entrance signed as restricted access from the beginning.

      Some government property has private roads that they still allow the public to drive on like a public road. A state park near me does this for example. I assume the prison only makes it an issue if someone pulls over and stays on the road for a long period of time.

The warden isn't joking when he says he has to shut the facility down for someone disobeying their order not to trespass.       It would help immensely if that were possible, but another large portion of the problem is how overpoliced we are and what is expected of police should be spread out over several other agencies providing community services and support.
      We treat them as societal garbagemen, using them to round up the end product of things we dislike and don't want to deal with then funnel into our for profit prison system.
      If we had an actual working social safety net we'd need less police and their jobs would be more straightforward.

      @@r33thSo he said that he was documenting what visitors need todo when visiting. He had business there and he wasn’t trying, nor did he go into any restricted areas. They can’t make a public road or parking lot private to selective people. Other members of public are allowed in the areas that he was in. The only difference was that he was recording, which is a constitutionally protected activity. And the deputy didn’t even do a proper investigation, he only heard the, at best inaccurate, if not lie, statement from the warden. Then said to him that he failed to register as a visitor, well he wasn’t given a chance. He was accosted by the warden almost immediately. What a complete injustice this was. And some that are trying to make the hot boxing not an issue by saying that the man didn’t complain about it on the ride to jail I say, the video only shows about 10 seconds of that time. How would any of you know what was said in the edited out footage? And even so, that cop knows how hot it gets in the back of his patrol car in 95* weather.

    I'm not sure a sign on the side of a road with no gate, no private road sign, is sufficient. There's a McDonald's sign next to the road on the way into town from my house, I doubt any reasonable person would assume the road is privately owned by a corporate entity from mere existence of a non-traffic sign.

    Again, if this is a public road and a public parking lot that any citizen may park at, and they are not entitled to film there then a sign must state as such with appropriate connected laws and be visible to all at all times. Nevada apparently doesn't have these laws or signs. Well, that's Nevada's problem not the auditors.

    Although America is a police state it somehow manages to not teach it's officers on basic civilian rights which often leads to lawsuits something incredibly common in North America society.     I wanna take a moment to talk about the part where he warned the guard about qualified immunity. It don't work for a jail/prison guard but, for reference when dealing with the police. Make sure to get it on film, ask the cop to look up specified case law. If the cop refuses to look it up, they can't use the excuse later in court that they didn't know they were violating your rights. That is how they get qualified immunity by claiming ignorance of the law. But, getting them on camera not looking up the law when presented takes away that "immunity." Then the individual cop can be held liable.

    The citation of laws pertinent to the incident is interesting, but the regulation says the Corrections Department gets to approve Cameras before they are brought INTO the facility, not TO the facility. The legality lies in interpreting what the rules and laws specifically say.
    There must be a difference between the Public Road and Public Parking Lot even in the documents citing "Access to the Facilities/Inmates." There are Fences, walls, and doors that control access to the building and inmates. This differentiates them from the Roads and Parking Lots. As with other Military Bases, they can set up a Guard House at the road if they want to restrict access and they can post signs if they want to restrict photography.
    The road was publicly accessible and I saw no designation that showed that the property was not Public.

    There is a lot more to this story. The officer tried to file a restraining order against the auditor and failed. The auditor took a no contest plea bargain due to bad advice from his lawyer.

      There is no more to this trespass he was legally asked to leave several times and this was not a traditional public forum. As a to a said very well auditors would do well to know the full law. State owned does not mean open 100% to the public and let’s just assume he never went to be prison website. Once the 1st corrections officer came he should have left. His hotboxing is bs unless he can prove it was done intentionally.
      And you did hear he filed a civil case pro se meaning no real attorney would take it.

      Yeah, but he was informed pretty much immediately that he was on the property and that the road was not a public roadway. That was the notice required by law. A "no trespassing" sign is only one of the ways to inform the public that access is restricted. The auditor chose to ignore that notice by incorrectly assuming the "no trespassing" sign was required.

    And even if there are policies in place that restrict access via scheduling appointments. Those limitations are time place and manner. Even if he doesnt have an appointment he has a right to be anywhere the public would be allowed via appoinment. Excluding restricted access areas (via due notice or reasonable restriction). How are you supposed to connect with a custodian of records in person if the roads and parking lots are all "restricted access"? This just reeks of collusion between state agencies and rampant corruption.

      No contest isn't exactly a guilty verdict. You're not accepting guilt and the court's haven't found you guilty. You're just accepting the punishment.
      People often do this if they can't afford to fight out the court case and they offer a plea deal with the no contest.

    Ata goes on and on about how government can limit filming on public property, yet fails to clarify how this public street is different then any other public street. Maybe he needs to look up the GIS survey to make his point. Without the clarification that the photographer was on DOC property then the street appears to be a traditional public forum. Based on the case cited, the street meets the 3 requirements for a traditional public forum. Public roadway accessible to anyone to use for traveling. I get that they may want to restrict filming of secure areas. Are they going to arrest everyone driving a tesla, or some other vehicle with a dash cam? If not, they cannot restrict access to a guy with a camera. Prison guards are not the brightest law enforcement. They typically barely made it out of high school. Being an affirmative action warden really doesn't look all that impressive.
