The court is stretching quran and constitution to suite their agenda. Unfortunately you too made a half truth statement. For the question on sikhs wearing turban, you mislead by saying it is mentioned in the constitution. In fact constitution is talking about kripan, not turban. It is understandable why constitution specifically talks about kripan. It is because it feared, since kripan is a weapon, a clarification is needed to protect the believers right. Those who write our constitution never foresee a situation where somebody will interfere in ones dress, that was why they did not mention turban or hijab particularly....!

Privately owned bodies need not respect religious rights. The rights are mostly applicable against government schools. At our private school, they had a very strict dress code with no hijab allowed for women as well. Most Fundamental rights are applicable against the state, not private bodies. There are some exceptions like Untouchability and Article 15
Yes but Ambedkar also lamblasted Hindus by saying they only think about their caste and don't see themselves as one. In these lines he was particularly refereing to India before Independence. Things have changed from those times, we now have a nation state.

Strongly support the HC decision on Hijab row. From Shah Bano to Sabrimala to Hijab and now to marital rape, the courts have shown consistency in supporting women's rights despite staunch resistance from clerics of both Hinduism and Islam. These clerics always give the shallow excuse of culture and/or religious freedom to mask their sexist and misogynistic agenda. Nice to see that the courts have remained unwavering on women's empowerment in spite of the societal and political pressures around these sensitive topics
This is clearly not in support of "women's rights" but more so in the the favour of equality and the right of educational institutions to enforce code of conduct inside their premises (if it was about women's rights, then the women should have been allowed to wear whatever they want {burqa/hijab}, but this would create a sense of double standards and chaos).

You know there is lots of inconsistency when the girls are protesting for the right to wear Hijab, but turn up in full Niqab and Burqa, it's clearly a cultural adoption because many regions around the world have their own styles.

My best friends family is rajput from Rajasthan. Everytime I went to their home, all women wore ghunghat covering their face. If everyone from different religions and cultures start practicing their culture at school- school will be circus.

Why did concept of Ghunhat came only in that part or community? Is it due to religion? Why did it evolve and why was deemed to good to practice. In 1980s I worked for 5 years at Bhopal in Muslim majority area. I have never seen women wearing hijab. Particularly young women. Few elder women burkhas but overwhelming majority women wore salwar Kurt's or saris. I could go to my bank client's home where women would come and participate in discussion without any hijab or burkha.
I had lived in Old Bhopal area around early 1990s, and do remember women wearing burkha while on streets. I don't remember much about inside the house as I was quite small. If I may ask, what according to you changed that scenario you are telling. If women were not wearing hijab earlier what made the change.
They are now being radicalised by the radical Islamic mob in India. They have been brainwashed in to believing that hijaab is a Muslim thing and to protect their faith they have to wear hijaab. There is nothing controversial in the court's order. The court was given a sealed cover providing details of the on going investigation carried out by Karnataka Government. The sealed cover most probably contained damming evidence to make such a statement.
I hate sealed cover evidences. What, common people are children and these judges and bureaucrats are wise men? That evidence, whatever it is, has been collected with public money. That should be in public domain.

@@desibigfoot3874 sealed evidences doesn't mean it's forever. Most of such evidences are unsealed once the case is complete. The only ones that remains sealed are probably military related stuff.
Fundamental rights in India are subjected to reasonable restriction. Institutional descipline prevails personal descipline in certain Organisations, especially Educational institutions. Essential religious practices are allowed (Still if its against public morality, descipline etc it may not be allowed), but Non esssential religious practice doesnt come under freedom of expression when comes to Organisational descipline.

I really wish SG would do a CTC on 'Secularism' in India - constitutional meaning, difference from Western context and extent and limitations. This is much needed in today's time when the word 'secular' is being exploited and misused.

This "passive secularism" or religious secularism is perfectly fine for India as unlike west, our religion give us strong cultural and civilisational foundation (why I said unlike west is because westerns have civilisational model of Greeks and Romans but their religion was Christianity and thus incompatible with old Roman ideals that they cherished since 1600s). Our religion gives us a distinct identity and better guidance than what our western friends have bc unlike Abrahamic religions, Indian religions (which includes Indian Sufism) doesn't enforce a "slave morality".

It talks about "Khimer" which is a cloth to cover their bosom. Also, bindi is nowhere allowed inside classrooms and isn't a part of essential practices of Hinduism. Islam has 5 ERPs and burqa or hijab is NOT one of them.
The last part of the Judgement was because the court got concerned about the Murder that followed after this controversy. It's rightly justified as the Court took note of it.

The issue the Court was facing is the uniform prescribed by the Government order for schools and colleges and whether the wearing of a hijab is in accordance with or violative of the uniform. The issue was not about how the controversy itself arose. The court was not asked by the petitioners to hear the matter of the Murder of the Bajrang Dal activist, Harsh. And it was not asked about the individuals or group who had started to raise this controversy. Therefore the court should not have commented on anything outside the issue in the case it was hearing.
@@globalnationalismyoutube The Court has powers well within its rights to take suo motto decisions on the matters related to the case. The courts have done so many times in the past. As a lawyer I know that when we draft a petition we also plead as "any other order or relief the Court may deem fit". The court understands the depth and dimensions of the problem so has commented on it. The court is not your servant that it passes order only on Issues you raise(especially in constitutional matters). It's an Authority of Justice. And this matter is of Constitutional interpretation which the courts hv done and the matter has resulted in a law and order situation. The Honourable court cantankerous note of it and order govt to take action on law and order to prevent such nonsensical violence and protests. Do you have more wisdom than the honourable court?
I am amazed at our country can equate the hijab with the Turban of the Sikhs. The Sikhs are the defenders of our nation. When I was in school in Calcutta with its frequent hartals . My mother would put our address in my pocket and would tell me if there was any sudden halt of bus service, I should try to get only a taxi with a Sikh driver. That is how much we trusted our Sikhs. I am sure my mother would never have asked me to take a taxi with a Muslim driver and much less someone with a frightening hijab!!!!!
Well pursuing my B.com in Bangalore I did wear a college uniform which was compulsory for us Monday to Thursday 🤣 but on one hand it was also good as it reduced my cost of purchasing cloths every now n then as the cost of living is quite High in Bangalore back in the early 2010s for a college student
Odd to say that, you can wear what you wear at home to college, uniform for me raises the cost... Uniform is a burden on too poor. We know them, their uniforms are torn and muddy, they get kicked out of assembly in schools and punish in public in schools for dirty uniform, maybe that was the case in schools I went only....

It's upto college to keep uniform most keep uniform and many have not kept. Even if there is no uniform there will be a clearly defined dress code which says what kind of dress u have to wear Some won't allow jeans , skin tight t shirts or shirts with slogans or round neck etc etc

While most of them entered the college wearing a hijab quite a few would head to the girls common room to take out the hijab attended classes in tees and jeans. Does wearing a hijab make one a muslim ? I am sure most progressive muslims will say NO just as the progressive Hindus will feel the same about saffron and hinduism. In schools the concept of uniform was introduced to ensure whatever the student's background(economic, religious faith etc) did not influence the student and teacher interactions in a way that one person or group may have a distinct advantage or disadvantage as a result of their background. Schools and colleges are places of learning regardless of who you are or what you follow...so this is an opportunity for those muslims who have been blindly following customs to break out of their shell and reorient their lives to adapt to practical ways of living albeit following Islam.

3:17 Article 14 in The Constitution Of India 1949 says: "Equality before law The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India Prohibition of discrimination on grounds of religion, race, caste, sex or place of birth." NOTE: Discrimination based on Language is not part of article 14(But lot of injustice done based on language). I wish language was part of article 14.
These same institutions do pooja of weapons and perform pooja regularly. It is purely majoritarian. Imagine all the communities start doing the same in these institutions. Even when a Rafale is brought it is with pooja, by our defence minister. Suppose PU defence minister was Christian or Muslim would he be allowed to perform their ritual. All these are text book quotes and the law of the land is majoritarian.

The Exception in Article 25 is for the Sikhs to carry a "kirpan" that means a small curved knife. I'm conflicted on the position of the hijab per se, however, when you cite an Article, and you portray it as something it is not, it challenges the veracity of your content.

Indian Islam for all its faults was more Indian than Arabic. We have coexisting despite a lot of bad blood and we never saw such stark differentiation until 80s onwards. This because of Saudi money flowing into madrassas. The black head to toe cladding of women was not something seen in India, instead it was more Persian with colourful hijab or no hijab at all. I would say that South Asian Muslims have generally become more conservative and backward than their Arab counterparts. Hinduism doesn't have any 'commandments' or rules, unlike other religions. It's personal choice. For example - Hindus in many northern states don't touch meat during Navratri, but Bengali Hindus cook fish and meat as part of the celebration during Durga Puja and Biryani is even served in the Puja Pandals.

No point in comparing with Sikhs who have always had this tradition for hundreds of years. It is one of the 5 core principles of Sikhism and Sikhs are allowed to wear their headgear in every profession they choose to do. In contrast claiming that wearing a hijab is an essential part of being a Muslim doesn't ring true simply because thousands of Muslim women all over the world as well as in India don't wear it. If this was true then Pakistan's women's cricket team would need to wear the hijab while playing.
There were lot of poor girls who just want to study but had a sort of compromise with their 'conservative' families, all those will be again sent back to dark days! The facts only can't apply in certain cases, in other cases its "values and morals"....ofcourse no woman should be suppressed by asking what to wear or not to...but at the same time, the judgement should be in such a way to protect first not enforce "facts"! No one talks about the following. 1. Why are Muslims in India becoming more conservative and is this overall a positive shift for Muslim women and Indian culture. 2. Muslims should not get to claim they are left behind other communities if their women continue to wear hijabs. To be frank, pls don't expect the moden world to accept anyone that is ultra conservative. Unfortunately you can't have both. 3. While Saudi is getting away from ultra conservatism, some Indian Muslims are turning the other side. 4. The more Muslims and politicians support the ultra conservative culture, it will strengthen conservative hindutva politics. Because of education institutes have right to impose reasonable restrictions. Collective rights as an institue prevail over individual choice. Had it been an obligation by religion and a core essential practice, then school code could be amended to allow hijab in the color of uniform or something. But strangely why is it now the girls want to wear hijab in class, when it is a girl's school and till gate they anyways were coming in full burqa. Also, it is reasonable. Uniform has a purpose. Atleast till school. We are a diverse society. students shouldn't be distracted by differences until adulthood and until they know better. also unifrom is a boon to thise poor kids whose social status could be ridiculed by their dress. American society is uniform but not india. If no uniform dress code parents will rub their dogmas on kids. Privately owned bodies need not respect religious rights. The rights are mostly applicable against government schools. At our private school, they had a very strict dress code with no hijab allowed for women as well. Most Fundamental rights are applicable against the state, not private bodies. There are some exceptions like Untouchability and Article 15

Strongly support the HC decision on Hijab row. From Shah Bano to Sabrimala to Hijab and now to marital rape, the courts have shown consistency in supporting women's rights despite staunch resistance from clerics of both Hinduism and Islam. In 1980s I worked for 5 years at Bhopal in Muslim majority area. I have never seen women wearing hijab. Particularly young women. Few elder women burkhas but overwhelming majority women wore salwar Kurt's or saris.

There is nothing controversial in the court's order. The court was given a sealed cover providing details of the on going investigation carried out by Karnataka Government. The sealed cover most probably contained damming evidence to make such a statement.
I hate sealed cover evidences. What, common people are children and these judges and bureaucrats are wise men? That evidence, whatever it is, has been collected with public money. That should be in public domain.

This "passive secularism" or religious secularism is perfectly fine for India as unlike west, our religion give us strong cultural and civilisational foundation (why I said unlike west is because westerns have civilisational model of Greeks and Romans but their religion was Christianity and thus incompatible with old Roman ideals that they cherished since 1600s).
Our religion gives us a distinct identity and better guidance than what our western friends have bc unlike Abrahamic religions, Indian religions (which includes Indian Sufism) doesn't enforce a "slave morality".

The issue the Court was facing is the uniform prescribed by the Government order for schools and colleges and whether the wearing of a hijab is in accordance with or violative of the uniform.
The issue was not about how the controversy itself arose. The court was not asked by the petitioners to hear the matter of the Murder of the Bajrang Dal activist, Harsh. And it was not asked about the individuals or group who had started to raise this controversy.
Therefore the court should not have commented on anything outside the issue in the case it was hearing.

As a lawyer I know that when we draft a petition we also plead as "any other order or relief the Court may deem fit".

The court is not your servant that it passes order only on Issues you raise(especially in constitutional matters). It's an Authority of Justice.
And this matter is of Constitutional interpretation which the courts hv done and the matter has resulted in a law and order situation.
The Honourable court cantankerous note of it and order govt to take action on law and order to prevent such nonsensical violence and protests.

I am amazed at our country can equate the hijab with the Turban of the Sikhs. The Sikhs are the defenders of our nation. When I was in school in Calcutta with its frequent hartals . My mother would put our address in my pocket and would tell me if there was any sudden halt of bus service, I should try to get only a taxi with a Sikh driver. That is how much we trusted our Sikhs. I am sure my mother would never have asked me to take a taxi with a Muslim driver and much less someone with a frightening hijab!!!!!

Odd to say that, you can wear what you wear at home to college, uniform for me raises the cost... Uniform is a burden on too poor. We know them, their uniforms are torn and muddy, they get kicked out of assembly in schools and punish in public in schools for dirty uniform, maybe that was the case in schools I went only....

FYI i went to a college which did not have a uniform and which was attended by many muslim girls. While most of them entered the college wearing a hijab quite a few would head to the girls common room to take out the hijab attended classes in tees and jeans.
Hence i support the courts order as it helps girls who are forced to wear attire they'd rather not wear under the guise of relogious conservatism.
That gave me a perspective on the u seem to be missing. In future hope u consider the possibility that others (including men) might have genuine insights that lead them to make comments rather than just blasting them down

Does wearing a hijab make one a muslim ? I am sure most progressive muslims will say NO just as the progressive Hindus will feel the same about saffron and hinduism.
In schools the concept of uniform was introduced to ensure whatever the student's background(economic, religious faith etc) did not influence the student and teacher interactions in a way that one person or group may have a distinct advantage or disadvantage as a result of their background.
Schools and colleges are places of learning regardless of who you are or what you follow...so this is an opportunity for those muslims who have been blindly following customs to break out of their shell and reorient their lives to adapt to practical ways of living albeit following Islam.

Shekar Gupta has done a wonderful job in summarizing this to us and thanks a lot. We were otherwise thinking about this in a Hindu Muslim parameter and not in a constitutional manner, Even in the West this is not reported as it should be since they declare it as Hindu Muslim issue. While normally not much news is reported on India but this was included in many US and BBC news channel as a Hindu Muslim feud in the context of Hindutva rather than as a real constitutional issue that was probed by a well functioning court, Once again Cudos for Shekar Gupta for this great broadcast,
3:17 Article 14 in The Constitution Of India 1949 says:
"Equality before law The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India Prohibition of discrimination on grounds of religion, race, caste, sex or place of birth."
NOTE: Discrimination based on Language is not part of article 14(But lot of injustice done based on language). I wish language was part of article 14.

Indian Islam for all its faults was more Indian than Arabic. We have coexisting despite a lot of bad blood and we never saw such stark differentiation until 80s onwards. This because of Saudi money flowing into madrassas. The black head to toe cladding of women was not something seen in India, instead it was more Persian with colourful hijab or no hijab at all. I would say that South Asian Muslims have generally become more conservative and backward than their Arab counterparts. You will see more niqabis in India, Pak and Bangladesh than Iraq, Turkey and Lebanon nowadays. We speak of love jihad but the greater tragedy is this self segregation our communities have engaged in. Hinduism doesn't have any 'commandments' or rules, unlike other religions. It's personal choice. For example - Hindus in many northern states don't touch meat during Navratri, but Bengali Hindus cook fish and meat as part of the celebration during Durga Puja and Biryani is even served in the Puja Pandals.

Went to a school in mumbai, state board, we were not allowed to wear, holy thread(mauli), payal, bindi none of the girls wore any hijab or burka..nothing was allowed
If HC had allowed Hijab to be worn in institutes where uniform is prescribed, then those muslim girls who doesn't wear hijab would have been under peer & societal pressure to wear one.
No point in comparing with Sikhs who have always had this tradition for hundreds of years. It is one of the 5 core principles of Sikhism and Sikhs are allowed to wear their headgear in every profession they choose to do. In contrast claiming that wearing a hijab is an essential part of being a Muslim doesn't ring true simply because thousands of Muslim women all over the world as well as in India don't wear it. If this was true then Pakistan's women's cricket team would need to wear the hijab while playing.
There were lot of poor girls who just want to study but had a sort of compromise with their 'conservative' families, all those will be again sent back to dark days! The facts only can't apply in certain cases, in other cases its "values and morals"....ofcourse no woman should be suppressed by asking what to wear or not to...but at the same time, the judgement should be in such a way to protect first not enforce "facts"! The concept of uniform was created so that poor wont feel left out, but this judgement does the same in a way, the one who dont see this side of the story, don't have far sightedness! in the long run, preferrable for those girls get education access

1. Why are Muslims in India becoming more conservative and is this overall a positive shift for Muslim women and Indian culture.
2. Muslims should not get to claim they are left behind other communities if their women continue to wear hijabs. To be frank, pls don't expect the moden world to accept anyone that is ultra conservative. Unfortunately you can't have both.
3. While Saudi is getting away from ultra conservatism, some Indian Muslims are turning the other side.
4. The more Muslims and politicians support the ultra conservative culture, it will strengthen conservative hindutva politics. The blame is entirely on muslims who want to benefit from secularism but will not follow it.

Where does Indian secularism hide when Sikh women who wear turban(amrit dhaari) and sikh men are allowed in schools. Why does CM of uttar pradesh wear a religious dress in a "public office".
Irony is that HC said that hijab is not compulsary, so now HC will read grant sahib and Qur'an to pass edicts.
Recently a Sikh girl was politely ask to come without her turban in Mt Carmel school, the same school banned muslim girls from wearing hijaab, and was allowing Sikh girl, upon insistance from the muslim girls, the school asked her to come without the turban "if possible". And told her categorically that they were telling her to do so because some muslim girls were insisting. In her defence the state education minister came and told she can wear and ban is only on Hijaab.
My friend India is not France where atleast they are not hypocrites that allow some signs and ban others.
The anger in Indian muslims is not about hijaab ban only, but the hypocrisy. They are made to feel alienated in the country they fought for and did not leave at Jinnah sabhs insistance.
We Kashmiris watch the fate of Indian muslims with disparities.
As the court was commenting about delayed reaction to uniform guidelines, it should also have commented about how the school should be sensitive to multi culturalism and make guidelines accordingly. After all, education is more important than uniform
What? Sensitive to multiculturalism is hardly even a requirement for education? How do you define education and what are the goals you want to achieve from the said education? Is a hardcore muslim extremist with profound knowledge of his books an educated man or a Hindu for that matter? If the goal of education is to inculcate the scientific rationale among students then "sensitiveness to multi-culturalism" (whatever that is) is irrelevant. Is a woman with an extensive knowledge of her religious scriptures and thorough adherence to her religious mumbo-jumbo an educated woman? Who is educated? What are your criteria for education?

Because of education institutes have right to impose reasonable restrictions. Collective rights as an institue prevail over individual choice. Had it been an obligation by religion and a core essential practice, then school code could be amended to allow hijab in the color of uniform or something. But strangely why is it now the girls want to wear hijab in class, when it is a girl's school and till gate they anyways were coming in full burqa. Also, it is reasonable. Uniform has a purpose. Atleast till school. We are a diverse society. students shouldn't be distracted by differences until adulthood and until they know better. also unifrom is a boon to thise poor kids whose social status could be ridiculed by their dress. American society is uniform but not india. If no uniform dress code parents will rub their dogmas on kids. We don't want some showing up in ghoonghat some in ultra modern, some in ragged clothes etc. It is a reasonable restriction.

Thank you. Thank you. Very clear and lucid. The judgment is narrow and only is applicable to the 10+2 schools and where a uniform is prescribed and Hijab is not part of the uniform. The rest of the media publicising at as Karnataka wide Hijab ban is either lazy or deliberately misleading journalism.
Question: Can a minority owned school make Hijab a part of uniform? If so would it then mandatorily apply to non-Muslim students too?

@@iip8948 I live and have infact lived in USA for 24 years out of my 36 years and am a secular minded individual. However India in the last 10 years has become less and less secular. Something which was infact predicted by Jinnah. Btw have nothing against common man anywhere but it's clear muslims as a minority and as descendents of mughals and Afghan rulers will always be criticized. Even though most don't actually trace their ancestry.

India is a hindu state and has been since 2014 run by right wing zealot. Pakistan was made out of necessity rather than desire something even most Pakistani politicians don't understand.
@@janoos24 you're assuming too many things... overwhelming majority of muslims in India are indigenous and part of larger culture. Most of afgan/mughal descent muslims either migrated to Pakistan or live in region around to delhi.

The answer lies in essential practices of a religion, the Sikh turban is an essential practice of Sikhism, unlike the burqa which is not, the non-consumption of beef is essential to Hinduism identical to the non-consumption of pork to the Muslims, don't drag everybody down just to satisfy your prejudiced mentality!
